“The JSC cannot form a court”: JSC Vice Chair Abdulla Didi grilled by Parliamentary Oversight Committee

The Vice Chair of the Judicial Services Commission (JSC), Criminal Court Judge Abdulla Didi, attended parliament’s Independent Committees Oversight Committee to answer its queries about the Hulhumale’ Magistrate Court and the appointment of the panel of judges hearing the Nasheed trial.

Abdulla Didi attended the committee despite the chair of the judicial watchdog, Adam Mohamed, disputing that the JSC was answerable to parliament on the grounds that the summons referred to an “ongoing case”.

Asked if he believed Adam Mohamed had acted legally in unilaterally deciding that the JSC would not abide by the oversight committee’s summons, Abdulla Didi responded that he “will not say that the Chair acted against the law,” and that he “cannot make any comments on the matter.”

“I personally believe that we must be answerable to the oversight committee. That is why I am here today,” he said.

Conflict of Interest

Before discussions on the scheduled topic began, Abdulla Didi requested that Maldivian Democratic Party (MDP) MP Ali Waheed leave the committee.

Didi said Ali Waheed currently had a case against him in the Criminal Court of which he the judge, and hence he believed there is a conflict of interest to have the MP question him during Thursday’s meeting.

“I wouldn’t have felt any hesitation if all the JSC members were here. But since I am being questioned separately, I don’t think it is a good idea to have someone who has a criminal case against him question me here,” Abdulla Didi said.

Ali Waheed said he believed he was not required to leave the committee as per the constitution, but was willing to do so as it was “ethically the right thing to do.”

Chair of the committee MDP MP Ahmed Sameer informed Abdulla Didi that Ali Waheed had previously informed the committee that he would not be asking any questions from the JSC member, and that he was only participating in the meeting due to the quorum requirements needed to have the meeting.

“Abdulla Didi is here as a JSC member, and not as a Criminal Court Judge. Likewise, it is the citizen Ali Waheed who has a pending case in the court, not the MP for Thohdoo constituency. As there is no conflict when viewed in the light of the capacities in which you both are participating in this meeting, I am of the opinion that MP Ali Waheed is legally allowed to stay and question you. I would like to state here that if Ali Waheed is leaving, it is only out of his personal accord,” Sameer stated.

Later in the meeting, Sameer referred to Ali Waheed’s voluntary exit from the meeting as an example of abstaining from action in cases of conflict of interest, and asked Abdulla Didi why he had not similarly abstained from voting on deciding the panel overseeing Nasheed’s case.

“You are a member of the JSC which voted on choosing judges for the Hulhumale’ Court panel of magistrates. You also serve as a judge in the Criminal Court. The case which this panel is to preside over concerns the Chief Judge of the court you serve under, Judge Abdulla Mohamed. Under these circumstances, why didn’t you abstain from the vote which decided upon magistrates for the Abdulla Mohamed case?” Sameer asked.

“I had no such intentions like what you are implying. The short answer to that question is that we did not decide on the panel to preside on an ‘Abdulla Mohamed case’. It disturbs me when you refer to the case as such,” Didi responded.

“It is a case regarding the arrest of Abdulla Mohamed, in which some other people are accused of having committed criminal acts. The case is about them, not Abdulla Mohamed,” he said, shaking his head.

Sameer also asked about alleged conflict of interest in the vote taken by the JSC to continue running the Hulhumale’ Magistrate Court itself.

“JSC Member Ahmed Rasheed, who is the husband of a Hulhumale’ Court Magistrate, was among the members who voted to establish or continue the said court, isn’t he? And you voted, too. This is extremely concerning, and so I repeat: the case concerns the detention of the Chief Judge of the Criminal Court by the then government. You are a judge serving in that court. Rasheed’s wife is a magistrate in the court trying this case. Do you think this decision is impartial under these circumstances?” Sameer asked.

Didi attempted to dodge the question, stating he was unaware how Rasheed had cast his vote. MP Sameer, however stated he had seen the related documents, and informed him that four members had voted, including Rasheed and Abdulla Didi.

Didi still insisted that he “found it difficult” to answer the question, or decide on the validity of the decision.

The Vice Chair of the judicial watchdog stated that as a norm, if a member felt that he had a conflict of interest in any matter that the commission was taking a vote on, he would state the reasons and excuse himself. He further stated that if a member failed to excuse himself, and yet JSC Chair Adam Mohamed believed such a conflict existed, the chair would then point it out and discuss with the relevant member an agreeable way to proceed.

MDP MP Hamid Abdul Ghafoor asked if any such issues had arisen during the vote taken to appoint magistrates to the Hulhumale’ Court panel.

“I cannot recall if any members declared any conflict of interest. Nor can I at all remember whether the Chair noticed such a conflict,” Abdulla Didi said.

The panel

Didi said that discussion about the panel of judges of the Hulhumale’ Magistrate Court initially began in the JSC after the then head of the court requested the commission assign judges from other courts to preside in a pending case at the Hulhumale’ Magistrate Court.

“Once this request came in, we discussed the matter and proposed names for the bench. We then sent these names to the Supreme Court bench, otherwise known as the Judicial Council, for comment. They decided on those names and sent it back to the JSC. This is how the process went,” Didi told the committee.

“This is also completely in line with what the laws state, I refer to Articles 47 to 49 of the Judges’ Act. I might be referring to the previous Judges’ Act. There were some amendments made to it later, which may have changed the order of these articles I quote. I am not sure, I haven’t reviewed it that much,” Abdulla Didi said.

Article 47 of the Judges’ Act states “If a judge is temporarily transferred to preside over a case in a different court, he must be transferred to a court of the same level as the one he is serving in.”

Article 48 states “A judge can be temporarily appointed to another court in the instance that the court is unable to sufficiently complete assigned work, or if the court had difficulties providing services, or if the judges serving in the court has been suspended from their duties, or if other circumstances which may cause a delay in the completion of work assigned to the court occur.”

Article 49 states “It is the Judicial Services Commission, with the counsel of the Judicial Council, which will come to a decision on the transfer of judges to oversee cases in other courts.”

After listening to Abdulla Didi’s version of events, Sameer presented the information previously gathered by the commission.

“The laws state that the JSC has no right to decided on the judges on a panel. Only the head magistrate of the relevant court has the powers to do so,” Sameer said.

“Now, the Chief Magistrate at this court at the time, Huraa Magistrate Moosa Naseem, sent in three names for the panel to JSC asking only for your commission’s comments. The list included his name as well. Can you then tell me what legal right the JSC has to disregard these three names and appoint three completely different magistrates?”

Abdulla Didi said in response: “We at the JSC considered the important cases pending at the Hulhumale’ Court. So we proposed other names with the intention of assigning qualified, experienced judges. I don’t believe this conflicts with any existing laws. What I am saying is, I did not come to any decision. It was after discussion with the other JSC members that we passed it through a vote.”

MDP MP Ahmed Abdulla asked the JSC member why, if the selection was based on merit and experience, the three magistrates proposed by the Hulhumale’ Court had been disregarded while all three were currently serving as chief magistrates of their respective courts.

“Let me explain. According to the Judge’s Act, no judge had the power to bring in judges from other courts to preside on cases. JSC considers the good magistrates in the atoll… That is not to imply that any magistrate is bad at their work, just that because of the nature of this case, we took special care to appoint the most able and appropriate judges who will treat the case with extra care and contemplate the matter deeply,” Abdulla said.

Didi insisted that the JSC that held legal powers to appoint magistrates to the panel, at which point the Chair of the parliamentary committee intervened and advised the judge to refrain from making misleading and non-factual statements.

“I am deeply disturbed that you are making these comments and passing it off ‘as what the law says’. The law says perfectly clearly outlines the role of the chief magistrate, and that if other magistrates are temporarily being brought into a court, they must be from the same judicial jurisdiction,” Sameer intervened.

Didi also claimed the JSC had appointed the panel after the Hulhumale’ Court requested additional magistrates to assist with their work.

However, member appointed from among the public to JSC Sheikh Shuaib Abdul Rahman, who had been interviewed by the committee prior to Abdulla Didi on Thursday, had stated that the request for additional magistrates and other support for the court had come after the appointment of the panel of magistrates.

MP Ghafoor questioned if the bench had been appointed after Nasheed’s case had been referred to the Hulhumale’ Court, to which Didi replied in the affirmative.

Asked if Didi was aware that one of the magistrates appointed to the bench had allegations of disciplinary issues, sexual offences and corruption against him, he responded that he was not aware of such a case.

When MDP MP Rugiyya Mohamed said JSC Member Sheikh Rahman had confirmed that indeed such an allegation was being looked into by the commission, Abdulla Didi then responded that he had heard such rumours via media and had asked administrative staff to look into the matter.

He later said he “did not believe any of the magistrates on the bench would have done anything of the sort.”

“I cannot confirm whether such a matter exists. The thing is, if we are to consider an allegation or a complaint, there has to be some solid reasons that should support the allegation, whether it be proved or not. If it is a solid and believable allegation, then I might not agree to have him on the bench,” he continued.

“I don’t think just being alleged of anything is reason enough to remove any magistrate from the bench. The allegation itself must carry some weight. However, such allegations can only be cleared once the relevant authority investigates it. So, I do believe any such investigations must be expedited. I don’t see any reason why such a magistrate cannot sit on the panel in the meantime.”

Is the Hulhumale court legitimate?

Asked directly whether Abdulla Didi believed the court to be a legitimate entity, he answered, “I am not saying it is a legitimate court. Then again, nor I am I saying it is illegitimate. All I can say is I don’t believe it will be liquidated.”

“I think the JSC cannot establish a court through a vote. I can’t really recall the law too well at this moment, but the JSC certainly cannot form a court,” Abdulla Didi confirmed in response to a question posed by Sameer.

Sameer then asked if the Vice Chair of JSC had cast his vote on the matter of forming the Hulhumale’ Court.

“That’s a huge misunderstanding. We never voted to form a court. We voted to establish that, in accordance with the laws, the Hulhumale’ Court will not be automatically cancelled. The court was in existence even before [the vote],” Abdulla Didi answered.

However, Sameer challenged Abdulla Didi’s statement. He stated that in 2007, the President’s Office had created an administrative office called the Hulhumale’ Courts Section, and not a court, saying that the existence of a magistrate court in Hulhumale’ is not noted on any paperwork.

“We have documents proving that after the ratification of the Judicature Act, that under a decision of the JSC itself, the budget, stamp and even staff of this Hulhumale’ Court Section office were transferred to the Family Court in Male’. And then, out of the blue, your commission decided there is a Magistrate Court in Hulhumale’,” Sameer stated.

“You are aware that a case against the Hulhumale’ Court was filed in a lower court. The JSC then referred it to the Supreme Court. Then JSC Chair Adam Mohamed, who is a Supreme Court Judge, cast the deciding vote on the case. Do you believe this was conducted in due process?” Sameer asked.

Abdulla Didi refused to answer the question on the grounds that he could comment on a decision of the Supreme Court. He said “there is no way I can call that a bad ruling.”

February 7 a failure of all state institutions, DRP: Umar Naseer

Prospective presidential candidate of the Progressive Party of Maldives (PPM), Umar Naseer, has said the controversial transfer of power on February 7, 2012 happened as a result of the failure of all state institutions and the then largest opposition party, Dhivehi Rayiithunge Party (DRP).

“The HRCM (Human Rights Commission of the Maldives) had become an entity which was only good for releasing vague reports. We saw that only the PG was effective in that he did some work and made some strong, solid statements,” Umar said, speaking at a rally titled “In celebration of reclaiming the people’s government”, held by the PPM in celebration of the first anniversary of the change of power.

“The police and the MNDF had their hands tied by [former President Mohamed Nasheed], and could only do as he instructed them to. I’d describe the judges as having been kept kneeling on the ground. Even DRP’s leadership had failed at the time. This is why we had to leave them and form another party. But what I am saying is that at the time, even the opposition had failed,” Umar continued.

“As a result of the failure of all these institutions, the people came out, struggled through tear gas and rubber bullets, and finally succeeded in bringing Nasheed’s government to an end.”

DRP MP Dr Abdulla Mausoom told Minivan News that the party “did not wish to comment on baseless, empty rhetoric.”

Umar told the approximately 600 people gathered at the rally that February 7 had been a result of “the hard work done by PPM members for the three years since November 11, 2008.”

“After having scored the golden goal and winning the match on February 7, our people bore many injuries when they went back home,” Umar said.

“Our people made their way through rubber bullets. Our people were hit by rubber bullets. Our people were admitted to hospital. Some of our people broke arms and legs. Many of them were arrested,” Umar stated.

“Many said to our people: ‘You won’t be able to do this’, but our people ignored these pessimistic remarks, ignored the pain they were in, and went forward to succeed.”

Citizens, police, MNDF changed government: Umar Naseer

Naseer alleged that had Nasheed’s administration not been toppled on February 7, Nasheed would have set in place “plans he had made to completely destroy the judiciary on February 8.”

Naseer alleged that Nasheed had planned to sideline the Judicial Services Commission (JSC) and instead replace it with a self-appointed Judicial Reform Commission.

“The President’s Office has a copy of a circular that Nasheed had signed and prepared for release. This circular shows that he had made up a Judicial Reform Commission to which he had appointed Mariya [Ahmed Didi, former Chairperson and MP of MDP] as head, and other party officials who would do his bidding. He planned to have judges take oath in front of this commission instead of the JSC, and to declare that any judge who did not would no longer be allowed in our courts.”

Naseer compared the events of February 7 to other historical events in the Maldives.

“The day was similar to when the Portuguese tried to force alcohol down the throats of Maldivians. Bodu Thakurufaanu and his allies had come to Male’ and saved the country then. February 8 was about to become a day like this, but the people saved the country by toppling Nasheed on February 7,” Umar suggested.

“Even the Chief Justice was scared and apprehensive, not knowing just when Nasheed would send security forces to arrest him,” he alleged.

“The most ordinary people of this country came out and changed the government a year ago. They included police, MNDF soldiers and general citizens,” Naseer stated.

“February 7 didn’t happen due to any greatness of ours. It was a victory granted by the Almighty Allah. Of course, Allah only grants victory when some humans put in an effort, which is what we did.”

Legal action against Nasheed must be hurried: Naseer

Naseer further said that the state institutions were “once again leaning back on their hind legs” and failing to take legal action against Nasheed.

“The arson attacks on February 8 were the largest of their kind in the country’s history. It must be called the ‘big flame’. That day wouldn’t have come if this government had taken strong action against Nasheed. We would have been able to save so much then,” Naseer said, criticised the current government of which PPM is also part.

“But then, our government was very new at the time. It had suddenly ascended to power and had a lot of matters to settle. Maybe that’s why they failed to take necessary action.”

Naseer then said that the institutions were once again failing to function as mandated, citing their “failure to take action against the MDP who are orchestrating street protests and yelling near houses.”

“Mohamed Nasheed still comes out onto the streets. He does as he pleases. He says what he pleases. He goes to foreign countries. He is even destroying our tourism. He is calling out for various action to be taken against us. He is able to do all this, in my view, because our institutions continue to fail us. Please don’t let this happen,” Naseer said.

“Remember that this victory is only temporary. We will only have fully succeeded when we win the 2013 elections. PPM will do all possible to ensure this,” Umar said.

“But as our party does this work, I call on all state institutions, the Attorney General, Prosecutor General, judges in all the courts, to keep in mind the ‘big flame’ incident of February 8 and take necessary action against its perpetrators,” Naseer said.

“Most importantly, I call on them to very quickly look into Nasheed’s arrest of Abdulla Ghazee [Abdulla Mohamed, Chief Judge of the Criminal Court] and to take whatever possible legal action against him soon,” Naseer said, concluding his speech.

President’s Office Spokesperson Ahmed Thaufeeq was not responding to calls at the time of press. HRCM Vice President Ahmed Tholal and Prosecutor General Ahmed Muiz were also not responding to calls, as was MDP Spokesperson Hamid Abdul Ghafoor and MP Mariya Ahmed Didi.

Nasheed adds third British legal expert to defense team

Former President Mohamed Nasheed has further bolstered his legal team by accepting the services of Kirsty Brimelow QC ahead of the continuation of the Judge Abdulla Mohamed detention case on Sunday.

Brimelow will join fellow UK-based legal experts Sir Ivan Lawrence QC and Barrister Ali Mohammed Azhar on  Nasheed’s defence team.

A statement appearing on Nasheed’s website describes Brimelow as a criminal law specialist with international experience who is “particularly sought after in cases with a human rights law element”.

Brimelow was appointed Queen’s Counsel in 2011 and has, among a number of high profile cases, acted as Legal Adviser to the Constitution Commission of Fiji. She is vice-chairwoman of the Bar Human Rights Committee and appears regularly on British television and radio.

Earlier this month, the Department of Judicial Administration informed local media that two of Nasheed’s lawyers, Hassan Latheef and Ahmed Adbulla Afeef had been barred from the trial.

Latheef had been barred from the trial as the state had called him as a witness, while Afeef was was barred as he had not signed new behavioural regulations for lawyers recently issued by the Supreme Court, explained department spokesperson Latheefa Gasim.

This leaves just two of Nasheed’s lawyers able to appear in court – former President’s Office Legal Advisor Hisaan Hussain and criminal defence lawyer Abdulla Shair.

Nasheed has stated repeatedly that he feels the outcome of the trial to be pre-ordained, with his conviction designed specifically to prevent him running in next year’s presidential elections.

“On Sunday I will face an extraordinary court, established especially to hear my case,” Nasheed wrote in Britain’s Financial Times this week.

“I am to be tried for abuse of power, in particular for the arrest of a corrupt judge, who was an ally of Mr Gayoom. My conviction is a foregone conclusion. Mohamed Waheed, my former vice-president, may decide to pardon me, but only in a way that ensures I remain barred from seeking office next year,” he wrote.

The issue of Nasheed’s trial was raised in the UK House of Commons this week by Conservative MP Karen Lumley, who asked Alistair Burt – Under Secretary of State for the Foreign and Commonwealth Office, about the fairness of Nasheed’s trial.

“We have sought and received assurances from President Waheed of the Maldives that any trial of former President Nasheed will be fair and free from political influence,” replies Burt.

“No trial date has been set. The next court hearing is on November 4 and we expect international observers to be present,” he added.

In response to Lumley’s question regarding the effect of the trial on a sustainable political outcome in the country, Burt said the following:

“The trial process is, of course, a matter for the Maldives, but there is international concern that if it results in the former President being prevented from leading his party into the elections next year, it will be seen as though the process was designed for exactly that object.”

“We urge political stability under all circumstances in the Maldives, and that will no doubt be enhanced if the former President is allowed to lead his party and take part in those elections,” continued the Under Secretary.

The statement on Nasheed’s website noted that the Attorney General’s regulations prevented any of the new additions to his legal team appearing alongside him in court.

“Article 2 (a) of the regulation states ‘a person has to either be a Maldivian citizen or be married to a Maldivian citizen and reside for most part in the Maldives’ in order to practice law in the Maldives,” read the statement.

“This restriction is a hindrance to clients who wish to have foreign legal professionals represent them in courts of the Maldives,” it said.

Nasheed’s legal team raised several procedural issues at the cases first hearing on October 9, all of which were dismissed by the court.

After challenging this ruling in the High Court, and calling for an injunction to halt the trial until the matter was resolved, it was announced last week that the High Court would hold a hearing on the matter on the morning of November 4 – the same day Nasheed’s trial in the Hulhumale’ Magistrate’s Court recommences.

“The party believes that the result of conducting both hearings on the same day will be the defence attorneys losing the opportunity to prepare for the original case at the Hulhumale Magistrate Court’,” a Maldivian Democratic Party (MDP) statement read.

The party held a march around the capital island Male’ on Tuesday calling for judicial reform. Over 500 protesters marched around Male’ with banners and placards displaying messages arguing the importance of judicial independence and of holding the judiciary accountable.

Chief Judge Abdulla Mohamed was originally taken into custody in January after blocking the Judicial Services Commission’s (JSC) proceedings into his alleged misconduct. A police mutiny and unrest in the capital led to Nasheed’s resignation three weeks later.

“Prosecution’s only objective to ensure I cannot contest next elections”: former President Nasheed

Former President Mohamed Nasheed in a public speech on Tuesday challenged the Prosecutor General (PG) as to why “such a small charge” was being raised against him while he was being accused of “the much larger crime of having hijacked the entire criminal justice system of the Maldives”.

Following Nasheed’s first hearing in the case against him regarding the arrest of Criminal Court Chief Judge Abdulla Mohamed, the former president addressed a crowd of over 1500 supporters at the Maldivian Democratic Party (MDP)’s rally grounds in ‘Usfasgandu’ on Tuesday night.

Speaking at the rally, Nasheed stated that the Prosecutor General had filed a case against him under Article 81 of the Penal Code for the arrest of a judge.

Article 81 of the Penal Code states that it is a criminal offence for any employee of the state to use the constitutional powers to arrest vested on him to deliberately arrest a person who has not committed a crime. The article further details that the maximum penalty for this offence is either a jail sentence or banishment for a period of up to three years, or a fine of up to MVR 2000 (US$130).

“If, as the President of the Maldives, I arrested the Chief Judge of the Criminal Court, then it is not as small a crime as is stated in Article 81. The Prosecutor General’s only objective is to ensure that I cannot contest in the next presidential elections. To do so, he has identified an article which would provide just the required period of detention to cancel my candidacy,” Nasheed explained.

“In truth, if I have committed the crime he is accusing me of, then it is far more serious than he is currently saying. If such a crime has been committed, then the charges must be for having dismantled the whole criminal justice system.”

“That the PG is not charging me for that, and instead is sticking to such a small charge shows beyond any doubt that he is looking at the matter from a political perspective,” Nasheed alleged.

Nasheed said he was confident that his legal team would prove in court the challenges that the criminal justice system of the country was facing, the problems that the whole justice system of the Maldives was facing, the ensuing risks to national security, and that the steps taken by the President of the Maldives to solve the issue fell within the legislative framework of the country.

“What is the specific moment during the orchestration of the coup that all political actors were noting as most important? The moment when Abdulla Ghazi (Judge Abdulla Mohamed) was released. The coup d’etat that was brought in this country was made possible because our criminal justice system has failed,” said Nasheed.

Nasheed also said that government employees in the southern atolls had raised concerns of not having received their monthly salary.

“Hassan Thaajudeen declared a wage system in the 1600s. Since then, the state has never once failed to pay wages, until now. What we are seeing are the effects of the coup,” Nasheed said.

Regarding the actions of the police, Nasheed stated that there were many police officers who worked with the national interest in mind. He said that these officers were following the orders of their “political leaders” with reluctance.

“The Home Minister may have instructed (police) to shoot me in the head and bring me back. Home Minister may have asked them to bring me with my hands cuffed behind my back. The Home Minister may also have asked them to completely destroy Aslam’s house, or destroy Fares-Mathoda and bring me back. We do not at all doubt that the state has the means and manpower to do so. However, these past few days have made it even clearer to me that there are lots of police and soldiers who are aligned with the national spirit,” Nasheed stated.

Nasheed further stated that the MDP’s campaign trip to the southern atolls, the “Journey of Pledges” had been interrupted by the state with the use of force disproportionate to the situation.

“Some days we fall, but then we get back up even faster,” Nasheed said, stating that the campaign trip would resume on Wednesday morning.

After the first hearing of the case on Tuesday, the court has scheduled the next hearing to be held on November 4. Although Nasheed has been freed from police custody after Tuesday’s hearing, he is still effectively under island arrest.

“We have heard the manifesto of our political opponents. They vow only to detain President Nasheed for a long period of time. There is nothing for the benefit of the people,” Nasheed said.

“Our party’s and my own first pledge is that my name will be on the ballot paper,” Nasheed declared, prompting loud cheers from his supporters.

Tholath and Ziyad’s hearing cancelled as judge takes sick leave

Today’s scheduled hearing of former Minister of Defence Tholhath Ibrahim Kaleyfaan and Maldives National Defence Force (MNDF) Colonel Mohamed Ziyad has been postponed after one of the three judges on the panel took sick leave, local media has reported.

Thalhath and Ziyad join other MNDF officers Moosa Ali Jaleel and Ibrahim Mohamed Didi (retired) as well as former President Mohamed Nasheed in being charged with Article 81 of the penal code.

Haveeru reported that no new date has been set.

If found guilty, Nasheed and Tholhath will face a jail sentence or banishment for three years or a Rf 3000 fine (US$193.5).

Nasheed’s hearing was scheduled for Monday was cancelled after he failed to present himself in court and instead left Male’ to campaign in the southern atolls, in defiance of a travel ban.

The department of judicial administration yesterday confirmed that police were to produce Nasheed at a rescheduled hearing at 4:00pm on Sunday, October 7.

Nasheed’s legal team last week voiced concerns that the Hulhumale’ Magistrate Court had been assembled illegally, with judges “handpicked” in contravention of the Judicature Act.

Nasheed fails to appear in court, defies travel ban

Former President Mohamed Nasheed departed Male’ today to participate in his party’s ‘Vaudhuge Dhathuru’ (Journey of Pledges) campaign in the southern atolls, defying a court order that he remain in the capital.

Nasheed’s departure contravenes an order from the Hulhumale Magistrate Court last week that Nasheed be confined to Male’ ahead of his court trial, which was to be conducted at 4:00pm today.

Journalists in the courtroom were required to undergo heavy security screening and were stripped of mobile phones, recording equipment and notepads. However, 20 minutes later a court official stated that the hearing was cancelled as the defendant and his lawyers had failed to appear. A new date was not set.

Nasheed meanwhile held a rally from atop a yellow flagged dhoni in front of 500 demonstrators near the petrol jetty in the south of Male’, before departing with five vessels and hundreds of supporters. Minivan News observed no police presence in the area.

“Once they started to set up a fabricated court, bring in judges who are not judges of that court, and the whole structure of it is so… politically motivated, it is very obvious it is not meant to serve justice,” Nasheed told the BBC.

“We intend to find out in this trip to what extent we were able to fulfil our pledges during this party’s period in government,” Nasheed told his supporters. “This is a journey of pledges. This is a journey for justice. This is a journey where we become one with the citizens.”

The party and its senior leadership will visit over 30 islands during the 14 day trip, taking in the atolls of Gaafu Alif, Gaafu Dhaalu, Fuvahmulah and Addu.

Meanwhile, the court hearing was to be the first in the case concerning Nasheed’s detention of Chief Judge of the Criminal Court, Abdulla Mohamed, while in office.

Nasheed also faces charges of defaming Police Commissioner Abdulla Riyaz and Defence Minister Mohamed Nazim as “traitors”, following February 7’s controversial transfer of power. The first hearing in Riyaz’s case has been postponed indefinitely.

Nasheed’s Maldivian Democratic Party (MDP) has expressed deep concern over the legality of the court’s procedures regarding the trials, which it contends are a politically-motivated attempt to convict the former president and prevent him from running in future Presidential elections.

Following the court-ordered travel ban on Nasheed ahead of the party’s southern atoll election campaign, the MDP announced that it would no longer recognise the authority of the courts in the Maldives until changes proposed by international entities were brought to the judicial system.

“This all looks very ‘Myanmar’ – using the courts and administrative manipulation to restrict political party activity,” said MDP MP and Spokesperson Hamid Abdul Ghafoor at the time.

“While President Waheed was lobbying the Commonwealth to remove the Maldives from its human rights watch-list, his regime had detained the leader of the opposition.”

The concerns were echoed by Canadian Foreign Minister John Baird, a member of the Commonwealth Ministerial Action Group (CMAG) who recently downgraded the Maldivesfrom its formal agenda to a ‘matter of interest’.

“Canada is deeply troubled by the reported September 25 travel ban of former President Nasheed in Malé,” said Baird.

“The recently adopted Commission of National Inquiry (CNI) report has raised substantial concerns about the independence of the judiciary. That too causes Canada grave concern as we strive to assure independent open elections in the Maldives,” he added.

“President Waheed offered no substantial defence of these questions, which is a telling response in itself,” said Baird. “Canada finds the declining state of democratic values in the Maldives alarming and deeply troubling.”

The court has maintained that the travel restriction is normal procedure for defendants ahead of court trials.

The case

Nasheed’s controversial decision to detain Judge Abdulla in January 2012 followed the judge’s repeated release of former Justice Minister – and current Home Minister – Dr Mohamed Jameel, in December 2011, whom the government had accused of inciting religious hatred over the publication of his party’s pamphlet, ‘President Nasheed’s devious plot to destroy the Islamic faith of Maldivians’.

Nasheed’s government further accused the judge of political bias, obstructing police, stalling cases, having links with organised crime and “taking the entire criminal justice system in his fist” so as to protect key figures of the former dictatorship from human rights and corruption cases, among other allegations.

Nasheed justified the judge’s arrest based on his constitutional mandate to protect the constitution. Judge Abdulla had in September 2011 received an injunction from the Civil Court preventing his investigation by the Judicial Services Commission (JSC), the watchdog tasked with overseeing the judiciary, which complied with the ruling.

Parliament’s Independent Commissions Committee, the body mandated with holding the judicial watchdog accountable, took no interest in the matter.

The then-opposition began nightly protests over the judge’s detention, while the government sought assistance from the UN and Commonwealth for urgent judicial reform.

However, Nasheed resigned on February 7 amid a police and military mutiny the day after the Commonwealth team arrived.

Judge Abdulla was released, and the Criminal Court issued a warrant for Nasheed’s arrest. The warrant was not acted upon.

Former Defence Minister Tholhath, former Chief of Defence Force Major General Moosa Ali Jaleel, Brigadier Ibrahim Mohamed Didi and Colonel Mohamed Ziyad are also facing charges for their role in detaining Judge Abdulla in January 2012.

The charges include a breach of article 81 of the Penal Code: “Arresting an innocent person intentionally and unlawfully by a state employee with the legal authority or power vested to him by his position is an offence. Punishment for a person guilty of this offence is imprisonment or banishment for 3 years or a fine of MVR 2000 (US$129.70).”

Over 80 pages, backed up with documents, evidence and letters, The Failed Silent Coup: in Defeat They Reached for the Gun recounts the experience of the outspoken whistleblower as she attempted to stop the commission from re-appointing unqualified and ethically-suspect judges loyal to former President Maumoon Abdul Gayoom, after it dismissed the professional and ethical standards demanded by Article 285 of the constitution as “symbolic”.

That moment at the conclusion of the constitutional interim period marked the collapse of the new constitution and resulted in the appointment of a illegitimate judiciary, Velezinee contends, and set in motion a chain of events that ultimately led to President Mohamed Nasheed’s arrest of Abdulla Mohamed two years later.

According to Velezinee, “the assumption that Abdulla Mohamed is a constitutionally appointed judge is based on a false premise, a political creation [which] ignores all evidence refuting this.”

“Judge Abdulla Mohamed is at the centre of this story. I believe it is the State’s duty to remove him from the judiciary. He may have the legal knowledge required of a judge; but, as the State knows full well, he has failed to reach the ethical standards equally essential for a seat on the bench.

“A judge without ethics is a judge open to influence. Such a figure on the bench obstructs justice, and taints the judiciary. These are the reasons why the Constitution links a judge’s professional qualifications with his or her moral standards,” she wrote.

“There is no legal way in which the Civil Court can rule that the Judicial Service Commission cannot take action against Abdulla Mohamed. This decision says judges are above even the Constitution. Where, with what protection, does that leave the people?” Velezinee asked.

Failure of judiciary, JSC and parliament justified detention of Abdulla Mohamed, contends Velezinee in new book

Nasheed resigned on February 7 after mutinying police and military officers joined forces with opposition demonstrators, who had been accusing Nasheed of interfering with the ‘independent’ judiciary in his arrest of the judge, and demanding not to be given ‘unlawful orders’.

The Commonwealth-backed Commission of National Inquiry (CNI) report found that there was no evidence to support Nasheed’s claim that he was ousted in a coup d’état, and that his resignation was under duress and the events of the day were self-inflicted.

“The inquiry is based on a false premise, the assumption that Abdulla Mohamed is a constitutionally appointed judge, which is a political creation and ignores all evidence refuting this,” Velezinee stated.

“Judge Abdulla Mohamed is at the centre of this story. I believe it is the State’s duty to remove him from the judiciary. He may have the legal knowledge required of a judge; but, as the State knows full well, he has failed to reach the ethical standards equally essential for a seat on the bench.

The JSC itself had investigated Abdulla Mohamed but stopped short of releasing a report into his ethical misconduct after the Civil Court awarded the judge an injunction against his further investigation by the judicial watchdog.

Parliament, Velezinee states, was the body responsible for holding the JSC accountable.

“The Majlis knew the threat Abdulla Mohamed posed to national security and social harmony. The Majlis was also aware of the Judicial Service Commission’s failure to carry out its constitutional responsibilities and its efforts to nullify constitutional requirements.

“Concern had been shared with the Majlis that the Judicial Service Commission had committed the ultimate betrayal and hijacked judicial independence. The Majlis failed its Constitutional responsibility to hold the Judicial Service Commission accountable for any of these actions. The Majlis had violated the Constitution and rendered it powerless. Where to from there?”

Ultimate responsibility for upholding the constitution fell to the President, Velezinee states.

“Democratic governance can only function if the entire system is working as an integral whole; it is impossible if the three separated powers are failing in their respective duties.

“Under the circumstances – once it was clear that Abdulla Mohamed was an obstruction to justice and a threat to national security, and once it became apparent that neither the Judicial Service Commission nor the Parliament was willing to hold him accountable – the only authority left to take control of the situation was the Head of State.”

With the return to power of Gayoom’s autocratic government behind President Mohamed Waheed’s “fig leaf of legitimacy”, the judiciary continued to be subject to influence, Velezinee writes.

“The judiciary we have today is under the control of a few,” she wrote.

“This was an end reached by using the Judicial Service Commission as a means. Most members of the Judicial Service Commission betrayed the Constitution, the country, and the people. They broke their oath. There is no room for free and fair hearings. And most judges do not even know how to hold such a hearing.”

“For democracy and rule of law to be established in the Maldives, and for the right to govern themselves to be returned to the people, they must have an elected leader. And the judiciary, currently being held hostage, must be freed.

“Article 285 of the Constitution must be fully upheld, judges reappointed, and an independent judiciary established,” she concludes.

Hulhumale’ Court rejects case against former President Nasheed

Hulhumale’ Magistrate Court rejected a case forwarded by the Prosecutor General against former President Mohamed Nasheed and three Maldives National Defence Force (MNDF) officers for their alleged role in detaining Criminal Court Chief Judge Abdulla Mohamed.

Hulhumale’ Court Magistrate Moosa Naseem told Minivan News that the case was sent back to the Prosecutor General’s Office after the court stated it did not have the jurisdiction to deal with such cases under the Judicature Act.

‘’We studied the case and we found that we do not have the jurisdiction to deal with the case according to article 66 of the Judicature Act,’’ Naseem said.

Naseem today told local media that the Hulhumale’-based court can only accept the case after the Chief Justice issues a decree in agreement with the Judicial Service Commission (JSC) and the Judicial Council as stated in the article 66[b] of the Judicature Act.

Article 66[b] of the Judicature Act states that “In accordance with Section (a) of this Article, if additions or omission to the jurisdictions stipulated in schedule 5 of this Act has to be carried out, the modification has to be done in agreement with the Judicial Service Commission and the Judicial Council and by a decree issued by the Chief Justice.’’

Deputy Prosecutor General Husaain Shameem said he was presently on leave and was not aware of the exact details of the matter when contacted by Minivan News. Prosecutor General Muiz was also not responding to calls by Minivan News at the time of press.

Earlier, Muiz has said that the case was sent to Hulhumale’ Magistrate Court because it related to the Chief Judge of the Criminal Court.  He contended therefore that the case cannot be filed at the same court overseen by the judge owing to a conflict of interest.

Former President Nasheed has said that he is “prepared” to justify the reasons for the arrest of Judge Abdulla, and said he was ready to appear in court and prove his actions were valid.

Nasheed also dismissed accusations of the High Court, the Supreme Court and the prosecutor general that he had ordered the military to arrest Judge Abdulla unlawfully.

“I did nothing unlawful during my tenure,” he challenged.

He also called on the population to be present at his trial and witness what happened in the court, alleging that the whole case was politically motivated and that his opponents were seeking to gain an unfair upper hand from the “political scandal”.

The Chief Judge was detained by the military, after he had opened the court outside normal hours to order the immediate release of former Justice Minister and current Home Minister and deputy leader of the Dhivehi Quamee Party (DQP), Dr Mohamed Jameel.

In late 2011, Judge Abdulla was himself under investigation by the JSC, the country’s judicial watchdog, for allegedly politically biased comments made to private broadcaster DhiTV. The Judicial Services Commission (JSC) was due to release a report into Judge Abdulla’s ethical misconduct, however the judge approached the Civil Court and successfully filed an injunction against his further investigation by the judicial watchdog.

Judge Abdulla’s arrest sparked three weeks of anti-government protests in January, leading the Nasheed administration to appeal for international assistance from the Commonwealth and UN to reform the judiciary.

Civil Court orders JSC to submit all documents related to Judge Abdulla’s misconduct

Civil Court Judge Maryiam Nihayath has ordered the Judicial Services Commission (JSC) to submit all documents relating to the ethical misconduct of Chief Criminal Court Judge Abdulla Mohamed, in a case filed by the judge last year to halt his further investigation by the judicial watchdog.

At the hearing held today, Judge Nihayath ordered the judicial watchdog to submit by next Thursday all documents and relevant video recordings , local media reported.

Speaking at the court, Judge Abdulla’s lawyer Ibrahim Riza, who is also the MP for Guraidhoo constituency, said that it was not legally appropriate to consider that his client was guilty of misconduct just because the JSC had decided it.

Riza told the court that the JSC’s decision on his client’s misconduct was taken following a statement Judge Abdulla made in an interview with private broadcaster channel ‘DhiTV’. The persons who interviewed Judge Abdulla had told the JSC that they did not know if he had made the comments implying political bias, Riza said.

Judge Maryiam Nihayath said that after the documents were submitted, a further hearing would be held before the verdict was delivered, local media reported.

Abdulla Mohamed filed the suit against the JSC after it completed a report into misconduct allegations against the Chief Judge last year.

According to the report, which the JSC has not yet publicly released, Abdulla Mohamed violated the Judge’s Code of Conduct by making a politically biased statement in an interview with DhiTV.

Following the JSC’s decision to take action against Abdulla Mohamed, he filed a case against the JSC in the Civil Court requesting that it invalidate the JSC’s report, claiming that DhiTV took his statement out of context.

According to the JSC, a total of 11 complaints have been submitted to the commission against Judge Abdulla Mohamed.

In 2005, then Attorney General Dr Hassan Saeed – now advisor to President Mohamed Waheed – forwarded to the President’s Office concerns about the conduct of Abdulla Mohamed.

Among the allegations in Dr Saeed’s letter was one that Judge Abdulla had requested an underage victim of sexual abuse reenact her abuse for the court, in the presence of the perpetrator.

Following Judge Abdulla’s obtaining of a Civil Court injunction late last year blocking his further investigation by the judicial watchdog, the President’s Office accused him of “taking the entire judiciary in his fist”, alleging that he was a threat to national security and ordering  his detention by the Maldives National Defence Force (MNDF).

Nasheed’s government listed 14 cases of obstruction of police duty by Judge Abdulla, including withholding warrants for up to four days, ordering police to conduct unlawful investigations, disregarding decisions by higher court, “deliberately” holding up cases involving opposition figures, barring media from corruption trials, maintaining “suspicious ties” with family members of convicts sentenced for dangerous crimes, ordering the release of suspects detained for serious crimes “without a single hearing”, actively undermining cases against drug trafficking suspects, “accepting bribes to release convicts”, “twisting and interpreting laws so they could not be enforced against certain politicians”, deciding that he alone could issue search warrantsarbitrarily suspending court officers, and releasing a murder suspect “in the name of holding ministers accountable”, who went on to kill another victim.

Opposition parties began a series of protests calling for the release of the judge, appealing to groups such as Amnesty International and the International Criminal Court, claiming the judge had been abducted and that Nasheed had violated international treaties.

The High Court and the Supreme Court ordered the release of Judge Abdulla, but the orders were dismissed by the MNDF.

On February 7 Nasheed was ousted from power after a group of police and military allied with opposition demonstrators, assaulting the main MNDF base and storming the state broadcaster while opposition politicians gathered in police headquarters. Nasheed subsequently resigned, later claiming that this was under duress, and the Criminal Court issued a warrant for his arrest.
