Hearing in Ibthihaal murder trial cancelled

A hearing in the trial of Afiya Mohamed Manik over the murder of her three-year-old son was cancelled today due to the absence of a defence lawyer.

At the last hearing of the trial on June 15, the judge offered Afiya the opportunity to appoint a lawyer at the state’s expense and explained the process of seeking a public defender.

The criminal court told local media that today’s hearing was cancelled because the accused did not have legal representation. The attorney general’s office is responsible for appointing public defenders to defendants who lack the financial means.

In addition to murder, Afiya was also charged with disobedience to order over child abuse and neglect with reference to the law on protecting children’s rights.

At the previous hearing, she pleaded guilty to the latter charge, but also confessed to the murder.

She told the court that she repeatedly abused her son, Mohamed Ibthihaal, and said she felt anger towards the boy because he was born out of wedlock.

Ibthihaal died “by my hands,” Afiya said. She confessed to strangling the child and kicking his chest three times.

Judge Muhthaz Fahmy reportedly stopped Afiya and reminded her that she was to answer the disobedience to order charge.

If she is found guilty of murder, Afiya faces a sentence of life imprisonment. She had reportedly confessed to murder during the police interrogation and her remand hearings.

Ibthihaal’s body was found with signs of severe abuse on January 28 in the worst case of child abuse in recent years. The horrific murder on the island of Rakeedhoo in Vaavu atoll shocked the nation while reports that the authorities had been aware of Ibthihaal’s abuse sparked public outrage.

Afiya was arrested for murder two days later and has since been held in pre-trial detention.

Mother confesses to abusing murdered three-year-old baby

A mother accused of murdering her three-year-old boy has confessed to killing the child at the first hearing of her trial today.

Afiya Mohamed Manik told the court that she repeatedly abused her son, Mohamed Ibthihaal, and said she felt anger towards the boy because he was born out of wedlock.

In addition to murder, Afiya was also charged with disobedience to order over child abuse and neglect with reference to the law on protecting children’s rights. She appeared for today’s hearing without legal representation and pleaded guilty to the latter charge, but also confessed to the murder.

Ibthihaal died “by my hands,” Afiya was quoted as saying by local media. She confessed to strangling the child and kicking his chest three times.

Judge Muhthaz Fahmy reportedly stopped Afiya and reminded her that she was to answer the disobedience to order charge. The judge and state prosecutor explained the charge to Afiya.

Afiya said she understood the charge and was confessing to abusing her son voluntarily.

The charge carries a penalty of six months in jail.

Reporters at the hearing observed that Afiya appeared calm, but her voice trembled when she spoke of abusing Ibthihaal on the day of his death. She was handcuffed throughout the hearing.

Afiya’s stepfather, Ismail Raoof, was arrested on April 1 on suspicion of physically and sexually abusing Ibthihaal.

In April, Chief Inspector Abdulla Satheeh said negligence by government authorities and the island community on Vaavu Rakeedhoo was partly responsible for the toddler’s murder.

Satheeh said marks on the child’s neck indicated that he had been strangled.

Police also found swelling on the right side of his forehead, scrapes on his face, wounds on his right ear and scars all over his body. Some of his ribs were broken as well.

Satheeh said Ibthihaal’s death was caused by “major injuries” while some older scars remained unhealed.

“Mohamed Ibthihal had received physical and psychological harm from different individuals on different occasions, for a long period of time,” he said.

Ibthihaal’s mother remanded for a further 15 days

The Criminal Court has extended the remand period of Afiya Mohamed who stands accused of having caused the death of her 3-year-old son Mohamed Ibthihaal on January 28.

Afiya was taken into police custody two day’s after authorities discovered the body of the toddler in Afiya’s home on the island of Rakeedhoo in Vaavu Atoll.

Police yesterday extended the detention period by a futher 15 days, reported Vnews.

The case has sparked a surge in reports of child abuse as reports that officials had been aware of Ibthihaal’s abuse prior to his death prompted national outrage.

Multiple investigations into the case have begun, though MPs involved in the Majlis inquiry have expressed concern that no the work of the government oversight committee is progressing slowly.

MDP concern over stalled Majlis investigation into Ibthihaal case

The opposition Maldivian Democratic Party (MDP) has voiced concern over the slow pace in which the Majlis investigation into the death of 3-year-old Mohamed Ibthihaal has been proceeding.

MDP MP Rozaina Adam said that, despite the government oversight committee receiving reports from the relevant authorities a week ago, a meeting has not been scheduled.

“We have been pleading and begging with the committee chair Riyaz Rasheed to schedule a meeting,” said Rozaina. “This investigation is getting stalled because a meeting has not been scheduled.”

The motion to investigate the death of the boy from Vaavu Rakeedhoo-year-old, who was found dead on January 28 with signs of severe physical abuse, was proposed by Rozaina, fellow MDP member Ahmed Falah, and Jumhooree Party MP Moosa Nizar.

Government oversight committee chair Riyaz Rasheed, of the ruling Progressive Party of Maldives, was not responding to calls at time of publication.

He explained last week that the first hearing into the case had been adjourned after most members of the committee requested more time to analyse the recently received documents.

Commenting on the reports given by the police, Rozaina said that the details given consisted only of events which occurred after Ibthihaal’s death, and did not have any details of the events leading up to his death.

Rakeedhoo island councilor Abdulla Rasheed had previously told Minivan News that the council had informed authorities Ibthihaal was being abused prior to his death.

Rozaina also said that the reports revealed police had not informed the Family Protection Agency (FPA) of the case, as required by Article 14 of the Domestic Violence Act, which states that the police shall inform the authority if any member of the police is present at the scene of an incident of domestic violence or when the incident is reported.

She said that the FPA has been facing severe budget constraints as it has not been able to obtain finances, since money was not allotted to the authority by the parliament as per Article 55 of the Domestic Violence Act.

“The PPM majority budget committee did not hold meetings with the FPA. In addition, the FPA has informed us that it is being run by only two to three staff members,” she said.

FPA staff have confirmed to Minivan News that they have only three technical staff members, with Policy and Advocacy Director Aminath Leena Ali saying this was “not even close” to enough staff to deal with the current workload.

She noted that there had been an increase in reports of abuse since news of Ibthihaal’s death broke. NGO Advocating the rights of Children has described the rise in reported incidents as the “tip of the iceberg”.

MP Rozaina went on to accuse the government of negligence, saying that the gender ministry has no parliament-approved minister. The ministry has been headed by Attorney General Mohamed Anil since its creation in July last year.

In addition, she said that the gender ministry’s child helpline 1412 has stopped functioning, and is not picking up calls.

“Ibthihaal’s murder illustrates when the government does not adequately address social issues,” said the Meedhoo MP.

Meanwhile, the Human Rights Commission of the Maldives (HRCM) – who is also conducting investigations into Ibthihaal’s death – released a press statement last night urging media outlets to not publish articles which might hinder its investigations or mislead citizens.
