Nexbis signals willingness to negotiate border control agreement

Mobile security system vendor Nexbis, which is behind the stalled build, operate and transfer agreement to upgrade the Maldives’ immigration system, has issued a statement welcoming the government’s decision to proceed with the project and said it is willing to negotiate the terms of the contract.

The upgrade was stalled earlier this year when the Anti-Corruption Commission (ACC) expressed concerns about the deal, claiming that there were “opportunities for corruption” during the bidding process.

“A number of further gross inaccuracies continue to be perpetrated, whether intentionally or through ignorance, particularly regarding the cost of the contract,” Nexbis said in its statement.

“Despite sensationalist claims in the media regarding [the tender process], the terms agreed to by the parties, or the suitability of the system being provided, Nexbis will be delivering a state-of-the-art, flexible and cost-effective security solution.”

Under the 20 year agreement, Nexbis levies a fee of US$2 from arriving and departing passengers in exchange for installing, maintaining and upgrading its immigration system, and a fee of US$15 for every work permit card.

“This means that neither the government nor the Maldivian public have to pay in exchange for a state-of-the-art border security protection,” Nexbis claimed.

The company said that “although the bid proposed a fee to be applied to all travellers including Maldivians”, the company waived the charges for Maldivians “as a goodwill gesture.”

“In addition Nexbis is providing a five percent revenue share to the government should passenger numbers grow. In stark contrast to some of the other bids, we have not requested a guaranteed minimum volume of passengers. Essentially the company must bear the cost risk should the number of visitors to the Maldives drop as has previously occurred during the tsunami and financial crisis.”

Immigration Controller Abdulla Shahid has expressed concern over both the cost and necessity of the project, calculating that with continued growth in tourist numbers Nexbis would be earning US$200 million in revenue over the 20 year lifespan of the agreement.

At five percent, royalties to the government would come to US$10 million, Shahid said, when there was little reason for the government not be earning the revenue itself by operating a system given by a donor country.

“Border control is not something we are unable to comprehend – it is a normal thing all over the world,” Shahid told Minivan News.

“There is no costing of the equipment Nexbis is installing – we don’t know how much it is costing to install, only how much we have to pay. We need to get everything out in the open.”

Nexbis meanwhile argues that “reasonable persons will likely realise that once the hidden costs after are taken into account and adjusted for inflation, the benefits and efficiencies of the Nexbis system will far outweigh the risk, inadequacies and uncertainties of any such alleged cheaper system.”

“This frees up the [Department of Immigration] from managing systems and securing the budget year in, year out to ensure the system is maintained. This will prevent interruption of service and avoid potential corruption as there will no longer be a need to purchase equipment every year.”

Shahid however estimates that maintaining a free system given by a donor country would cost at most several hundred thousand dollars a year, and said he was unsure as to why such an agreement had ever been signed.

“Airport charges are calculated based on government expenditure – such as the cost of the immigration counters. The US$18 collected as an airport tax is included in the ticket, and in the end [under this agreement] the amount for immigration will be going to Nexbis,” he said.

He further noted that despite Nexbis offering not to charge Maldivians for use of the service as a “goodwill gesture”, there was no mention in the contract that Maldivians would have to pay at the border: “the contract says every foreigner,” he said.

Shahid would not comment on the specifics of the pending negotiations with Nexbis, but said that the Immigration Department had the government’s full support in the matter.

Nexbis meanwhile said it had agreed to review the government’s additional requirements, “and have expressed our willingness to accommodate any such changes within commercially viable terms.”

“We have this requires some changes to the solution we ultimately provide, then it is within the scope of our agreement to accommodate these changes,” the company said.

Meanwhile, an ongoing police investigation into labour trafficking in the Maldives last week uncovered an industry worth an estimated US$123 million, eclipsing fishing (US$46 million in 2007) as the second greatest contributor of foreign currency to the Maldivian economy after tourism.

Police discovered several thousand passports confiscated from expatriate workers during a recent raid of 18 ‘paper companies’, created to fraudulently apply for work permit quotas. The imported workers, many of them illiterate and from rural Bangladesh, are then typically employed for a pittance under substandard conditions or else simply abandoned at the airport after having paid up to US$2000 to bogus recruitment agencies.

  1. I fully support ACC scrutiny on this. Its not a system issue, it is an issue with people at the top of these institutions. You cant solve these problems with bogus system and financial model which only looks good on the outside. Maldives is a small country, our immigration traffic can be handled by a "spreadsheet"

Shahid wants to Fail Iylas everything and what he did, It is very sad to tell to Public Shahid is working with MDP guys to spoil Immigration and all the projects last 3 years what Ilyas did, Detention Center , Work Visa , Border Project etc..     Who made the complaint?
    When can they conclude the investigation?

    Who were involved in the Nexbis deal?
    Is the ACC politically influenced?

    The above are important questions since the allegations are serious…

  7. On the 11th hour of signing, the ACC intervenes citing an anonymous complaint alleging possible corruption. During the 8 months since, no specific allegations against any persons involved has been made public, neither has the investigation been concluded.

    Did Shahid knows what is corruption that acc is talking about?

I read on the Malaysian news paper a few weeks back that Nexbis had gone to court in several countries against Abdulla Shahid and other individuals as well as the ACC for defamation which caused the company millions. So most likely not long before we see one of them getting arrested while traveling abroad. In countries like in Europe and other Asian countries ACC would not dare speak anything against any company without evidence because companies can take the ACC to court for defamation.

    I guess Maldives is going to learn this the hard way

  9. Immigration Controller Shahid is manipulating the issue. He tried his best to terminate the agreement when he took office. His suggestion went up to AG. AG approved the contract before signing therefore AG wanted Shahid to get final word from the Cabinet since it was risky to slap on the face of investors coming in to the country just for the sake of some people interest. Cabinet did not discuss the review. It was again Shahid pushing thru President Office the word REVIEW came. There was 10 ministers in that sitting si Shahid can not hide the fact. Even today Shahid is saying he will make sure the contract is terminated because the Informatics have said such a system can get for USD.9 million n he wantbto give to them? It’s almost ONE month to cabinet decission to continue agreement but Shahid refusing to meet NEXBIS either to so called REVIEW or suggestions. So? Shahis is taking advantage of ACC uncompleted initial report to sabotage the contract thinking he can make some money from Informatics with the help of Adam Naseer and Ibrahim Waheed who within the DoIE tried to sabotage this contract . Why can’t ACC come with final report since Oct. 2010? What’s wrong with us?

    The best way to immigration is to move their seniors to other government offices, These seniors cannot spend a single day in office moving up and down for to spread rumors and show powers to officers, since Mr Ibrahim whaheed who join from IGMH was the person behind this and organize the plan for Adam Naseer. Mr Ibrahim Waheed is the only person who was in immigration got all the benefits from shafy regime which promotion and study in immigration fund etc…

    Since he took over the department, he had created havoc for foreign professionals applying for visa to work in this country legally.

    Has anyone seen the queues he created starting before dawn? The guy has this Arab mind set.

    We need a forward thinking person who can not only manage the department efficiently but work with the Labour Ministry to introduce a more efficient system to control the influx of illegal workers into the country.

    When the immigration controller is clearly stating the facts I don't know why the government is pushing for this. I'm surprised that Nexbis has such a media presence in the matter.Totally befuddled. The matter is quite transparent, the government agency that did the bidding process and approved nexbis should be making the case for Nexbis.

  14. Not to mention 20 years of tax collection for Nexbis is just preposterous.

    Lets take the tourist arrival for 2010, which is 71,1917. $2 tax from each would amount to $1 million, 583 thousand and 834. Thats a figure excluding tax from work permits. Nexbis would be making one fat load of profit, and whoever is behind pushing for the deal to get approved.

    And imagine this years tourist arrivals just increased.

    This is a bad deal for Maldives. Why should Maldives go for this system when they can get a free one from a friendly country?
    In fact this system offered free has been in use with some prominent countries and why should Maldives pay Nexbix some 200 odd million dollars for 20 years?
    No one in their right mind would sign a contract of IT for 20 years.
    The Government should either renegotiate with Nexbis or go for a new tender.
    Joany, this defamation is a civil matter and not a criminal matter and no democratic country would just arrest someone just because a defamation case has been filed at a civil court.

    I believe you are being shortsighted. The reason we are in this debacle is not because of a lack of but because of a corrupt system.

    It certainly seems unfair for us to be "paying", I use quotes because it is opportunity costs, $200 million for a system which can be had for free. However, keep in mind that there is no such thing as free lunch. A free or cheap system will deliver just that- a free and cheap service. A Nexbis system (currently used in Malaysia), fingerprints all arrivals and departures and data is stored and retrieved from a centralized system. This process is handled by them, immigration officials cannot tinker with the software or data.

    Nexbis a relatively large player in this business will stand to make very little but lose a lot if it colludes in human trafficking, therefore an educated guess would be they will not jeopardize their $200 million deal- Immigration officials in charge today have proven they have no such qualms.

    Shahids' motives for opposition are unknown, we can only speculate. The ACC have failed to provide any specific allegations, much less proof of corrupt practice with regard to the Nexbis deal.

    This is not about buying an expensive system when a cheap one can be had. It's about our proven failure to self regulate so we are handing this over to a third party.

  20. $200 million is a humongous sum for a system that would be implemented only in Hulhule Airport, the cost of the hardware I believe would not amount to more than a million.

    The tourism sector is booming $200mil is just the minimum estimate.

  21. I know a lot of the Border Control Systems used in other countries.(I have no vested interest in this) but the PISCES system offered to Maldives by the USA free of charge is as equal or better than the Nexbis system. This has all the APP, APIS and E-Gate too.
    What Nexbis offers is there in PISCES too and it is free.
    Just because the USA is giving it free does not mean it is bad. A lot of other countries including Thailand and some European countries have received this from USA.
    Why should we pay 200 odd million dollars when all this is given free and is just as good?
    Furthermore, a free product would eliminate any corruption involved too as there would not be any money involved to win this?
    Please do not tell me that the US government would have to bribe someone in the Maldivian government to accept a free product.
    The 200 odd million dollars collected from the passengers then could be utilised for other much important infrastructure development in The Maldives.
    This is simple. In the pred bidding,All the other competitors was eliminated to leave all clear for Nexbis.
    Do you guys know that Illyas visited Malaysia and Nexbis before the tender was decided?
    I am no fan of Shahid but in this case he is right as this is a huge thing and we should not accept this kind of costs as it would not cost more than a 5 to 6 million dollars to install such a system even if the Government buys it but it is much better to accept the free offer from the USA.(It does not come with any pre conditions when they gave it to other countries).

  23. Peter, I am not involved in immigration nor do I know Shahid well. I do not even know who is this Adam or Waheed and have never met them in my life.
    Is is asking too much as a Maldivian that I would like to do away with corruption that is prevalent in my country? Or are you encouraging it?
    I have not filed anything to the ACC, as I think they are bunch of imbeciles too.
    It is not that all Maldivians live in Maldives either. A lot of Maldivians live in places like Malaysia too so it is not surprising that I may know Ilyas was visiting Nexbis. The way you go on about here, it looks like that you may be a party to benefit from this deal.

    As a Maldivian I would prefer that there is no corruption at all. So getting a free system would eliminate this corruption.
    Or do you want the Maldivian Government to lose 200 odd million dollars that could be utilised for some other important development?
    Surely you cannot be such a big idiot to think that a completely free system would also be "sold" to the Government of Maldives and to other countries?

My friend who work in disaster ministry when shahid was controller say he always make deal with china company and he get rf100000 evrytime Shahid is the corrupt one and he will even sell his country to the jews and now he make trouble with labour ministry.

    He now haves deal with lanka company for immigration system so that he can bring more illegals from there. He cannot even add and he want be controller. He says $2 for 1 million tourist is 4m ! What a joker ! He said there will be 5.5m for company every year so he mean there will be 250000 workers every year, thats most of our population.

    He make trouble now for labour ministry and before that for disaster. Soon he will destroy our country !

  26. In Maldives with present system of governing it is better the Government send all there projects, RFP and a draft contract for each project to ACC who then can guide the Government to make those documents more professional .

    Once ACC approves then the Government can sent it to Finance Ministry for Tender! Thilafishi project with Heavy load is moving on but ACC doesn’t get an injunction from the court to stop work because ACC don’t have such proof to convince courts otherwise.

  29. Manik must be the ‘friends’ of one of the bidders who lost that is complaining and used their inside man in immigration to report to the acc to try to stop the project after they have lost.

    My cousin told me he knows that the losing bidder has a man in immigration including a very senior political deputy appointee who tried to get the project without bidding.

    When they bid they lost and now trying to cause trouble. The ACC should investigate these complainants. Check how many times they have been to Colombo.

    Can you understand what I am saying then? I am saying that I do now want a system that has to be bought. If you go for a bid and award a contract, The Maldivian Government has to pay for this.
    I prefer a free system that is being given by a friendly country that is as good as the one Nexbis is selling to us.
    Now you are going to tell me that I work for the US Government. If something is given free then you do not pay for it. Don't you understand?
    I am not in the Government and have no interest in who gets the bid so long as Maldives gets the best deal and we do not have to pay through our nose for it. Paying any company 200 odd million dollars is paying through our nose while we reject free aid from friendly countries.

    Your stance would hold water if we were actually paying a cent to Nexbis from the treasury. As stated in the article the money will be collected from those arriving and applying for work permits.

    You are correct, the govt of USA has indeed offered the PISCES(Personal Identification Secure Comparison and Evaluation System)to many countries, their motivation being to monitor suspected terrorists.

    A few questions though. Why are we in this situation? What good is a "free" system if the same corrupt officials are in charge? (I don't believe the US or any other govt will actually operate or accept responsibility for the system once in place).

    Human trafficking has been happening on a massive scale. This is not due to a lack of a system. It is due to the (correct) belief that Maldivians have a lot to gain through corruption and relatively little to lose if caught. A free system without the involvement of a third party would be business as usual. The easiest way to combat this is to bring in outsiders, who have no vested interest, and much to lose ($200 million)and their reputation if caught.

    Collecting $200 million from people for the privilege to visit and work in our country is not a big deal, especially if it prevents thousands more poor innocents being exploited.

    I paid $30 for my 15 day tourist visa to Thailand recently. Nexbis wants $2. If Maldives imposed a similar amount the lions share would still be ours.

    Again, no free lunch - there is always a price.

  34. Peasant, I know that the Nexbis system would be charging passengers arriving here. Just look at this more broadly than Immigration charges.
    Passengers are being charged a lot now. They pay all these taxes(especially if they come from Europe) then GMR has increased the fuel prices and the all the charges related to the Airport. Now they are going to raise the Airport surcharge to 25 dollars.
    All these are extra costs the passengers have to pay and if we keep charging the passenger all these things, there would be a reduction at some point.

    It is much better to use the free PISCES system.
    As for corruption, I do not care who is in charge of Immigration and if you have a personal problem with Shahid, and if you think he is corrupt, sure kick him out and get someone who is not corrupt. I do not know the man well enough to know much about him, apart from the fact he was involved in the November 3 attack.

    $123 million worth of human trafficking. This is reason enough to do this right. I'm assuming, many assumptions here, that a paid system means more leverage, better quality, and most importantly an end to the practice ruining lives of already desperate people for profit.

    Nexbis, or whatever company in charge, if of course contracts are negotiated properly will be in charge of operating and upgrading, with personnel at hand.

    A free system would be great if it comes will the same bells and whistles as a paid one along with personnel to monitor the system. We need to effectively out source this task. Besides corruption within the Immigration dept, there are too many people with a vested interest making too much money to take this lightly.

    Manik, it's not about individuals. I am assuming even if the whole dept is changed, the people who actually profit the most from human trafficking will simply approach the new ones. Given the state of our law enforcement, the risk of corruption is quite high.

    Of course if there is exactly no difference in the free system and the paid one, i.e. systems fixed and passwords given to our immigration and they fly back to Malaysia; it really doesn't matter, the purpose is defeated. I'm assuming in a free system the provider will be less involved and therefore take no responsibility.

  37. When will have immigration a free system and still we never heard about system will donate from any country. Only Indian Goverment may help them. But still Indian never use biometric system.

    I think some one using propaganda to promote like media freezing for their own intrest . What they will have in a free system , it suppose to come with same as past , so easy to tell without knowing what you will get and without knowing what you will use that's why some one is acting like agent to promote ,.

  39. good news to malaysian company and to maldives government

    however, capability of nexbis to deliver is questionable.
    with high turnover in the company, incapable software developers which translate to full of bug in the software, reseller kind of business style, nexbis will delay the delivery of the software.

    in malaysia alone, they are not capable of delivering well to the malaysian immigration department. nevertheless their infrastructure / backend servers are prone to hacking.

    eventhough they claimed that dermalog system that they will bring in, this system is relatively slow if compared to the other system like nec, sagem and also few other competitor brand out there.

    for facial recognition, most probably they will source it from somebody else. e-gate which developed by iris; also a malaysian company which are known as bad after sales service will be bought by nexbis to maldives.

    current situation in maldives whereby the old system developed back in early 2000 proven the stability compare to what nexbis want to offer.

    a part from bad reputation and software, nexbis operational team leading by a man who are not in the immigration / border control sector before. he was from a pharmacy background which way different in term of the technology used.

    muslim are good and soft but firm in decision making. dealing with him will create a disaster. he is kind of losing control of his own software development and software delivery team. he will race again time to deliver the solution but at the background, disaster in the making since they are not capable of delivering the total "near to perfect" solution.
