Indian government offers to replace destroyed police vehicles

The Indian government has offered to replace all police vehicles destroyed during the unrest that flared across the country following the recent transition of Presidential power.

The police bore the brunt of the anger that followed former President Nasheed’s resignation, resulting in damage that the Ministry of Home Affairs has estimated to amount to Rf183million.

The majority of the damage occurred in the atolls where 16 vehicles were destroyed during February’s upheavals.

President Waheed appoints seven state ministers, including Gayoom’s son

President Mohamed Waheed Hassan has appointed seven state ministers for various ministries in a ceremony held in the President’s office yesterday.

The newly appointed state ministers were Imad Solih as the Minister of State for Education, Fuad Gasim as the Minister of State for Fisheries and Agriculture, Ahmed Shameem and Mariyam Mizna Shareef as Ministers of State for Tourism, Arts and Culture, Abdulla Ameen as the Minister of State for Economic Development, Gassan Maumoon as the Minister of State for Human Resources, Youth and Sports and Sheikh Mohamed Didi as the Minister of State for Islamic Affairs.

Gassan Maumoon, appointed Minister of State for Human Resources, Youth and Sport, is the son of former President Maumoon Abdul Gayoom. Gassan also contested in the last parliamentary elections under a DRP ticket against the recently unseated MDP MP Musthafa. Gassan lost the election twice, after the Elections Commission held the election for a second time after the first election was declared invalid.

The Criminal Court in October 2011 ruled that the arrest of Gassan was unlawful, after he was summoned for questioning in connection with an injury sustained by an MDP protester outside his residence Endherimaage.

During the incident, a 17-year-old boy was struck on the head with a wooden plank allegedly thrown from Endherimaage, while protesters led by MDP MPs, councillors and senior members were marching by the former President’s residence. Police submitted documents containing early evidence for the judge’s considering, including a medical report of the injuries sustained by the 17-year-old, photos, witness statements and “evidence we collected from the scene.”

Gassan’s legal team, including current Attorney General Azima Shukoor, argued that witness statements were invalid as they would have come from “people participating in an unlawful assembly.”

Police argued at the time that if Gassan’s arrest was unlawful, “everyone police have ever arrested and brought before the court [for extension of detention] have been arrested in violation of the constitution”, and suggested that Gassan’s legal team was “concerned that we might present evidence” and that the legal argument bore “no weight.”

Imad Solih, appointed as the state minister of education, is currently the deputy leader of Dr Hassan Saeed’s Dhivehi Qaumee Party (DQP) and was a former presidential appointee to the People’s Special Majlis during the time when the constitution was drafted.

Gasim, appointed as the state minister for fisheries and agriculture, is the current secretary general and a council member of business tycoon and politician Gasim Ibrahim’s Jumhoree Party (JP).

Shameem, the newly appointed State Minister for Tourism, Arts and Culture, is a senior member and a council member of Dr Munavvar’s political party, the Maldives Reform Movement. Shameem is also the brother of the Human Rights Commission member Dr Ali Shameem.

Ameen, appointed as the Minister of State for Economic Development, is the current Secretary General of Dr Hassan Saeed’s DQP.

Mariyam Mizna Shareef, who was made state minister for tourism, arts and culture, is the daughter of DRP deputy leader Ahmed Shareef.

Sheikh Mohamed Didi, appointed as the State Minister for Islamic Affairs, is the President of the Civil Alliance, an umbrella coalition of NGOs behind the December 23 movement in defence of Islam. Didi also played a pivotal role in organising the 23 December Islamic rally and has been working with the opposition during the tenure of President Nasheed.

President Waheed, speaking to the newly appointed state ministers, expressed confidence in the new appointees and that he had no doubt in that they would serve the nation with best of their capacities.

MDP Spokesperson Imthiyas Fahumy said: ” Gassan is not at all experienced in working in such a position. What is happening right now is exactly what happened during Gayoom’s regime.”

“We are day-by-day seeing that Waheed does not have full power over this government. Someone else from Maumoon’s end is controlling this. Those who were involved in this coup are getting the positions,” Fahumy said.

New elections officer appointed for Thimarafushi by-election

Election Commission President Fuad Thaufeeq has appointed a 19 year old council worker to oversee the Thimarafushi by-election, scheduled for next month.

Thaufeeq said that the appointee met the need for somebody adequately qualified but without political affiliation.

The previous elections officer in the constituency was Maldivian Democratic Party (MDP) member Ali Hassanfulhu. His replacement was intended to head-off potential unrest in an area with both strong MDP and Progressive Party of Malives (PPM) support.

The PPM said it feared that the appointment was politically motivated and had sent a letter of complaint to the Election Commission.

Discussions for Parliament’s reconvening at a “crucial and sensitive” juncture

Speaker of the People’s Majlis Adbulla Shahid has that discussions regarding the reconvening of Parliament are ongoing. Despite his belief that a sit-down with all party leaders was not currently possible, Shahid stated that talks were being held on a party by party basis.

Shahid added that details of these discussions, if released prematurely, could damage progress. “That’s why in this crucial and sensitive juncture, I urge all political parties to recognize the importance of dialogue and thus refrain from actions that would impede the discussions.”

The scheduled opening of Parliament last week was cancelled after MPs from the Maldivian Democratic Party blocked Shahid’s entry to the chamber in protest against the government’s reluctance to fix a date for fresh elections.

In response to this, former President Maumoon Abdul Gayoom’s Progresive Party of the Maldives (PPM) joined the Dhivehi Rayithunge Party (DRP) withdrew from the roadmap talks, which are aimed at ending the current political crisis.

Amnesty condemns use of excessive force on demonstrators, following police raid on protest

Amnesty International has condemned the use of excessive force by police against 300 Maldivian Democratic Party (MDP) supporters in the Lonuziyaarai Kolhu (tsunami monument area) early on March 7.

The MDP yesterday accused police of attacking demostrators and vandalising the ongoing protest, after they pursued a group of youths to the area suspected of vandalism and threatening police.

During the raid on the MDP camp, “at least six protesters were injured, some seriously, when combined police and military officers attacked around 300 MDP protesters – part of a wider pattern of attacks, documented by Amnesty, on supporters of the political party of the ousted former President Mohamed Nasheed,” the human rights group said in a statement.

One of the victims told Amnesty “[the police] grabbed hold of my hair and pulled me up, shouting they would teach me a lesson for demonstrating against the new President.”

Among the six protesters injured was a 16 year-old boy who was placed in the custody of the Child Protection Unit, said Amnesty. The organisation was refused permission to visit him.

“People who were peacefully exercising their right to protest were beaten on the head with batons, kicked and sprayed with pepper spray. This use of excessive force violates human rights standards,” said Amnesty International’s researcher Abbas Faiz, who is documenting the human rights situation in Maldives.

“The Maldives authorities must clearly announce, and demonstrate, that they do not tolerate retaliatory raids by the police against protesters. Police and military must not act outside the law,” Faiz said.

“When police officers act like political opponents towards demonstrators, they erode respect for the rule of law and cast doubt on their impartiality as officers of justice,” he added.

Amnesty called on police to make public the number of people who had required medical treatment following their arrest.

“Credible sources have told Amnesty that the police and military arrested more than a dozen people during their raid on the MDP rally. They arrested some more people in the hospital after they had gone to receive medical treatment for their injuries. The detainees were taken to police detention centres in Malé, and were later transferred to Dhoonidhoo, an island close to Malé which is the main detention centre.”

Police Spokesperson Sub-Inspector Ahmed Shiyam yesterday told Minivan News that police had pursued a group of young men armed with knives, who had vandalised police stations and threatened officers before retreating to the MDP protest area.

Police stopped at the edge of the open area and requested backup, but by the time it arrived word had spread that police were about to raid the protest site and MDP supporters had arrived to protect the area.

“When police entered the [camp] to arrest the suspects forcefully, everyone in the area became hostile to police. There was a huge confrontation,” Shiyam said added.

“This was a very serious thing and we are sad that it happened,” Shiyam said. “We have no interest in doing anything [to the MDP camp], and we don’t want to have a confrontation. But people are coming out of the area, committing acts of violence, and going back there to hide, which is not something to be accepted.”

Elements of the police and military were complicit in the ousting of former President Mohamed Nasheed, who contends that he was forced to resign by security forces “under duress” in a bloodless coup.

MDP calls for compromise amid ongoing political standoff

The Maldivian Democratic Party (MDP) is open to compromise in its position on the opening of parliament, the party has said, in its pursuit of an early election date.

“[The MDP] have to compromise as well. It should not be expected that during negotiations that only one side will make all the efforts to compromise,” said the MDP’s Parliamentary Group Leader Ibu Solih yesterday.

In a conciliatory statement, Solih said: “Just look at what happened last week. [The government] said that a date for an early election will not be settled until the parliament is opened, while we maintained that the parliament cannot be opened until a date is set. Both sides wanted their way.”

He continued to posit national welfare as the paramount concern during the current political upheavals: “Finding a way to co-exist should be of fundamental importance right now.”

President’s Office Spokesman Abbas Adil Riza said that the all-party talks would continue when the convener Ahmed Mujuthaba returns next week. Riza himself represented the Jumhoree Party (JP) of resort owner Gasim Ibrahim at the recent round of talks, and spoke of the need to find common legislative ground before fresh elections.

“Let parliament function and politicians be politicians,” said Riza. “We cannot allow extreme elements to take control.” Riza stated that the JP wanted assurances that the democratic processes that many people had worked hard to cultivate “would be allowed to function properly before it could support fresh elections.”

“We must not return to square one,” he continued, as he emphasised the need for clearer methods, situated on common ground, to resolve procedural deadlocks. He cited the PPM’s displeasure with the Electoral Commission and the MDPs unhappiness with the Judicial Services Commission as examples of this systemic conflict.

“Having nearly brought the democratic process to a standstill… let us legitimise the process,” he said.

Committee of National Inquiry (CNI)

Transparency Maldives Project Director Aiman Rasheed reported that a meeting between NGOs and the CNI today was candid and contained much “positive energy”.

Today’s meeting was attended by a number of local groups including the Maldivian Democracy Network, the Maldives NGO Federation and Democracy House.

“The inquiry is an opportunity for unity… It is a collaborative civil society effort,” Rasheed said. He emphasised the popular theme of better dialogue between parties.

Several parties on the side of the new government, the Dhivehi Rayyithunge Party (DRP), Progressive Party of the Maldives (PPM) and the Adhaalath Party (AP) last week walked away from the India-mediated roadmap talks  after MDP MPs blocked the entry of Parliamentary Speaker, Abullah Shahid, to the People’s Majlis. The CNI has been presented by India as an important of  path to political reconciliation in the Maldives.

President Dr Mohamed Waheed Hassan earlier in the week wrote to all parties urging a renewal of their commitment to the all party talks “in the best interest of the nation.”

During the meeting between the CNI and the representatives of Maldivian civil society,  the issue of time constraints on the newly formed investigative body were also highlighted. Whilst time is needed to adequately staff and establish working procedures, Rasheed said he believed time was “a luxury” that could be ill-afforded.

The CNI has asked the Foreign Ministry to expedite its normal procedures in contacting the United Nations. International participation has been strongly advocated both domestically and internationally to safeguard the transparency of the inquiry process.

Following the MDPs recent claims of witness intimidation – including of police officers willing to speak to the inquiry – CNI members were candid about the challenges faced, acknowledging that witness protection would be an important issue.

The President spoke to local television station DhiTV this week, stating his intention to work tirelessly to unite the divided country.

In a subsequent statement on the President’s Office website, Dr Waheed said “satisfactory results could not be achieved if I attempted to work alone.”

“What we have witnessed over the past three years was the decisions of a single individual being imposed on all,” Dr Waheed claimed.

India engaged in diplomatic fire-fighting as Maldives instability grows: Eurasia

Indian Foreign Secretary Ranjan Mathai’s visit to the Maldives was continuance of diplomatic fire-fighting where India has actually messed up big time, writes Rajeev Sharma for the Eurasia Review.

The official line taken by the Government of India is expectedly much different. The Ministry of External Affairs issued a press release on February 29 claiming that the representatives of all parties who met Mathai, individually and collectively, expressed the view that India had played “a very useful role” in taking the process forward as a facilitator and friend of the Maldivian people.

This has to be taken with a pinch of salt as India continued to be a fence sitter as the then President Mohammed Nasheed committed errors of judgment one after another and sought Indian help when he was neck deep in trouble. Maldives is the second SAARC country which has witnessed fall of President after he took on the judiciary of his country. The previous example was that of Pakistan where President Pervez Musharraf had to bow out of office after he unsuccessfully locked horns with Chief Justice Iftikhar Muhammad Choudhry. But Maldives is not Pakistan. Unlike in Pakistan India could have, and should have, played a more pro-active role in Maldives and nipped the crisis in the bud which India failed to do.

The MEA has claimed that Mathai’s Male visit threw up a broad measure of agreement with all stakeholders. All parties agreed to continue dialogue on the way forward including possible amendment to the Constitution and enactment of legislation for institutional reforms. All Parties recognized the need to undertake the necessary amendments and legislation within a quick timeframe in the People’s Majlis. Maldives’s new President Mohammed Waheed Hassan, in his concluding meeting with Mathai, reiterated appreciation for India’s assistance and support to the reconciliation process and expressed further potential outcome of the continued consultations while agreeing that India would continue its role of facilitator.

But the ticklish situation remains as Nasheed continues to sulk and has refused to join the national government. Though Waheed has agreed on the need for early elections and continue further consultations among all major parties under the rubrique of All Party Consultative Committee (APCC), no fresh dates of elections have been announced. Waheed does not seem to be in a tearing hurry to holding fresh polls. Nasheed demonstrated his power and his intentions on March 1 when his supporters squatted in front of Majlis – Maldives’ Parliament – and prevented President Waheed from opening Parliament. The incident showed that Maldives’ political instability is going to exacerbate. That all parties have agreed to look at India as a ‘facilitator’ in bringing about national reconciliation has endowed a big responsibility on New Delhi. It is also a key opportunity for India which it cannot afford to whittle away. But the Indian path is laden with more of thorns and less of roses.

A delegation of the Commonwealth Ministerial Action Group (CMAG) that visited Maldives on February 17 recommended that early elections should be held in the country and preferably within this year itself. CMAG had urged President Waheed to commence an immediate dialogue without preconditions. Having come in the wake of the visit of the Indian Foreign Secretary and the subsequent roadmap that President Waheed’s Office itself had made public, it was expected that discussions would be held among the principal political players in this regard and dates would be firmed up at the earliest. However, this does not appear to be happening.

At a rally organised by the “December 23 Coalition” on February 24, an alliance of religious NGOs and political parties led by former President M A Gayoom’s Progressive Party of Maldives (PPM), President Waheed adopted a strident position on the issue. He declared that before declaration of a date for the elections, former President Nasheed should first establish the illegitimacy of the present Government. Earlier, Waheed had reacted to the suggestions of the CMAG by appointing his own Commission of Enquiry to go into the circumstances leading to transfer of power (events from January 14 to February 8).

The Commission is headed by Ismail Shafeeu, Minister of Defense and National Security in Gayoom’s regime. He had also said that the CMAG’s recommendations for international participation in such an inquiry were for the Commission to consider. In view of the volte face by President Waheed on the assurances given to the CMAG, the Commonwealth and foreign office as well as the international community is seriously considering sending observers to Male in order to oversee a smooth return to democracy by the convening of early elections. The international initiative has become urgent in view of what happened in Male on March 1 when the Majlis could not begin its scheduled session due to large-scale protests from Nasheed’s supporters.

India cannot afford to lower its guard in Maldives at a time when China has raised its strategic sweepstakes in this country and Pakistan too has become active. The Wahabi tremors that are already being felt in Maldives have accentuated the situation further. Any diplomatic blunder by India vis a vis Maldives will prove to be costly. If India were to display any diplomatic shortsightedness in Maldives, the results would be catastrophic. This will downsize India in its strategic backyard which is strategically located near busy, pirate-infested shipping lanes.

Government assures Transparency Maldives of willingness to accept international assistance in inquiry

President Dr Mohamed Waheed Hassan has assured Transparency Maldives of his willingness to include international groups in the inquiry into the events surrounding his accession to the presidency.

In a meeting with the local NGO, President Waheed and Attorney General Azima Shukoor also welcomed requests for increased transparency in the workings of the Committee of National Inquiry (CNI) which is charged with looking into the legality and legitimacy of the transfer of presidential power.

Transparency Maldives Project Director Aiman Rasheed emerged from the meeting confident that Dr Waheed would respect the importance of transparency and accountability in the inquiry process.

Rasheed told Minivan News that Dr Waheed saw an independent and transparent process as the way forward, and recognised that an enquiry which did not have the support of the people would only further political discontent.

The inclusion of international experts in any such inquiry has been urged by numerous international actors as well as the party of  former President Nasheed. The Commonwealth Ministerial Action Committee (CMAG), in a statement released after its own inconclusive enquiry into recent events, had strongly recommended an international element to any future investigation, “as mutually agreed to by political parties in Maldives.”

The largest party in the People’s Majlis, Nasheed’s Maldivian Democratic Party (MDP), yesterday criticised the CNI for “dragging its feet” on the issue, in what it said was “a clear violation” of the wishes of the international community.

“The MDP hopes that the international community will immediately call on the Dr Waheed regime and the CNI to commit to significant international assistance in the investigation,” the party said in a statement.

MDP said it had received reports of that members of the police force willing to talk to the CNI were facing intimidation. MDP International Affairs Spokesperson Hamid Abdul Ghafoor said he believed that such reports only increased the need for international experts, including witness protection specialists, to help bring investigations to a successful conclusion. Ghafoor has previously drawn unfavourable comparisons between this investigation and the 2003 Maafushi jail enquiry whose independence was questioned and whose outcome was censored.

The CNI currently consists of three members: Ismail Shafeeu, former minister of defence and national security during President Maumoon Abdul Gayyoom’s administration; Dr Ali Fawaz Shareef, Deputy Vice Chancellor at Maldives National University; and Dr Ibrahim Yasir, former Director General of Health Services.

One member of the commission has already been reappointed. Dr Ali Fawaz Shareef replaced Ahmed Mujuthaba, who said his position as the convener of the all-party consultative meetings was a conflict of interest.

Transparency Maldives, which is scheduled to meet the CNI tomorrow with three other NGOs, including the Maldivian Democracy Network, Maldives NGO Federation and Democracy House, has been active in raising awareness of the detrimental impact corruption and opaque governance on society.

The group’s current projects include Parliament Watch, a program that aims to increase public scrutiny of the procedures and processes used in the People’s Majlis, and the CRINIS Project advocating for changes to political party financing transparency. Others include the Right to Information Project, creating demand for right to information for greater transparency and accountability, the Decentralisation Project promoting accountability and increasing citizen engagement in local governments, and Advocacy and Legal Advice Centres Project, helping victims of corruption with the legal systems in place.

It has also produced reports on media, and conducted surveys on corruption perception. In pursuit of its stated goals of justice and democracy it asked the President to consider allowing it observer status on the CNI. It also requested that the CNI’s findings be made public.

MMA accepts MDP MP Musthafa’s BCCI debt after the court rejected the money

The Civil Court has refused to accept payment of the debt it had ordered paid by Maldivian Democratic Party (MDP) MP Mohamed Musthafa, after the ruling against him was last week upheld by the Supreme Court.

The case had been filed against him by Progressive Party of the Maldives (PPM) Deptuy Leader Umar Naseer, and the ruling meant that Musthafa was disqualified as an MP for the former ruling party, forcing a by-election in his seat of Thimarafushi.

Musthafa this morning sent a person to pay the debt to the court – a loan of US$31,231.66 (Rf 481,952) borrowed from the now defunct Bank of Credit and Commerce International (BCCI).

The Civil Court has confirmed that a person had sought to pay the debt on Musthafa’s behalf, after the Supreme Court ruling did not mention that the money was to be paid to the former ‘Madhanee’, or Civil, Court.

Until President Nasheed signed the Judicature Act into law last year, the official name of the Civil Court had been Madhanee Court – ‘madhanee’ being the Arabic word for ‘civil’.

MDP MP Musthafa today told Minivan News that he had been trying to pay the money every day since losing the caase last Friday, but said the court had not accepted it.

‘’Today I thought I would inform that media and send someone to the court to pay the money, and the court did not accept it again,’’ Musthafa said. ‘’I wrote a letter to the court but they did not respond to it.’’

Later today, Musthafa said the Civil Court registrar had called him and met with him, and said the Supreme Court’s ruling did not specify who the recipient of the money was to be, and that the Civil Court did not know what they should do with it, Musthafa said.

‘’The Supreme Court told me to get assistance from the Maldives Monetary Authority (MMA) and the Attorney General,’’ he said. ‘’So then I sent the money to the MMA, and the MMA has received the money.’’

He also said that tomorrow he will file a case in the Civil Court asking the court to order the MMA to pay him the US$500,000 that the BCCI was obliged to pay Musthafa, in a separate case concerning the supply of meat and other goods.

‘’They have today proved that the MMA are the live parent of BCCI [despite BCCI being defunct],’’ he said. ‘’This is funny to me – because when they have to pay me something owed by BCCI, they deny they are the live parent, but when I have something to pay to BCCI they become the live parent of BCCI.’’

In November last year Musthafa threatened legal action against the Maldives Monetary Authority (MMA) if it did not pay the US$500,000 that BCCI owed his company Seafood International, alleging that the sum was due to be paid to his company according to a 1991 London court ruling.

Citing MMA as the “live branch of BCCI in the Maldives,” Musthafa previously stated that “the debt of a dead person has to be paid by a living legal parent.”
