DRP positioned as “moderate” alternative to PPM and MDP: Dr Mausoom

The Dhivehi Rayyithunge Party (DRP) has said it will provide a “moderate” alternative to the more “extreme” political policies of the Maldivian Democratic Party (MDP) and Progressive Party of Maldives (PPM), ahead of presidential elections set for 2013.

Speaking to Minivan News today, DRP Parliamentary Group Leader and MP Dr Abdulla Mausoom said that the party was pushing ahead with a new national strategy over the next 12 months to employ more “moderate policies” in areas like economic development and privatisation.

The comments were made following a DRP rally held on Thursday at the artificial beach area of Male’. During the gathering, speakers including party Leader Ahmed Thasmeen Ali claimed the party had both the following and the polices to defeat the MDP and former President Nasheed at the next elections.

While being ultimately committed to playing a role in coalition government of President Dr Mohamed Waheed Hassan until an election race begins, Dr Mausoom also stressed that with “no clear agreement” on the exact policies of the present government during its formation, “differences of opinion” were to be expected among different parties.

According to Parliamentary Group Leader Mausoom, the impact of these differences was potentially already being seen in the rivalry between different parties.

Local media coverage of the rally alleged that around 60 people in the audience at Thursday’s gathering were expatriate workers who were instructed by several Maldivians to stand and applaud during talks from key DRP figures. However, Dr Mausoom responded that any expatriate workers present had likely been supplied by political rivals to tarnish the party’s reputation.

“This sort of thing is done to tarnish the reputation and respect held by the public for the DRP. The public often judge popularity by the number of people at the rally and we noticed some of the media had taken photos of the rally before people had begun arriving,” he said. “It is very irresponsible , but we expect this to happen as rivalry increases between different parties.”

“New drive”

Mausoom said that Thursday’s rally represented the beginning of a “new drive” by the party to hold events across the capital and in the outer atolls to mobilise and involve its members in promoting its policies and attracting new followers.

“We are getting lots of support from members in the islands and things look very promising for the party right now. We are anticipating huge numbers to join us [up to 2013],” he added. “We are attracting many MDP members who have been let down by the party’s failure to uphold democracy and shifting towards us.”

Mausoom contended that the DRP also expected to attract members of other political parties in the country that he said had been “more extreme” in their policies and actions.

“We are a clear alternative to major parties like the PPM and MDP. The MDP for example mismanaged democracy [during the administration of former President Nasheed]. They disrespected the rule of law and independent institutions. The DRP will give due respect to the law.”

Mausoom claimed that this respect for law was reflected in the more “moderate stance” the party hoped to take on issues ahead of the next general election.

“We don’t want privatisation of essential public services. In areas like education and healthcare we are completely against total privatisation,” he said. “At the moment we are committed to more generic policies. But we will be announcing more clear objectives later.”

In trying to play up the party’s more “moderate” political aims, Mausoom raised two key issues were it had already shown a difference of opinion to other government-aligned parties, such as the PPM.

“One issue has been the motion to renounce the Maldives’ commonwealth membership. The DRP has said it would not support this. This is the same for debates on national health funds. We believe that basic healthcare should be provided by the state.”

According to Mausoom, the DRP also holds a vital and unique role in the Majlis for enabling policy that was being passed in parliament, either by voting in line with the government-aligned PPM or the opposition MDP.   The MDP and the PPM are presently are two largest parties in terms of parliamentary representatives.

“Any amendments to laws or policy in the country need to be passed through the Majlis. In order to get the numbers to do this, there should be either a PPM and DRP agreement, or a DRP and MDP agreement,” he said, “However, there may be issues that we do not agree and we would not therefore back these changes. There may be issues that the MDP and PPM agree on passing, but I do not see that happening.”

The party claimed it represented a “middle ground” within Maldivian politics between the MDP and the PPM, established by former President Maumoon Abdul Gayoom.

The claim was rubbished by MDP spokesperson Hamid Abdul Ghafoor however, who claimed that the DRP as a political party had been stifled both internally and externally.

The DRP was originally founded by Gayoom before a war of words with his annointed successor and present party leader Thasmeen saw a breakaway faction of party members establish the PPM.

Ghafoor alleged that following the formation of the PPM, which now holds the second largest number of MPs in the Majlis behind the MDP, the DRP was effectively being replaced as a political entity by Gayoom’s new party.

“I believe that the DRP have failed to identify themselves and what they stand for,” he said.  “Over the weekend, Mr Thasmeen spoke of having outlined policies that can defeat the MDP at elections. But he has failed to articulate any of those policies. I would welcome commitments to establish a grass roots political network on islands like the MDP has done, but the DRP have not managed this. The party is disappearing and the PPM is replacing it.”

Ghafoor claimed that whilst the MDP had identified itself as “a democratic champion” under former President Nasheed, the rest of the country’s political parties had been “left behind” and failed to provide actual alternative polices to the public.

PPM power

Despite the MDP’s claims, PPM Vice President Umar Naseer told Minivan News last month that he believed the MDP realised it faced electoral defeat in the current political environment.

Naseer, who had previously served as deputy leader of the Dhivehi Rayyithunge Party (DRP) before being dismissed, claimed that recent by-election victories for the party over the last two months,  showed clear public support for the wider coalition government.

“If [general] elections were held right now, the MDP would be defeated badly,” he said. “The MDP understands this.”

Ahead of any future presidential elections, Naseer claimed the PPM was focused on bolstering its presence in the Majlis after assuming the minority parliamentary leadership role in April.

Naseer claimed the party would continue pursuing a coalition that might eventually allow it to replace the MDP as majority leader in the majlis.

“Our main focus now will be the elections in 2013,” he said.

Naseer added that when elections were held, the PPM would be working to strengthen the position of its own possible presidential candidate.

“My feeling right now is that [President Waheed] will not stand during the presidential elections,” he claimed.

Comment: Black magic a national policy priority?

As anticipated, the three-day Bandos Resort retreat for participants at the Roadmap Talks has ended inconclusively. The fact that the representatives for the all-party negotiations, aimed at finding ways out of the current political impasse in Maldives, have promised to meet again should be seen as a success in itself, however limited.

Given the inherent nature of the talks and the stiff positions that the nation’s polity had taken on issues that were at hand, to expect anything more was rather out of the question.

In the ordinary circumstances, the talks could have broken down on the rival positions taken by the Government side and the Opposition Maldivian Democratic Party (MDP) on substantive issues. That was not to be. Media reports indicate that the Government parties had a long list of woes that they wanted the MDP to address prior to major issues could be taken up.

Or, so it seemed.

Already, there was a six-point agenda, and after a lot of haggling, the MDP had agreed to stick to an agreed prioritisation for discussions. Included in the list of woes presented by the Government parties was a demand for MDP cadres not to stop Government party leaders from setting foot on various islands. The MDP could crow about the demand as a measure of its continuing popularity on those islands. Otherwise, it is a law and order problem, which the Government is expected to handle independent of the parties involved.

Then there was a demand on the MDP promising not to practice black magic on Opposition leaders and other opponents, real or perceived. News reports claimed that the police had recovered from Male’s Usfasgandu MDP camp site materials purported to have been used by practitioners of black magic. Marked photographs of some identifiable police officers, against whom it was feared black magic might have been practised at the camp site, were also recovered. The MDP has all along claimed to be a modern, no-nonsense party. It did not contest that such materials were recovered from the camp site.

It was, however, thought that the retreat and the Roadmap Talks were expected to address major policy issues, including the dire economic situation facing the nation. It is anybody’s guess when ‘black magic’ became a national policy, above the nation’s economy, for the Roadmap Talks to expend its time on such trivia. If parties felt strongly about them, other avenues should have been identified for discussing their concerns, without holding the Roadmap Talks hostage to sub-texts whose numbers are many and can be multiplied at will.

It is anybody’s guess why the Government should have also initiated the provocative police action at the Usfasgandu MDP site coinciding with the retreat talks. The court has intervened since, and stalled the process, but the damage has been done. The Government’s move even threatened the retreat talks. It also contributed to the MDP possibly re-visiting its strategy for the retreat talks. Clearly, the prioritisation outside of the six-point agenda for the Roadmap Talks had to undergo a change. The 30-point talks thus aimed at facilitating the Roadmap Talks thus occupied much of the talks time at the retreat.

MDP too not without blame

Yet, the MDP, going again by media reports, too is not without blame. At the talks, the MDP representatives seemed to be playing hide and seek with the Government side on the give-aways and take-aways from the negotiations. They wanted the Government parties to commit themselves to one of the four demands they had made before the MDP could commit itself to one of the 30 points discussed on normalising the street situation – without giving any hint as to what the MDP’s offer could be.

If the MDP strategists thought that they were smart, that is highly doubtful. At best, the retreat process displayed the MDP’s lack of seriousness to the negotiations process. Otherwise, it amounted to a continuing display of the party’s child-like behaviour on issues of serious national importance.

The MDP’s credibility continues to be at stake. In these weeks and months after the abrupt resignation of the party’s Mohammed Nasheed as the nation’s President on February 7, the world is not any more eating exclusively out of the hands of the MDP’s media machinery. It is watching the goings-on, revisiting the information on hand – once perceived as the truth – and is possibly exchanging notes. On a serious note, for instance, for the MDP to send out names of people which it knew would definitely be rejected by the Government for inclusion in the recast Commission for National Inquiry (CNI) on the ‘resignation episode’ was to make the Commonwealth initiative look a joke of sorts. The party was not exposing the Government to the international community. It was exposing itself – and, possibly the international interlocutors.

The MDP list included the name of a serving General in the Maldivian National Defence Force (MNDF), the nation’s military. His presence on the CNI would prove the MDP right, the party had claimed. The Government, while rejecting the nomination, pointed out that the officer was a close relative of former President Nasheed. The MDP has not denied the Government’s statement. As may be recalled, through all these past months since Nasheed’s resignation, the party had said that serving senior officials of the MNDF had proposed a ‘counter-coup’ to the ‘coup’ that Nasheed claimed, after a time-lapse, as being responsible for his ‘forced resignation’. Whether any linkages could and would be made remains to be seen.

Continuing mistrust

The pre-expansion CNI has since come out with a time-line of events surrounding the resignation episode that it was tasked to probe and report on. The MDP having questioned the impartiality of the three-member probe as it stood, the latter seems to be recording its interim findings for the people to judge – before the expanded CNI took over. The party has since described the publication of the time-lines by the truncated CNI as a “blatant attempt to conceal the truth by pre-empting impartial enquiry”.

The publication is a reflection on the continuing mistrust among the stake-holders. This mistrust cannot be allowed to continue if the findings of the expanded CNI, with a former Singaporean Judge identified by the Commonwealth, and an MDP nominee accepted by the Government, have to be seen as being credible and conclusive. A split-verdict is a possibility, and any run-in during the run-up to the functioning of the expanded CNI would not make things easier, either for the impartiality of the probe or the credibility of its findings. The external member on the panel would be under pressure, too, he having to be seen as being impartial as much as he is impartial.

It is still not unlikely the expanded CNI might start off with reviewing the work already done by the probe, starting with the time-lines already publicised. It could only be a starting-point. Having had its way in having the CNI expanded with its nominee to boot, the MDP would have to swear by its report, whenever submitted. Independent of the protestations to the contrary, the party will have to answer queries on the time-lines set out by the pre-expanded CNI, particularly on the controversial questions on the even more controversial situations leading up to President Nasheed’s resignation.

For instance, there is one question on who ordered the pull-out of police men on duty at the site of competing political rallies on the night of February 6 – and, why. Reports at the time had indicated that a section of the policemen on midnight duty for weeks by then had protested to the unilateral withdrawal from a scene of prospective violence without suitable replacements being ordered in. They were among those who had taken to the streets the next day, along with political protestors, leading to the resignation, it was reported further.

Mixed bag for stake-holders

It’s at best a mixed bag for all stake-holders. Expelled MDP president Ibrahim Didi and vice-president AlhanFahmy have since taken the easy way out, by joining the Jumhoree Party of billionaire-politician Gasim Ibrahim, who had chaired the constitutional negotiations in 2007-08. The duo had threatened to challenge their expulsion by a nominated national council of the MDP in the court after the Election Commission refused to entertain their petition. The CNI time-line now indicates that Didi, then also a Minister, had chaired a Cabinet meeting when President Nasheed was in the MNDF Headquarters, talking to commanders and possible protestors, during the fateful hours preceding his resignation on February 7. Didi’s version, if any, to the CNI could thus be seen as being coloured. So could it contradict his pro-Nasheed protestations while in the party.

The MDP however has suffered a reversal since. The People’s Majlis, or Parliament has voted out the no-confidence motion moved by the party against Speaker Abdullah Shahid. Numbers did not add up, as two MDP parliamentarians voted against the party resolution and two others abstained. The party is in a quandary about initiating disciplinary action against them. It cannot afford to lose numbers. Nor could it allow individual violation of the three-line whip for MPs to become a greater issue of indiscipline that it may not be able to handle after a time. Already, the party has lost two parliamentary by-elections held since the resignation episode, bringing its strength to 31 in a House with 77 members.

The MDP cannot complain that the Government was inducing/encouraging defections from the party. It had adopted a similar tactic when President Nasheed was in office, with mixed results after failing to muster a majority in the parliamentary polls of 2009. Otherwise, too, the party needs to sit up and review its strategy in terms of targeting every democratic institution in the country as being inimical to the MDP – and by extension, to democracy as a concept. The MDP needs to look at the mirror and apply correctives if the international community on the one hand and discerning Maldivians, whose numbers are not small, have to take the party, and also its claims and allegations more seriously than at present.

Internal contradictions

The Government too cannot settle down to business as usual as if nothing had happened between December last and the present. The delayed processes pertaining to the CNI and the Roadmap Talks may have conferred post facto justification for delayed elections to the presidency than was perceived. That is not saying all. Political administration may be about processes and procedures. It is not so with politics, per se. There is a growing feeling that the Government parties are shying away from early polls, not sure of the MDP’s continuing popularity – and also owing to the internal contradictions within the ruling coalition and the internal problems facing some of the parties in power.

These internal contradictions will remain, whenever the presidential elections are held – now, or when due by July-November, 2013. Nor could the internal differences within some of these political parties, notably the Progressive Party of Maldives (PPM), founded by former President Maumoon Gayoom, be wished away at any time in the foreseeable future. The run-up to the presidential polls, whenever held, could be an occasion for furthering these differences, not cementing them. That being the case, the Government parties would need to come clean on their strategy for the future. Only based on such a strategy could they work back, on accommodating the MDP’s demand on advancing the presidential poll. Other arguments in this regard, including constitutional constraints, would fall flat on the face of mounting evidence to the contrary.

Senator calls for US to back early elections in the Maldives “as soon as possible”

A US Senator serving as Chair of the Foreign Relations Committee’s Near Eastern and South and Central Asian Affairs Subcommittee has called for fresh elections in the Maldives at the earliest date possible, to ensure democracy is not at risk of being “derailed” in the tiny island nation.

The Press Trust of India (PTI) quoted Senator Robert Casey as requesting the US “continue calls for elections to be held in the Maldives as soon as possible to ensure that the seeds of the democratic process planted in 2008 are able to flourish.”

The comments were reportedly made yesterday during the confirmation hearing in Washington DC of the US Ambassador Designate to Colombo Michele Sison.

President Dr Mohamed Waheed Hassan, has previously claimed that the earliest date elections can be held on the country will be July 2013, as detailed in the country’s constitution.  The Commonwealth Ministerial Action Group (CMAG) has continued to request that early elections be held before the end of the present year.

The opposition Maldivian Democratic Party (MDP), which contends that President Waheed’s government is illegitimate after he came to power on February 7 in a “coup d’etat”, has said early elections could be held within two months without need for constitutional amendment should the president and vice president resign, under provisions for an interim government run by the Speaker of Parliament Abdulla Shahid.

However Waheed and the former opposition parties now in the ruling coalition and occupying senior cabinet positions, initially insisted that “conditions are not right” for early elections, and later contended that the earliest elections could be held under the constitution was July 2013.

Tweeting on June 2, Waheed posted a picture of himself with a group of children and wrote: “These young people advised me not to hold an early election.”

Amid talk of fresh elections, the US government in April pledged US$500,000 (Rf7.7 million) in technical assistance to ensure a free and fair presidential election, assistance it said would “be made available from July 2012”.

“Important” ally

Speaking during yesterday’s confirmation hearing for Ambassador Designate Michele Sison, Senator Casey claimed the Maldives remained an “important” ally to US interests.

Casey therefore raised concerns that the country’s “democratic beginning” was in danger of being “derailed” due to the political unrest leading up to and following the controversial transfer of power in February, according to media reports.

Sison responded that the country continues to push the Maldives to work within “existing democratic institutions” to ensure a resolution to its current political deadlock.

“The US government now has a window of opportunity to step up its engagement in Maldives, and USAID recently committed funding to assist Maldives in ensuring that the next round of presidential elections is free and fair,” Sison was reported to have told senators during the hearing.

The US Embassy in Colombo said it did not have a copy of the transcript of Sison’s confirmation hearing and was unable to clarify the comments attributed to Senator Casey, and would not comment on the political significance of the senator’s comments.

However, the embassy confirmed that like every US ambassador appointed to a foreign position, Sison was required to go before the senate to answer questions about her role.

During yesterday’s hearing, the embassy spokesperson said Sison would have been asked questions on Sri Lanka and the Maldives by senators to ensure she was qualified for the position, ahead of a vote to appoint her.

Responding to the reported comments in the US Senate about early elections, President’s Office spokesperson Abbas Adil Riza referred to the recent comments by UN Secretary General Ban Ki-moon commending agreements between President Waheed and the opposition MDP in seeking a political resolution in the country.

In his statement, Ki-moon urged all political parties “to resume immediately their political dialogue, both within and outside of Parliament, in order to find a mutually agreeable way forward on the basis of the Constitution and without jeopardising the democratic gains achieved thus far in the Maldives.”

Riza told Minivan News today that the government supported the UN’s comments that any solution to the current political upheavals must be made through local stakeholders and also not contravene the constitution.

He claimed that the government was already committed to a process of resolving political differences through a roadmap plan outlined by the president that includes All-Party Talks designed to set a six point agenda concluding with setting a date for early elections.

The last round of All-Party Talks, held at Vice President Waheed Deen’s Bandos Island Resort and Spa last weekend and monitored by UN mediator Pierre Yves Monett, collapsed after parties in the ruling coalition presented the MDP with a list of 30 demands that included “stop practicing black magic and sorcery”, “stop the use of sexual and erotic tools”, and “not walk in groups of more than 10”.

Anti-terrorism Assistance Training

Aside from assigning funds for early elections, present US Ambassador Patricia A. Butenis this week signed a Memorandum of Intent with Maldives Police Service Commissioner Abdulla Riyaz to provide Antiterrorism Assistance (ATA) training in the country.

The training programmes, which will take place between June 10 – June 21 and July 1 – July 12, will focus respectively on “Police Leaders’ Role in Combating Terrorism” and “Preventing Attacks on Soft Targets”, according to the US Embassy, as well as making police aware of their human rights obligations.

Former Inquiry Commission’s release of timeline “blatant attempt to conceal truth by pre-empting impartial inquiry”: MDP

The Maldivian Democratic Party (MDP) has condemned the former three-member Commission of National Inquiry (CNI) after it yesterday released a ‘timeline of events’, calling it a “blatant attempt to conceal the truth by pre-empting an impartial inquiry.”

The initial three-member panel was appointed by President Mohamed Waheed Hassan to investigate the controversial circumstances that brought him to power. It was boycotted by the ousted MDP, who contended that its members had been appointed by those it was accusing, and it was not credible or impartial.

The Commonwealth Ministerial Action Group (CMAG) and civil society groups concurred, and pressured the government to reconstitute the commission to include a nominee representing former President Mohamed Nasheed, a retired foreign judge, and UN and Commonwealth monitors. Earlier this week the government announced it had accepted the 13th nominee proposed by Nasheed, Ahmed ‘Gahaa’ Saeed.

However yesterday the three-member panel released a 282-point ‘timeline of events’, for the stated purpose of “asking for public opinion”.

“It is unacceptable that a committee that has been discredited by the civil society, members of the public and the international community should proceed to make public its findings, ahead of the commencement of the work of a restructured commission,” said MDP’s Spokesperson Hamid Abdul Ghafoor, in a statement on Thursday.

“It is incomplete, biased and reveals the malicious intent of the Commission,” he said, adding that neither former President Nasheed nor any MDP member had given testimony to the commission before it released its findings.

The agreement for a restructured commission was brokered by the Commonwealth’s Special Envoy to the Maldives, Sir Donald Mackinnon, “just two days ago”, Ghafoor noted, a move praised in public statements by the UN, Commonwealth and the UK Foreign Office at the time.

“The publication of the findings of the commission is a blatant attempt by the government to pervert the course of justice. This is in flagrant disregard for the appeals of the international community, including the CMAG, which had demanded that the composition of the Committee be changed to make it impartial, independent, credible and more broadly acceptable,” Ghafoor said.

“This conduct by the current Commission is further confirmation that the real mandate of this Commission is to conceal the truth and absolve the perpetrators of the coup from guilt.”

President’s Office Spokesperson Abbas Adil Riza said the CNI was entitled to ask for public support, “and the government has no views about it, as the commission is independent.”

“We see no wrong-doing in [the commission] requesting public support,” Riza told Minivan News. “The government’s view is that the inquiry is fully independent and that it can ask for help where it wishes.”

Asked whether canvassing public opinion was in the commission’s mandate when it was set up, Riza stated that the commission had a mandate to “find the facts from January 14 to February 7”.

At to whether the timeline was relevant, given that the reconstituted commission would presumably be starting from scratch, Riza said “it is up to the commission to determine that.”

Attorney General Azima Shukoor meanwhile today told local media that administrative work had begun to formulate the new CNI.
Shukoor told local newspaper Haveeru that the new commission needed to be established by a new presidential decree, which was currently being drafted in time for President Mohamed Waheed’s return from the UK.
She also said that work is being carried out drafting the procedures and principles of the commission, as well as the code of conduct for the commission members with advice of senior members of the commission. Shukoor also said that the three-member panel had taken not wage or allowances for the work they had done  up until now.

Former Commission of National Inquiry panel releases timeline “for public opinion”

The former three-member panel of the Commission of National Inquiry (CNI) has released a ‘timeline’ of events it claims took place from the period of January 16 to February 7, for the stated purpose of “finding public opinion”.

The composition of the panel has since been revised to include a representative of former President Mohamed Nasheed and a retired Singaporean judge, as well as international monitors from both the Commonwealth and UN.

The 282-point Dhivehi document does not feature any input from the Maldivian Democratic Party (MDP), who contested the panel’s impartiality prior to the re-composition. The report begins its findings on the day police attempted to summon Chief Judge of the Criminal Court, to the day the controversial transfer of power took place. The panel conducted interviews with assorted non-MDP participants, however the report does not source its findings.

The night of February 6

The timeline suggests the initial ‘turning point’ of the unrest began on the night of February 6, after the supporters of the Maldivian Democratic Party (MDP) arrived at the artificial beach in Male’ where supporters of the coalition of then-opposition parties had already been protesting, calling for the release of Judge Abdulla and for the constitution to be upheld.

The timeline states that the Specialist Operation (SO) officers of the police had stationed themselves in Heniveru Stadium, in preparation to prevent any violence that may have taken place if supporters from both sides clashed.

The report stated that police intervened after they received information that the situation was deteriorating from two police officers who were there to assess the situation.

It states that police intervention calmed the situation and cordoned a security line between the two protesting parties, after forcing them further behind the sides of the area they had been protesting.

The three member panel alleged that Minister of Home Affairs Hassan Afeef ordered Commissioner of Police Ahmed Faseeh to withdraw police officers who had been stationed on the site. The Commissioner sent two officers to assess the situation, who reported back stating that the situation had deteriorated, which the Commissioner relayed to the Minister.

The Minister repeated the order but the Commissioner of Police refused to comply, stating that the situation could get worse if the police withdrew their forces.

According to the report, after the commissioner refused, President Nasheed himself called the commissioner and ordered him to withdraw police from the scene.

Faseeh then reportedly sent the Deputy Commissioner of Police to assess the situation, and he too relayed the situation was worsening.

The report claimed that the president called the commissioner a second time and ordered him to withdraw police from the area, stating that he “could not trust the police”.

After this order, the report said that the commissioner personally took the decision to contact the Male’ Area Commander of the Maldives National Defence Force (MNDF), asking that the MNDF intervene as the police were withdrawing.

The statement read that the tactical officer of the SO opposed the idea of withdrawing police from the area, stating that both the protesting parties had weapons that could be used for violence, including wooden sticks and metal rods.

The SO police present in the area refused to withdraw without the MNDF arriving to take over their position, the timeline claimed.

The panel also claimed that a resignation letter was drafted by the police commissioner and was left on his table, as “the commissioner did not believe that the withdrawal of the police was the right decision.”

After the MNDF took over the area, the panel claimed that President Nasheed called the Male’ area commander and ordered him to withdraw MNDF officers from the area, giving him assurances that the MDP supporters would not resort to any kind of violence.

However, the statement read that when MNDF withdrew their officers from the area, violent confrontations began and there “bottles and objects” thrown by both protesting parties, which led the MNDF to intervene again.

February 7

The statement claimed that some of the SO police officers who had been in the Artifical Beach area then went to the MDP protest camp and vandalised the premises, and attacked some of the MDP supporters inside.

An MNDF SWAT team arrived after the SO police officers left premises, “to guard the area”, the panel stated.

The statement read that, as the usual routine of the police is to fall in at the Republican Square after protests ended; the police officers retreated and convened to the area.

The panel said that initially the MNDF attempted to arrest the police officers who by then had begun to gather in Republic Square, adjacent to police and military headquarters. However the MNDF reportedly decided to negotiate with the police officers as the military was outnumbered and police had similar equipment to the MNDF officers.

According to the report, police told the MNDF officers who were sent to negotiate with them that would begin following orders again after they were given assurances that they would not be ordered to carry out any unlawful orders, and that no action be taken against any of the officers regarding their involvement.

“The MNDF officers assured them that the MNDF would not confront police officers in the area,” the panel claimed.

During the negotiations, the panel claimed that police requested to meet the commissioner of police. The MNDF officials proposed officers go into the MNDF headquarters to to meet the commissioner, but police said they wanted to meet the commissioner inside police headquarters.

It was decided that the commissioner would meet meet in Iskandhar Koshi, an MNDF barracks on the other side of Male’, to the police officers initially agreed. However, police rejected the idea after the MNDF insisted the police go without their weapons and riot gear.

President’s arrival to Republic Square and his resignation

The panel claimed that in the early morning of February 7, between 5:00am to 6:00am, President Nasheed informed the commissioner that he wanted to meet the police officers who were at Republican Square.

It further claimed that the President also ordered the commissioner to meet the police officers in Republic Square, however the commissioner left military headquarters and entered police headquarters without meeting police gathered outside the building.

Before meeting the police, Nasheed asked one of the MNDF commanders whether he had any reservations over arresting the protesting police officers, to which the commander reportedly replied that he did.

The President then reportedly told the commander that it would be better if he stayed at home for the time being, however two other commanders also told the President that they had reservations and left.

The panel claimed that Nasheed then told the police officers that they had “done something wrong” and requested they hand themselves over to the MNDF. Police refused the order.

According the panel, Nasheed then returned to military headquarters and ordered the MNDF officers inside the barracks to go outside and arrest the officers who had disobeyed him.

At this point, some of the MNDF officers left the barracks and joined the police officers protesting.

While Nasheed was inside the MNDF base, the panel claimed that the President’s secretariat informed cabinet members that there would be a cabinet meeting, but failed to inform Vice President Dr Mohamed Waheed Hassan as two key staff of the VP’s secretariat had not reported to work.

The panel also claimed that the then-President of the MDP, Dr Ibrahim Didi, called Nasheed and discussed how to resolve the ongoing unrest. Nasheed reportedly asked for Didi’s help in releasing a joint statement by the president and leaders of the opposition parties.

It said that Didi had then contacted opposition Dhivehi Rayyithunge Party (DRP) leader Ahmed Thasmeen Ali and Progressive Party of the Maldives (PPM) Parliamentary Group Leader, Abdulla Yameen, however both of them declined to help unless Nasheed personally requested they do so.

Dr Didi then informed Nasheed of this response, who told him to make a decision after discussing the matter with MDP Parliamentary Group Leader MP Ibrahim Mohamed Solih and former Chairperson of the Party, MP Mariya Ahmed Didi.

The panel alleged that Dr Didi tried contacting MP Mariya Ahmed Didi, who did not respond, and then contacted MP Ibrahim Mohamed Solih, who said he would get back to Dr Didi after consulting on the issue with Nasheed.

After the reply from MP Solih was delayed, Didi reportedly called Nasheed back, and was told that the High Commissioner of India, Dnyaneshwar M Mulay, would contact him.

According to the panel, Mulay contacted Dr Didi and asked him to come to the High Commission. When Dr Didi arrived to the High Commission, the opposition Progressive Party of the Maldives (PPM) Parliamentary Group leader Yameen was already there.

According to the panel, as Dr Didi, Mulay and Yameen were discussing how to resolve the crisis, MP Solih called Yameen and informed him that Nasheed was going to resign.

Didi then reportedly contacted Nasheed and asked to him to give the phone to Yameen.

According to the panel, Nasheed informed Yameen that he was going to resign and asked him to ensure the safety of his family, to which Yameen replied that he would do everything to ensure the safety of Nasheed’s family.

The meeting adjourned after the president informed them that he would resign.

New MNDF commander

Meanwhile, according to the panel, two civilians: resigned police officer Abdulla Riyaz (the new Police Commissioner) and dismissed MNDF officer Ahmed Nazim (now the Defence Minister), entered the MNDF headquarters reportedly on the invitation of the Minister of Defence and National Security, Tholath Ibrahim.

After discussions with Nasheed in the MNDF barracks, Nazim came out to the crowd and revealed that he had asked Nasheed to resign unconditionally before 1:30pm that afternoon, along with the commissioner of police and his deputies.

According to the panel, Nazim told the crowd that his demands were “non-negotiable”.

The protesters were then informed that Nasheed would resign, and would announce this in the President’s Office.

According to the panel, Nasheed wrote the resignation letter inside the President’s Office, and then announced it on state television – which by this stage had been stormed by a second group of police and protesters.

CNI statement “lacks legitimacy

The MDP – now in opposition – said it would not formally comment on the statement prior to the release of an official statement.

However, an MDP official told Minivan News that the party did not consider the timeline “substantial”, and said it “lacked legitimacy”.

The party was “not even interested” in the timeline because the investigation would start from scratch under the new composition.

”The Commonwealth Ministerial Action Group (CMAG) has asked the government to change the composition of the commission and the government has agreed to it. I think the current co-chair of the commission thinks that his work is over,” the party official said.

The premature release of the timeline “for public comment” was “not a good thing”, he added.

The CNI claimed that if anyone wished to propose amendments to the timeline, they should submit amendments before June 21.

MP Rasheed committed to MDP despite support for Majlis speaker

Maldivian Democratic Party (MDP) MP Ahmed Rasheed said he remains committed to the party even if he is “punished” by its Parliamentary Group for not supporting a no-confidence motion forwarded against Majlis Speaker Abdulla Shahid.

Rasheed told Minivan News today that he expected to remain an elected member of the party, which he continued to support, despite standing by his position to back the parliamentary speaker against a reported three-line whip enforced by the MDP.

During a vote of no confidence taken against Shahid yesterday, 45 out of the 74 parliament members present in the sitting voted in favour of the speaker and 25 voted against him. Two members abstained. MDP MPs Hassan Adil and Ahmed Rasheed were said to have voted against their party line. MDP MPs Mohamed ‘Colonel’ Nasheed and MP Ali Riza abstained.

MDP Spokesperson Hamid Abdul Ghafoor said that the MPs who voted against the no confidence motion would now be required to explain themselves to the party’s Parliamentary Group Leader, MP Ibrahim Mohamed Solih.

Hamid added that the MDP had not yet decided on what course of action may be taken to deal with the MPs who voted against the whip at a time when the party trails in parliamentary support to a coalition of government-aligned parties.  The MDP currently stands alone as an opposition party against the coalition government of President Dr Mohamed Waheed Hassan, which it alleges was brought to power in a “coup d’etat”.

“I wouldn’t go as far as to say that we will do anything rash. Under these stressful circumstances we have to be disciplined as a party,” Ghafoor explained in regards to the possible measures that could be taken against MPs who had not supported the vote.

While the exact nature of action to be taken by the party against members who voted against the bill is presently unknown, MP Rasheed said he would not be looking to switch his political allegiance even when potentially facing being reprimanded or expelled.

“I believe in the MDP manifesto. There is no question to me that it is the only party that actually has a manifesto,” he claimed. “In my mind, there is also no one trying to force me out of the party.”

Last month, the MDP’s former President Dr Ibrahim Didi and former Vice President Alhan Fahmy switched allegiances to the Jumhoree Party (JP). The decision was taken after the MDP’s National Congress passed a majority vote to remove both men from their respective leadership posts after they stood accused of making statements contradictory to the party’s official line.

Despite pledging his allegiance to the party today, Rasheed maintained his support for Shahid in the no confidence motion, claiming that the present speaker, out of 77 parliamentary members, was the “only person right now” who should have the Majlis chair.

Despite Shahid representing the government-aligned Dhivehi Rayyithunge Party (DRP), Rasheed contend that the speaker – due to a perceived lack of power in the position of his party – would not directly support former President Maumoon Abdul Gayoom and his Progressive Party of Maldives (PPM).  The PPM was formed last year after an increasingly bitter war of words between current DRP Leader Ahmed Thasmeen Ali and Gayoom, who had originally founded the party. The war of words saw the party split between supporters loyal to Gayoom and those in favour of Thasmeen’s tenure.

“Discipline”

Questioned as to whether the MDP, through its Parliamentary Group, would be looking to discipline the MPs who failed to back the party line, Ghafoor would not be drawn into the possible repercussions until an internal review was complete.

“The issue is that these MPs went against the whipline. This has been noted by the Parliamentary group Leader.  He now wants to find out why,” he said. “If they go against the party line they must have a good explanation for doing so.”

Ghafoor claimed that as a party, the MDP had generally been “disciplined” in ensuring solidarity among its members during parliamentary voting – a decision he said had afforded it the best record among fellow parties.

“There have of course been mishaps from time to time where people have gone against the party line,” he said.

Ghafoor took the example of former Party President Dr Ibrahim Didi and Vice President Alhan Fahmy as a notable example of where its members had been reprimanded.

“At this delicate time, [voting against the party line] does serve to reduce confidence in the party,” he said.

“Major principles” were at stake in yesterday’s high-profile no-confidence motion, Ghafoor said, adding that there was particular pressure from grassroots supporters to ensure the no-confidence vote succeeded.

“This is nothing personal, but the party supporters are in no mood to tolerate such actions from their MPs,” he said.

Ghafoor claimed that whatever action the party may decide to take against MPs voting against the official MDP line, it would not act in a “rash” manner.

The MDP Parliamentary Group has maintained that it has held “serious reservations” for some time about the Parliamentary Speaker’s ability to pass policies into legislation – despite his capabilities and understanding of national politics.

Speaker support

Speaking during yesterday’s debate, DRP Leader Thasmeen stated that the no-confidence motion had been forwarded amid baseless accusations.  He defended his fellow party member, saying that he had been executing the responsibilities of the speaker in accordance with the parliament rules and procedures.

Thasmeen further claimed that the motion was an attempt by MDP to “break” the coalition after the party leadership’s recent “political failures.”

“Such a motion will not impact the ‘unity’ between the parties in the coalition supporting the government of President Waheed. So therefore I must say, yet again this is another wrong step taken by the MDP leadership,” Thasmeen added.

PPM spokesperson MP Ahmed Mahloof stated that despite his being an outspoken critic of Shahid who made several statements in the media and the parliament floor, he would stand by the speaker’s side today.

“Yesterday, the PPM Parliamentary Group (PG) came to a conclusion that this motion is a ‘trap’ set up by the MDP to ‘finish off’ the people and the ruling coalition,” he said.

“Today at a time where Abdulha Shahid is facing a grave matter at hand, I will stand by him. Abdulla Shahid will get all the votes from PPM. What we ask is that he act justly and equally,” he added.

MDP MP Ali Waheed during the debate alleged that the motion would reveal those MPs who spoke “in two mouths”, referring to the PPM MPs allegations of that Shahid and Thasmeen had cut deals with GMR and the government of former President Mohamed Nasheed to support the privatisation of Ibrahim Nasir International Airport (INIA).

Reporters Without Borders condemns stabbing of Hilath Rasheed: “All the hallmarks of a targeted murder attempt”

Reporters Without Borders (RSF) has condemned the stabbing of well-known Maldivian journalist and blogger Ismail ‘Hilath’ Rasheed.

Rasheed had his throat slashed outside his house in Male’ around 8:15pm on Monday night, and was rushed to ADK Hospital for emergency surgery. Sources at the hospital said that the attack severed his trachea (windpipe), missing a vital artery “by millimetres”, and initially gave him a five percent chance of survival.

Hospital staff stabilised Rasheed’s condition around 2:30am on Tuesday, and as of Wednesday evening his condition was said to be improving. An informed source told Minivan News that Rasheed was unable to speak due to his injuries, but had communicated with his parents in writing.

“This knife attack has all the hallmarks of a targeted murder attempt,” Reporters Without Borders said in a statement.

“Rasheed has made many enemies through his outspoken blogging. The authorities in charge of the investigation should not rule out the possibility that this was linked to his journalistic activity. He is a well-known journalist who has repeatedly been censored, arrested and threatened.

“The police must, as a matter of urgency, put a stop to the harassment of Rasheed and take the issue of his safety seriously. Any lack of response on their part will constitute a criminal failure to assist a person in danger,” RSF stated.

The organisation noted that Rasheed had previously been attacked on December 10, 2011, suffering a fractured skull “while attending a peaceful demonstration in support of religious tolerance.”

“The police then arrested him for taking part in the demonstration and held him until 9 January,” RSF added, noting that Rasheed’s blog, www.hilath.com, had also been blocked on the orders of Ministry of Islamic Affairs on 19 November 2011 on the grounds that it contained “anti-Islamic” material.

“If it is confirmed that the attack was prompted by his journalism and blogging, Rasheed would be the first journalist to have been the target of a murder attempt in Maldives,” RSF observed.

The Maldives Journalist Association (MJA) has also condemned the attack on Rasheed.

“The violent attack on Hilath was an attempt to kill him. The association calls on the authorities to find those who had involved in this crime and bring them to justice,” the MJA stated.
“We call on the police and political figures of this country to stop quarrelling for power and make the country – especially the capital Male’ – a place where families and children can live without fear.”

The MJA added that if the trend of violent murders across the country continued, the resulting impact on the country’s tourism-based economy would be “irrevocable”.

Minister for Human Resources and spokesperson for former President Maumoon Abdul Gayoom, Mohamed ‘Mundhu’ Shareef, told AFP that while the government condemned the attack, “Hilath must have known that he had become a target of a few extremists.”

“We are not a secular country. When you talk about religion there will always be a few people who do not agree,” Shareef said.

Police Sub-Inspector Hassan Haneef meanwhile said that while no arrests had been made, police had obtained CCTV footage of the area and were in the process of analysing it.

Police were also investigating the stabbing of a Bangladeshi man at 11pm on the same evening, Haneef said. The victim suffered minor injuries and was discharged from hospital on Tuesday.

The Maldives was ranked 73rd out of 179 countries in the 2011-2012 Reporters Without Borders press freedom index. The country jumped from 148th in 2005 to 51st in 2009, following the introduction of multiparty democracy and freedom of expression.

High Court ruling on Usfasgandu ruling not “setback” for government: Home Minister

Home Minister Dr Mohamed Jameel Ahmed has said that a High Court ruling to uphold a Civil Court order preventing the dismantling of a Maldivian Democratic Party (MDP) protest camp at Male’s Usfasgandu area is not a “setback” to efforts to reclaim the land.

The camp was raided last Tuesday (May 29) by police after they obtained a Criminal Court search warrant to search the area under suspicion that criminal practices were performed on the site, including the practice of “black magic”. Under evidence, the warrant alleged that people in the Usfasgandu area had on May 25 thrown a “cursed rooster” at MNDF officers.

Shortly after the raid, the Civil Court ordered a halt to the ongoing removal of the camp with a temporary court injunction, after the MDP challenged the legality of the operation.  The Civil Court decision was later appealed by the state.

The temporary injunction was upheld today though by the High Court, which said there had been no grounds to amend the Civil Court’s order, according to local media.

However, Dr Jameel maintained that the Usfasgandu site, which was leased to the MDP by Male’ City Council (MCC), was in fact the property of the government, a position he claimed would ultimately be supported by the law.

“I am confident that a claim to [Usfasgandu’s] vacant possession will be granted by the courts as it has a clear position in law,” he told Minivan News.

Jameel added that it would not be his responsibility or decision to appeal against the High Court verdict.

“The decision to appeal is a matter for the attorney general to make,” he added.

Black magic

During the police raid of Usfasgandu last week, police collected evidence reported to include pieces of paper with Arabic inscriptions,  incense, a box of unused condoms, a discarded ‘Tiger’ beer can, and a laminated sheet containing photos of police officers marked with ‘ticks’ and ‘crosses’.

Questioned on whether the evidence gathered by police from Usfasgandu – including the alleged black magic paraphernalia – was sufficient to support the legal case to ultimately dismantle the camp in its entirety, Dr Jameel said it was a matter for the police to decide.

“We will have to wait and see for their conclusion on the matter,” he said, also addressing the concern of authorities about black magic being practiced by anti-government protesters: “I do not know whether anybody is more concerned about black magic than those who indulge in such outdated activities.”

MDP spokesperson Hamid Abdul Ghafoor and MP Imthiyaz Fahmy were not responding to calls from Minivan News at time of press.

Stalemate

The fate of Usfasgandu represents an ongoing stalemate between the Home Ministry and Male’ City Council.

The Housing Ministry initially sought to repossess the area from the Council, which refused to cooperate. The Home Ministry then instructed police to retake the area, who approached the Criminal Court for a warrant. The court initially denied this warrant, stating that the repossession was a civil matter and not within its jurisdiction.

The Home Ministry has argued that leasing the area to a group for political purposes contravenes the deregulation act under which the land was granted to the MCC.

In a precursor to this issue, the previous area at Lonuziyaaraiy Kolhu used for the staging of the MDP’s operations, dubbed ‘Justice Square’, was dismantled by police and the MNDF on March 19. The subsequent court case was dismissed on a technicality and, after being re-submitted, has recently been delayed once again following for a similar reason.

The MCC has remained defiant, last month writing to the Police, the Maldives National Defense Force (MNDF) and the Housing Ministry, arguing that the area was fulfilling a pressing need for large numbers of people to conduct political activities without inconveniencing residents of Male’ City. It also dismissed the legal right of the government to claim the area.

The Housing Ministry has recently removed Sultan Park and the artificial beach area from the municipal council’s jurisdiction.

CNI nominee agreement “important step forward for the Maldives”: Commonwealth Secretary General

The Commonwealth Secretariat has confirmed that an agreement between the government and former President Mohamed Nasheed has been reached concerning the appointment of a Nasheed nominee to the Commission of National Inquiry (CNI).

The government this week confirmed its acceptance of Ahmed ‘Gahaa’ Saeed, who was formerly both Principal of ‘Ahmadiyya School’ and Deputy Principal of the British College of Sri Lanka.

The CNI was established by President Mohamed Waheed Hassan to investigate the controversial transfer of power that took place on February 7, after Nasheed’s Maldivian Democratic Party (MDP) claimed the former president was forced out of office in a “coup d’etat“.

The MDP – and subsequently the Commonwealth Ministerial Action Group (CMAG) – challenged the credibility of the three member panel appointed by Dr Waheed, and pressured the government into accepting a nominee from Nasheed and a retired foreign judge to serve as co-chair.

The government agreed, but imposed a set of restrictions on Nasheed’s nominee that saw the first 11 candidates rejected.

“I am happy that we finally have a resolution on the issue of Mr Nasheed’s nominee, and I commend both sides for their patience and perseverance in this regard,” said Commonwealth Special Envoy to Maldives, Sir Donald McKinnon, in a statement.

“Now that we have agreement on the reconstituted Commission, I look forward to it starting its work and carrying out its important mandate. I hope also that with its enhanced terms of reference and revised composition, the Commission will be a more broadly acceptable mechanism and will allow the country to move forward,” Sir Donald added.

The Commonwealth noted that in keeping with the commitment signed by the Maldives Government on 15 May 2012, the Commission will be co-chaired by a Commonwealth-funded senior retired judge from Singapore, “and the Commonwealth and the United Nations will each provide an expert adviser for support.”

Commonwealth Secretary-General Kamalesh Sharma also welcomed the agreement, which he said represented “an important step forward for the Maldives”, and expressed hope that the CNI would be able to conduct an impartial and credible investigation.

Meanwhile, UN Secretary General Ban Ki-moon also commend the agreement between President Waheed and former President Nasheed “to make the national inquiry body more independent and credible and to find a resolution to the current political crisis.”

In a statement, Ki-moon urged all political parties “to resume immediately their political dialogue, both within and outside of Parliament, in order to find a mutually agreeable way forward on the basis of the Constitution and without jeopardising the democratic gains achieved thus far in the Maldives.”

The last round of All-Party Talks, held at Vice President Waheed Deen’s Bandos Island Resort and Spa last weekend and monitored by UN mediator Pierre Yves Monett, collapsed after parties in the ruling coalition presented the MDP with a list of 30 demands that included “stop practicing black magic and sorcery”, “stop the use of sexual and erotic tools”, and “not walk in groups of more than 10”.
