Fines to be issued for people catching migratory birds: EPA

Maldives Environment Protection Agency (EPA) has warned that people catching migratory birds will face fines of MVR 30,000 (US$1,941) and a further MVR 25,000 (US$1,618) for every additional bird.

Local media reported that migratory birds are protected under international and Maldivian law and that many different species of bird migrate to the country at this time of year.

Marine biologist discovers turtle, shark slaughter in Maldives’ UNESCO biosphere reserve

A marine biologist working in the Baa Atoll UNESCO Biosphere Reserve has reported the discovery of the remains of a baby shark and endangered sea turtle barbecue on the uninhabited island of Funadhoo, one of the country’s 14 priority nesting beaches legally protected under Maldivian law.

Marine biologist with local environmental consultancy Seamarc, Sylvia Jagerroos, was participating in a beach clean up on August 24 with local people when the group came across the scene.

“We had removed fishing lines, nets, and other marine debris and of course all the garbage from the beach. This consisted mainly of plastic bottles, and that day we found many red bull cans,” she said.

The group then discovered the slaughtered remains of a large, one metre adult nesting green turtle and 2-3 newborn lemon sharks, “still smoking on the barbecue”, surrounded by smashed eggshells.

“We found where the killing took place, there was a lot of blood in the sand, and maybe what was the trace of the turtle crawling to try and nest. I don´t know if she was killed before or after the nesting. I didn’t find any nest, so if there was one then probably all the eggs were eaten already,” Jagerroos said.

“I went snorkeling and found the remains of the turtle in the nearby waters, including the head. Some bones and flippers, were discarded a couple of meters from the barbecue. I also found the remains of baby lemon sharks on the barbecue. The lemon sharks was a newborn sized only around 50-60 cm, the meat had been removed and eaten. My theory is that they saw the green turtle nesting and killed her immediately, while slaughtering and throwing in the pieces in the ocean. The baby sharks were attracted to the smell and since they swim in very shallow waters it’s a piece of cake to catch them.”

Jagerroos noted that the Maldives had proclaimed itself the world’s second shark sanctuary in March 2009.

“For a marine biologist to find a juvenile sickle fin lemon shark on the grill when this creature is listed as “Vulnerable on the red list” with the World Conservation Union (IUCN), and is already extinct in many nearby countries, hurts,” she said.

The catching and consumption of turtles is banned across the Maldives, and turtles – together with many other species – are especially protected in the biosphere reserve.

However turtle eggs are considered a local delicacy and can fetch up to MVR 10 each – a single nest can contain between 100-200. The practice is generally not illegal, but is prohibited on the country’s nesting islands.

Marine biologists working on resorts in the atoll have also privately complained of boatloads of local poachers sneaking onto the islands at night without lights or noisy engines, after hearing of the discovery of a nest of eggs. In some instances, resorts have been forced to post security guards to protect the nests from poachers.

Baa Atoll was in June 2011 added to the UN body’s global list of biosphere reserves after five years of lobbying by the government, placing it in the company of world famous sites such as the Komodo in Indonesia, Uluru (Ayer’s Rock) in Australia and the Galapagos Islands.

The Baa Atoll Biosphere Reserve was officially launched alongside with Baa Atoll Conservation Fund by President Mohamed Waheed in July 2012 at a ceremony in the atoll’s capital of Eydhafushi. At the ceremony, the UNDP presented a cheque for US$250,000 as a contribution to the fund, on behalf of the Global Environment Facility (GEF).

Jagerroos said the team had called the Environmental Protection Authority’s (EPA) ranger at Hanifaaru Bay – a world famous habitat for mantas and whale sharks – “and he said they’d look into it. But they’d have to patrol the whole area – it’s too big,” she acknowledged.

Director General of the Environmental Protection Authority (EPA) Ibrahim Naeem said he was not aware of the incident or that it had been reported to the Hanifaaru Bay ranger, and referred Minivan News to the Ministry of Fisheries which he said was responsible for sharks and turtles.

“It is not allowed to catch and eat turtles. There is no such ban for eggs. Even in the biosphere there are actions that are allowed,” Naeem said.

Minivan News is seeking comment from the Ministry of Fisheries.

Thilafushi closed for clean-up as ‘garbage island’ overflows

Male’ City Council has banned waste dumping at Thilafushi, commonly known as ‘garbage island’, until the current overflow has been cleaned up and boats can access the appropriate dumping areas.

“We decided to ban all the parties from dumping waste until we draft regulations and devise policies on dumping waste,” Councillor Ibrahim Shujau told Haveeru News yesterday.

He explained that parties bringing waste from place other than Male’ would be allowed to dump in designated areas only after a cleaning operation had been carried out and new regulations published.

Minivan News was unable to reach Shujau at time of press.

Tourism Ministry Deputy Director General Moosa Zameer Hassan said the temporary closure “can’t go on for long,” and hopes to re-open the area by the weekend. “But boats will be monitored to ensure they follow procedures,” he added.

Hassan said “waste being brought to the site is not properly put into the collection area–many boats are impatient so they dump their waste outside of the designated area. Now boats cannot access the collection area.”

Thilafushi accommodates only a few boats at a time for dumping. Environmental Protection Agency (EPA) director Ibrahim Naeem earlier said that limited capacity was pushing boats to break the rules.

“The mechanism for waste collection and disposal needs to be improved,” he said previously. “The EPA has to do some work on the matter, and the people who are bringing in the garbage and contributing to its buildup also need to take responsibility.”

Naeem today reiterated that the solution lay with management.

“The City Council has to be more active in getting the necessary equipment and budget to manage waste disposal,” said, adding that boats should also be more patient even in queues one to two hours long.

This is the third time in three months that reports of free-flowing waste have come out of Thilafushi, Naeem notes. Hassan said transferring Thilafushi management to the City Council as per the Decentralisation Act has affected operations.

While City Council does not have sufficient capacity to fully support Thilafushi operations, solutions including splitting the cost of waste operations and utilities among users have been agreed upon. They will be implemented at a later date.

Naeem said an Indian company had been contracted to manage waste disposal, and had submitted its Environmental Impact Assessment. “But we don’t know when that will start. There are deadlines, but I think [the council] is a bit behind,” he said.

Meanwhile, the Council is trying to manage the situation effectively in the short-term.

Among the parties implicated for the waste overflow were resorts, which lean heavily on Thilafushi’s services.

“Right now the issue is about management at Thilafushi,” said Hassan. “Of course there are issues with resorts but they are indirect, such as with transfer boats from outsourced parties.”

Hassan said that tourism regulations require resorts to have an Insinkerator system, a bottle crusher and compactor, and a long-term oil storage system. “Most resorts have the mechanisms but few use them,” he said. “Up until lately Thilafushi has worked well, so there was less incentive to operate their own machinery.”

Incinerators create smoke, and operating the machines is high-cost and highly specialised, Hassan explained. Resorts generally crush and condense waste, but “it’s not a total solution, it’s a step towards on-site management. Thilafushi is the ultimate destination,” he said.

The ministry today met with concerned parties, and enacted plans for immediate clean-up and to re-start operations. The EPA and the Environmental Ministry have agreed on the need to restore waste management operations as as soon as possible.

The clean-up operations will be overseen by Thilafushi Corporation and the city council.

EPA confiscates birds on Thilafushi

Environmental Protection Agency (EPA) has confiscated birds of two species held captive on industrial island Thilafushi.

An EPA statement said some birds that had been held captive and there was evidence of wing-clipping, a practice to keep birds from flying off.

Officials told Haveeru they would also check Hulhumale for more captive birds. He said a wider search conducted by police and councilors will inspect distant islands as well.

According to the EPA, 70 different bird species are protected in the Maldives, most of them since 2003. They include the Crab Plover, the Lesser Noddy, the Purple Heron and the Red-Footed Booby. Among the species confiscated on Thilafushi was the Catlle Egret.

Garbage floats freely from “impatient” boats

The Environment Protection Agency (EPA) has blamed a surge of garbage floating in Thilafushi lagoon on “impatient” trash boats; trash which is now flowing into the sea.

In 2009, the UK’s Guardian newspaper reported that 330 tons of waste are transported in Thilafushi island for processing. Thilafushi is commonly known as ‘garbage island’.

Head of the EPA, Ibrahim Naeem, said a “huge amount of garbage” has been collecting in the ocean, due partly to a change in tides. Speaking to Minivan News today, Naeem did not want to say whether the trash was coming from resort boats, but did say the problem “involves everyone”.

“The mechanism for waste collection and disposal needs to be improved,” he said. “The EPA has to do some work on the matter, and the people who are bringing in the garbage and contributing to its buildup also need to take responsibility.”

Naeem said the EPA had photographs and names of several boats that had been dumping garbage into the sea. The agency is now investigating 10 cases.

Naeem said legal action will be taken against boats caught dumping garbage, which would affect fishing and tourism, two of the country’s largest economic contributors.

Yet there are signs that both the garbage and a lack of regulation may already be affecting tourism. In a recent interview with Minivan News, French tourist Marie Kivers noted a lack of waste bins on Male and Guraidhoo.

It’s funny because we who live abroad think that Male’ will be an example for the world about pollution and everything, since global warming is important here. But when you see the inhabitants in the Maldives, they put anything into the sea,” she said.

Some boat captains have claimed that boats from islands, safaris and resorts dump garbage into the lagoon instead of anchoring near Thilafushi, reports Haveeru. An earlier rule stating that garbage had to be dumped before six in the evening likely contributed to the rushed habit.

Reports indicate that the waste exceeds the capacity of Thilafushi. Naeem says some boats are getting impatient.

“The facility at Thilafushi is designed so that only two or three boats can dock and dump at a time,” said Naeem. “If the waste is not removed from the area, however, or the boats take a while, other boats won’t be able to get in and dump their waste.”

The EPA has said that arrangements are being made to ensure that waste is only dumped on the island under the supervision of a council employee – a thing earlier practiced, reports Haveeru. An official also said that boats traveling to Thilafushi will be charged according to waste weight.

Thilafushi is currently the only island designed for waste disposal in the Maldives. Naeem told Minivan News that there are plans for a new site to be developed in Raa Atoll.

EPA report chronology unclear, claims Champa Moosa’s lawyer

An Environment Protection Agency (EPA) report on alleged illegal dredging and reclamation on Kaafu Thun’bafalhu was not clear whether it took place before or after environmental regulations came into force, Azima Shukoor, lawyer for Champa ‘Uchoo’ Mohamed Moosa, claimed in the Civil Court on Monday.

Azima Shukoor, former Attorney General, is contesting that the EPA violated the constitution and the Environment Protection Act by imposing a fine on Champa Moosa.

In June, the EPA labelled Champa an “environmental criminal” for irreversibly damaging the island of Thun’bafushi and the marine ecosystem of Thun’bafalhu and fined Moosa the maximum penalty of Rf100 million (US$6.5 million) for conducting dredging and reclamation works in the area without an Environmental Impact Assessment (EIA).

According to newspaper Haveeru, Azima argued in court that the island or sandbank was leased to Champa Moosa in 1992 while regulations under the Environment Protection Act of 1993 requiring EIAs was put in place in 2007.

Azima further claimed that the EPA provided its report to Champa with chapters missing, depriving the local business tycoon of his right to fully answer the charges.

State Attorney Usham Ahmed however said that the island was leased to Champa in 1997 and read out the first letter sent from the EPA noting the illegal activities on the island and ordering a halt to it.

“When she says they do not know what was done illegally, I don’t know how to make this any clearer,” Haveeru quoted Usham as saying.

Usham said that the EPA met Champa on numerous occasions and offered him opportunities to answer the charges, adding that the report was made available to Champa’s legal team four days after it was requested. Usham noted that Champa Moosa did not request the report before the EPA decided to impose the Rf100 million fine.

Judge Mariyam Nihayath adjourned the hearing after announcing an additional trial date to consider the full EPA report before delivering a judgment, which is reportedly due on September 27.

Government signs MoU for first national marine park sponsored by private individual

The Ministry of Housing and the Environment has signed a memorandum of understanding with a private individual, Mohamed Hameed, to create the Maldives’ first comprehensive national marine park.

The park, which Hameed says was conceived in the 1980s, is designed to protect nine islets in South Miladhunmadulu Atoll Edhudhfarru.

Hameed proposed his plan to former President Maumoon Abdul Gayoom’s administration in 2007, but says the current administration has been more supportive and would be overseeing the project.

The government has asked that the plan involve minimal intrusion to the natural environment. “I would expect the government to have a majority share in the program,” said Hameed, explaining that a foundation would be established for the park project.

Hameed said he has been advised by scientists from all over the world, and describes the Edhudhfarru area as “fragile and sensitive, with more water than land, and many unique flora and fauna.”

Hameed said the Marine National Park will provide day trips only, and visitors will pay a fee. An underwater observatory is also expected to draw researchers and tourists alike.

Bluepeace, a local environmental NGO, voted last night to support the project.

“We are very supportive of the concept,” said the NGO’s founder, Ali Rilwan. “I think it is very important that private sector individuals get involved in conservation.”

Rilwan said the Edhudhfarru area is very rich in biodiversity, adding that Bluepeace “expects [the foundation] to be much better than most places because of Hameed’s vast knowledge and interest in the place.”

Rilwan noted that this was the first time a private individual had proposed a conservation project to the government, and that the marine park would be the first national park to host a research center. The land itself will be given to the project’s foundation, which has yet to be established.

Tourism Minister Dr Mariyam Zulfa said the park was intended “not just for preserving species for people to see, like in a zoo. There will be activities going on with the research.”

International groups had been inquiring about such a park for years, she noted.

“The park should have been established a long time ago, because tourism in the Maldives is based on sustainable development,” she said.

Director of the Environmental Protection Authority (EPA) Mohamed Naeem said the organisation had not been officially informed of the project, although he understood it had been given to a private company, and said it was “too early to know what to expect from Mr  Hameed.”

Hameed has meanwhile said he hopes locals will become involved in the project. “A national park can only be preserved with the collaboration of the community, and the community should not feel they are deprived of use of the area in any way,” he said.

EPA Director General approved for voluntary redundancy three weeks before sudden departure

Former Director General of the Environmental Protection Authority (EPA) Mohamed Zuhair had given notice that he intended to participate in the government’s voluntary redundancy program three weeks before his sudden departure last week, Environment Minister Mohamed Aslam has revealed.

Zuhair resigned publicly stating that his departure was due to “political interference” in the EPA’s fining of local business tycoon Mohamed ‘Champa’ Moosa – the owner of opposition-leaning private broadcaster DhiTV – for conducting dredging and reclamation works around Thun’bafushi without an Environmental Impact Assessment (EIA).

Photos obtained by Minivan News, corroborated by the eyewitness accounts of foreign experts, suggested that Thun’bafushi had been used as a dump site, with piles of old machinery, oil drums and used car batteries rusting in the sun. At the time the photos were taken, a number of sharks were also being kept in a concrete tank containing less than a foot of tepid water.

The EPA labelled Champa an “environmental criminal” and fined him the maximum penalty of Rf100 million (US$6.5 million) after the EPA assessed damage to the area as amounting to Rf2,230,293,566 (US$144.6 million), under new enforcement regulation introduced in February.

“Thun’bafushi has been an issue long before we took office,” Aslam told Minivan News, explaining that the previous administration had initially rented the island to Champa for Rf 100 a year (US$6.40) under an agreement that stipulated that he “not do anything detrimental to the environment – he was allowed to grow trees and monitor the shifting of the islands. He was not allowed to reclaim or extend the island.”

However Champa had conducted these works without ever submitting an EIA, Aslam said.

“The area has been surveyed 2-3 times now, and last year the Director General attended himself a survey to assess the cost of the damage.”

The government had on several occasions asked Champa to explain himself, and he had corresponded with the EPA, Aslam said.

“Champa disputes he has done anything illegal, and states that has done everything according to the initial agreement.”

Champa’s lawyer, Aslam noted, “a professional with a background in island morphology”, had claimed that the Maldives did not have the capacity to do an accurate assessment.

Champa has yet to appeal the EPA’s formal issuance of the fine, Aslam said, “and it is up to him to take the matter to court.”

Aslam disputed Zuhair’s parting public accusation that the government had interfered in the fining of Champa, noting that several resort properties had also been fined for unapproved reclamation works.

“We know this accusation to be inaccurate,” Aslam said, explaining that Zuhair had expressed his decision to take the voluntary redundancy package three weeks ago.

The Asia Development Bank (ADB)-backed redundancy incentive program offered lump sums of up to Rf200,000 (US$13,000) as well as scholarships and preferential SME loans to civil servants in an attempt to downsize the state budget. The deadline for applications was May 31.

Zuhair’s decision to apply for the program had caught the government by surprise, Aslam said, explaining that he had met with the EPA’s Director General to try and retain him.

“His reason was that government pay was not meeting his financial needs, and he was looking to move to the private sector. We offered to move him to another department that would allow him to also work in the private sector – which is not allowed under the EPA’s regulations.”

Aslam said he became concerned when he pressed Zuhair for an explanation, “but he said on this matter he couldn’t tell us anything further.”

“We asked asked him then if this was a matter of national security, but he said no. So we respected his decision, and he submitted [the voluntary redundancy forms] with the Ministry of Finance, and we were just about to sign them – my signature was to be the last.”

Around this time Zuhair was allegedly sent a letter containing a mobile phone SIM card and a slip of paper note requesting he use it to call Nawal Firaq, the CEO of DhiTV.

Minivan News understands the letter containing the note and SIM card, registered in the name of a Bangladeshi labourer, was delivered to Zuhair’s flat on Friday morning but instead found its way to police.

Firaq denied knowledge of the letter when contacted by Minivan News.

In the police inquiry subsequent to his resignation Zuhair cooperated with police but denied any knowledge of receiving the letter.

“This is Champa building his court case by attempting to question the independence of the EPA,” Aslam suggested, noting that as the EPA’s Director General, Zuhair’s signature was on all the correspondence with Champa, including the notice informing him of the fine.

Despite Zuhair’s expressed financial concerns, his sudden resignation following the fining had meant he had forfeited his entitlement to the redundancy package he had applied for, Aslam noted.

“The numbers don’t add up,” he said.

The EPA’s Director Ibrahim Naeem told Minivan News that neither he or the EPA had received any communication from Zuhair following his sudden resignation.

“I heard his words on television, and some of them did not match his actions,” Naeem said. “He was the guy who signed the letter [fining Champa]. Why would he have done so if he was not happy about it?”

As to why Zuhair would have resigned before receiving his resignation chit from the civil service commission, “that is a very big question, and the answer is not very clear.”

Minivan News has sought to contact Zuhair for several days in regards to his resignation, but his phone appears to have meanwhile been switched off. The EPA and the Environment Ministry have also reported difficulties contacting him.

Minivan News also sought response from Champa but he was not responding to calls at time of press.

Champa Moosa “an environmental criminal”, claims EPA, while police interrogate authority’s former Director General

The Environmental Protection Authority (EPA) has labelled local business tycoon Mohamed ‘Champa’ Moosa an “environmental criminal” for irreversibly damaging the island of Thun’bafushi and the marine ecosystem of Thun’bafalhu.

The EPA on Thursday fined Moosa the maximum penalty of Rf100 million (US$6.5 million) for conducting dredging and reclamation works in the area without an Environmental Impact Assessment (EIA).

Director-General of the EPA Mohamed Zuhair has reportedly resigned over the matter. Furthermore, Police Sub-Inspector Ahmed Shiyam confirmed to Minivan News that Zuhair had been taken in for questioning regarding an undisclosed investigation. Zuhair was not responding at time of press.

Director of the EPA Ibrahim Naeem told Minivan News the area had been irreversibly damaged and a large reef habitat destroyed.

Sharks left in a foot of tepid water

“This was originally a reef ecosystem with a small sand bank in the middle, but he has been dredging the island without any clearance and the changes are now irreversible,” Naeem said.

After three surveys of the area, the EPA had assessed the damage as amounting to Rf2,230,293,566 (US$144.6 million), not including the impact of sedimentation from the dredging which can smother coral kilometres from the site.

A foreign consultant who was involved in surveying the island told Minivan News that the area “seems to have been used as a dumping ground.”

“There were what looked like hundreds of used car batteries, waste metals and oil drums leeching into the marine environment,” the consultant said.

“We were looking at the effect of the dredging on sedimentation, and there were no water quality tests done. But you can just imagine what it would have been like with all the batteries and waste metals.”

Images of the island obtained by Minivan News showed discarded piles of rubbish and batteries, old earthmoving machinery rusting in the sun, and half a dozen reef sharks in a tank containing a foot of tepid water.

While the unauthorised reclamation works are several years old and have been a subject of EPA concern for some time, Naeem explained that the procedure and mechanism for calculating and issuing fines was only established in February this year.

The Environmental Protection Act already states the requirement for an EIA assessment and the illegality of conducting works without acquiring one, but does not outline how this should be penalised. Naeem noted that the EPA had lost court battles on the specifics prior to the introduction of the new framework in February.

“We now calculate environmental damage caused by [unauthorised] dredging at Rf65,000 (US$4200) per square metre,” Naeem said, “but Rf100,000 million is the maximum fine.”

Fines were open to appeal and negotiation, Naeem said, suggesting that “this is likely to happen in this case.”

Piles of rubble and old machinery

Moosa could also request the EPA resurvey the damaged area, Naeem  said, although he noted that the EPA had already surveyed the area three times, most recently in March.

Ali Rilwan of Environmental NGO Bluepeace expressed concern that the EPA’s previous issuing of fines for environmental damage was sporadic, and those that were issued were often unpaid “or the day afterwards, pardon is given.”

The EPA’s lack of independence from the executive also “raised doubts” as to whether fines were politically motivated – Moosa’s business interests include private broadcaster DhiTV, which the ruling Maldivian Democratic Party (MDP) has previously criticised for being heavily aligned to the opposition.

“The Environmental Act does not conflict with the Constitution, but the EPA should be an independent body like the Human Rights Commission,” Rilwan said.

“It should be an independent agency autonomous from the government staffed by academic professionals, rather than civil servants and ministers. Because of the current setup, we do have doubts [over its independence].”

A building on the island used for storage

Naeem responded that while he did not know if there was a political element to the decision to fine Moosa a week before the government was seeking to push through major economic reforms in parliament, “what we do know is that Champa has definitely done this without a license or any form of clearance.”

“I don’t know if there is a political element – but he has committed a crime, and we have to take our responsibility towards the environment seriously,” he said.

Minivan News contacted Champa Moosa for comment but he had not responded at time of press.
