UN Human Rights Committee calls for widespread institutional reform in the Maldives

The UN Human Rights Committee (UNHRC) has urged the Maldives to guarantee citizens’ right to democracy, permit freedom of religion, reform the Judicial Services Commission (JSC), abolish flogging and the death penalty, and deal with human trafficking, among other recommendations.

The  Committee has issued concluding observations regarding the Maldives’ commitment to universal human rights, following the country’s defence of its record in Geneva on July 12-13.

The Maldivian delegation to the UNHRC was headed by Home Minister Dr Mohamed Jameel, a former Justice Minister during the 30 year rule of President Maumoon Abdul Gayoom and co-author of a pamphlet entitled ‘President Nasheed’s devious plot to destroy the Islamic faith of Maldivians’, published in January 2012.

Dr Jameel was accompanied by State Minister for Foreign Affairs, Dunya Maumoon – Gayoom’s daughter – as well as the Maldives’ Permanent Representative in Geneva, Iruthisham Adam.

Religion

A core concern of the committee involved the Maldives’ reservation to Article 18, concerning freedom of religion, the validity of which was questioned by the committee on the basis that it was “not specific, and does not make clear what obligations of human rights compliance the State party has or has not undertaken.”

Particular concerns included the tying of religion to citizenship, prompting the UNHRC to call on the country to revise its constitution, and abolish the crime of apostasy in legislation.

The committee also expressed concern about the clause in the constitution enabling the limitation of rights and freedoms “in order to protect and maintain the tenets of Islam”, challenging the broadness of the clause and warning that such a provision could be “invoked to justify the failure by the State party to fulfil its [human rights ] obligations”.

Concern was also raised about the criminalisation of homosexuality, and the “stigmatisation and marginalisation of homosexuals in [Maldivian] society”.

For its part, during its defence, the Maldives’ delegation stressed that the country was a homogeneous society and spoke one language and followed one religion, adding there was therefore no debate in Maldivian society regarding the removal of the provision relating to freedom of religion.

“This is not dogmatic government policy or preference, but rather a reflection of the deep societal belief that the Maldives always has been and always should be a 100 percent Muslim nation. Laws, like government, should be based on the will of the people,” Dunya told the panel.

Controversial transfer of power

The Committee noted in particular “the legal and political circumstances” under which the Feburary 7 transfer of power took place, and called on the government to ensure a citizen’s right to self determination – “ which lies at the core of democratic government based on the consent of the people.”

The report called on the Maldives to ensure that the Commission of National Inquiry was able to function “in conditions guaranteeing its complete independence and impartiality”, and called on the government “as a matter of urgency” to protect individuals who had provided information to the inquiry.

Torture inquiry commission

The UNHRC called for the government to establish an independent commission of inquiry to investigate “all human rights violations, including torture that took place in the State party prior to 2008 and provide compensation to the victims.”

The Committee should further investigate all allegations of torture that took place at the time of the demonstrations of February 8, 2012, in Malé and Addu, prosecute those responsible, and provide compensation and rehabilitation to the victims. The State party should implement the findings of the Commission of Inquiry set up to investigate events that took place during the political transition period.”

The committee also expressed concern at the composition of the police integrity commission, which was “hampering its independence”, and said it was concerned at the low number of cases relating to torture and ill-treatment received by the Commission as well as at the low number of police officers sanctioned.”

Legal reform

The composition and the functioning of the Judicial Services Commission (JSC) was “seriously compromised”, the UNHRC observed, a state of affairs which was affecting the independence of the judiciary “as well as its impartiality and integrity.”

“The Committee is concerned that such a situation undermines the judicial protection of human rights and fundamental freedoms in the Maldives,” the report stated, and called on the government to reform the JSC.

The UNHRC also called on the Maldives to abolish flogging and the death penalty.

Human trafficking

The committee expressed particular concern over reports relating to “trafficking in migrants from neighbouring countries for labour and sexual exploitation purposes.”

“No legislation has yet been enacted by the State party to prevent and protect against trafficking in persons. The Committee is further concerned at the lack of statistical data on the number of trafficked persons, the investigations conducted, the number of prosecutions and convictions, and the protective measures put in place, as well as the absence of a strategy to combat trafficking,” the Committee stated, calling on the government to study the root cause of the problem, provide data, punish traffickers, and provide protection to victims.

Domestic violence

Positive observations included the enactment of an Anti-Domestic Violence Act in April 2012, although the committee expressed concern at the low rate of complaints lodged for domestic violence, and at the lack of effective mechanisms of protection and rehabilitation for victims.

“The State party should take the necessary measures to implement fully the Domestic Violence Act. It should facilitate complaints from victims without fear of reprisals, intimidation or exclusion by the community; investigate, prosecute and punish those responsible with appropriate penalties; and provide compensation to victims. The State party should further establish a proper mechanism of protection, including by setting up shelters and by providing psychological rehabilitation and conduct awareness-raising campaigns on the negative impacts of domestic violence,” the report noted.

The Maldives is required to respond within one year detailing how it had implemented the Committee’s recommendations.

  1. The recommendations on domestic violence, human trafficking and judicial reform should be implemented within a reasonable time-frame starting now.

    As for the issues centering around religion the popular mindset and prevailing attitudes among the electorate do not allow for any elected government to make the changes recommended by the UNHRC. Of course it is the job of the UN's Human Rights monitoring body to advocate for such changes and we as a nation must accept that are trying to do their job and we must respond with our stand on these issues.

    As for the recommended Truth and Reconciliation Committee, which I assume is the concept referred to in the UNHRC's concluding remarks, this threatens to pick at scabs. This is a highly sensitive and divisive issue. Although one cannot ignore the fact that past injustices must be acknowledged in some form for our country to move ahead. However the feasibility of setting up a Commission is highly questionable given the current situation.

  4. Somebody should have told the UN Council that Maldives is a sunni muslim nation, sorry 100% sunni muslim nation, with its own dumb religious based laws that are unlikely to be amended anytime soon.
    Therefore:
    Human rights is contrary to the teachings of islam and will not be permitted in Maldives
    Sunni islam is the 'real thing', Maldivians are 'God's Chosen People' and freedom of religion will never be tolerated in Maldives
    Flogging of women in public is permitted in islam and will stay on the statute books
    There is no prescribed minimum age of marriage for girls in islam therefore it will be perfectly alright for nine year old Ayeshas to legally wed old men
    Apostacy is permitted in islam and will be retained at all costs
    Anybody insulting the koran or the prophet will be hung, drawn and quartered
    Homosexuality is an abomination and any Maldivian advocationg it will be set upon in a dark alley and have their throat cut
    Beats me how you can bring civilisation and modernity to a bunch of primitive islanders who still hark back to the seventh century.
    While the rest of the world moves forward, sunni muslims are stuck in reverse gear.
    You backward people make us hindus look so progressive.

  5. Freedom of religion is a must.

    To be born a muslim is a curse. A horror story, out of which one can never come out clean.

    The community generally feels an overwhelming need to punish anyone who declares or questions their faith. What they dont realize is that, is it they who claim that God will punish the non-believers, yet when they see that God does not punish the unbelievers any more than the most devout of them, they feel so confused. To not look lost, they lash out at the non-believers, angry at their own confusion, angry why they have been subjected to hunger-fast, why they cant enjoy an occasional drink, why they cant enjoy a one-niter etc.

    Yes. Freedom of religion in Maldives is a must. This is the last frontier, which will open up the country to the world.

    Be it MDP, DRP or IDP, any party who advocates the freedom of religion, will get my vote.

I have seen maldivian kids who are taught only english. So where does that put them? And how about us apostates? We don't follow your barbaric religion from 1400+ years ago.

    Like a person said above, the only way this country will even start developing is when it becomes secular. When religion becomes an option in schools, and when science and reasoning win over superstition, then this country will start seeing real progress.

  16. Evan Naseem was not killed while he was sleeping at home right ?

    He was a child who was abandon by his mother and father when he was just few years and was left to live by himself on the road. I happened to live close by where his mother lives .

    Evan Naseem was nuisance for the neighbor even when he was just five years old. I do not blame him his problem but it was the complete ignorance and abandoning of him from his father and mother.

    Evan Naseem become a threat from nuisance when he reaches age 10 where he had a serous robbery and fight with neighbors.

    It would be completely irresponsible, devoid of caring, naive as hell for ANY Maldivian politician to be seen to allow freedom of religion in Maldives. This is because, No Maldivian Government can be SEEN to allow freedom of religion without provoking a riot and mutiny in which innocent ppl will be hurt in the process as bystanders etc…

    If you choose to be a non-Muslim, publicly, nobody can save you from the rejection, attacks, the suffering which will befall you, though one or two in Maldives and millions MAY secretly admire you for your courage, they can’t physically save you.

    I am extremely sad that this is a painful fact that no-one knows how to stop, though millions wish we could, but, you don’t get freedom without paying the price of suffering for it.

    Noone can FREE you, you have to find the courage within yourself to pay the price everyone had to pay for freedom, loneliness, physical pain, and possibly death.

    The best the freedom lovers can do is to encourage each other, love each other, and hope that, through that love they can find personal courage, the courage they need to face the suffering demanded for being honest about who and what they are.

    I don’t blame a Maldivian politician for not publicly coming out for religious freedom, they may otherwise be genuinely concerned for helping their people. But what I hate, is when the religious card is USED as a weapon so viciously the way it had been.

  25. I disagree with some comments here. The only way we will progress, is if we enforce true Islamic shariah in the Maldives. We should stone adulterers and hang apostates. Murderers shall be beheaded. Science and european languages like english, should be removed from our education system and replaced with the study of quran and sunnah, along with mandatory arabic. Western medicine must also be banned. I'm pretty sure, honey, dates and camel urine would be sufficient to cure many diseases that our people suffer from. Testing the wings of a fly using non-western methods may also lead us to great scientific discoveries.

    Also, stop importing jewish products such as toothpaste and deodorant. We have miswaak and athar can be obtained easily.

    the west was more or less in the dark ages while Asia and the middle east was thriving near about 500 years ago.

    Geography, medicine, arts, architecture, literature and even physics(for example the theory behind the model of a camera/concept of refraction/reflection in relation to lenses) came from the Middle east,

    And a large portion of the concept of modern projectiles came from china,

    And this was the time when the west was near wiped out from plague, and during this time in different parts of europe, hygine was at such a low that, clothing was so flea infested that (this was only for royalty since the poor didnt have means to do this either), they kept clothing over human waste, to kill the fleas from gaseous ammonia emissions from the breaking down of proteins in feces and urea in urine. And as for them to criticize arabs of 1400 years ago for marrying someone under age, marriages were reported in europe as young as the age of TWO!

    And the whole Radical islamic movement was brought about by someone called ibn Wahhab and the followers, and they were supported strongly by the british empire because of their allegiance to king Saud
    and this was to a)-secure oil(America became the worlds super power after the british empire fell in the world war two, and the Americans sort of "requested" the british to leave from the suez?(cannot be bothered to get references at this moment ), and b)- it was to use them to create internal conflict against the ottomans(who werent very nice people either).
    Hence the West was more or less assisting the middle east give birth to this retarded "strict" form of Islam, which probably is a whole lot different from what it was a few hundred years ago

    And to this day, the entire middle east had been pillaged and destroyed by war, and installed dictators(working to secure oil for the west): for example the saudi royal family, and the Shah's in Iran who were toppled in the 1960's who killed hundreds of people who opposed him. And not to mention Iraq since they supplied iraq weapons to fight iran in the iran-iraq war, and later supplied weapons to iran to fight iraq as well. Not to mention the several dictators placed in various african countries like Idi Amin in uganda, by the british (which wasnt too long ago, near the 1970's) who killed and tortured a whole lot of people. And the Iraq war in the 2004/5 and even now, was for weapons of mass destruction, oh wait, they didnt have any did they? and how many people have died? near a million.
    How much infrastructure is damaged?billions of dollars worth? what happened to the oil, which the people can gain income from to build homes, roads, universities, schools, hospitals? all of that wealth taken by those "civilised" parts of the world

    My point is, The middle east was far more civilised than the west was a few hundred years ago, but..

    Its not in today's time because of various conflicts which was directly or indirectly manufactured by the West, who apparently are the most civilised people on earth right now. But all their hands are red.. any tax payer in countries responsible for these atrocities, are responsible for those deaths as well.

    And apparently those people have a civilised brand, they have created, Wow they have homosexuals there! YAY! okay?
    but lets look at countries in asia with the highest GDP, singapore for example, is homosexuality allowed? nope.
    But are they less "civilised" because of this arent they? and guess what? their GDP per person is FAR FAR more than the U.K and one rank above america as well.

    You've raised some interesting thoughts. It's true that the Middle East as is known today was far more developed during the Middle Ages and people in that region had a better standard of living than Europe or elsewhere. It's also true to say that the form of Islam and its practitioners were very different to what we have today.

    Much of the innovation that happened during that time did not take place due to religion per se. It was the cumulative work of a large number of people who worked to gather and enhance knowledge and encouraged by benevolent Caliphs. It also served the Caliphs well in that the advances in knowledge helped them to expand their empires.

    If you take the example of countries like Singapore, Korea or Taiwan and compare them to the countries of the Middle East, you'll observe some very significant differences in many aspects of life. You'll observe a very striking work ethic and competitive culture in the Asian countries whereas you'll see an almost sleep like lethargy pervading the Middle East. Perhaps this is because of the "easy" money that the Middle East has access to in the form of petrodollars.

    The sad truth is that these countries are seen as role models by the rest of the Muslim world. They are hardly fit as role models. Most of them are absolute dictatorships. Their societies have degenerated into lazy-do-nothing sections and their productivity is negligible. Their mighty petrodollars are produced by the work of foreign labourers and external investors.

    The aforementioned Middle Eastern nations do try their utmost to "export" their version of Islam and culture often mixed into a very nasty cocktail. You'll see clear examples of that here in the Maldives too. Have you encountered the recent phenomenon of people calling themselves "bin Mohammed bin Abu bin..."? (My nickname is supposed to reflect the irony in that). Now, this form of naming is a cultural tradition in the Middle East that pre-dates Islam! However, the idiots who are copying this here in the Maldives somehow think that by calling themselves "bin something-or-the-other", that they are somehow being "better" Muslims like their "brothers" in the Middle East.

    There are other cultural artifacts that get mixed up in the religion like under-age marriage, women covering head-to-toe etc. These are all "exports" of the Middle East and of course, this all serves the purpose of the exporters and makes them feel somehow more important than they really are. There was a very famous politician who saw through all of this in the early 20th century. He was none other than Mustafa Kemal Atatürk of Turkey. He not only saw through this smoke and mirrors, but he saw the danger in continuing to subscribe to this distorted and dangerous "exported" version of Islam. The rest is history.

    have to agree with a lot you had to say,
    middle easterners,even a lot I met, do not share the ridiculously good work ethic the Asians have.

    And its a pity that what represents Islam, even in Maldives, is a whole lot of absurd nuts who are raving nuts, who sort of are responsible for the dislike towards the religion.

    Knowledge is really important in this day and age, but..
    cant really point fingers at the middle east for being so behind as well, since they have been facing war more or less for the past 60 years, atleast a large portion of it. And their leaders are oil rich slobs, who need to indoctrinate religion into totalitarianism so that they can control the masses.

    But at the same time, I am definitely sure I disagree with you(I have read a few comments on this website for a while now,but not yet commented) when it comes to politics, since I dislike MDP as much as I dislike PPM or whoever whoever, because they seem more like self involved, hypocritical S.O.B's, who have some form of agenda of their own, but I respect your opinion since you are expressing your views in a structured and polite manner, unlike the nuts here (LOL, and Ms concubine)
