Sea turtle killing threatening Maldives’ dolphin-safe tuna certification

The Maldives is at risk of losing its dolphin safe tuna certification, while fishing vessels will be banned from delivering tuna for export if they participate in sea turtle killing.

A recent report by Minivan News found that the practice of slaughtering sea turtles is widespread throughout the Maldives due to lack of enforcement and poor awareness, and prevailing attitudes that the practice is acceptable.

A marine biologist and former civil servant with knowledge of the matter told Minivan News that the killing of endangered sea turtles was a nationwide problem.

“I know for a fact there are still specific island communities that harvest and consume green turtle meat. For example, in Laamu Atoll there are good nesting sites. Sea turtle meat is sold for a high price because it is marketed as a substitute for beef,” he said.

The marine biologist stated that the vessel in a photo published by Minivan News showing a large number of slaughtered sea turtles was “very obviously a diving dhoni”.

This, he said, raised the possibility that Maldivians were supplying resorts and/or safari boats with sea turtle meat for the consumption of guests.

The large number of slaughtered turtles on the boat also indicated that they were taken from a special nesting beach with a high nesting intensity.

“If it is nesting season there are many female turtles in the water and on the beach, and they can be easily caught,” the marine biologist stated.

Meanwhile, a safari boat operator who contacted Minivan News forwarded a photo showing half a dozen dead sea turtles, including one being ridden by a small Maldivian child. The source informed Minivan News that the photo was taken during a picnic last year on Thulhaadhoo in Baa Atoll, inside the UNESCO Biosphere Reserve.

Dolphin safe certification threatened

The international non-governmental organisation (NGO) that provides the Maldives with its ‘dolphin safe’ tuna certification, the Earth Island Institute (EII), has expressed alarm over the reports of mass turtle slaughter in the Maldives.

“No dhoni (boat) that fishes tuna for export can be allowed to be involved in sea turtle kills. Any tuna dhoni that also kills sea turtles will automatically be banned from delivering tuna to any Maldives processor for tuna export,” Earth Island Institute Associate Director Mark Berman told Minivan News.

He explained the EII’s dolphin safe policy requires that “no tuna company will deal in sea turtles, sharks, dolphins, whales, or their products. All efforts to minimise bycatch of these species is mandatory”.

“Each company in the Maldives, including those owned by the government, are signatories to the policy, therefore the government must do its best to stop this slaughter,” Berman stated.

Maldivian tuna is a “premium” product for the European and US markets because it is pole and line caught (no nets are allowed), there is no bycatch, and because it is dolphin safe and sustainable.

Berman emphasised that the EII will work with the Maldivian government and tuna industry to help stop the practice of turtle killing.

“I am very concerned and surprised this sea turtle [slaughter] problem has grown.

“The EII is not at all blaming the tuna industry or the government for this issue. We want to help solve it,” said Berman. “Earth Island has been a partner of the Maldivian tuna industry, friend of the government, and has campaigned for sustainable dolphin safe tuna exports for over 20 years.”

“However, other NGOs will see this issue and then attach it to any products exported [from the Maldives]. Then consumers in the US or Europe may tie the two together,” he warned.

Berman said the Fisheries Ministry need to alert fishing boat owners, while the EII would inform tuna companies.

“The government should do everything possible to educate the fishing folks that this is a serious problem both for fisheries and tourism. Also, the Convention on the International Trade in Endangered Species (CITES) could weigh in on the situation,” said Berman.

However the marine biologist told Minivan News that EII was not genuinely concerned with dolphin-friendly advocacy, and instead “have their own political agenda which is very business related and selfish”.

“Some countries are much worse than the Maldives but EII still gives them dolphin-safe certification,” he said.

EII has been working with the Maldivian government as well as fishing and processing companies since 1992. The Maldives was the second nation to sign onto EII’s dolphin safe policy.

“No direct linkages with turtle capture and the fishing industry”: Fisheries Ministry

Minister of Fisheries and Agriculture Ahmed Shafeeu told Minivan News the Ministry had launched an investigation based on the recent report of mass sea turtle slaughter.

“It is very unlikely it is a tuna fishing boat. There are no direct linkages with turtle capture and the fishing industry,” Shafeeu stated. “Based on the photo it appears to be a normal ferry boat, which looks like it may once upon a time have been used as a dive or safari boat.”

“Just because a group of people have done something [illegal], the entire fishing industry can’t be blamed for breaking the law and committing a crime,” he added.

Shafeeu said the Fisheries Ministry is working the the Maldives’ Marine Research Center (MRC) to stop sea turtle slaughter.

“The MRC Director General Dr Shiham Adam is engaging directly with island councils to investigate.

“Also, Shiham and I are discussing how to fill the legal gaps, such as banning collection of sea turtle eggs. The current regulations are vague and do not apply nationwide – collecting eggs is prohibited only on specific islands,” said Shafeeu.

The Fisheries Ministry is also coordinating with the Environment Ministry to “determine how to start an [awareness] campaign”.

Monitoring fishing vessels directly was very difficult, but fishing boats did require registration and licensing in order to sell tuna.

Given that monitoring is such a challenge, the government needs Maldivian citizens to report any unlawful actions, Shafeeu said.

“We expect that when sea turtle killing occurs, someone will report it to us or directly to the police so it can be investigated,” he said.

“Even with the councils, they just keep a blind eye, so these things continue. People need to know we are serious and won’t just let go of this issue, it is our responsibility to take action,” he declared.

The marine biologist meanwhile explained that environmental law in the Maldives provides an umbrella framework, but only on paper.

“There has been a total ban on killing and catching sea turtles since 2006. However, as environmental crime is not appreciated in the Maldives, enforcement needs to be strengthened,” he emphasised.

Fisheries Ministry asks Majlis committee to determine if fuel subsidy is fundamental right

Parliament’s Finance Committee has decided to summon officials from the Ministry of Fisheries and Agriculture to a meeting on Wednesday over issuing MVR 100 million (US$6.4 million) allocated as fuel subsidies for fishermen in the 2012 budget, after the ministry asked the committee to determine if the subsidy could be considered a fundamental right.

The Finance Committee on October 17 approved guidelines for providing the fuel subsidy directly to boat owners and informed the Fisheries Ministry of the decision.

However, Auditor General Niyaz Ibrahim questioned the legality of issuing the subsidy, suggesting that it could be in violation of the Public Finance Act.

Under amendments brought to the Public Finance Act in 2010, “any relief, benefit or subsidy by the state” must be given in accordance with laws passed by the People’s Majlis.

The ruling coalition has sought to reverse the changes voted through while in opposition.

Fisheries Minister Ahmed Shafeeu told local media last week that the subsidies could not be released until the legal issue was resolved but expressed hope that it could be done before Thursday (November 15), leaving one and a half months for the ministry to release funds to 1,053 vessels registered for the subsidy.

Following legal advice from the Attorney General, the Fisheries Ministry asked the Finance Committee to determine if the fuel subsidy could be considered a fundamental or basic right.

Attorney General Azima Shukoor had advised the ministry that the subsidy could be issued without specific enabling legislation if the financial assistance to fishermen was considered a fundamental right.

Azima told newspaper Haveeru that in accordance with a Supreme Court ruling, the subsidy could be issued without a specific law if it is deemed a fundamental right.

At today’s meeting of the Finance Committee, Parliamentary Group Leader of the Progressive Party of Maldives (PPM), MP Abdulla Yameen, reportedly insisted that a law would be needed to issue the subsidy.

Dhivehi Rayyithung Party (DRP) MP Visam Ali meanwhile suggested that the Fisheries Ministry should consult with the Attorney General’s Office to determine if the fuel subsidy was a fundamental right.

Finance Committee approves guidelines for MVR 100 million in fuel subsidies for fishermen

Parliament’s Finance Committee yesterday approved guidelines for issuing MVR 100 million (US$6.4 million) worth of fuel subsidies for fishermen following consideration of revisions proposed by the fisheries ministry.

At a press briefing today, Finance Committee Chair MP Ahmed Nazim said that the guidelines were finalised in July but the committee had been unable to vote it through until now due to the reworking of committee composition and the suspension of parliament.

“Today we have informed the fisheries ministry of our decision,” Nazim said. “The sub-committee’s decision states that after deducting MVR 1 million for administrative costs, the remaining MVR 99 million should be used to subsidise the cost of fuel for each [fishing] trip based on engine horsepower.”

The People’s Alliance (PA) MP for Meemu Dhiggaru explained that the fuel subsidies would be released based on fuel consumption or engine horsepower (hp) instead of the size of the fishing vessel as was done previously.

Fishing boats would be divided into three categories based on engine horsepower, Nazim said, ranging from 2hp to 829hp and higher.

The rationale for the decision was to ensure that “as many fishermen as possible receives the subsidy,” he said.

Some 1,053 vessels eligible for the subsidy have been registered at the fisheries ministry, Nazim revealed.

Unlike the past two years, said Nazim, the Finance Committee has instructed the fisheries ministry to directly deposit the subsidy to the boat owner’s bank account and post details of the subsidy and recipient on a special website.

The new mechanism would allow crewmembers to calculate the portion of subsidy owed to them, he added.

Although only two months remained of 2012, Nazim suggested that the fisheries ministry could disburse the total amount before the end of the year.

The Finance Committee had calculated that the MVR 100 million annually would cover 20 percent of fuel costs for each fishing trip, Nazim explained, but the fisheries ministry could now provide a higher percentage of the cost.

The newly approved mechanism would have safeguards in place to avoid fraud, Nazim observed, as the subsidy would only be issued when the boat owner presents the fuel bill along with other documentation.

Asked if the state budget could bear the brunt of MVR 100 million as subsidies, Nazim conceded that the expenditure would strain the budget but argued that increased productivity in the fisheries sector would boost the flagging economy.

“I believe that if fishing improves through such a stimulus or incentive, the benefits to the economy would be felt broadly,” he said.

Concurring with the committee’s chair, Maldivian Democratic Party (MDP) MP Mohamed ‘Colonel’ Nasheed argued that the state should assist workers in the primary sector at a time of economic slowdown.

Noting that the MDP government pledged to make the Maldives carbon neutral in a decade, Nasheed said the previous administration had conducted research in collaboration with international universities into alternative sources of energy to replace marine diesel.

“I still believe that the permanent solution for this would be finding an alternative source of energy, for us to be able to use renewable energy for fishing,” the MP for Haa Dhaal Nolhivaram said.

“Incentivising”

Speaking at a press conference in June, Fisheries Minister Ahmed Shafeeu said the subsidy would “incentivise” many fishermen who were unable to fish due to high fuel prices.

“A lot of fishermen now use larger fishing boats which require more fuel. So they opt not to make trips if they can’t get a good catch after burning so much fuel. The fuel subsidy will encourage more people to go fishing,” said the minister.

Shafeeu said fishing in the Maldives has declined from approximately 185,000 tonnes of fish caught in 2006 to about 70,000 tonnes in 2011.

Meanwhile, in 2011, the MDP administration withheld releasing the subsidy citing insufficient funds in the state budget. Former Finance Minister Ahmed Inaz told parliament in October 2011 that the state would have to reduce other subsidies to release MVR100 million as oil subsidies for fishermen.

In the same month, the then-opposition Dhivehi Qaumee Party (DQP) sued the finance and fisheries ministries for withholding the budget allocated for fuel subsidies.

Former CEO of the Maldives Industry of Fisheries Corporation (MIFCO) Adil Saleem, who also held the position of Transport Minister in the former government, told Minivan News in June this year that encouraging a subsidised industry “completely reverses” the former government’s policies, although he said it was important for fishermen “in the current situation.”

“Subsidising is wrong,” Saleem contended, arguing that it did not address the core problems in the industry and was “not the solution for a sustainable industry.”

“Coup financiers are shaping the industry so that the fishermen act as their staff, going fishing everyday on subsidised fuel,” said Saleem.

However, he noted that fishermen were currently in “desperate need” of assistance due to the low prices they get for the fish, and said the subsidies should be released as a short-term measure.

Government to issue fishing subsidy upon Majilis approval

Fishermen will start receiving the 100 million Rufiyaa (US$6.4 million) fuel subsidy allocated to them in the 2012 state budget as soon as Parliament approves revisions proposed by the Fisheries Ministry, the government has said.

Speaking at a press conference on Wednesday, Minister of Fisheries and Agriculture Ahmed Shafeeu said subsidising fuel for fishing vessels would “incentivise” many fishermen who are currently unable to fish due to high fuel prices.

“A lot of fishermen now use larger fishing boats which require more fuel. So they opt not to make trips if they can’t get a good catch after burning so much fuel. The fuel subsidy will encourage more people to go fishing,” said the minister.

Shafeeu said fishing in the Maldives has declined by more than half from approximately 185,000 tonnes of fish caught in 2006 to about 70,000 in 2011.

“It is very important to assist the fishermen as it affects the livelihood of many people. Also, this needs to be done in order to sustain the industry and increase fish exports as there is a risk of losing some markets,” he explained.

This year’s subsidies, unlike previously, will be given based on the horsepower (hp) of the fishing vessel instead of the size of the vessel. Registrations are open until June 7 for fishing boats to apply for subsidies, according to the ministry.

The former administration withheld releasing the subsidy citing insufficient funds in the state budget for the fishing subsidy. Former Minister of Finance Ahmed Inaz told the Parliament in October 2011 that the state would have to reduce other subsidies to issue Rf100 million as oil subsidies for fishermen.

Governor of the country’s central bank Fazeel Najeeb last month said the Maldives was facing its worst economic crisis in recent history. Parliament’s Finance Committee revealed in May that expected revenue for 2012 had plunged 23 percent – a shortfall of US$168.6 million, leaving the country with a budget deficit of 27 percent.

Fisheries Minister Shafeeu said although the state is in debt, the 100 million must be released to fishermen since  Parliament had allocated the money for fishing subsidies in the state budget.

Lease agreement revoked for five islands

The Ministry of Agriculture and Fisheries last month revoked the lease agreements for five islands rented for economic or industrial purposes.

Haveeru reports that the Maldives Inland Revenue Authority’s (MIRA) recommendation to revoke the licenses was prompted by non-payment of rent and fines going back to 2005.

The islands include Shaviyani Ekasdhu (Rf12 million), Noonu Kalhaidhu (Rf8 million), Noonu Bandaidhihdhu (Rf9 million), Baa Maa Maduvvari (Rf5.9 million) and Gaaf Alif Fonahdhu (Rf1.7 million).

According to Haveeru, MIRA sent notices to Zuleyha Hafeez, Manager of Shaviyani Ekasdhoo, Moosa Naseer, Manager of Noonu Bandaidhihdhu, Noonu Kalhaidhu Manager Adam Naseer, Maduvvari Investment which manages Baa Maa Maduvvari and Abdulla Abdul Azeez who manages Gaaf Alif Fonahdhu.

An official from MIRA said that in addition to revoking licenses the owners would be sued for non-compliance with the lease agreements.

Government departments strike over salaries

Staff at several government departments, including the fisheries ministry and the attorney general’s office, have gone on strike in protest at the restoration of salaries for only some areas of government.

Staff a some of the other ministries, including the tourism ministry, are rumoured to be deciding whether they should take part.

Yesterday salaries were restored for staff at the independent commissions, courts, parliament and the judicial services. The president announced over the weekend that the remaining civil servant salaries will be restored in April if the country’s economy has stabilised.

A senior staff member from the attorney general’s office told Minivan News that more than 40 people working at the office were participating the strike, and would continue to do so until their received the restored salaries.

“We will come to the office every day, but we won’t be doing any work,” he said, claiming that the strikers were just trying to get their legal rights.

A senior staff member from the fisheries ministry confirmed that most of the civil servants at the ministry were on strike, including the management.

Some of the ministry’s senior staff had threatened legal action against the strikers, he said.

”We are working legally to get our rights,” he claimed, explaining that civil servants were present at the office but were refusing to work.

A civil servant working in the tourism ministry said staff were planning to sent a letter to the Civil Service Commission (CSC) about the issue.

”We will decide to strike or not depending on the answer we get,” she said.

The economic ministry said that all of its staffs were present and all of them were working “as normal.” A staff member said that they were not planning to strike.

Spokesman for the Dhivehi Rayyithunge Party (DRP) Ibrahim Shareef said that no legal action could be taken against the civil servants protesting.

”It is a right for the civl servants according to the law,” Shareef said, but added that the DRP had not yet decided whether to support the strike.

CSC spokesman Mohamed Fahmy Hassan said the CSC had yet to discuss the issue in detail but was currently “definitely not calling for strikes”, and was instead trying to solve the dispute through administrative and legal means.

“We have stated very openly that if we cannot solve it administratively, we will take the issue to court until we get a verdict,” he said.

Strikes would disrupt the services provided by the ministries and inconvenience the public, he added.

“I think the fact that some salaries have been restored has made it harder to persuade civil servants that the country has a financial problem. It’s very unfair what’s happened.”

State Minister for Finance Ahmed Assad said that civil servants were entitled to strike for their rights.

”We have not decided to change any of our decisions yet,” Assad said, refusing to answer more questions “as it is too early to say anything.”

The proceeds of illegal fishing in the Maldives

Fishing has always been a huge part of Maldivian life. Ever since people settled here, fishing has provided a source of food and income. Even after the industrialisation of the fishing sector in 1979, the Maldives maintained a strict policy ensuring sustainable fishing.

The main methods used are pole and line and hand line fishing. These methods ensure that the resource is not over utilised.

However there have always been illegal fishing activities conducted in the Maldivian economic exclusive zone (EEZ), an area of nearly a million square kilometres recognised internationally as Maldivian fishing territory.

The most recent case was reported October 2009, when two Iranian fishing vessels were apprehended by the Maldives National Defense Force (MNDF) coast guard. These two vessels carried a total of almost 60 tonnes of fish.

Currently all illegal fishermen apprehended by the MNDF are handed over to police for processing and fined between Rf100,000 to 1 million, according to Hussain Sinaan from the ministry of fisheries and agriculture.

The coast guard are left with the problem of what to do with the confiscated fish, he said, which can include high-value product such as shark fin.

“The MNDF will hold an auction to sell the fish, if they believe the fish will go bad,” he said, adding that the auctions are usually announced and open to the public.

The coast guard did not respond to enquiries from Minivan News as to how much confiscated fish has been sold at these auctions, whether the cargo is inspected for protected species, or where the proceeds go.

Recent regulations passed by the EU requires the licensing of vessels catching fish for the European export market, intended to reduce the amount of illegal fishing.

New licence required to export fish to Europe

All organisations involved in the export of fish to Europe must carry a special licence from next month.

The Maldives Seafood Processing and Export Association said that from next year they will only accept fish from vessels carrying this license.

Haveeru reports that the Fisheries Ministry will issue licenses for free until the end of December. After that licences be issued at a price depending on the length of the vessel.
