Comment: MP Privileges Bill about building status, not state

On December 28, 2010, the Peoples’ Majlis passed Bill No 29/2010, the ‘Imthiyaz Bill’ or parliamentary privileges bill, among a host of others as members prepared to take their two month annual holiday from the Majlis floor.

The bill, which was submitted by Vilufushi MP Riyaz Rasheed, was passed with 44 ‘yes’ votes, 21 ‘no’ votes and 10 abstentions.

This is a substantial level of agreement in a parliament fiercely divided by party lines and plagued by frequent public displays of discord and disagreement on the floor which ends in cancellation of proceedings.

On December 15, 2010, prior to the passage of the privileges bill, the parliamentary Financial Committee submitted a report to the floor proposing to award themselves a “committee allowance” of Rf 20,000 (US$1550), increasing the already inflated MP salary of Rf 62,500 (US$4860) to Rf 82,500 (US$6420) per month.

Understandably, this caused public outrage which strangely appears to have taken some MPs by surprise.

The two different instances of personal privileges and remunerations are being sought by MPs at a time when the government is struggling to cope with an all-time high budget deficit, and being heavily criticised for making controversial cut-backs in civil service wages. These developments have lead to a considerable build up of public frustration, dissatisfaction and loss of confidence in the parliament.

On December 30, 2010, protesters gathered outside the parliament building demanding the resignation of MPs and the whole parliament, and ridiculed MPs for asking payment to “get out of bed”!

A few young people went so far as to call for a “Majlis Fund” and joined the protest with a cardboard donation box, raising funds for the allegedly destitute MPs.

Two days later on January 2, 2011, another public demonstration took place at Raalhugandu where protesters demanded MPs show accountability to the people and called for the reinstatement of civil servants’ wages and the scrapping of the proposed MP salary increment.

Citizen opinion

An open Facebook group entitled “Majlis membarunge musaara bodukurumaa dhekolhah” (“against MP salary increment”, sprang up virtually overnight and has attracted nearly 2000 members in just over a week.

As the momentum of the public protest gathered speed, a group of concerned citizens met at the social centre (MCSE) in Malé on the evening of January 8, 2011 to discuss and analyse the privileges bill.

Several lawyers and an economic analyst gave presentations on the issues arising from the bill. Two MPs, Mr Ahmed Nihan and Mr Ahmed Mahloof attended the meeting. They explained to the audience some of the difficulties conducting their work, including their obligation to follow the party line as well as the issue of getting insufficient time to read bills before voting.

Both MPs – who incidentally had voted in favour of the bill – said that they now supported those speaking out against the bill.

Nihan informed a member of the audience that he would not support the bill any more. This brings little comfort for citizens who find the contents of the privileges bill a parliamentary disgrace. The fact that an MP tried to justify voting for a bill he did not have time to read, further undermined any efforts for redemption.

On the evening of January 9, 2011, MNBC One aired a live panel discussion organised by three NGOs: Strength of Society, Madulu and the Maldivian Democracy Network.

The four panellists were practising lawyers Ali Hussain, Ahmed Abdulla Afeef and Shafaz Wajeeh, as well as economic expert Mr Ahmed Adheeb. The panel was moderated by prominent social advocate Salma Fikry.

Opening the discussion, Shafaz explained that the main purpose of the 400 year old principle of parliamentary privileges was to facilitate the unobstructed and independent freedom for MPs to perform their duties and functions as MPs.

However, nearly 75 percent of the “privileges” in the Maldivian MPs privileges bill, the panel argued, went beyond the remit of the principle of parliamentary privilege. In fact, it appears that the elected MPs of the new Maldivian democracy have attempted to redefine the whole concept of parliamentary privilege, as practiced in established democracies around the world. Privilege in the context of parliamentary practice had become distorted to personal status building.

Issues and concerns

Critics of the bill raised several concerns. They argued that it contravened citizens’ basic rights as provided in the constitution, contravened the constitution and existing laws and completely disregarded the serious economic situation of the country.

If ratified, they argued that this bill could not be implemented because it falls foul of many existing laws of the country.

The MP privileges bill gives powers to the Speaker of the Majlis to impose jurisdiction over independent statutory bodies, the judiciary as well as individual citizens.

According to Article 5 of the privileges bill, outlining “actions which impede privileges”, the penalties for non-compliance by any individual or institution range from fines between Rf1,000 to Rf100,000 as well as removal from employment or a jail term of 1-2 years. Several other articles of the bill set out similar punishments for non-compliance or “criminal misconduct” as perceived within the bill.

Of the 39 articles in the bill, 30 percent include non-compliance penalties directed outside the realm of the Majlis.

Legal experts say that the harshest punishment for non-compliance with parliamentary privilege in a developed democracy is up to six months in jail. In the fledgling democracy of the Maldives, this has reached a new height.

Moreover, they point out that the current bill gives the Speaker of the Majlis powers to remove from office senior officials of the Police, members of the Judiciary, the Prosecutor General and other such heads of statutory institutions. This undermines the concept of “separation of powers”.

Supported by Article 102 of the Constitution, Article 7(a) of the MP privileges bill stipulates that all financial remuneration including MPs own salaries will be decided by the parliament, meaning by themselves.

A vocal critic of the privileges bill,lawyer Ali Hussain, argued that MP salaries should be decided through a public referendum, even if this requires a constitutional amendment. This is perhaps a valid argument given the situation where the constitution is facilitating the highest degree of conflict of interest by requiring MPs to set their own wages. One could argue that the constitution is setting a precedent for MPs to abuse their powers. And they appear to have done just that in the privileges bill.

Some “privileges”:

  • Article 7 (b) of the privileges bill requires the provision of medical insurance for MPs, their spouses, any children under 18 and parents to receive an insurance package which includes services available in the Maldives as well as any SAARC or ASEAN country.
  • Article 7 (c) states that every MP and spouse must be issued a diplomatic passport.
  • Article 7 (f) states that each MP should be entitled to import one duty free car during each term in office although should such a car be sold or passed on to another person, duty should be paid.
  • Article 7 (g) explains that if a “natural incident or any other incident” prevents the use of such a vehicle, the importation of a replacement would be permitted.
  • Article 8 (a-c) provides pension entitlements of 30 percent of the salary for serving one term in office, 45 percent for 2 terms and 60 percent for 3 terms.
  • Article 8 (e) states that any person who has served as an MP should receive medical insurance (presumably for life)
  • Article 8 (f) requires an official passport to be issued to any person who has served as an MP and article 8 (g) states that such person(s) must receive “honourable status” and should be addressed as the “honourable member for” whatever constituency seat held at the time of departure from the parliament.
  • Article 9 requires MNDF to provide bodyguards if any MP requests for protection at any time.
  • Under article 16 (c-d), MPs cannot be searched (by law enforcement authorities) in a public place unless “absolutely certain without suspicion” of an offence.

Critics argue that this is a non-sequitur highly illogical and outside of legal reasoning which would be impossible to implement.

What next?

As more and more citizens come to understand the distorted, pervasive and impossible remit of Bill No 29/2010, the MP Privileges Bill, they are also beginning to understand just how unfit for public office their MPs really are.

While most citizens neither have the time nor the inclination to speak out against what they see as meaningless political shenanigans, MP accountability can only come with active citizen participation and protest. As the country struggles to get to grips with its new democratic constitution, its MPs are busily seeking to ensure their collective and personal interests at the expense of the ordinary citizen and the financial health of the nation.

While the job of MPs is state building, their preoccupation is personal status building. The MP privileges bill has the capacity to undermine democracy, respect for citizens’ rights and the rule of law in the Maldives, unless its citizens act to make the parliament accountable.

On January 3, 2011, the parliament sent the MP privileges bill to the President for ratification. As they await the President’s decision, concerned citizens are putting their faith in their elected leader’s capacity and willingness to listen to the people and return this bill to parliament, as wholly unfit for ratification given its current ludicrous content.

Leaked diplomatic cables will include 3325 from US Embassy in Colombo

The US diplomatic cables leaked by whistle-blowing website Wikileaks includes 3325 as-yet unreleased missives from the US Embassy in Colombo, making the Embassy in Sri Lanka among those hardest-hit by the scandal.

Wikileaks, in conjunction with several newspapers in the UK and Europe such as the Guardian, will stagger the release of 250,000 cables over the next few days. Today’s leak has already sparked diplomatic crisises all over the globe.

Correspondence already released includes urging by Saudi Arabian leaders for the US to attack Iran to disrupt its nuclear programme, while leaders in Saudi Arabia, Egypt and the United Arab Emirates described the country as “evil”, an “existential threat” and a power that “is going to take us to war”.

The Guardian’s newspaper’s report on the leaks noted that former president of the Jordianian senate, Zeid Rifai, had told “a senior US official” to “bomb Iran, or live with an Iranian bomb. Sanctions, carrots, incentives won’t matter.”

The leaked cables included allegations that Russian intelligence agencies were using mafia bosses to conduct criminal operations, with one cable claiming that the country was “virtually a mafia state.”

According to the Guardian’s report, the cables also identified “intense US suspicion” around the “extraordinarily close relationship” between Russia Prime Minister Vladimir Putin and Italian Prime Minister Silvio Berlusconi in relation to “lavish gifts”, “lucrative energy contracts” and “shadowy” contacts.

The cables identify Saudi Arabian donors as allegedly “the biggest financiers of terror groups”, and disclose an “extraordinarily detailed account” of plans to disguise the bombing of al-Quaeda targets with the assistance of countries such as Yemen.

Hacking attacks directed at Google, which prompted the search giant to leave China, were reportedly ordered by a senior member of the Chinese politburo after he typed his name into the popular search engine and found disparaging articles written about him.

One of the most controversial leaks concerns a directive requesting the specification of communications equipment and IT systems used by top UN officials and details “of private VIP networks used for official communication, to include upgrades, security measures, passwords, personal encryption keys.”

Maldives Foreign Minister Dr Ahmed Shaheed noted that former US President Richard Nixon had tapes of his conversations leaked in the early ’70s.

“Nixon used a few choice phrases to describe some close allies. It didn’t damage [international] relationships, but he may have upset some of the people he referred to,” Dr Shaheed said.

The correspondence includes 3325 as-yet unreleased cables from the US Embassy in Colombo, some of which may concern the Maldives.

Dr Shaheed told Minivan News that while he doubted the dispatches would be as sensational “as some people think”, “it will make the US uncomfortable when some of its confidential reports go public.

“However I don’t think it will damage US ties in this region because, by and large, this not central region for US diplomacy and they US has not been brokering difficult negotiations – what the US has been saying here it has been saying very publicly,” he added.

Dr Shaheed confirmed that the US Embassy in Colombo had notified the Maldivian government that the release of the cables was likely, “however they don’t know what the contents are or the areas they will [concern].”

Cultural Affairs Officer and Spokesperson for the US Embassy in Colombo, Glen Davis, told Minivan News that the US would not be commenting specifically on the contents of the leaked cables.

“Cable traffic is very preliminary; pieces are incomplete and read out of context, they are easy to misconstrue,” he said.

“A disclosure like this is bad for contacts, harmful to global engagement and makes it difficult to tackle problems such as organised crime and nuclear proliferation. Washington has taken very aggressive action to ensure the privacy of future communication is secure.”

Davis added that the US Embassy was “determined to keep doing what we’re doing, and reassure the people we work with. It’s hard to see [how the leak] will lead to constructive results.”

The UK High Commission in Colombo said it was official policy “not to comment on the substance of leaked documents.”

However, it condemned the “unauthorised release of this classified information, just as we condemn leaks of classified material in the UK. They can damage national security, are not in the national interest and, as the US have said, may put lives at risk. We have a very strong relationship with the US Government. That will continue.”

The diplomatic cables were drawn from the US government’s Secret Internet Protocol Router Network (SIPDIS), a separate US military-run internet that is accessible to approximately three million Americans. The US reportedly suspects that the leak originated from the same source as the Iraq and Afghan war logs, 22 year-old US soldier Private Bradley Manning, who was posted as a junior intelligence officer in Baghdad.

Minivan News responds to MNJA allegations of ‘irresponsible journalism’

The following is an English-language translation of a press release press release issued by the Maldives National Journalists Association (MNJA) on October 28 2010, in response to our coverage of the Vilu Reef ‘wedding’ video.

The verbatim translation of the filthy language used by a ‘celebrant’ in a symbolic wedding ceremony conducted on a Maldivian resort published by Minivan News is not the type of journalism that should be practised by a responsible newspaper. The publication of filthy language by anyone, in whatever language, falls outside the standards of professional journalism.

This organisation condemns the use of unacceptable language of low standards in any newspaper or website that can be read or accessed by children, adults and families. We would also like to take this opportunity to note that the translation published in Minivan News will damage Maldivian tourism and business.

Minivan News responds:

Minivan News heartily agrees that the Maldives National Journalists Association (MNJA) should be concerned about the filthy language used by a Vilu Reef staff member in the leaked video, in which paying tourists seeking to renew their wedding vows are mocked and degraded by up to 15 complicit resort staff.

However Minivan News feels such concern would be better voiced by the Maldives Association of Tourism Industry (MATI), easily done as the two organisations are headed by the same individual, Sim Mohamed Ibrahim.

Minivan News is in fact surprised that MATI has yet to comment on an incident which has sparked worldwide concern about the humiliating and degrading treatment of guests on a resort, and hopes it has not adopted a head-in-the-sand approach to an issue of such national importance.

Furthermore, Minivan News believes that the duty of a ‘responsible’ news publication is to bring such sensitive issues to light, without fear or prejudice, holding big business to account when its behavior damages the Maldives’ cherished reputation for tourism excellence.

We sincerely hope that MNJA/MATI stops ‘shooting the messenger’ and uses its respect and political clout to ensure that such shameful behaviour does not happen again in the future.

Maldives democracy sparked vicious political struggle

The establishment of a multi-party democracy in the Indian Ocean archipelago in 2008 ended a 30-year period of authoritarian rule under President Maumoon Abdul Gayoom, writes New Delhi journalist Vishal Arora for Global Politician, but it started a vicious political struggle depriving the Maldivians of any sense of relief.

“Six months after former activist Mohamed Nasheed won the October 2008 presidential election, Gayoom’s Dhivehi Rayyithunge Party (DRP) and its allies got a simple majority in the parliamentary election. When two rival parties became almost equally powerful, the clash was inevitable.

The tussle between the ruling coalition led by President Nasheed’s Maldivian Democratic Party (MDP) and the conservative DRP and its ally People’s Alliance (PA) peaked in June 2010 when the education minister Dr. Mustahafa Luthfee’s planned to make Islam and national language Dhivehi optional in school curricula for senior students.

The Gayoom regime homogenised Sunni Islam by restricting people’s religious and cultural rights – the South Asian island nation claims to have a 100 percent Muslim population like in Saudi Arabia. Nasheed, on the other hand, is seen as a liberal Muslim.

The other bone of contention was the government’s move to privatise the Malé International Airport, which was a source of income for some opposition legislators.

In response, the opposition moved a bill in the parliament to amend the Public Finance Act to resist further privatisation of state property, and brought in a no-confidence motion against the education minister.

However, on June 29, President Nasheed’s cabinet resigned en masse alleging inability to carry out its constitutional duties. The government also arrested some opposition legislators – including the leader of the PA and Gayoom’s half-brother, Abdulla Yameen – on charges of bribing lawmakers to vote against the government in the parliament. The arrests led to violent street protests in which several people were injured.”

MDP reschedules elections for Friday

MDP (Maldivian Democratic Party) has rescheduled its delayed constituency elections for Friday, October 1.

The elections were postponed after MDP encountered what it claimed were “technical problems” with its plans to allow voters to cast their votes in text messages. Voters who had not previously registered for SMS voting will now have to cast their votes on paper, reports Haveeru.

Haveeru also reported that MDP is seeking to verify how the technical problems arose but have not yet got to the root of the problem.

The elections on Friday will be held from 2:30 to 7:30 pm.

Bad weather politics: rain cancels concurrent DRP protests

The Dhivehi Rayyithunge Party (DRP) was to hold two concurrent protests this evening after the ‘For Sale’ protest organised by the party’s Deputy Leader Umar Naseer for Friday was delayed due to weather.

However continuing poor weather led to the cancellation of both protests, which would have coincided at the Artificial Beach this evening at 9pm.

Naseer told Minivan News that both protests “were planned to take place as one.”

The outspoken and uncompromising critic of the government’s privatisation of state assets issued a press statement this week announcing the ‘For Sale’ protest, without the apparent approval of the party’s secretariat.

The party’s council voted 16-11 in favour of bringing Naseer before the party’s disciplinary committee over the matter, leading Naseer on Wednesday to publicly question the sincerity of DRP leader Ahmed Thasmeen Ali, and allege that senior officials in the party “are known to be involved in secret deals with the government.”

In support of Naseer, DRP MPs Ilham Ahmed and Ahmed Mahlouf condemned the council’s decision as characteristic of a “dictatorship.”

The DRP Council meanwhile announced a protest for this evening at 9pm at the Artifical Beach, coinciding with Umar Naseer’s protest until the cancellation of both.

Factional rumblings within the DRP became noticeable during its last congress, when the party voted against holding primary elections to determine the party’s presidential candidate, and instead opted for the leader to automatically become the candidate. Thasmeen was then elected to leadership unopposed, after prior public endorsement by former President Maumoon Abdul Gayoom.

Naseer, who had resigned from and attempted to disband his own Islamic Democratic Party (IDP) to pursue higher political ambitions, was a vocal critic of the decision to not hold primaries.

Following the congress Faathin Hameed, one of the DRP’s formative members and niece of the former President, told Minivan News that the voting itself was suspect because delegates “were bought before they even got [to Male’].”

“There were a lot of complaints from the islands lodged directly at the DRP office,” Faathin told Minivan News in March. “I made a point of writing to the committee in charge of the congress, headed by the [Parliamentary] Speaker Abdulla Shahid, reporting the complaints I was receiving and requesting action in order to ensure a transparent, free and fair democratic process.”

Faathin claimed the DRP’s “failure to fund its grass-root groups” had made the party dependent on outside financial support at the island-level, which had resulted in delegations from Male’ travelling to went to the islands “to ‘assist’ in holding the elections – teams sent by people with vested interests.”

Among the complaints shown to Minivan News were allegations from party members that they had been deliberately excluded from participating in island-level meetings, that island-level meetings were not announced or held in secrecy, that agendas were not announced in advance, and that candidates were not given the opportunity to put themselves forward. There were also disputes over vote counting.

Despite apparent tension over the issue of holding primaries, the party continued to insisted it was united even as a subsequent court case related to US$100,000 in debts was levelled at then-DRP leader elect Thasmeen by Abdulla Yameen, the former President’s half-brother and leader of the DRP’s coalition partner the People’s Alliance (PA).

Yameen contended at the time that that court case was “a civil case with no bearing on a political arrangement”.

Comment: Political parties will not resolve current conflicts

The killer headlines these days are about the standstill to Maldives political party peace talks.

The UN has spent more than US$40,000 to recruit a peace negotiator, and the resources allocated towards this are justifiable. There have to be efforts made to resolve the bickering and barking of the political parties.

In my graduate studies in human rights and peace studies, I was asked in one course to research a paper on how to connect human rights and peace. It was challenging as these were two varied disciplines and the advocates of both notions have different discourses.

Oftentimes during conflicts, the human rights advocators desire to settle scores with the human rights violators and bring justice. If the human rights violators are the past regime or the government, the government will reject all peace talks.

At the same time, peace keepers may show some indifference to human rights violators as their main aim is to resolve disputes and conflicts so that peace processes and peace talks can resume. When you study the history of peace negotiations in conflicting countries, each country has undergone dissimilar transformations.

We can consider the examples of good peace negotiations and try to adapt a workable methodology that may be appropriate to Maldives.

No external expert can resolve the case without internal and domestic willingness to resolve the political differences to accord peace to the citizens of the Maldives.

Maldivian context

The international community has been adamant that the Maldivian politicians would be able to settle their differences for the sake of the Maldivian people. I was skeptical and shared my views with the international diplomatic missions, statesmen or whoever came during the past few months to influence the Maldives politicians to resolve our domestic political affairs.

At the beginning there were reservations by Maldivians and politicians that the good name of the peace talks could be stolen by external experts and foreign countries. When Assistant Secretary of US State Robert Blakes met us in July, I was critical and open.

I shook my head negatively at his hypothesis that political parties will resolve the conflict.

There was a series of successive visits by foreign diplomats before his visit and afterwards. Another visit was a mission from UN Department of Political Affairs who met stakeholders but kept nodding off through nearly all the meetings.

I predicted at the time that the peace talks will be boycotted sequentially. I predicted that the sudden quick agreements will stall if there are no international negotiation facilitations. I suggested having an international negotiation facilitation team of 2-3 members with local consultants.

It will be a costly affair but I felt it has to be done.

Psychological warfare

Do you know what happens when two kids starts fighting over a toy? Each kid will tug at the toy, trying to gain control and power. The stronger kid will always win.

A smart kid knows how to cajole, and sweet talk will win over the other kid. Nice is manipulative and always wins. We need this kind of approach in the resolution of politics in the Maldives.

Nobody wins at all rounds, some lose and some win. We have to learn to accept defeat sometimes.

Immature political games

The deadlock in parliament’s deliberations has been challenged several times, at a cost in public spending of Rf400,000 a day. When the deadlocks are at climax, the pressure rises from the public. The general public starts calling for the resignation of MPs through radio and television channels, which are their only outlet.

Local television polls have shown that the public believes the MPs are not doing their jobs, although the political parties do not take these polls seriously are claim this is work of the opposition or government.

Again, are there any laws where the public, ultimately the highest authority in the Maldives, can make the MPs accountable?

Unfortunately, there seems to be no such laws and the MPs seem to be above law. They have failed many times to pass the required laws as per the Constitution. The public has witnessed the MPs name-calling on the parliament floor, accusing everybody of corruption without citing credible sources, accusing each other of fraud, vulgarity and theft.

Many times we have seen the MPs committing criminal offenses in parliament by hitting each other, but none of these cases have been put to trial.

Each MP – not to be outdone – presents that he talks on behalf of the public. This is an old story we are sick of hearing.

How many MPs can truly say that they have talked and understood the voices of the public? The general public elected the MPs with high expectations and hopes for a better democracy.

Way forward

Dialogue, dialogue and more dialogue.  We understand the Maldivian context, we are going through a democratising process and there will be many political hurdles, but not at the cost of public spending, our public life, and political peace.

The MPs are paid large amounts of public money for their salaries and they have to fulfill their obligations. How can, the ruling Government, the opposition or the independent candidates say that they are not ready for dialogue or peace talks?

The only way forward to any political solution in the Maldives is to keep up the dialogue. Ask any Maldivian citizen and you will hear same thing: we need the politicians to talk and bring solutions to the political conflicts.

Also, the peace expert should climb down from his chair and talk to the average citizens to hear our grievances. To the politicians, if you are not ready to dialogue, please resign from the political scenario and give peace to average citizens.

We have bigger issues in trying to make ends meet and earn a living, what with the high rents, spike in food prices and living costs. In addition to this, we have to deal with drug and gang warlords, fear, and sadly a society disintegrating moral values.

Politics of race and corruption impoverishing Malaysia: Tengku Razaleigh Hamzah

“Without a doubt, Malaysia is slipping. Billions have been looted from this country, and billions more are being siphoned out as our entire political structure crumbles,’ claims former finance minister Tengku Razaleigh Hamzah speaking at the 4th Annual Malaysian Student Leaders Summit. “Yet we are gathered here in comfort, in a country that still seems to ‘work’ – most of the time. This is due less to good management than to the extraordinary wealth of this country.”

“Last year, we received US$1.38 billion in investments but US$8.04 billion flowed out. We are the only country in Southeast Asia that has suffered net FDI outflow,” he said. “I am not against outward investment. It can be a good thing for the country. But an imbalance on this scale indicates capital flight, not mere investment overseas.”

“When race and money entered our game, we declined,” he said. “The same applies to our political and economic life.”

The Maldives may drift back into dictatorship

The Maldives is in danger of drifting back into dictatorship, writes Al-Jazeera journalist Mark Seddon on website ‘Big Think’.

“The Maldives is not only the World’s newest democracy—it is one of the World’s most fragile democracies. In recent weeks, the rule of the democratically elected President Nasheed began to look a little shaky, as elements of the old Gayoom regime coagulated under a grubby coalition of MPs and corrupt judicial figures to try and force him out.

“What had infuriated them more than anything else was the seriousness behind the intent of the Maldives to recover huge stolen assets—some $400 million, in fact, that now resides in foreign bank accounts. This grand larceny does not include the wealth already squandered on luxury yachts, palaces and all of the paraphernalia associated with bog standard dictators. It was enough to alarm Gayoom, and his close supporters and family, who it is alleged have paid off enough Opposition MPs to make the Maldives more or less un-governable.”
