Privileges Bill will see Maldives MPs earning on par with Sweden

A comparison of Maldivian MPs salaries and allowances with those of MPs in other countries reveals that should the recently-passed MP Privilieges Bill be ratified, Maldivian MPs will earn thousands more than their counterparts in many developed countries.

The comparative list, currently being circulated by protesters on the ‘Majlis Membarunge Musaara Bodu kurumaa Dhekolhah’ Facebook group lobbying against the recently-passed MP Privileges Bill, notes that Majlis MPs have voted themselves a total monthly salary increase from US$4863 to US$7083 (including base salary and allowances of $US1667), despite the country having a crippling budget deficit of over US$370 million.

According to the comparison, also available as an interactive graph, an Indian MP earns US$5966 per month, a French MP US$6651 and an Italian MP US$6936.

In fact if the bill were ratified in its current state, a Maldivian MP would earn just US$215 a month less than MPs in Sweden, one of the world’s most highly developed economies and ranked ninth in the United Nations’ Human Development Index. The Maldives ranked 86th.

Ahmed Adheeb, a local financial consultant in the private sector, observed that MPs were seeking to raise their salaries and allowances at a time when the country was in a “very critical economic situation”, and under pressure from the International Monetary Fund (IMF) to drastically cut the wage bill for civil servants and independent institutions.

“I hope the President does not ratify it, for the sake of the country,” he said, suggesting that neither parliament or the independent institutions had performed to a standard befitting a substantial pay increase in a climate of economic catastrophe.

“Parliament and independent institutions are trying to give themselves increased pay and benefits without justifying what the country is getting in return – for instance, the Anti-Corruption Commission (ACC) has not concluded a case since 2008,” he observed.

“We haven’t had an Auditor General appointed for over a year. Banks are investing in T-bills and bonds because they feel they are more secure, and so they are giving loans to the private sector. The Maldive Monetary Authority (MMA)’s foreign exchange reserve is falling. Everyone, including the IMF, has agreed we are in bad shape.”

While the deficit had improved to 16 percent of GDP, this was in part due to several “once-off” income events such as the US$78 million upfront payment from Indian infrastructure giant GMR.

“I think people need to realise how bad the situation is – very few people are talking about the economy,” Adheeb said.

DRP MP Rozaina Adam, who voted in favour of the MP Privileges Bill, said the party had a whip line “and most MPs wanted to pass it”.

“It’s unfortunate that parliament has to decide its own salary,” she noted. “Ministers don’t decide their own salaries, we do it. On the other hand, it is written in the constitution that we determine our own.”

Rozaina explained that the figure of Rf 62,500 (US$4883) commonly given as the MPs salary “is not our full salary – it includes our living allowances, phone bills, secretariat, travel.”

It was also important to note, she said, that in the Maldives an MP’s salary “is also seen as a welfare fund by many people. If anything goes wrong, constituents go to their MPs. It has been like this for a long time now, and I feel we need to move out of it – these are things that are supposed to be done by the government, but it has been a tradition for a long time to ask MPs. When someone comes and says their nine year-old needs a kidney transplant, it is hard to say no. In the long term, this means that only rich people can be MPs.”

Nonetheless, Rozaina said, protests outside parliament over the MP’s salary increases “don’t really reflect what the public is thinking. Most of [the protesters] were MDP supporters. I think the government is very unpopular at the moment, and because of that the President is trying to degrade the work of parliament. and the government is doing its best to make people think parliament is not doing enough. After the bill was passed I travelled to Haa Alif and Haa Dhaal Atolls and nobody was talking about it there, and there were no protests.”

Adheeb suggested that because of the penchant in parliament and independent institutions for members to approve themselves salary increases, “I propose an independent commission to structure the pay scale, linked to the economy and bench-marked against the private sector – because it is the private sector that generates the income for the government.”

The country’s fledgling democracy, he said, was proving too expensive for the economy to sustain.

“The Constitution cannot be financed like this. When democracy first arrived in the US, people gave their own time to work in the Senate,” he noted.

Further taxing the private sector to fund a bloated state wage bill, he said, such as with the recently-passed Business Profit Tax, could not be done without improving confidence in the private sector.

“We have not had a direct tax on businesses before, instead we have had duties and a high import tax, relative to other countries, and businesses have passed the tax on to the public. Businesses prefer direct taxes, because it is a tax after profit rather than a tax on imports during operations. But my concern is not so much increased taxes, but whether the money that is being collected is being invested in good purposes.”

None of the three arms of state, or any of the independent institutions, were really concerned with the economy, Adheeb said, “just their own policies and agendas.”

“Parliament has passed a budget with a huge deficit, but if you see any of their statements, they say they are worried about the economy. Yet now they are increasing their benefits.”

“If I keep silent, I have become a traitor”: Velezinee vows to continue campaign against “silent coup”

The President’s Member on the Judicial Services Commission (JSC) and outspoken whistleblower Aishath Velezinee has vowed to continue pushing for a public inquiry into the activities of the JSC, despite what she has described as an “assassination attempt” on Monday January 3.

Velezinee was hospitalised after she was stabbed three times in the back, in broad daylight on the main tourist street of Male’, “right outside the Home Minister’s door.”

Many international organisations, including Transparency International and the International Commission of Jurists (ICJ), have expressed “grave concern that the attack may be politically motivated.”

Velezinee turned whistle-blower on the JSC in August 2010, after parliament failed to issue an injunction she had requested on the reappointment of judges before the conclusion of the constitutional interim period. Velezinee contends the reappointment of unsuitable judges – many largely uneducated and some with criminal convictions – was rushed through in collaboration with senior members of parliament.

Since then she has campaigned against what she alleges is a “silent coup”, an “alliance between parliament and the judiciary to subvert the rule of law, derail constitutional democracy and use the courts to bring down the executive.”

“I didn’t stop complaining. I realised this was a bigger thing, a conspiracy, and mentioned names. They were not interested in change – they are using all their powers, their status and the respect people have for them to subvert the rule of law.”

The public, she claims, is poorly informed on the matter as “there is a huge information gap because the JSC meetings are closed. If the JSC sittings were open to the media, the public would be able to put together what has happened.”

“I sit in the JSC and I see the Speaker of Parliament (Abdulla Shahid) and DRP MP (Dr Afrasheem Ali), also members of the Commission, do whatever they will. What is done in the JSC is done by parliament.”

For example, she explained on the last day of the final parliament session for 2010, the opposition-majority Majlis amended the Judges’ Act (13/2010) to award a Rf 53,250 (US$4140) monthly retirement package to former JSC Vice Chair and Interim-Supreme Court Justice Mujthaz Fahmy, despite a conviction for embezzling state funds in 1996.

“It was not an honourable discharge, he was not fit to be a judge. But they made an amendment to the judges bill solely for one man – only Mujthaz it applies to, and only Mujthaz it will apply to,” Velezinee explained.

MP Afrasheem observed at the time that judges are awarded high salaries and benefits to ensure their ethical and disciplinary standards, and that it is essential for them to continue to be able to uphold their dignity and impeccable ethical standards even after they leave office.

“If a retired Justice were forced to wheel a cart on the street after leaving the bench, it will not give them the respect and the love that they received in office, and still deserve,” Afrasheem said.

The entire amendment, Velezinee alleges, was “to pay Mujthaz his dues for his role as an instrument in the silent coup.”

Meanwhile the public, she stated, “ is misinformed as to the reality of the judiciary they have. We have high state officials using their status and their authority to confuse the public, and legitimise that which is unconstitutional.

“The public are helpless when it is the state that has dissented. We Maldivians have been taught to obey. Obedience is the priority – our religion is about obedience. It is a completely different culture for us to stand up for ourselves and demand things of our leaders.”

Lead-up

Days prior to being stabbed in the street, Velezinee had been trying to get the Majlis to distribute a 34-page letter to members of the JSC’s parliamentary oversight committee, without apparent success. On January 2, she delivered 250 posters to citizens around Male’, calling for a public inquiry into the JSC.

“The Constitution grants everyone a free and fair trial, but JSC’s treason has deprived the people of not only a right to a free and fair trial but thereby compromised all other fundamental rights,” she wrote on her website, the day before her stabbing. “The State can neither protect fundamental rights of the people, nor further human rights and practice democratic government without the institutionalisation of an Independent judiciary.”

The attack

At 10am on the morning of January 3, Velezinee was walking along the main tourist street of Chandhanee Magu near Islanker school, “when I felt this knock on my back.”

“I thought I had been bumped, I didn’t realise I had been stabbed,” she said. “When I looked back I made eye contact with a guy as he was turning around. So I kept walking and then he turned back and stabbed me a second and third time.”

Her assailant, whom she described as “a young kid, a teenager”, jumped on the back of a waiting motorbike driven by another and rode off.

“At that point I put my hand up and it was completely soaked in blood, and I realised I had been stabbed. If I had fallen I would have been dead, the second two stabs would have finished me off, as would the first if their aim had been correct. But I’m light and my bag got in the way. I think it was meant to be assassination attempt or else hit my spine and make me a vegetable for the rest of my life.”

While still upright she was, however, “bleeding everywhere. I was soaked through.”

“My fear was that I would easily I bleed to death. But I took a deep breath and realised I was alive. As soon as I realised this, the only thing I wanted to do was go and get the blood stopped and get to the Commission because this was the day of the High Court appointments, and I know they wanted me out of the way. I didn’t realise how serious the wounds were, I didn’t see them until two days later when I went for a dressing change.”

“I tried calling 119, it took four attempts to get through, I told them I was stabbed. Nobody stopped to help me, so I saw a neighbour from my childhood and didn’t give him a chance to say no and jumped on the back of his motorbike and said ‘take me to IGMH (Indira Gandhi Memorial Hospital), I’ve been stabbed.”

“He took me round the corner to his home, where he could get a vehicle. At that point another man stopped and said “no, you can’t wait if you’re bleeding like that, get on my bike.”

“I got on the bike without thinking and then wondered, ‘who are you?’ He was really good, screaming at traffic to get out of the way, but I was bleeding very heavily. I had to hold on and he was afraid I would faint – it was dangerous on a motorbike.

“He came to Majeedhee Magu. He tried to get a taxi to respond, but I saw a police car and they took me to hospital.”

On the agenda at 2:30pm that day at the JSC was the decision over which applicants would qualify for appointment as High Court judges.

“It was very suspicious the way the Commission acted [after the stabbing],” Velezinee said.

“Not a single Commission member called or came to the hospital or made any effort to see how I was. Instead they hurried to organise an extraordinary meeting to discuss the assault, and then decided to hold a press conference – all of this without checking on me – and as I understand it, it was suggested by the Speaker of Parliament that the Chair of the Commission, who’ve I’ve previously alleged is suffering from a psychiatric disorder, be nominated to give a press conference.

“At the press conference they made very strange statements. They said that ‘Nobody should be attacked for having different opinions, or the way they express their different opinions’.

“The commission did not show me any respect, because after that press conference they organised a meeting on Tuesday to decide on the High Court judges. The Commission had previously agreed not to meet on Tuesdays because Tuesday is cabinet day.

“So I requested Commission members talk with the chair and make him postpone the meeting. The Speaker was leaving the country that night – I asked the Secretary General to speak with the Chair and delay the meeting until Wednesday, but the response I got was that they could not delay the meeting because it was ‘the right of the people to have the High Court’.

“I put out a rude statement accusing the Commission of trying to expedite things while I was incapacitated, and that persuaded them to cancel the meeting. But they did not say they were doing so out of concern for my wellbeing – instead they told the media that the meeting was postponed “because some members are busy.”

Still busy

Velezinee says she does not believe last week’s attempt on her life will be the last.

“I don’t believe the State can actually protect me. Because it is the state that wants me silenced – the parliament and the judiciary. If you look at what happened in the days before the attack, there was a flurry of attacks in the media – including by the parliamentary oversight committee – criticising me, my character and my performance in the JSC. This has been a very organised effort to discredit me, and some people speak in different voices.

“There are honourable men in this country who are owned by others, and they may be put in a position where they believe they have to take my life. I knew there was a chance that I was risking murder, and I wasn’t wrong. It was only because of God’s grace that I survived.”

The police, she said, had been “very effective” in their investigation so far. However police spokesperson Sub-Inspector Ahmed Shiyam said that it was “very difficult” for police to release an update on the case, as it was “complicated”.

Police were, he said, collecting evidence and would release an update to the media “as soon as it is available.”

As to whether the attacks would dissuade her from continuing to campaign against the “derailment of democracy” by parliament and the judiciary, “if I close my eyes, I will have betrayed my country and people,” Velezinee said.

“I will have betrayed them by failing to inform people and give them a chance to change this. When the State fails it is up to the citizens to hold the State accountable. The state has failed here, and as a state official it is my responsibility to inform the public and give them the chance to make an informed decision.

“I know for a fact that rule of law has been subverted. I know for a fact that there is corruption at the highest level in parliament. And I know that if I join the majority in keeping silent, I have become a traitor.”

Divide or unify: Gayoom’s return to politics raises election stakes

The return to politics of former President Maumoon Abdul Gayoom following his retirement in February last year could unify the opposition or deepen the growing factional split between the two parties, observers have suggested.

The former President returned to the Maldives to campaign on behalf of the opposition Dhivehi Rayithunge Party (DRP), of which he remains the ‘Honorary Leader’.

In a speech on Thursday evening at Kalaafaanu School in Male’, Gayoom did not show overt support of either the faction led by dismissed Deputy Leader Umar Naseer, or that of current party leader Ahmed Thasmeen Ali whom he endorsed on his retirement.

Conflict between the two factions came to a head in mid-December when a party rally descended into a factional brawl after supporters of the dismissed Naseer gatecrashed the venue.

In his speech Gayoom urged unity, quoting from the Quran and emphasing that “we should work to reduce the disputes among us.”

“I am saying this in my capacity as the Supreme Leader of DRP, as a father of all you members and as an elderly person,” local newspaper Haveeru reported the former President as saying.

He expressed concern that rival parties would exploit the opportunity to divide the opposition ahead of the elections, and said the DRP needed to win in order to protect both the country’s Arab-Islamic heritage and national assets – a clear criticism of the government’s decision to allow Indian infrastructure giant GMR to take over the management and development of Male’ International Airport.

“We should utilise the resources bestowed on us by God Almighty. The rich natural resources we have are for our children, the future generations and for us. That should not be given to foreigners,” Haveeru reported Gayoom as saying.

Despite the call for unity and his prior public endorsement of Thasmeen, Gayoom appears to be hitting the campaign trail with dismissed Deputy Leader Umar Naseer – whom the Elections Commission last week maintained had been formally removed from the party’s membership list despite the party’s “internal dispute”.

”The DRP office requested the commission remove his name from the party’s membership, saying that they have dismissed him,” said Elections Commissioner Fuad Thaufeeq. ”So we removed his name accordingly in respect to the party’s wishes.”

DRP MP Ahmed Mahlouf, himself a supporter of Naseer, told Minivan News today that while Gayoom “had invited everyone in the party to join his [campaign] trip, the others [Thasmeen’s faction] are travelling separately.”

“The target is the same – to win the local council elections,” Mahlouf said. “He definitely helped during the parliamentary campaign when he travelled to the islands, and he also campaigned for me. He is starting his first trip on Janurary 10, and islanders and candidates are looking forward to his visits.”

Political impact

The former President remains an enigmatic figure in Maldivian politics. The true extent of his popularity since the DRP’s win in the parliamentary elections over two years ago is unclear, given the absence of independent and impartial political polling in the country. The MDP contends that its infrastructure and development projects have won over many islanders, but many Maldivians – and certainly Thasmeen – still live in the shadow of their ‘Honorary Leader’ of 30 years, and responsibility for the many teething problems of the new democracy have landed at the MDP’s feet.

Certainly, news of Gayoom’s return to Male’ prompted thousands of supporters to appear at the jetty on December 31 holding posters of the former president.

The ruling Maldivian Democratic Party (MDP), Mahlouf suggested, was scared of Gayoom and the loyalty he inspired in the party faithful.

“Gayoom is the only person with popular support, and that was clearly seen in the parliamentary election. [The MDP] are scared he will run in 2013, but that will be the decision of other people. He is the right person for an election in 2011, if it were held,” Mahlouf said.

Gayoom had not said whether he would run for 2013, Mahlouf added, and had only said he would talk about the 2011 local council elections.

“But if he fit enough to run, he is the right person to change things again, and stabilise the economy,” Mahlouf suggested. “Maybe not the full five year term, maybe 2-3 years and then hand the leadership to his Vice-President. This is just my speculation, nothing has been decided – I think it should be decided at a DRP primary.”

He acknowledged that while Gayoom had publicly endorsed Thasmeen as leader in February, “I’m not sure whether he supports him anymore, or feels that [Thasmeen] is the right candidate for 2013.”

The split has put the party’s coalition agreement with the People’s Alliance (PA) under strain, with growing tension between Thasmeen’s faction and PA leader Abdulla Yameen potentially threatening the opposition’s parliamentary majority.

Mahlouf acknowledged that “the fighting is getting hot”, but said the party had resolved not to discuss internal politics with the media before the conclusion of the local council elections.

“I know Yameen is also very concerned about what the government is doing, and will only tolerate things to a certain point. There are things that need to be corrected on both sides, and we need to sit down and resolve them.”

MDP Chairperson Mariya Ahmed Didi said the former President’s return to politics “gels us together – those who believed and came out against his dictatorial regime.”

Furthermore, she suggested, it had allowed “aspiring leaders in DRP and those affiliated to DRP to see Gayoom for what he really is – concerned only about his self interest and trying to set up a dynasty.”

Thasmeen and DRP party spokesman Ibrahim Shareef had not responded to Minivan News at time of press.

Motivation

Concern over the former President’s impact on Maldivian politics reached right to the top: in the final days of 2010, President Mohamed Nasheed publicly warned Gayoom that returning to the campaign trail would not be wise and raised concerns over his safety.

“Sometimes when former presidents leave the country and then return to the Maldives, a very regrettable fate has occurred,” Nasheed said. ”I am concerned that something very regrettable is about to happen in Male’.”

”If Gayoom is returning to politics then he is messing with the feelings of the citizens that could cause them to confront and return to their history, and it is very possible that a regrettable consequence may occur,” Nasheed said. ”Do not mess with the feelings of the citizens of the Maldives, because when they are shaken, not even I can curb the pressure.”

Rumours of a previous back-room truce between the two leaders over the pursuit of corruption and human rights allegations against the former President in return for his retirement from public life appeared to be on shaky ground following Nasheed’s high profile support of elderly historian Ahmed Shafeeq during the launch of Shafeeq’s book in October 2010.

In his book, Shafeeq alleged that 111 people died in custody under the former administration and that he himself had been arrested and his diaries destroyed. Nasheed promised that police would investigate and revealed that human bones discovered in the former Gaamaadhoo prison matched the age and estimated period of death of Abdulla Anees, Vaavu Keyodhoo Bashigasdhosuge, an inmate officially declared missing in the 1980s.

Nasheed’s public support of the book prompted Gayoom to write to the British Prime Minister David Cameron, appealing for pressure to be placed on President Mohamed Nasheed following “the escalation of attempts to harass and intimidate me and my family.”

The matter, he told the British PM, involved “unsubstantiated allegations by an elderly man by the name of Ahmed Shafeeq that I had, during my tenure as President, ordered the murder of 111 dissidents.”

“In a book authored by this Shafeeq, which was ceremoniously released [on October 10] by Mohamed Nasheed himself, it is accused that I also ordered the man’s arrest and supposed torture in prison. In a country of just over 300,000, it is safe to assume that even one ‘missing person’ would not go unnoticed, let alone 111.”

Nasheed’s government had “escalated its attempts to harass me” in the run up to the local council elections, Gayoom wrote, despite his retirement from politics.

“After the government’s defeat in last year’s parliamentary elections, the popularity ratings of the ruling MDP have fallen further in recent months as a result of the government’s failure to deliver on its campaign promises, and its lack of respect for the law.”

“On the other hand,” Gayoom told the British PM, “I continue to enjoy the strong support, love and affection of the people, and have been voted by the public as ‘Personality of the Year’ in both years since stepping down from the presidency.”

India and Maldives conduct joint surveillance operation

India and the Maldives have begun an operation to conduct surveillance of the Maldives’ Exclusive Economic Zone (EEZ), using Maldives National Defence Force (MNDF) coastguard vessels and Indian navy aircraft.

The joint surveillance operation comes after several boatloads of Somali castaways were rescued in the Maldives last year. One of the dinghies contained a spent bullet shell.

No suspicious activities have been detected since the launch of the operation on Thursday, the MNDF said.

UN “ignored Maldives’ vulnerability” in decision to graduate country, Ambassador tells WTO

The Maldives has appealed to the World Trade Organisation (WTO) to soften the impact of the country’s graduation from Least Developed Country (LDC) to middle income status.

The Maldives will graduate on January 1, 2011, and lose access to both concessional credit, certain trade concessions, and some of the foreign aid upon which aspects of the country – such as civil society – have historically depended on for both skills and financial support.

The country’s Permanent Representative to the WTO, Iruthisham Adam, told the organisation’s general council that while the Maldives welcome the graduation as a “positive
step in the country’s development”, the country would nonetheless “continue to require special treatment and support from international partners.”

The Maldives ,said Ambassador Adam, remained ”acutely vulnerable at economic, commercial and environmental levels” and would therefore require “certain flexibilities”, particularly in regards to trade.

The UN had “ignored the issue of vulnerability” in its decision to graduate the Maldives from the list of LDC countries “on the basis of its strong socio-economic development over recent decades.”

She noted that the Maldives will be the first member of the WTO to graduate and suffer the deprivations attached to loss of LDC trade concessions.

A World Bank Economic Update Report released last month showed a per capita Gross Net Income (GNI) for the country of US$4090 for 2010, up from US$3690 last year.

However it noted that fiscal consolidation – reigning in the ballooning budget deficit with austerity measures and the introduction of taxation on business profits – “remains the foremost challenge in the coming years”.

“A less destructive political climate” will be needed to maintain recent positive developments, the World Bank cautions.

“Despite having posted better-than-expected fiscal results in the first half of the year, the country will be hard-pressed to sustain this in the medium term.”

Minivan News understands that the government will be announcing its plans later this week for mitigating the impact of the graduation.

State Minister for Finance Ahmed Assad has previously told Minivan News that while the government has included the graduation in its financial predictions, the Finance Ministry had banked on the Majlis passing the tax bill by June 2010.

“Some people say [the graduation] will increase borrowing capacity and give us more independence,” Assad said. “But like becoming an adult, it means taking on both freedom and responsibilities.”

An internal report by the World Bank, obtained by Minivan News in May, revealed that the doubling of spending on state salaries in 2007-09 crippled the country’s economy, and left the Maldives “facing the most challenging macroeconomic situation of any democratic transitions that has occurred since 1956.”

One of the Maldives’ most successful female badminton players is battling the country’s Badminton Association in court claiming she was dismissed for unspecified disciplinary reasons.

Neela Ahmed Najeeb, formerly the only female badminton player on the national team, holds a string of championship medals and several international competitions to her credit. Najeeb said that her abilities meant she could play against men during training sessions “and even beat a few of the good players, enough to compete with them.”

She claims the Association has sought to obstruct her from playing the sport ever since it sent her home from a competition in Sri Lanka in 2006 for allegedly smoking a cigarette.

In May last year, the 25 year-old was suspended from the Association altogether after clashing with her Indonesian coach, whom she alleged attempted to make her run for four hours in punishment for missing a training session – half an hour short of the average marathon.

“I had just started training again and I was not even physically fit,” she says. “I missed practice one morning and the coach told me to run for two hours, but I couldn’t do it – I’ve been in the national team for eight years and we’ve never had to do anything like that before. I ran for 30-45 minutes but I could not run anymore.”

The coach, she said, “didn’t like it, and said I could not join the training unless I ran for another 1.5 hours. I didn’t make it a problem.”

However, Najeeb said that, “a few days later, I missed another training session because of my work, and the next day [the coach] asked me to run for two hours again. I could only do 30-40 minutes, and he said that because I had only run 30-40 minutes the last time, I now had to run three hours.”

Najeeb says she took the matter to the Badminton Association, explaining she did not feel she was capable of running the three hours and was afraid of injuring herself early in the training. But she claimed they sided with the coach, “reasoning that he had a degree in Physical Education.”

“The last time I went to training I said I would run 30-40 minutes, but he said no, now I had to run for four hours.”

“I couldn’t believe it. I told him that was impossible. He became angry and said I was useless, and some things that really hurt me. He asked me to leave the stadium, and made a complaint about my behaviour, and filed a disciplinary case,” Najeeb says.

The next day, according to Najeeb, the Badminton Association sent her a letter saying she was terminated from the national team.

“They didn’t even talk to me. If they are going to fire a player from the national team, they have to give me a chance to appeal. They didn’t do that. I don’t want to be against them, they should be advising me.”

Najeeb had been selected to travel to Greece on June 10 last year for a youth training session by the International Olympic Committee.

However, athletes attending the training required the backing of their local association – and Najeeb claims the national chairman “said he was not going to give it.”

Instead, Najeeb said she was informed her application was invalid following the disciplinary report filed by a coach four years ago for the alleged smoking of a cigarette while attending the Sri Lankan tournament in 2006. “Which,” she added, “was not true.”

“I think this must be personal – this is not what you do to an athlete. You don’t just terminate them,” Najeeb claimed.

“I think Maldivian players deserve better. If you have a problem with a coach, [sporting associations] are supposed to advise you – but the Badminton Association takes everything personally.”

President of the Badminton Association, Ali Amir, told Minivan News that he was unable to comment on Najeeb’s disciplinary action as the case was pending in court, but did confirm that the Association was defending the case.

A senior badminton player Minivan News spoke to, who requested anonymity, said he felt it was unfair that Najeeb had been obstructed from practising for 4-5 years.

“She was not supposed to smoke [while attending the Sri Lankan tournament in 2006], and she did smoke, and was sent back to Male’. We have to sign an agreement [with the Badminton Association], but there was nothing in it saying that if we smoke we are sent back to Male’.”

“After that she was unable to play on the national team for two years. Eventually she was allowed a new coach, but then she was suspended again in May last year.”

“It’s a big loss for her,” he added, speculating that “there is something going on between [Najeeb] and the Badminton Association. I have no idea what.”

“She can’t even play alone – if anyone from the Association sees her in the stadium, they call the guards to take her out. The Association is doing this, not the players.”

The new coach’s running regime was “very ruthless”, he claimed. “If we do not come to the morning session we have to run 1-2 hours that night and lose time training. It’s useless.”

Najeeb said she “will not quit playing a sport I love”, but confirmed that she has been escorted from the stadium “because I don’t have an association membership card. It is really frustrating.”

Najeeb and the lawyer representing her in the case, Mizna Shareef of Shah, Hussein & Co, allege that her suspension contradicts the termination procedure of the Constitution of the Badminton Association as she was not given a chance to defend herself.

“The Association unfairly and quite harshly terminated Neela without establishing adequate cause and without giving Neela the opportunity to defend herself,” Shareef told Minivan News. She added that outside the Association’s own regulations “there are no applicable laws covering this type of situation.”

The case was lodged in May this year but despite having three hearings, Shareef claimed “the Badminton Association has stalled the case by appearing in court without having prepared their statements.”

“The longer this case gets delayed, the longer Neela suffers without being served justice. At this point, there is no certainty as to when the case would end,” Shareef said.

“Neela,” she added, “has personally experienced gender discrimination where the Association has held a different set of disciplinary standards for its male players. If we are successful in getting a judgement in Neela’s favour, it would definitely encourage more woman players to play the sport at a professional level, without fear of discrimination and unfair treatment.”

Najeeb, for her part, describes the time she has been away from badminton as “one of the most difficult times in my life”, and that if she is allowed to continue playing on the national team, “I have faith I can achieve more for my country.”

“I resigned from my job to make the training sessions, but they just took their decision [to terminate me] without thinking. They are misusing their power. For me badminton is my life, and they’ve taken it away from me – twice.”

DRP celebration ends in factional brawl

A meeting of the opposition Dhivehi Rayyithunge Party (DRP) last night came to blows when Umar Naseer, the party’s Deputy Leader prior to his dismissal by the party’s disciplinary committee, and his supporters gatecrashed the venue.

The meeting was being held in celebration of last Thursday’s Supreme Court ruling, which saw seven cabinet ministers departing their posts after their reappointments were disapproved by the opposition-majority parliament.

“We don’t really know what happened,” said Sub-Inspector Ahmed Shiyam, of last night’s incident at Ghiyasuddin International School.

“We know the Vice President of the DRP Umar Naseer tried to enter and there was some disturbance inside. People tried to attack each other but police intervened.”

Shiyam noted that while some people were claiming to have been injured in the fighting, “police haven’t received any official reports.”

“There was damage to chairs and a table,” he said, but added that police would not be following the matter “as no one has requested an investigation.”

Local media reported that a glass table in front of DRP Leader Ahmed Thasmeen Ali was smashed after supporters of Naseer forced their way into the venue while former Attorney General Azima Shukoor was speaking.

According to newspaper Haveeru, Shukoor called an end to the meeting and described the clash as a “dark and regretful” night in the party’s history.

Deputy Leader of the DRP and Spokesperson Ibrahim Shareef alleged today that Umar Naseer was attempting to attack and hurt Thasmeen during the meeting, which he said was attended by 3000 people.

“There were two stages – at first [Naseer’s] supporters came in; there were about 25-30 of them. 40-50 including his security detail,” Shareef said.

“There was uproar and both Thasmeen and the Speaker [Abdulla Shahid] were removed by their security detail.”

Naseer’s dismissal from the party was followed by an acrimonious war of words with Thasmeen and allegations that he and Shahid were bribed by GMR – allegations Shareef described as “totally fake”, and “ a dirty tactic to discredit the Speaker and the Party Leader.”

The dismissal of Naseer led DRP MP Ahmed Mahlouf to speculate last week that “there will be a split in the party for sure.”

“[Naseer] is someone with a lot of support in the party, and to date he has done a lot of work for us. He is very loyal to the former President, Maumoon Abdul Gayoom,” Mahlouf said.

Shareef alleged today that the main goal of Umar Naseer and his supporters was now “to dislodge Thasmeen from the leadership of the party.”

“They are urging people not to vote for the official DRP candidates in the local council elections, over SMS and telephone,” he said.

“They are doing everything they can to rebel, and hope to change the party’s constitution in the 2012 congress so they can elect their man to the leadership post.”

He acknowledged that the factional fighting could have a have “a negative impact on our election prospects [in the local council elections], but not that much.”

“”Thasmeen as a leader is cool-headed and wise, and does not use such populist tactics,” Shareef said.

“We know that some of the new government’s policies are not right, such as the airport concession for GMR. But at the same time we would not support a hijacking of the airport – we have to use legal means and not damage the nation’s economy. We will not use terror tactics.”

Shareef observed that Naseer were saying they had the backing of “the Honorary Leader” – former President Maumoon Abdul Gayoom.

“We don’t know how true that is,” Shareef said. “I don’t think it is in anyone’s interest – including that of the Honorary Leader – for us not to unite and win the election.”

Shareef said he had observed among Naseer’s supporters “many activists belonging to the coalition [People’s Alliance] party”, which is led by the former President’s brother in-law, Abdulla Yameen, and together gives the opposition its parliamentary majority.

Despite the coalition partnership, Yameen filed a civil court case against Thasmeen in February seeking repayment of debts, reported in local media to be around US$100,000.

“I don’t know how involved the coalition leadership is in this,” Shareef said, adding that he did not believe the present factional infighting would jeopardise the coalition or its parliamentary majority.

Rather, he said, “I think the dispute comes from a belief that we are not being aggressive enough, that there is not enough direct activism, and that therefore we are not fighting the government.”

“Our view is that if the government is doing something good for the nation, we will back them. We believe we have a role to help govern.”

Q&A: CEO of GMR Male’ International Airport, Andrew Harrison

Indian infrastructure giant GMR and Malaysia Airports Holdings Berhad (MAHB) have formally taken over the reins of Male’ International Airport, the beginning of an expansion project that includes the construction of a new airport terminal by 2014 and the refurbishment of the existing terminal in just 180 days.

Minivan News speaks to the CEO of GMR Male’ International Airport, Andrew Harrison, the man now in charge of making it happen.

JJ Robinson: What stage does the airport currently stand at following the official handover on November 25?

Andrew Harrison: The focus so far has been on engagement with employees, and bringing together various stakeholders. An airport is like a community, with customs, immigration, Maldives National Defence Force (MNDF), ground handling and all the other services involved. We want to ensure people work together as a community and recognise that each depends on the other to make sure the experience for the passenger best it can be.

The development aspect involves hard construction, but it is very important to look at development of the people – the greatest asset we have. If we develop our people they will look after our business.

JJ: How is the situation different now compared with when GMR first arrived?

AH: An initial challenge was that we had a ground handling company, MACL, and another company that did cleaning and inflight catering. We were not taking the catering but we were taking the cleaning. So you have three different companies with three different organisational cultures that now need to merge into one, and add the culture of GMR Airports.

People ask what apprehensions I had – I wondered how we were going to merge these organisational cultures together. That was the real challenge. Having said that, people responded very well. There were lots of issues where there were differences between those companies, so we had to work to iron out those differences,

JJ: What were an example of some of those differences?

AH: The amount of leave people received in the three companies was different, so we standardise that so one isn’t perceived as having more than another. There are obviously differences in pay scales as well, but that has to be addressed over a longer period of time.employees. to integrate and look at aspects skills, performance and reviews of 1513 employees takes a period of time.

JJ: You had a high success rate retaining employees to the new airport company?

AH: It was 100 percent. [Initially] we had a few people overseas on training and it took a bit longer to get the documentation to them. We had a process with the government of the Maldives and MACL. In the conditions for handover we had to demonstrate the implementation and success of the plan, and we had a daily report on how many people on the list passed to us accepted our offer and conditions. I’m pleased to say it was 100 percent.

In terms of people development we are now looking at training programmes. We are just about to send 25 fire and rescue staff to Malaysia for three and a half months of training.

I was interested in that training being not just an assignment, but something people will value and recognise and help to advance themselves. So I said we will invite the parents by surprise to go to the passing out parade of the two best students – best improvement and best overall student – so they can watch their sons be recognised for the distinction they have demonstrated in their learning. I think that is a way we are showing that we are going the extra mile.

In terms of development, the new terminal will be completed in late summer of 2014, and will be really designed to reflect the beauty of Maldives. The terminal will have large glass facades, and natural materials people are used to seeing in resorts, skylights to allow natural light in, and natural water bodies and water features surrounding terminal so you always have that feeling of being close to water. That’s one of the reasons people come to the Maldives.

As for the refurbishment of the existing terminal, we [have launched] a 180 day terminal improvement programme. In the concession agreement we are given one year to complete it, but we have decided to do it in six months.

In those six months we will look at improvements in processing capacity, such as baggage reclaim, capacity of the check-in counters, and centralised security screening – there are two at the moment. This will give passengers greater time in retail area and reduce queuing.

JJ: The GMR bid was particularly generous on the fuel revenue sharing with the government (27 percent from 2015), and less so with the sharing of airport revenue (10 percent from 2015). How will GMR justify such a low margin on fuel?

AH: Today in global airport development there is a balance between aeronautical revenue and non-aeronautical revenue. Aeronautical revenue includes typical revenue from aircraft landing and parking, direct charges to airlines and passenger fees.

But in these challenging times there is continuing pressure to reduce the burden of aeronautical charges. The development of the last few years has been an emphasis on non-aeronautical revenue, as the burden of fuel costs, and engineering costs has increased significantly.

We look at the non-aeronautical development as being part of the commercial arrangement, including the the utilisation adjacent land, conference facilities, hotels, things that actually compliment our services. Our strategy in the long term is a greater focus on these.

At same time, we will focus on the development of the economy as a whole. Because the airport is literally a gateway, an economic engine. It facilitates trade, travel and employment. Generations of Maldivians have worked at this airport and we see this as continuing.

We see ourselves as having a much wider remit – for example, today there is the resurgence of Sri Lanka. 10-12 years ago people booked a 14-day holiday, with 10 days in Sri Lanka, four days in Maldives. They would spend five days in Sri Lanka, come over to the Maldives for four days and go back for five.

When the Liberation Tigers of Tamil Eelam (LTTE) problems arose in Sri Lanka, people came to the Maldives because of the perception of increased security and reduced risk.

Now Sri Lanka has put the LTTE difficulties behind them, we now have the difficulty of the resurgence of Sri Lanka. Now we run the risk people going back to Sri Lanka because it cheaper – and you can do many things there that you can do in the Maldives. In my opinion it’s not as beautiful, and it’s not as exclusive, but not everyone wants to pay that [higher] price in the Maldives.

We are also looking at developing much better traffic between the Maldives and the United States. Today it is the most under-represented nationality in terms of visitors to the Maldives. We have airlines like Qatar Airways and Emirates so we know we have flight connectivity which will allow seamless transfer.

JJ: How do you convince a country like the US to fly to the Maldives instead of closer and more developed destinations such as the Caribbean and Bahamas?

AH: They will be other destinations the Maldives competes with – Hawaii for the US and the Canary Islands for the UK. Fiji to a much lesser extent, which serves Australia and New Zealand.

There is competition with Mauritius to far lower extent, because even though it is a far bigger island it doesn’t attract the number of visitors that the Maldives does.

Curiously, one of the reasons I discovered for this is because the temperature of the water is cooler so divers have to spend less time diving compared to here where our average water temperature is 26 degrees.

JJ: The fuel trade has historically been a key component of the airport’s income, will that continue?

AH: With the fuel trade today we have means of procuring and supplying fuel to the airlines. The airlines also have some of their own arrangements, because they take advantage of global purchasing deals, and companies that supply them in other countries also supply them here.

What we are doing is looking at the existing contracts, and simply reviewing how we can enhance consumer gets. Some airlines like greater term of credit, other airlines a term of time – we have to match various needs and at the same time remain a competitor in the region.

JJ: There have been concerns that such a high fuel share with will compress your own fuel revenue, which could involve passing on the cost and potentially make it more expensive for the airline.

AH: No, I think the strategy we recognise is that we have experience introducing efficiencies. MAHB has 39 airports, GMR has three airports. Between two of us we can leverage what we know and bring that advantage here, and that will make us more efficient.

Because what drives the price of fuel is the cost. If we become more efficient providing fuel we can manage the implications going forward. We have studied that very carefully so that it represents a very good deal for the people of the Maldives and us as business, and also the consumer, be they a passenger or airline.

JJ: How big a part of the airport’s revenue do you expect the fuel trade to be?

AH: It’s not an issue for us, to be honest. We have so many advantages through being able to help the government to influence amount traffic coming in, and in the airport. That doesn’t just mean duty free but food and beverage, transfer services – there are so many needs passengers have here because of the uniqueness of the way people arrive and depart from the Maldives.

The seaplane operation, for example, is an example of how we collaborate. In our original design for the terminal the arrivals section sat on top of the seaplane operation. We are now adjusting that because we recognise how important the seaplane operation is to the Maldives – 60 percent of arrivals are transferring to seaplanes.

What I’d like is that once you come out of arrivals after clearing customs, you have three choices: seaplane transfer, boat transfers to resorts, and passenger transfer to Male’. It is very straightforward and more importantly it is very efficient.

We see many opportunities with the non-aeronautical developments once we complete the terminal development. We have proposals in terms of developing the land area [around the airport],and that is where we see the opportunities.

JJ: What is your own background, and what do you bring to the operation?

AH: I have worked for GMR for five years and before that the TBI group in the UK, which ran 26 airports.I have worked 13 airports around the world.

I guess what I bring is an understanding of how an airport can be developed efficiently within a stakeholder environment, looking at needs of a country as a whole, where we are a facilitator of the economy while ensuring the development of leadership qualities in people so they can take over managing the airport.

In a period of five years, we would like this airport to be managed entirely by Maldivians. And some of those Maldivians will move onto our other projects. My real role is to mentor and lead our team here and develop them to go onto bigger and better things.

JJ: An airport is a complex operation – has it been hard to find skills such as qualified engineers?

AH: It has not been a challenge because Maldivians are very talent and very dynamic. They are very self-sufficient. I have guys here in engineering who are able to do virtually anything. It’s amazing, it’s a new skill, and I think to myself, ‘Wow, if we’d had people like this working in India those projects could have been done in half the time.’

We have a lot to learn from Maldivians here, but at the same time we have a lot to share with them.

We recognise that a lot of people have gained their skills through time spent in that department – that doesn’t mean they are in touch with current trends, products and processes that have changed over time to make things more efficient. We are also going to send people to other airports in our group, to give them exposure.

It’s not a matter of finding technological capacity – what we recognise is that we can enhance skills greatly with training and exposure to other airports.

JJ: What have been some of the key challenges here?

AH: There have been a few. I think one of the challenges has been perhaps the misunderstanding people have had – and that’s really changed – about what we are here to do.

There was an earlier misconception that we were going to put a thousand Indians on a boat and set sail for the Maldives and replace everybody here with Indians because it was cheaper labour and would be our preference. But clearly it is not. We are not doing that. Our manage structure at the leadership level is a combination of Maldivians and non-Maldivians. We will learn from them, and share what we have learned. Our challenge is to transfer knowledge to them and harness what they have learned so we can use them in our other airports.

Then the next time we bid for an island airport I’ll know exactly who to call on to take leadership roles in that airport, because I know guys who run a great island airport here.

The second misconception has been that we have come in here to increase all the rates.

JJ: Former Deputy Leader of the opposition Umar Naseer famously stated that the airport deal “will allow Israeli flights to stop over after bombing Arab countries.” How do you respond to such rhetoric?

AH: We look at it, and the information in the media at moment. I find here that people are intelligent and forward thinking, and they able to determine what is fact and fiction. We have full confidence in general public’s ability to discern that.

I think a challenge we faced was the notion that we were coming in and increasing charges. The CEO of the International Air Transport Association (IATA) has said their members prepared to pay increased charges, provided they see improvement in the airport in terms level or service and the development of airport. Clearly they will see that [in the Maldives].

Our mandate is to review the cost of providing services, determine what every stakeholder wants, and determine at what cost we can provide that.

We have airlines who have come to us and told us that the lounge is not what they expect, and that they would like to build their own lounge – three airlines have come forward to build their own lounge – but cant have everyone building their own lounge because we don’t have enough space for that. But what we can say is, ‘What do you require?’

For instance, only one airline currently has a first class service into Male’. All the rest have a business class and economy service, and sometimes premium economy. But the airlines are telling us that some of the passengers arriving on business class are in fact first class passengers, who have flown from London to their hub in first class, but then in business as a downgrade. To all intents they are a first class passenger with first class expectations, and as a result of that the kind of lounge the expect is not the kind they get.

We are working to determine that. But the person on the street may decide ‘You’ve come in here and built a new lounge and now you’re charging more money for it.’ But what they don’t see is the airlines requirement to actually have that facility, because the facility that is there does not meet the standards they expect it to.

These are some of the areas there are misconceptions that are not clear to the public and may be misconstrued.

JJ: On the subject of fact and fiction, I’m sure you’re following Maldivian politics with great interest – one of the current issues involves bribery allegations concerning GMR, denied by the Speaker of Parliament Abdulla Shahid and Leader of the Opposition Ahmed Thasmeen Ali, involving them travelling to Delhi on tickets purchased by GMR. Once and for all – has GMR had any contact with the Speaker of Parliament or the Leader of the Opposition?

AH: I think for the interests of clarity, we are extremely privileged to have this opportunity to manage the airport, and the GMR Group will at all times want to confine itself to that responsibility – and nothing else. Because that’s what we’re good at – we are no good at politics. And so we try to stay away from issues such as those.

What I can tell you is that any of the meetings and discussions that we have with anyone in government today have been open, well-known and available to the public. We go to public meetings, and we have other stakeholders present in these meetings. So for us, there is no question of anything occurring that would be shrouded in secrecy, or not known to the public.

Certainly I can tell you I have no knowledge of anything like that taking place. This seems to be something going on between people outside of GMR, although somehow we have appeared in the frame.

Those parties allegedly involved will be able to determine between themselves what is fact and what is fiction.

JJ: Former Deputy Opposition Leader Umar Naseer has claimed he has a letter from Sri Lankan Airlines confirming the authenticity of tickets purchased by a travel bookings company used by GMR, FCM Travel Solutions [shows ticket]. Has GMR flown these two individuals to Delhi?

AH: We don’t have a travel company, we use different travel service providers – we don’t use a defined company. I can’t comment on what Sri Lankan is saying because that information is privy to the airline that made the booking. Certainly anything we do is in the public domain. So if that were the case, it would be something publicly known and something people would be aware of.

This is something between the parties, the airline, and those who allegedly have been involved in purchasing whatever, and who are making the allegations. We honestly wouldn’t be able to comment on that. Because we have no knowledge of this, to be quite honest.

JJ: Have GMR made any efforts to determine the the source of the opposition to the airport, or the concerns of the coalition of parties opposed to it?

AH: No, because we have decided very clearly that our remit is to manage the airport, and we feel it is important to confine ourselves to this remit.

Otherwise it becomes very easy to confuse our mandate here and what people may perceive we are here to do. All of our attention is focused on the airport and demonstrating that we are an airport operator that will be responsible and respectful of the society and culture, and the laws of the Maldives.

As a result of that, I don’t think you would find us doing anything that goes beyond the boundaries of this airport, other than the relationships with those involved who have anything to do with the development of the airport.

JJ: This opposition coalition group have previously said they may take back the airport if elected, suggesting this could potentially become a campaign issue. Are you worried that a change of government could precede nationalisation spree?

AH: No, it’s not really a concern for us. Because quite frankly we are very pleased with the transparent process in which the bid was managed and assessed and awarded, and supervised by an independent body.

I think once people see the new airport, nobody is going to want to undo what has happened to it. We have staff who are motivated and engaged and telling us that this is an environment very different to the one in which they were working before, and they are very excited by these changes. And we have stakeholders who have welcomed the changes we have made until today.

Passengers coming through this airport haven’t been telling us that there is something they don’t like about how the airport is being managed. So our job is to manage the expectations of consumers and stakeholders to transform the airport into a much better experience. I think by doing that, we will address any concerns people outside the airport community have about us being suitable people to run the airport.

I would like to say that this airport belongs to the people of the Maldives, and nothing is going to change that. We may have financial responsibility for the airport, but physical ownership of the airport will always remain with the people of the Maldives.

What we are doing is continuing the evolution of the development off this airport from the volunteers who in the 1960s came to build it through sweat and toil into what it is today. This evolution continue, as will growth in tourism and trade. We are simply a guardian, a custodian of this national economic asset.

JJ: No concerns about sea level rise?

AH: No. When we became involved in the bid process we engaged three leading companies who are at the forefront of analysing geophysical activity, climate change and the impact rising sea levels.

What we can tell you today is that the risk of rising sea levels coming above the land is so low that it’s not even considered in the insurance premiums for the Maldives.

Insurers are notorious for considering even unimaginable risks, so I can tell you that if no insurance company considers this in any of their policies for the Maldives, we think that the risk is pretty low.

Speaker seeks legal advice after Acting Finance Minister presents 2011 budget

Speaker of Parliament Abdulla Shahid has told local media that he is seeking legal advice after Acting Finance Minister Mahmoud Razee presented the 2011 State Budget to parliament.

Finance Minister Ali Hashim resigned on Friday following the Supreme Court’s ruling that ministers rejected by parliament could no longer hold their positions. President Mohamed Nasheed appointed Economic Development Minister Mahmoud Razee as acting minister in Hashim’s stead.

Haveeru reported Shahid as saying the budget would not be debated on Monday as he was seeking legal advice on the matter. Shahid was not responding to calls at time of press.

“We need to find ways to carry out this task without disrupting the state,” Haveeru reported Shahid as saying, despite observing that Deputy Speaker of Parliament Ahmed Nazim had told the paper that Razee would be able to present the budget as he had been endorsed by parliament.

Independent MP Mohamed ‘Kutti’ Nasheed told Minivan News that he believed there had been a move towards tabling the budget during tomorrow’s session of parliament.

The text of the Constitution requires the “Minister of Finance” to submit the budget for approval “prior to the commencement of each financial year” – in the Maldives, the calendar year.

Nasheed said that this was a specific responsibility of the Finance Minister, and that the Constitution did not appear to allow for an acting or state minister to present the budget, however he noted that “there is cross-party support to get the budget moving. It is likely they would approve whomever the President nominates as Finance Minister.”

The Speaker had consulted him on the issue, Nasheed said, adding that he had suggested that irrespective of whether there was a finance minister, the budget had already been released into the public domain and there was nothing preventing parliament from starting an informal deliberation.

It was, he said, entirely normal for committee hearings to conduct informal discussions prior to obtaining quorum, such as when a member was late or absent, and then conduct the formal debate and speech once quorum was achieved.

“In view of the Supreme Court’s decision [on Thursday], an appointed minister is a de facto employee until approval by parliament, whereupon he ripens into a fully-fledged cabinet minister. The easiest way may be for the President to just appoint a Finance Minister.”

Nasheed added that he did not think the issue was critical, as if the budget was delayed parliament had the potential to pass an emergency budget to ensure the functioning of basic services in the interim, as it did when the new government took office.

Theoretically, Nasheed noted, there was nothing preventing the President from simply reappointing dismissed ministers in perpetuity, although he suggested that this would be “unproductive” and run against the “spirit of the constitution”.

The President today reappointed Dr Ahmed Ali Sawad as Attorney General (AG), following Sawad’s resignation on Friday.

The Supreme Court ruled on Thursday that cabinet members rejected by parliament could not remain in their posts. Sawad was among the members of cabinet not endorsed by the opposition majority parliament.

“There’s nothing in the rules, but this has to come to an end some time,” MP Nasheed said. “If disaappoved again, the Attorney General could be appointed a third time – the Constitution doesn’t go into such detail.”

Similarly, Nasheed added, the potential for repeated rejection of appointed ministers by a vindictive opposition “goes with the Presidential system of government that we have. It’s unlikely that a president [in the Maldives] will command a majority, and it’s the same situation faced by US President Barack Obama [with a Democrat executive and Republican Congress].”

During the original appointment of ministers, “the President did it very beautifully,” MP Nasheed said. “He proposed the names and sent them to parliament, and then they were appointed, which was the responsible way to proceed.”

The loss of seven ministers, Nasheed suggested, was an “extreme situation” and unlikely to reoccur.

“The results might have differed if the MDP had taken part in the vote,” Nasheed said. “They may have been able to salvage more [without the boycott]. To let go of seven cabinet ministers must have been a huge decision.”

Meanwhile, President Nasheed has ratified the First Amendment Bill to the Public Finance Act, following a ruling from the Supreme Court for early ratification of the bill.

In a statement on the President’s Office website, the President said the bill was ratified in compliance with the Supreme Court’s ruling “despite legal issues [that] would negatively affect government’s social protection system.”

The newly reappointed Attorney General has filed a case in the Supreme Court seeking a ruling of of several articles in the Act as contradicting the Constitution.
