State companies dismissing May Day protesters from jobs

The state owned utilities company Fenaka Corporation has dismissed two employees without notice for their alleged participation in an antigovernment protest on May Day, amidst growing concern that other state owned companies are considering similar actions against opposition supporting employees.

“The notice for dismissal I received said I had taken part in an act against the state. But my contract does not state I cannot take part in political activities,” Ibrahim Didi, a Fenaka employee told Minivan News today.

A Fenaka supervisor in Addu City, Abdulla Sodig, was accused of traveling to Malé to participate in the May Day protest and was fired.

“I was in Male’ but I did go to the protest. I have requested the company to review the situation and reverse their decision,” he said.

Nearly 200 people were arrested and scores injured when violent clashes broke out in the capital Malé.

Approximately 20,000 people took to the streets on Friday against the imprisonment of ex-president Mohamed Nasheed in the largest antigovernment protest in a decade. Two police officers were also severely beaten.

On Saturday, ruling party MP Ahmed Nihan urged the government to track down civil servants and employees of state owned companies who had participated in the protest and dismiss them immediately.

The Maldives Ports Limited (MPL) had earlier warned employees it would fire anyone seen at the May Day protest, but a senior manager Ahmed Athif said the company has not yet received any reports their employees had taken part in the protest.

 

Employees of the Maldives Customs Services told Minivan News they are being shuffled between departments due to their political views.

“We haven’t gotten direct threats or anything like that but people are being shuffled around departments because of their political views. These are acts of intimidation,” a senior officer who wanted to remain anonymous said.

He also said employees are asked to attend ruling party events even as they face reprisals for taking part in opposition activities.

“We got an internal memo asking to participate in a PPM event earlier. It said employees are advised to attend the event to show support for the ruling party,” he said.

But the commissioner general of customs Abbas Adil Riza rejected claims of intimidation.

“The customs always has and will always follow the rule of law. We will not intimidate or scare our staff,” he said.

Meanwhile, a former customs employee has said he was fired for taking part in an opposition demonstration on February 27.

“I served for 36 years in the government out of which 34 years I spent in the customs. I took part in the opposition February 27 protest and was asked to either resign or face being fired. I resigned,” he said.

In March, at least four employees of State Electric Company Limited (STELCO) and one from Malé Water and Sewerage Company (MSWC) were dismissed, and at least five were suspended from MPL over the February 27 demonstration.

Government to sign MoU with Dubai Ports World to develop port at Thilafushi

The government is planning to relocate the central commercial port from Malé to Thilafushi and sign a joint venture agreement with Dubai Ports (DP) World to develop the port as a free zone, the cabinet’s economic council has revealed.

Speaking at a press conference at the President’s Office yesterday, Tourism Minister Ahmed Adeeb said “advance discussions” have taken place with DP World about a joint venture with the government.

“In my view, such progress shows the confidence in the Maldives,” the co-chair of the economic council said.

Economic Development Minister Mohamed Saeed and Youth Minister Mohamed Maleeh Jamal would depart for Dubai on Wednesday night to sign a Memorandum of Understanding (MoU), Adeeb said.

DP World is one of the largest marine terminal operators in the world and currently manages more than 60 terminals across six continents.

The envisioned free zone at Thilafushi port would include facilities for bulk breaking and transhipment cargo handling, Adeeb said.

DP World has expressed interest in investing in the port project, he continued, and negotiations were ongoing concerning details of the joint venture between the Emirati company and the Maldives Ports Limited (MPL).

DP World would be required to keep existing local staff at MPL, bring Maldivians to the top management and provide training, Adeeb said.

The project would be divided into three phases with an estimated investment of between US$250 and US$300 million, he said.

Adeeb explained that DP World would be offered incentives under the government’s flagship Special Economic Zones (SEZ) Act with “a free trade zone area” and relaxed regulations.

A larger port was essential logistically if 50 new resorts were to be developed, he continued, noting difficulties at present in importing and clearing resort supplies through the central port.

The government would also hire a port expert for the negotiations to ensure the “best deal” for the Maldives, he added.

Economic Development Minister Saeed said the Maldives was ripe for “an ocean economy” and the current administration has undertaken unprecedented efforts to diversify the economy with a focus of maritime businesses.

Congestion was a serious problem at the Malé commercial port, which has space for about 60,000 containers, Saeed explained.

The SEZ investment board was in the process of finalising plans for establishing “a free zone or dedicated free trade zone” at the port, Saeed revealed.

During last year’s budget debate, opposition MPs expressed skepticism of the government’s forecast of US$100 million expected as acquisition fees for SEZs by August 2015.

The opposition has also criticised the lack of significant foreign investments despite assurances by President Abdulla Yameen’s administration with the passage of the SEZ law last year.

Saeed meanwhile noted that the seaport project was announced in April last year at an investor forum in Singapore.

“So in a very short period of time, we have steadied the economy, stabilised the currency, increased the gross reserve, increased investor confidence, and while solving issues in the domestic environment or arena, we are seeing today that what this government is doing is real governance,” he said.

“So citizens should rejoice. And I believe that the progress we are making is unprecedented in recent history.”

Adeeb also said projects to construct a new terminal and second runway at the Ibrahim Nasir International Airport (INIA) as well as a bridge connecting the capital to Hulhumalé would begin before the end of the year.

Workers protest outside Maldives Ports Ltd

Port workers gathered in front of the Maldives Ports Limited (MPL) building this morning to protest the work stoppage caused by technical problems.

According to an unnamed worker who spoke to Sun Online, only five containers were brought to the unloading area by 8am this morning. “MPL has been doing this for some time now,” Sun was told.

Speaking to Minivan News, an official from MPL stated that 130 containers were listed to be cleared today and that the containers were not brought to the unloading area at the normal pace due to technical problems that occurred with transport equipment and vehicles.

Efforts are underway to repair the technical problems and port workers have already returned to work after brief discussions between MPL management and the workers, the official stated.

Minivan News was unable to obtain a comment from the Maldives Port Workers Union.

Civil Court uphold right of Center Enterprises to seek compensation from ACC

The Civil Court has decided that the Center Enterprises Company has the right to file a lawsuit against the Anti-Corruption Commission (ACC).

The company initially sued the ACC following allegations made by the ACC that the company had defrauded money from Maldives Ports Limited (MPL) over a project concerning the supply of a cargo boat to MPL.

The Civil Court decision came after the commission disputed that the company could sue it, as the commission had the authority to halt the business transaction.

The company has claimed that the ACC’s allegations had made the banks lose trust in the company, which had affected some of the contracts and business transactions of the company.

The Center Enterprises Company is demanding the ACC pay MVR 74 million (US$4.8 million) in compensation for the losses caused by the allegations.

The Civil Court stated that Center Enterprises had said the lawsuit was not based on the fact that the ACC had ordered the MPL to halt the project, but was rather based on the allegations made by ACC through local media without referring to a letter sent to the ACC by MPL, reportedly vindicating the company.

Global trade union rubbishes Maldives port operator’s claims on rights abuse resolution

The International Transport Workers’ Federation (ITF) has rubbished claims by the state-owned Maldives Ports Limited (MPL) that the company has allayed the organisation’s concerns over the alleged infringement of employee rights.

The ITF, a global trade union representing 4.5 million transport workers across 154 countries, said it continued to share concerns raised by the Maldives Ports Workers Union (MPWU) over alleged rights abuses by MPL management.  As a result the ITF has begun calls for international solidarity action by its worldwide members after a perceived failure by the MPL and the government to address the alleged rights issues.

Earlier this year, the MPWU, which represents staff employed at the MPL, accused the state-owned company of violating employee rights over, alleging amongst other concerns, that it had unfairly dismissed four employees due to their political activism.

Disputes between the MPWU and the MPL later escalated to a point where the trade union back in September accused the state corporation of forming a “paper union” to shove aside the alleged violations of employee rights.

MPL has denied all the accusations, claiming that the staff members in question were disciplined on the basis of “disobedience” and “punctuality” in line with national employment regulations.

MPL CEO Mahdi Imad told Minivan News on Wednesday (November 7) that the state-owned company had also responded to the ITF, which it said later “apologised” over having raised the issue without checking facts.

However, the ITF has rubbished the claims, maintaining that it had so far had no reply from the MPL regarding the concerns. The global trade union said therefore it dismissed the state-owned company’s assumption it had “won us over”.

“That’s rubbish. There has been no attempt by MPL and the government to address what’s happening to dockers in the Maldives, and in fact what’s happening in the country at large,” an ITF spokesperson told Minivan News.  The trade union group said it would now be stepping up pressure on the MPL and the Maldives government should negotiations with the MPWU not be forthcoming.

After having sent two letters to President Mohamed Waheed Hassan, the ITF announced Thursday (November 9) that it was now calling on the government to intervene over “union intimidation” or “face embarrassment wrought by widespread international solidarity action”.

ITF General Secretary David Cockroft said the organisation was calling for a real “dialogue and conciliation process with MPWU” that can lead to a negotiation settlement with the union’s members.

“Members of the union have been fighting off victimisation by the MPL in a campaign to prevent them from participating in union activities; union leaders have also been dismissed,” the ITF has claimed “These actions run counter to the government’s own employment legislation and constitution as well as International Labour Organization (ILO) conventions.”

MPWU representatives, alongside a delegation from the national union centre, were said to have held a meeting with President Waheed last Monday (November 5), though the ITF added that the ports union had failed to receive any “adequate assurances”.

“As a result the MPWU, with support from the ITF, has vowed to step up its campaign,” a statement on the trade union’s website read.

President’s Office spokesperson Masood Imad told Minivan News today that as the MPL was a public company, the government “don’t look into issues like this”.

“These companies are totally independent, we appoint a managing director and the CEOs, but it is the board that makes decision,” he added, referring enquiries on the matter to the MPL.

Workplace disruption

Despite the stance being take by the ITF, MPL CEO Mahdi stressed that workers alleging to have been dismissed on political grounds were actually punished for creating “disruption” in the workplace.

He contended that the workers behind the allegations still had the options of taking their cases to the country’s employment tribunal to resolve any grievances that the company would then have to abide by.

Mahdi claimed that workers dismissed under previous MPL management in 2009 and 2010 had under similar circumstances been reinstated under his stewardship, as well as receiving compensation.

“These people who have been disciplined, they know a tribunal would not come out in their favour,” he said.

Mahdi also vehemently denied that he operated the MPL in a politically motivated manner, adding that the company was run in a “very technical” manner that respected due process.

“I will challenge anybody who says we are politically motivated, I believe no one has a bigger right than anyone else,” he added.

Mahdi alleged that one of the dismissed workers who had gone onto make accusations about political motivation had come into his own office and shouted at him, adding that billions of companies allowed the world would discipline such actions by staff of a senior representative.

“This is work disruption, no one is allowed to break work regulations like this. Belittling and scolding me when I’m on the street in public is ok. But here in the work place they must show me respect,” he said. “I can understand that because of the lower education of some of these people that they don’t understand this.”

Mahdi said that in the present time, the entire country had become deeply politicised even seemingly down to a person’s choice of branded bottled water.

However, he rejected accusations the MPL management were politically motivated in their roles.

Mahdi accepted that with the change of government in February, top positions within state owned companies had changed, though this was the nature of political positions under each successive government and would continue to remain so.

“These are not dismissals,” he said.

“Fabricate the truth”

Earlier this year, sacked MPL employee and President of the MPWU, Ibrahim Khaleel, alleged that the MPL was trying to “fabricate the truth” about the violations of worker rights.

In a letter on July 12 to MPL CEO Mahdi Imad, Chairperson of the MPWU Ibrahim Khaleel said: “Although the constitution guarantees freedom of expression and freedom of assembly, it is now common within MPL to stop employees from expressing certain political views, and violate the Employment Act by unfairly dismissing employees and transferring employees to different departments without prior warning or explanation of any offence committed.”

Speaking to Minivan News, Khaleel said the company mainly targeted employees who supported the ousted Maldivian Democratic Party (MDP).

“They send people with cameras to MDP protests to check which MPL employees take part in the protests,” Khaleel said.

In addition to the four employees who have been dismissed at the time, 30 had intially been suspended and 10 have been transferred from their position at the Malé port to Thilafushi Island port, Khaleel claimed.

Global trade union claims President’s Office still failing to address port workers’ rights abuses

The International Transport Workers’ Federation (ITF) has accused President Mohamed Waheed Hassan of failing to respond to ongoing concerns it has over certain rights violations of workers employed at the state-owned Maldives Ports Limited.

A spokesperson for the ITF, a global trade union representing 4.5 million transport workers across 154 countries, said it expected to send a third official letter this week to President Waheed after it had not received a response from his office on two previous occasions.

In the last letter sent to the President’s Office on October 29, ITF General Secretary David Cockroft raised concerns over what he claimed was a “dire” situation facing members of the Maldives Port Workers Union (MPWU)  employed by the Maldives Ports Limited (MPL).

Some former port workers employed by the MPL have claimed they have been victimised at the work place for taking part in anti-government protests.

The MPL has previously stated that it has only ever exercised its right to discipline staff when “in breach of their employment contract”, adding that it had never deviated “from any Maldivian government regulation” in the way it operates.

However, Cockroft claimed that MPWU members appeared to be having their rights to freedom of association and to organise within a trade union movement attacked by the MPL on the basis of their political beliefs.

“Further to my letter of September 29, I am disappointed to have to write to you again as you have decided not to respond to my first letter,” he wrote to President Waheed at the time.

Cockroft added that allegations of port workers being denied union rights was taken very seriously by the ITF.  He therefore requested that the president intervene to try and resolve the matter where possible.

“[I] call again upon you to use your office as President of the Republic of Maldives to instruct the chairman and management of the Maldives Port Limited to respect the country’s Constitution and Employment Laws and immediately halt their anti-union campaign against members of the MPWU and to enter into a real dialogue and conciliation process with MPWU which will result in a negotiated settlement which addresses the legitimate grievances of members of the Maldives Port Workers Union,” Cockroft wrote.

Speaking today, President’s Office Spokesperson Abbas Adil Riza said he would need to confirm if any letters from the ITF had been received. Minivan News was still awaiting confirmation from the President’s Office at the time of press.

Meanwhile, Deputy CEO of the MPL Ahmed Faiz requested that Minivan News meet him at his office tomorrow instead to address the concerns raised by groups such as the ITF.

MPL Media Coordinator Ibrahim Rilwan at the time confirmed the suspensions, but said he did not know the specifics regarding the case. The code of conduct does not prohibit participation in political activities, but staff can be disciplined if they transgress good behavioural norms, he added.

However, some staff at the MPL alleged that the senior officials of the state corporation had warned employees to not to participate in protests, and that action would be taken by those who do.

In a document received by Minivan News, MPL Chairman Abdul Matheen Ahmed allegedly responded to queries raised by ITF’s Asia Pacific Regional Office, stating that MPL was “extremely surprised” by the statements in a letter it had been sent by the group.

The letter addressed to ITF official Mahendra Sharma further stated that the MPL as “a corporate entity” exercises its “right to take disciplinary action against staff when they are in breach of their employment contract”, and said it had been the practice since the formation of the company.

MPL, in the letter, further claimed that it did not “deviate from any Maldivian government regulation” during the course of its action and “will not do so in the future”.
“Hence we are quite surprised on this issue you are talking about. Please make this clearer to us. As to the events you have stated in the letter, we are sure it has not taken place in our company and nor is our human resource department aware of any such issues,” read the letter.

The letter also goes on to describe the MPWU as an “unfounded, illegal association”, attempting to defame the MPL.

MPL accused of creating fake ports worker union to dismiss employment rights violations

The Maldives Port Workers Union (MPWU) have accused Maldives Ports Limited (MPL) of forming a “paper union” to shove aside the alleged violation of employee rights by the state corporation.

Sacked MPL employee and President of MPWU, Ibrahim Khaleel, told Minivan News that his former employer was trying to “fabricate the truth” about the violations of rights of their employees.

The ‘Maldives National Port Workers Union’ was formed just five days after MPL received a letter from the Asia Pacific Regional Office of International Transport workers Federation (ITF), which had raised concerns over the alleged employment rights violations.

“[ITF] sent a letter raising concerns of the employment violations in MPL to its management. So what they did was instead of addressing the issues and concern, they formed a paper union, legally recognised it and made the Maldives Port Workers Union illegal,” Khaleel explained.

He further claimed that MPL had labeled the union – which is registered with the ITF and International Labour Organisation (ILO) – as a “political gang” working against the current government of President Mohamed Waheed Hassan.

“They are attempting to destroy the union by sacking its leaders, including myself, and suspending or taking action against those who raise their voice. This is unconstitutional,” Khaleel challenged. “The constitution ensures us the right to freedom of assembly, right to strike, and freedom of expression. They terminate our employment contract because we practised our constitutional rights.”

MPL Media Coordinator Ibrahim Rilwan did not respond at time of press.

Exchange of letters

In a document received by Minvan News, MPL Chairman Abdul Matheen Ahmed allegedly responded to ITF’s Asia Pacific Regional Office, stating that MPL was “extremely surprised” by the statements in ITF’s letter.

“Hence we are quite surprised on this issue you are talking about. Please make this clearer to us. As to the events you have stated in the letter, we are sure it has not taken place in our company and nor is our human resource department aware of any such issues,” read the letter.

The letter also goes on to describe the MPWU as an “unfounded, illegal association”, attempting to defame the MPL.

“Moreover let us bring to your notice, given the present political situation in Maldives’, many such unfounded, unauthorised illegal so-called associations and unions could be sending you such letters, to try and defame the government internationally.”

“It would be our humble request for your organisation not to get entangled in such unfounded allegations brought forward by politically’ motivated groups and gangs,” Abdul Matheen Ahmed wrote.

MPL requested the ITF communicate instead with the “Maldives National Port Workers Union (MNPWU)” -the ‘paper union’ Khaleel has alleged was created by the ports authority itself.

The MNPWU meanwhile dismissed all claims of the MPWU and said that no employment rights violations were taking place.

ITF General Secretary responds

Meanwhile, another letter received by Minivan News, which was sent by the General Secretary of ITF David Cockroft to President Waheed, described MPL’s actions as “an anti-union campaign” and raised concerns over “the systematic targeting” of the leaders of MPWU and its members by MPL.

The letter strongly rebutted the assertions made by the MPL Chairman that the ITF had not fully examined the facts surrounding the situation, and said it takes “serious cognisance” in situations where workers were “denied trade union rights, threatened and victimised” for conducting legitimate trade union activities.

“May I also draw your attention to the fact that the ILO warranted the MPWU complaint legitimate enough to write to the Maldives government concerning the issues which have been raised with it,” read the letter.

The letter also contested the MPL’s claim over the legitimacy of MPWU, where it stated: “The Maldives Port Workers Union is an officially registered trade union, having received its registration certificate from the Ministry of Home Affairs on 29th May 2011. It was also a member of the Maldives delegation to the ILO’s International Labour Conference held in June 2011,”

“On 29th August, the ITF Regional Secretary for Asia Pacific received a written response from Abdul Matheen Ahmed, the Chairman of Maldives Port Limited which incorrectly referred to a different union and which denies that the termination of employment of the MPWU’s President, an MPWU Executive Member and 6 MPWU members, the suspension of a further 49 MPWU members, and the reassignment of many other MPWU members to other ports has taken place,” read the letter.

The letter also raised doubts over the alleged ‘paper union’, the MNPWU, stating that it “appears to have been registered at the Ministry of Home Affairs five days after our Regional Secretary sent his correspondence to the Chairman raising the serious trade union rights violations within Maldives Port Limited”.

Cockroft, in the letter, further urged President Waheed to ensure that the Maldivian constitution and employment laws were fully respected and upheld by the MPL.

“I request that you use your office as President of the Republic of Maldives to instruct the Chairman and management of Maldives Port Limited to respect the country’s constitution and employment laws and immediately halt their anti-union campaign against members of the MPWU, and to enter into a real dialogue and conciliation process with MPWU which will result in a negotiated settlement which addresses the legitimate grievances of members of the MPWU.”

‘Maldives National Port Workers Union’

Speaking to Minivan News, a founding member of the new Maldives National Port Workers Union, Ibrahim Rasheed, said the union was registered last month and it was “very difficult” for him to comment on it because they were still working on the inaugural meeting and the elections of the union.

“Yes, we registered the union last month. But we still have to hold the inaugural meeting and the elections so it is very difficult to comment on the union or what we plan to do,” he said.

Asked why another union was formed when MPWU already existed, or if the union was formed because MPWU had failed to do its job, Rasheed simply said that it was not because MPWU was not upholding the rights of the employees but because “anybody can form a union.”

“It is not like that. You see, even in some islands there are more than one association, so like that what is wrong with having two or even five unions? That is why we thought of making another union,” he said.

Rasheed assured Minivan News that the MNPWU would provide more details about itself, and assured the publication it would be invited to cover the inaugural meeting.

However, Rasheed later called Minivan News back, referring it to another individual, stating that this person “would give more information” about the union.

“You should also call the number I gave. He is more active. You know, even if a couple forms a company, it would usually be the husband who would get more involved, so like that he is more involved in it than I am,” Rasheed said.

The phone number Rasheed provided was switched off when Minivan News called it.

Political motive

However some staff at MPL alleged that the senior officials of the state corporation had warned employees to not to participate in protests, and that action would be taken by those who do.

An employee who wished to remain anonymous said, at the time, that he too had been warned by his directors not to attend MDP protests. Furthermore, he added that he had not yet seen the company’s code of conduct.

“They do not share the code of conduct when they recruit you. I have not seen this, I don’t think anyone has. I don’t even know what it says,” he said.

“A lot of MPL staff are MDP supporters. So the senior staff send people to MDP protests to monitor and take pictures of who attends. The whole point of this is intimidation,” he alleged.

Last July, MPWU accused the MPL of violating employee rights, alleging the state-owned company had unfairly dismissed four employees due to their political activism.

In a letter sent on July 12 to MPL CEO Mahdi Imad, MPWU President Khaleel said: “Although the constitution guarantees freedom of expression and freedom of assembly, it is now common within MPL to stop employees from expressing certain political views, and violate the employment act by unfairly dismissing employees and transferring employees to different departments without prior warning or explanation of any offense committed.”

Following the concerns of MPWU, The World Federation of Trade Unions (WFTU) expressed concern over the allegation claiming “infringement of trade union rights and freedoms,” and called upon President Waheed to immediately terminate its “attack” on members and the leadership of the MPWU.

Meanwhile, last month a leaked audio of former Deputy CEO of MPL Ahmed Faiz discussing the hiring of individuals to loudly promote President Waheed in local cafes.

In the 15 minute audio, Faiz spoke in detail about his intention to hire his audience as government supporters, President Waheed’s reluctance to maintain ties with the Progressive Party of Maldives (PPM), an intention to “wipe [former President] Maumoon out of the political picture”, other problems arising in the current ‘unity’ government, his own influence within the State Trading Organisation (STO), and large amounts of money being illicitly obtained.

“What I’m saying is, this government is now appointing people to different posts and it’s getting structured in the manner we want. Now there are a lot of things that I can do. Material benefits can be gained, and lots of other things. Credit from STO (State Trading Organisation) worth millions of rufiya, that’s absolutely welcome,” he says in the alleged audio clip.

Faiz also stated his intention to gain wealth and money in the audio clip, saying no means would be spared.

“I will only be able to acquire money when the condition to getting more money is put in place. We’ll be able to get more money now than we have ever managed to get from this country all our lives. This is what I want. I want money too,”

Faiz is a member of President Dr Mohamed Waheed Hassan’s Gaumee Itthihaad Party (GIP), and was previously appointed by him as the Managing Director of the Maldives National Broadcasting Corporation (MNBC).

MPL sacks three over duty-high bags

Maldives Ports Limited (MPL) has sacked three employees who had smuggled out high-duty plastic bags from Male’s commercial harbour.

The black plastic bags in question were recently levied a 400 percent duty, to encourage carriers to opt for environmentally-friendly alternatives.

MPL CEO Hussein Hilmy was quoted as saying that the act was likely assisted by “outside help” who had made “offers” to the employees, and that MPL company would not tolerate corruption.

According to Haveeru, the three employees had tried to alter the settings on a computerised system which regulates port traffic.

Assistant Clearance Officers Mohamed Ahmed and Ahmed Afraad, and Assistant Data Processing Officer Ashiya Mohamed were dismissed from their posts, reports Haveeru.

Two individuals have been arrested over the matter.
