Construction chief not ruling out “organised crime” behind foreign worker surge

Almost half the employees in the Maldives’ construction industry are unregistered, the head of the Maldives Association of Construction Industry (MACI) has told Minivan News.

MACI President Mohamed Ali Janah said an estimated 40 percent of the foreign employees in the sector were thought not to be legally registered.

Considering these numbers, Janah said he could not rule out the involvement of organised crime in certain employment agencies, which supply a large amount of foreign labour to building sites in the Maldives.

Earlier this month, the Human Rights Commission of Maldives (HRCM) accused state and private sector employers in the country of lacking consistency in their efforts to address human trafficking.

The government – for its part – recently launched a ‘blue ribbon’ campaign with the aim of raising awareness of the rights of foreign workers, while also ratifying eight “fundamental” International Labour Organisation (ILO) conventions.

However, local independent institutions in the Maldives say the country is yet to ratify a core convention on protecting migrant worker rights, while no legislation is in place to punish those involved in smuggling workers.

Migrant worker demand

Janah claimed that 95 percent of construction groups operating in the country were Maldivian owned. However, as the country’s second largest industry on a GDP basis, the vast majority of employees in the sector were migrant workers, he said.

“We employ a huge workforce of some 60,000 to 70,000 people,” Janah explained. “Of these people, sadly we have 40,000 to 50,000 who are expatriates. We estimate there are some 15,000 to 20,000 Maldivian staff,  which includes management through to the supply chain.”

Of these migrant labourers, Janah said only some 30,000 were registered as construction workers.

“There are no records of where [these workers] come from. This is something we need to correct,” he said.

Highlighting the huge growth in the country’s unregistered migrant workforce, Janah said that in 2003 there were just 3000 foreign employees working illegally.

“At the time we thought that number was too high. Today, it has exceeded 50,000. This is hearsay. We don’t have the right statistics on this, it could be 100,000, but who knows,” he said. “The truth is that the economy is thriving because of these people,” Janah added.

Employee “mismanagement”

Over the last decade, MACI has said it has sought to advocate against the growth of illegal labour and mismanagement of foreign labourers by the construction industry.

A lack of Maldivian workers looking for jobs in the industry meant that the sector – as with many of the country’s prominent industries – was dependent on skilled and unskilled workers from abroad.

The Maldives could learn from how other thriving construction markets were dealing with the exploitation of foreign work forces, he said.

“The Maldives is experiencing what Singapore and some Middle Eastern countries experienced in the 1990’s, which is a huge influx of an unmanageable immigrant workforce that is not registered,” he explained.

“I cannot call them illegal immigrants or something like that. But I also wouldn’t rule out that organised crime is involved in this. This is being done with the support of several agencies in [several] countries and needs to be addressed – this is something respective governments need to look into.”

Aside from the construction industry, Janah also called for greater regulation of third party employment agencies that were often responsible for registering and providing foreign staff to building companies in the Maldives.

“[These agencies] pay a nominal fee to register themselves, yet they do millions of rufiyaa in business. They should pay a security deposit themselves in case something goes wrong,” he said.

Janah claimed said his own Maldives-based construction group, Alysen Services Pvt Ltd, had now opted against using third party agencies in favour of its own HR department. He said some eight to nine million rufiya was spent on deposits for foreign workers.

Accepting that employment agencies were vital to meeting the country’s workforce needs, he said MACI recommended its members look at the track record of these companies to limit the likelihood that the staff they were hiring were victims of human trafficking.

“Our advice is that employees themselves should not be charged any fees themselves by agencies to come here to work,” he said, a policy recommended to all MACI members as the best way to avoid association with organised crime.

Managing the workforce

However, Janah contended that managing the country’s foreign labour market was not something the industry could do alone, adding that government involvement was vital.

He pointed to a need to learn from different construction models not just in the region but internationally, pointing to other nations that have worked to legitimise foreign workers by requiring individual construction projects to be registered with local authorities.

With this registry in place, Janah said construction workers would then be required to be attached to a legitimate project in the country.

He also pointed to attempts by the former and present governments to provide an amnesty for unregistered workers in line with a similar scheme run in Dubai.

However, Janah stressed that Dubai’s amnesty was followed by a much stricter policy on migrant workers including the use of a “proper border control system”.

By comparison, he noted that successive administrations in the Maldives had failed to address human trafficking problems before implementing such an amnesty.

“The problem is that the government just adds rule after rule without addressing [immigration] problems,” Janah said, claiming that companies legitimately employing foreign workers were being forced to pay for the mistakes of others.

“There is collateral damage as a result of these policies. Many companies are suffering from the [work] permit issue.”

MACI contended that the worker quota system employed by Maldivian authorities in recent years made it possible to register a business as a construction company, even without fulfilling the “basic criteria” required of such an enterprise.

He said authorities should require construction companies to be registered not just as a business entity at the Ministry of Economic Development, but also with the Ministry of Housing.

However, the MACI president concluded that much more work needed to be done by the construction industry itself to try and curb the practice of unregistered workers to ensure they were not being made the victims of human trafficking.

“A lot more work needs to be done by industry. Companies who are entering the industry should not take short-cuts and must adhere to rules,” he said.

Janah added that a failure to address these concerns would not be feasible for the country in the long run, particularly with the amount of US dollars leaving the country as remittances.

“We need these workers,” Janah said. “But can we manage with less if we are more efficient?”

Janah also reiterated concerns raised by the Immigration Department and President Dr Mohamed Waheed Hassan Manik that a continued influx of unregistered and illegal workers could see the migrant population outgrow the indigenous Maldives population if unchecked.

Earlier this month, a Maldivian trade union alleged corrupt immigration practices and the use of unregulated employment agencies by private and state employers were limiting efforts to curb abuse of migrant workers and prevent illegal practices such as retaining staff passports.

The comments were made as a source with knowledge of the current immigration system also told Minivan News that the practice of retaining passports – a long-standing habit of Maldivian employers – was a key contributor to human trafficking in the country.

Meanwhile, back in January, a Malaysian IT company at the centre of legal wrangling over a deal to provide a border control system (BCS) to the Maldivian government alleged “criminal elements” could be behind efforts to scupper the agreement.

No effort made to follow up promises on human trafficking: HRCM

The Human Rights Commission of Maldives (HRCM) has accused state and private sector employers in the country of lacking consistency in their efforts to address human trafficking, preventing “real” change in controlling illegal migration.

HRCM member Jeehan Mahmoud told Minivan News that despite attempts under the present government to try and introduce new legislation, the Maldives had made little progress towards improving the treatment and rights of foreign workers over the last four years.

The government has in recent months launched a special campaign intended to raising awareness of the rights of foreign workers, while also last month ratifying eight “fundamental” International Labour Organisation (ILO) conventions intended to bring legislation on employee rights and trade unions in line with international standards.

However, independent institutions in the Maldives have maintained that the country is yet to ratify a core convention on protecting migrant worker rights, while no legislation is in place to punish those involved in smuggling workers though the country’s borders.

The Prosecutor General (PG’s) Office has confirmed that a lack of legislation has meant no cases have been prosecuted against human traffickers in the Maldives.

While accepting efforts were being undertaken by the present government to try and address human trafficking in the Maldives, trade unions, foreign diplomats and independent institutions have continued to raise concerns about the scale of the problem nationally.

The Maldives has appeared on the US State Department’s Tier Two Watch List for Human Trafficking for three years in a row. Should the Maldives drop to tier three – the worst category- then the country will face significant reductions in aid and potential travel restrictions on its citizens.

HRCM member Jeehan claimed that every time the US State Department had reviewed the Maldives’ efforts to curb human trafficking, successive governments had shown commitments to try and implement new control measures.

However, she claimed such efforts were often only temporary and not followed up in most cases.

“The effort is not consistent and that is why we are not seeing real change here. We have not seen change since our 2009 report and in the periodic reviews since then,” Jeehan said

Passport retention

HRCM member Jeehan identified the issue of employers retaining passports as a prevalent concern that had failed to be addressed since the commission carried out a study in 2009 assessing the employment situation in the Maldives for migrant workers.

“One of the findings was that passports were being kept not only by agencies or the companies themselves.  We also found the practice was used by the state in hiring teachers and nurses,” she said. “We had called for abandonment of this policy as migrant workers need access to their identity.”

Last year, the Department of Immigration and Emigration issued a notice (Dhivehi) expressing concern at the rising numbers of undocumented workers in the country, and set out a revised visa system to try and combat people trafficking.

The document included a clause stating that under no circumstances should a passport or travel documents be possessed by anyone other than the rightful owner, and threatened legal action against anyone found to have infringed these rights on the grounds of human trafficking.  An unofficial translation can be read here.

According to the HRCM, freedom of identity is a right enshrined in the Maldives constitution for any person residing in the country.

Jeehan added that the HRCM had since 2009 continued to recommend changing state-mandated practices for the processing visa documentation of foreign workers.  She said despite the efforts, the issue that had not been addressed by either the government of former President Mohamed Nasheed or the present administration of President Dr Mohamed Waheed Hassan Manik.

“Our argument is why not find an alternative ID that would allow them to release a passport,” Jeehan said. “If the state kept a work permit instead, there would be no need for passports to be held.”

Despite efforts to outlaw the practice, Jeehan claimed that on the occasion of International Migrant Worker day back in December 2012 , a public forum was held with various stakeholders including the HRCM to try and raise awareness on critical issues facing migrant workers.

She added that during the course of the workshop, the HRCM had not been notified of any significant change in the practice of the state retaining passports.

“The state issued a circular prohibiting retention of passports that was applicable to private persons and agencies. But the state ministries continue retaining passports,” she claimed.

Having spoken with private sector employers about migrant workers rights, Jeehan added that many companies said they were following the state’s example by continuing to retain passports.

“The response we receive is that ‘if the state is practising this, we can do this as well’,” she said

Legislative focus

Despite criticism of efforts by the state and private sector to combat human trafficking, Jeehan claimed work had been undertaken to implement new legislation on combating human trafficking. She said this legislation was currently under review within parliament, stalled at committee stage.

The commission has said it remains involved in assisting the development of the human trafficking bill, which Jeehan said would be an important development towards addressing the rights of foreign workers.

According to Jeehan, a lack of legislation on human trafficking was regularly cited by authorities as a key set back to dealing with issues of labour exploitation and migrant rights.

However, she maintained that human trafficking itself goes back to the principle of exploitation, something that is prohibited in Islam and by extension the constitution of the Maldives.

“An estimated one third of the population is made up of migrant workers, so it is only justified we review this,” she added.

Jeehan claimed that as recently as last year, the Maldives Police Service did not have a legal mandate to even investigate potential cases of human trafficking.

The HRCM said efforts had now been taken to screen cases where foreign workers were complaining of non-payment of wages or not being given any free time, to ascertain whether they were victims of human trafficking.

She also expressed hope that the state would also move to clearly identify the individual roles that various stakeholders in the country would play in efforts to combat people smuggling; from institutions like the police and Immigration Department, to the human rights and youth ministries.

Government commitments

Besides signing the ILO conventions on labour rights, the Ministry of Foreign Affairs this month also inaugurated an initiative targeted at raising awareness of the human trafficking issue in the Maldives.

The strategy, entitled the ‘Blue Ribbon Campaign Against Human Trafficking’ promises activities to try and raise awareness among students and the business community.

Speaking at the inauguration of the campaign last month, Minister of Foreign Affairs Dr Abdul Samad Abdulla stated that the initiative formed part of a larger plan to try addressing human trafficking in the Maldives.

This strategy is expected to include activities to try and raise awareness among students and the business community. The tourism industry, which employs the largest number of foreign staff in the country, was identified as another key focus of the initiative.

The ministry itself defines human trafficking as “taking undue advantage of a person through employing him, transferring him from place to place, taking guardianship of him, depriving him of making decisions on personal matters, assuming control over him through threats or abuse of power; or to create dependence, kidnap, or deceive him through any other means and take undue advantage of a person’s weaknesses and to conduct any of these activities in a manner that includes exchange of money from or to oneself.”

Under the new scheme, individuals held responsible for human trafficking offences would include staff in government offices mandated to oversee the issue, as well as companies and other groups found to be involved in illegal practices.

Employers who force employees to work with no respect or regard to protecting human rights and persons who obstruct the taking of legal action against people who commit human trafficking offences will also be held responsible, according to the Ministry of Foreign Affairs.

“Corrupt practices”

At the same time, a source with knowledge of the current immigration system highlighted that the now illegal practice of retaining passports – a long-standing habit of Maldivian employers – remained a key contributor to human trafficking in the country.

Back in January, a Malaysian IT company at the centre of legal wrangling over a deal to provide a border control system (BCS) to the Maldivian government alleged “criminal elements” could be behind efforts to scupper the agreement.

Vice President for Nexbis Nafies Aziz told Minivan News at the time that “intelligence” received by the company suggested groups backing the country’s lucrative human trafficking industry could be seeking to sabotage the introduction of its BCS to undermine national security controls.

Foreign labourers are estimated to account for a significant proportion of the country’s workforce.  Just over a quarter of the Maldives population of 394,451 people is estimated to be made up of foreign workers, according to recent statistics supplied by the Department of Immigration and Emigration.

The official immigration figures found that the expatriate workforce in the Maldives had risen by September 2011 to 99,369 people from just 57,968 registered workers in December 2009.

Corrupt immigration practices, unregulated agencies fueling migrant worker abuse

Corrupt immigration practices and the use of unregulated employment agencies by private and state employers are limiting efforts to curb abuse of migrant workers and prevent illegal practices such as retaining staff passports, a Maldivian trade union has alleged.

The Tourism Employees Association of Maldives (TEAM) has claimed that while companies are not permitted to retain the passports of foreign workers, some hospitality operators – as well as unregulated third party agencies and government ministries – are still keeping employee travel documents without consent.

The comments were made as a source with knowledge of the current immigration system told Minivan News that the practice of retaining passports – a long-standing habit of Maldivian employers – was a key contributor to human trafficking in the country.

The source, who wished to remain anonymous, said despite improvements late last year among some state employers, the issue still needed significant work from government and private enterprise if it was to be resolved.

Last year, the Department of Immigration and Emigration issued a notice (Dhivehi) expressing concern at the rising numbers of undocumented workers in the country, and set out a revised visa system to try and combat potential people trafficking.

Immigration Controller Dr Mohamed Ali was not responding to calls from Minivan News at time of press.

In October last year, a senior Indian diplomatic official expressed concern over the ongoing practice of confiscating passports of migrant workers arriving to the country from across South Asia – likening the practice to slavery.

Tourism workers

With the tourism industry one of the largest employers in the Maldives, TEAM Secretary General Mauroof Zakir alleged that relevant authorities in the country were either not able, or unwilling, to address abuse of foreigners.

“The issue of abuse of migrant workers is not being addressed by concerned authorities very much. We have a corrupted Immigration Department that is not able to handle these issues,” he said.

According to Mauroof, the practice of resort operators keeping worker passports was a “complicated issue” due to the common practice of outsourcing the hiring of foreign staff to agencies. He contended that a number of resorts and hotel operators were either keeping passports of staff themselves, or doing so through third party employment agents.

“Passports are being kept, often for stupid reasons. While passports should not be kept by employees, I am sure companies are doing this anyway,” he said.

Mauroof claimed that even this week, TEAM had received complaints that one multi-national hotel operator in Maldives was insisting on retaining the passports of its foreign staff, in some cases against their wishes.

Mauroof also criticised the use of third party employment agencies in particular, alleging that by relying on unscrupulous labour suppliers, resorts risked inadvertently hiring illegal workers.

“One complaint we received involved a resort paying a group of migrant workers US$100 as a monthly basic salary,” he claimed, adding that this did not include service charge payments.

A common human rights abuse involved the housing of foreign staff in substandard conditions. In one example, a group of labourers from Bangladesh were not provided with a toilet in their accommodation, forcing them to use the facilities at nearby mosques.

According to Mauroof, although TEAM’s constitution did allow for foreign workers to become members, only a small number of migrant employees had so far joined the union.

TEAM said it was at present handling three cases relating to the treatment of foreign staff.

With a majority of the country’s tourism workforce made up of foreign staff, Mauroof expressed concern that a large number of immigrant workers could see their basic rights infringed by employers with no realistic chance of seeking legal redress.

Societal attitude

A source with knowledge of the Department of Immigration’s work over the last several years said that while employers, including government ministries, had stepped up efforts to cease retaining passports, it would take “some time” before the issue was resolved.

The source claimed that the practice of retaining passports had been part of the employment culture in the Maldives for a long time, and that changing wider societal attitudes was challenging.

“Withholding passports infringes the basic rights of workers. We are talking about someone’s identity here. Addressing the matter is also the first step in working to prevent human trafficking,” the source claimed. “[Retaining passports] has been part of the culture here for a long time – the Education Ministry and Tourism Ministry have all done this. Keeping passports has been practised since foreign experts began coming to the Maldives.”

The source told Minivan News that the Department of Immigration and Emigration has sent “numerous memos” against the practice of retaining passports, but alleged that certain agencies favoured keeping worker documentation to better manipulate them.

“This is a common practice seen all over the world. But it creates major problems. If a foreigner wishes to go to law enforcement agencies for assistance, they will be asked to identify themselves with a passport,” the source said.

Third party agencies appeared to want to keep the passports to be able to “manipulate” foreign workers for their own financial advantage, the source explained.

“I do not believe that people are aware [keeping passports] is such a bad thing. Big companies, government employers and resort companies are all known to have done it,” the source claimed. “There has been an improvement that we have seen since late 2012 towards stopping the retention of passports. We have talked with government ministries and tried to resolve the matter, however when passports are being kept for visa processing they are not always returned.  This is a big challenge for employees in the outer atolls.”

The same source stressed that while ministries were showing improvements in returning passports to foreign workers, it may take “some time” till the matter was addressed properly.

Minivan News understands at present that the Department of Immigration is temporarily unable to renew work visas for expatriates, and is instead providing a three month extension period to foreign workers as a stop-gap measure. The temporary measures were imposed as a result of ongoing disputes over the controversial implementation of a new border control system provided by Malaysia-based IT firm, Nexbis.

Sources within the immigration department warned Minivan News that the country could have to resort to a “a pen and paper system” for monitoring immigration if the country’s courts approve a parliament vote to scrap the Nexbis deal, without providing an adequate replacement.

Resort challenges

Several resort operators in the Maldives, speaking on condition of anonymity, said while they did not use employment agencies themselves, the level of bureaucracy faced in hiring staff – especially for properties far from Male’ – did sometimes require third party assistance.

The general manager of one resort told Minivan News that the property had its own HR department to obtain documentation for its foreign employees, rather than relying on a third party.

“We do all the application processes ourselves and we have staff passports here in a fire-proof safe,” he claimed. “Staff can have these documents back whenever they request them.  If they do not want to be here, they are welcome to leave.”

Despite having opted against the use of employment agencies, the general manager added that, particularly for resorts in the country’s outer atolls where travel to the capital was difficult, some hospitality operators had little choice but to turn to employment agencies.

“In their defence, the state uses such a bureaucratic system that the government plays a part in these problems,” he claimed. “They have to simplify the [visa application] process. I would say some 70 percent of the rules they have are a joke.”

Another multi-national resort operator with properties across the Maldives confirmed that it did make use of some employment agencies, but favoured sourcing staff either internally from other operations, or from local islands. A source from the resort stressed that in the two years they had worked at the property, they had received no complaints concerning employment agencies they had used to bring in foreign workers.

Blue Ribbon Campaign

The Ministry of Foreign Affairs earlier this month inaugurated an initiative targeted at raising awareness of the human trafficking issue in the Maldives.

Entitled ‘Blue Ribbon Campaign Against Human Trafficking’, the strategy is expected to include activities to try and raise awareness among students and the business community.

The Foreign Ministry announced that it had signed a memorandum of understanding (MOU) with multiple local media outlets in the country as part of the campaign’s aim to raising awareness of human trafficking and other related issues.

The Maldives has come under strong criticism internationally in recent years for the prevalence of people trafficking, and the  country has appeared on the US State Department’s Tier Two Watch List for Human Trafficking for three years in a row.

India and US were never going to donate border control system: Immigration Controller

Controller of Immigration Dr Mohamed Ali has dismissed claims that India and the US had proposed to donate a border control system to the Maldives.

According to local media, the Anti-Corruption Commission (ACC) had previously stated that India and the US had proposed to set up a border control system free of charge.

The current border control system project contract has been awarded to the Malaysian company Nexbis for a period of 22 years by the previous government, however last month parliament voted unanimously to terminate the agreement over allegations of “foul play”.

Speaking on Television Maldives (TVM), Ali said the Foreign Ministry had confirmed that neither America nor India had proposed to donate the border control system.

“No country has proposed such a system free of charge. I have written to the Foreign Ministry last week and have got it in writing. They said that no country has made such an offer,” Ali was quoted as saying in Sun Online.

According to Ali, the Maldives is currently using US$2.3 million worth of passport reading machines installed in 2003. However the machines are incapable of reading the required software, so Nexbis had won a bid to upgrade the current system.

“The meaning of border control is that, when a foreigner enters the country, we are able know his whereabouts, know when he checks out of one hotel and checks into another, and know how long the person has stayed so that all this will be notified to MIRA, and whatever taxes the person owes can be duly collected.

“For the construction worker, we need to know who brought him into the country, and the site where he is currently working. [The system] has to provide all this,” Sun Online quoted Ali as saying.

Last week the Ministry of Foreign Affairs stalled the handover of 8000 passports to their respective High Commissions claiming that details regarding the owners’ whereabouts still needed to be obtained by immigration authorities.

State Foreign Minister Hassan Saeed said the Foreign Ministry would only deliver the passports to the respective consular authorities once immigration clarified the location of the owners, a task described as “huge” and “difficult” by Immigration Controller Dr Mohamed Ali.

In December last year, parliament voted unanimously to instruct the government to terminate the border control project agreement with Nexbis.

All 74 MPs in attendance voted in favour of the Finance Committee recommendation following a probe into the potential financial burden placed on the state as a result of the deal.

Presenting the Finance Committee report to the floor, Committee Chair MP Ahmed Nazim explained that the “main problem” flagged by the ACC was that the tender had not been made in accordance with the documents from the National Planning Council that authorised the project.

The documents were changed to favour the chosen party and facilitate the deal, Nazim said, which the ACC considered an act of corruption.

Nexbis is “systematically denying” any allegations of corruption, according to a company source, adding that if there was any foul play within the contract “we were unaware of it”.

Earlier this month, Vice President for Nexbis Nafies Aziz told Minivan News that “intelligence” received by the company suggested groups backing the country’s lucrative human trafficking industry could be seeking to stymie the introduction of its border control system to undermine national security controls.

Meanwhile, a source with knowledge of the present immigration and border control system said that should parliament’s termination decision be upheld, the Immigration Department would be returning to “a pen and paper system” for monitoring arrivals to the country.

Foreign Ministry stalls return of 8000 “ownerless” passports

The Foreign Ministry has stalled attempts to hand over almost 8000 foreign passports to their respective High Commissions, claiming details regarding the owners whereabouts still needed to obtained by immigration authorities, local media has reported.

State Foreign Minister Hassan Saeed said the Foreign Ministry will only deliver the passports to the respective consular authorities once immigration clarifies the location of the owners, a task described as “huge” and “difficult” by Immigration Controller Dr Mohamed Ali.

Saeed claimed the number of foreigners who had not left the Maldives while on temporary travel documents was close to the number of ownerless passports held at immigration, local media reported.

“We have a number of foreigners who have left the Maldives on temporary travel documents. But if that number does not match with the passports and if we try to hand over the passports there will be complaints, and questions asked over the quantity of the passports and the whereabouts of the holders,” Saeed was quoted as telling local newspaper Haveeru.

Dr Ali told Minivan News on Tuesday that it would be a “huge task” to obtain the details needed before the passports could be handed over to the respective High Commissions.

Asked if it was realistic to expect immigration to find the whereabouts and details of the owners of all 8000 passports, Ali said such feat would be a “difficult task”.

According to local media the exact number of expatriates in the Maldives is unknown. However immigration statistics show there are 120,000 registered expatriates who regularly pay their visa fees and a further 40,000 illegal immigrants.

Ali told local media that the majority of the passports are from Bangladesh, however there were passports from India and Sri Lanka as well.

An official from the Indian High Commission said the passports should be returned to the respective governments, as they posed a security risk.

The official condemned the practice of Maldivian employers – including some government departments – withholding the passports of their employees: “Keeping someone’s passport is a threat on a private level.

“Passports should belong to the person and no one else. It is a security risk for individuals to not have their passport in their possession,” the official said.

Earlier this month, the Ministry of Foreign Affairs inaugurated an initiative targeted at raising awareness of the issue of human trafficking in the Maldives.

The Maldives has come under strong criticism internationally in recent years over its lack of effort to prevent people trafficking, with the country appearing on the US State Department’s Tier Two Watch List for Human Trafficking three years in a row.

Speaking at the recent inauguration of the Blue Ribbon Campaign Against Human Trafficking, Minister of Foreign Affairs Dr Abdul Samad Abdulla stated the initiative formed part of a larger plan to try and addressing human trafficking in the Maldives.

“We have been conducting a lot of work to deal with the issue, though it may be generally a little known fact,” Samad claimed. “Our intention now is to work together with local media outlets and create more awareness about the issue. I would like to request media cooperate in this initiative.”

The Foreign Ministry also announced it had signed a memorandum of understanding (MOU) with multiple local media outlets in the country to conduct the Blue Ribbon Campaign.

Human traffickers sabotaging border control deal: Nexbis

The Malaysian IT company at the center of legal wrangling over a deal to provide a border control system (BCS) to the Maldivian government has alleged “criminal elements” could be behind efforts to scupper the agreement.

Vice President for Nexbis Nafies Aziz told Minivan News that “intelligence” received by the company suggested groups backing the country’s lucrative human trafficking industry could be seeking to stymie the introduction of its BCS to undermine national security controls.

The comments were made following an appeal hearing held at the country’s Supreme Court on January 9 to block an unanimous vote by parliament to terminate Nexbis’ agreement with the government over allegations of “foul play”.

The country’s Anti-Corruption Commission (ACC) said that regardless of its concerns about human trafficking in the Maldives, a case regarding the Nexbis’ deal had been submitted to the Prosecutor General (PG’s) Office under the previous government.

Meanwhile, a source with knowledge of the present immigration and border control system said that should parliament’s termination decision be upheld, the Immigration Department would be returning to “a pen and paper system” for monitoring arrivals to the country.

The Maldives has come under strong criticism internationally in recent years for the prevalence of people trafficking, and the  country has appeared on the US State Department’s Tier Two Watch List for Human Trafficking for three years in a row.

In a statement to Minivan News, Nexbis Vice President Aziz said that the company was now awaiting the Supreme Court’s decision concerning its appeal hearing on January 9.

“The ACC in the previous Supreme Court hearing submitted that there was no implication on Nexbis or any corruption whatsoever in the contracting state of the Border Control System project,” he said. “The Border Control System is fully implemented and is operational in Male’ International Airport.”

Responding to allegations of wrong-doing in its signing of a border control agreement with the Maldives government, Aziz alleged that “criminal elements supporting human trafficking” had been identified through its “intelligence” as potentially funding a campaign to halt its agreement.

“Stakeholders across the political spectrum have in the recent past all highlighted the growth of human trafficking in the Maldives and pointed out to hundreds of millions of dollars of illegal gains made by the criminal elements behind the growth of human trafficking in the Maldives who stand to lose out the most from the full implementation of the Maldives Immigration Border Control System,” he claimed. “To that end, as the public can clearly see, there is an elaborate amount of money that is being spent to campaign against the Border Control System and the security it will bring to the country.”

Aziz also contended that any attempts to weaken border controls in the country would only serve detrimental to the nation due to not only an “influx of illegal immigrants to the country,” but also the nation’s international standing.

“In addition to this, the Maldives has been on the US State Department’s Tier 2 Watch List for Human Trafficking for three years running now and may possibly be re-classified this year into Tier 3, which is the worst category, if proper controls and systems are not put in place,” he said.

“The implications are far reaching and would again impact the people of Maldives as countries around the world begin imposing stringent visa requirements on Maldivians.”

Aziz said it had become “imperative” for Maldives’ national security that supposed efforts by human traffickers to sabotage its agreement did not succeed.

“The full implementation and operation of the Nexbis BCS will undoubtedly help curb issues of human trafficking, identity fraud as well as weak enforcement controls. The Border Control System encompasses a total end-to-end solution for a Build, Operate, Transfer (BOT) contract term as stipulated by the National Planning Council,” he said.

“This is a proven and internationally certified system, and shall provide the required border control capabilities including foreign worker management and mobile enforcement features, which will increase the efficiency of the current immigration processes. The biometric capabilities of the system are certified to be of the highest performance worldwide for speed and accuracy,” he said.

Immigration Controller Dr Mohamed Ali was not responding to calls at the time of press.

However, a source with knowledge of the current immigration and emigration system – who asked not to be identified – told Minivan News that border control authorities were facing “lots of problems” in performing their function. These problems were said to have arisen due to ongoing wrangling over the Nexbis deal.

While not wishing to comment on Nexbis’ allegations of possible criminal involvement in efforts to halt the project, the source claimed that a failure to implement a BCS like that being offered by the Malaysia-based firm would “strengthen the hand” of human traffickers operating in and out of the country.

The source said that the biometric systems included within Nexbis’ system were a step towards curbing a common practice of returning illegal immigrants – in some cases with criminal convictions – to the Maldives under new identities.

With the Supreme Court yet to decide on the legality of parliament’s decision to terminate the Nexbis agreement, Minivan News understands the company’s BCS is still being used at Ibrahim Nasir International Airport (INIA) to screen arrivals.

However, the source said that Nexbis technical staff who had implemented the border system had been removed from the project, meaning that any bugs or issues with the technology were unable to be resolved.

“We need the system to capture biometric details from passengers in cases where people are changing names. This would make it impossible to create false passport under separate names as people are doing right now,” the source said.

The same source also said the automated system would allow authorities to run background checks on passengers on incoming flights.

A decision to uphold parliament’s decision to cancel the Nexbis agreement – a stance the government has said it will honour – would see immigration officials having to use “a pen and paper system” for monitoring immigration, the source claimed.

ACC view

The MVR 500 million (US$39 million) BCS project moved ahead last year after a series of high-profile court battles and delays that led Nexbis to last year threaten legal action against the Maldivian government should it incur losses for the work already done on the project.

The Malaysia-based mobile security provider has come under scrutiny by political parties who claim that the project is detrimental to the state, while the Anti-Corruption Committee (ACC) has alleged corruption in the bidding process.

Despite Nexbis’ claims that “no implication” of corruption had been registered by the ACC, the corruption commission’s President Hassan Luthfee said his department would only have previously sent a case to the PG’s Office if it held concerns with the agreement.

However, Luthfee also conceded his department had been made aware of issues regarding human trafficking in and out of the country.

“We have received complaints about people smuggling to the country, but we have not been able to start an investigation as the size of such a case is beyond our capacity,” he claimed, adding that the ACC was not tasked to investigate such matters.

“This is just too big a case. [For example] there have been some claims that ships from Sri Lanka and India are travelling to the Maldives around 20 kilometres from Male’ and transferring people to fishing vessels, and from there they are distributed as laborers across the country. These are reports I have received.”

Migrant concerns

Meanwhile, late last year, Indian authorities told Minivan News that tightened restrictions on providing medical visas to Maldivians was a “signal” for the country’s government to address a number of concerns about the nation’s treatment of migrant workers.

Rising migrant worker population threat to “Maldivianness, culture and nationhood”: President Waheed

President Mohamed Waheed Hassan Manik has warned the Maldives will face difficulties in seeking foreign assistance should it descend to Tier 3 of the US State Department’s human-trafficking watch list.

Speaking at a ceremony to celebrate National Day, Waheed stated the Maldives is now “forced” to take measures against changes to the “national character” due to the rising number of migrant workers in the country.

The Maldives has been listed on the tier 2 watch list for human trafficking for three years in a row. Waheed stated that if the country descends to Tier 3, “it would face difficulties, among other issues, in seeking foreign assistance”.

In 2012, the Maldives only narrowly avoided a descent to Tier 3 – the worst category – after presenting a written plan that, “if implemented, would constitute making significant efforts to meet the minimum standards for the elimination of trafficking.”

In his speech today (January 13), Waheed said the government was taking measures to prevent the country from falling into Tier 3 category of human trafficking, by initiating an awareness campaign underway and a draft bill on anti-trafficking submitted to the People’s Majlis.

Foreign influence threatens “Maldivianness”: President Waheed

In his National Day speech, Waheed also warned that the Maldivian population risks being overtaken by the migrant population in just six years if immigration continues to grow at its current rate.

Waheed stated that this was something “no Maldivian can and will, want to accept”.

“If the number of migrant workers continues to increase, [Maldivian] national character will be lost,” the President was reported as saying on the island of Fonadhoo in Laamu Atoll.

“If the influence of foreigners grows, [the] threat of negative impacts on Maldivianness, culture and nationhood is not unrealistic,” he added.

Border control system crucial in addressing human-trafficking

At the National Day speech, the President was reported as saying that an effective border control system was crucial for addressing trafficking.

Last month, parliament voted unanimously to instruct the government to terminate the border control project agreement with Malaysia-based IT group Nexbis, over allegations of corruption.

Speaking about the BSC project last month, Majlis Finance Committee member Ahmed Hamza told Minivan News at the time there was a “worry” within the immigration department that their own border control system would not be sufficient.

Furthermore, Hamza stated there was a “possibility” that human trafficking could increase should the Nexbis contract be cancelled, and to combat this parliament will need to provide a “sufficient solution to deal with these problems”.

Speaking at National Day, President Waheed claimed there were approximately 111,000 migrant workers using work visas and over 40,000 illegal migrant workers in the Maldives.

‘Blue Ribbon Campaign Against Human Trafficking’

Meanwhile, former President Mohamed Nasheed gave his own National Day statement calling for a security force that is “impartial and honest” to help build the nation.

“The nationalism that had defended [our] freedom [in the past] should be beneficial to the people and their progress.

“The true guardians of this system are the people. Today, due to an uninvited interference by the security forces to the people’s rightfully elected government and their interference to the progress of the nation has resulted in re-emergence of the old political culture,” Nasheed said, in a statement.

The Ministry of Foreign Affairs has today inaugurated an initiative targeted at raising awareness of the issue of human trafficking in the Maldives.

The Maldives has come under strong criticism internationally in recent years over its record in trying to prevent people trafficking, with the country appearing on the US State Department’s Tier Two Watch List for Human Trafficking three years in a row.

Speaking at the inauguration of the Blue Ribbon Campaign Against Human Trafficking, Minister of Foreign Affairs Dr Abdul Samad Abdulla stated that the initiative formed part of a larger plan to try addressing human trafficking in the Maldives.

This strategy is expected to include activities to try and raise awareness among students and the business community. The tourism industry, which employs the largest number of foreign staff in the country, was identified as another key focus of the initiative.

“We have been conducting a lot of work to deal with the issue, though it may be generally a little known fact,” Samad said. “Our intention now is to work together with local media outlets and create more awareness about the issue. I would like to request media for strong cooperation in this initiative.”

The Foreign Ministry also announced that it had signed a memorandum of understanding (MOU) today with multiple local media outlets in the country to conduct the Blue Ribbon Campaign.

The MOU states that the media outlets will produce and broadcast programmes aimed at disseminating information on the issue of human trafficking.

The media outlets signed up to the scheme will also be required to report widely on related cases, providing airtime to create awareness on how to combat the issue, as well as reports on measures taken by the government in its fight against the issue.

The media outlets which signed the MOU today are MBC, Haveeru, VMedia Group, RaajjeTV, Miadhu Daily, Channel News Maldives, Sun Magazine, Sun FM, Sun Online, DhiFM and DhiFM Plus.

However, the Ministry of Foreign Affairs said it would not be answering any questions from media today on its work and other issues affecting human trafficking during today’s press conference.

The ministry itself defines human trafficking as “taking undue advantage of a person through employing him, transferring him from place to place, taking guardianship of him, depriving him of making decisions on personal matters, assuming control over him through threats or abuse of power; or to create dependence, kidnap, or deceive him through any other means and take undue advantage of a person’s weaknesses and to conduct any of these activities in a manner that includes exchange of money from or to oneself.”

Under the new scheme, individuals held responsible for human trafficking offences in future would be officers in government offices mandated to oversee the issue, and yet fail to do so, as well as companies and other groups found to be involved in illegal practices.

Employers who force employees to work with no respect or regard to protecting human rights and persons who obstruct the taking of legal action against people who commit human trafficking offences will also be held responsible, according to the Ministry of Foreign Affairs.

Visa restrictions “signal” Maldives must address expatriate concerns: Indian High Commission

Indian authorities have said that tightened restrictions over providing medical visas to Maldivians are a “signal” for the country’s government to address a number of concerns about the nation’s treatment of migrant workers.

The Indian High Commission in the Maldives, which this month tightened rules on granting medical visas for Maldivians, has today claimed the action was taken to draw attention to fears over the treatment of workers from India by both local employers and authorities.

The High Commission has claimed that the tightened restrictions were in line with a bilateral agreement signed back in 1979 and its appropriation by Maldivian authorities in the intervening years.

The Department of Immigration and Emigration has today said it was presently working to address some of the issues raised by Indian authorities.

However, some of the High Commission’s concerns have been played down by Home Minister Dr Mohamed Jameel Ahmed, who earlier this week dismissed allegations that Indian workers had experienced difficulties in coming to the Maldives.

Diplomatic tensions

Amidst increased diplomatic tensions between the Maldives and India in recent months, members of the public have this month found themselves queuing outside the Indian High Commission in Male’ in order to obtain visas to travel for medical treatment.

In some instances, local people have complained of queuing for over 24 hours outside the high Commission’s building in Male’ to try and get a limited number of daily tokens for obtaining an Indian medical visa.

A high commission source speaking to Minivan News today claimed that critically ill patients seeking urgent medical attention outside of the Maldives were being cleared for travel immediately, while other cases were being prioritised depending on the severity of their illness.

The source also contended that all visas given to Maldivians for travel to India were provided free of charge – a courtesy claimed to have not been extended to Indian citizens coming to the Maldives for work.

The commission spokesperson added that the introduction of the tighter regulations was in line with the visa agreement signed back in 1979 and was imposed as a clear “signal” from Indian authorities that the concerns it had over practices in the Maldives such as the confiscation of passports of migrant workers, needed to be brought to an end.

On November 26 this year, a public notice had been issued by the Maldives Immigration Department requesting no employer in the country should be holding passports of expatriate workers.

The Maldives has come under strong criticism internationally in recent years over its record in trying to prevent people trafficking, with the country appearing on the US State Department’s Tier Two Watch List for Human Trafficking three years in a row.

Back in October, a senior Indian diplomatic official in the Maldives had expressed concern over the ongoing practice of confiscating passports of migrant workers arriving to the country from across South Asia – likening the practice to slavery.

The high commission also claimed this year that skilled expatriate workers from India, employed in the Maldives education sector, had continued to be “penalised” due to both government and private sector employers failing to fulfil their responsibilities.

Meanwhile, a senior Indian medical working in the country has also alleged that expatriate professionals were regularly facing intimidation and fraud in the country from employers and some members of the public.

“Real progress”

Sources with knowledge of the High Commission’s present discussions with Maldivian authorities have nonetheless expressed hope that “real progress” was being seen in trying to address both countries’ respective grievances over the medical visa issue.

Minivan News understands that discussions were being held to ensure that aside from verbal commitments, Maldivian authorities would directly address the concerns Indian authorities held about the treatment of its citizens.

The Department of Immigration and Emigration today said it was presently working to try and resolve some of the concerns raised by the Indian High Commission over treatment of expatriates coming to work in the Maldives.

Immigration Controller Dr Mohamed Ali confirmed to Minivan News that his department was looking into issues such as Maldivian employers confiscating passports of Indian workers.

“We are working on that,” Dr Ali responded when asked if officials were working on issues such as retaining the passports of Indian Expatriates in the Maldives. The immigration chief did not clarify the exact nature of the work presently being carried out by his department on the matter.

Speaking to local media on Thursday (December 27), Home Minister Dr Mohamed Jameel Ahmed dismissed accusations from the high commission that Indians were facing difficulties in travelling to the Maldives – as well as claims that some 50 nationals from the country had been deported this year.

Dr Jameel pointed to recent tourism ministry statistics that he said indicated 4,180 Indians had travelled to the Maldives to date this year.

“If you look at these numbers, there is ground to believe that it’s relatively easy for Indians to travel to Maldives. Moreover, the policy is the same for other neighbouring countries,” he was quoted as telling newspaper Haveeru.

Dr Jameel was presently out of the country and unable to respond to calls from Minivan News at the time of press.

However, the High Commission, in a statement released yesterday (December 28) said that the home minister had incorrectly stated figures of visitor numbers to the Maldives

“The [home minister’s] statement contains incorrect facts and figures. While it states that only 4,180 Indians have travelled to Maldives so far this year, as per statistics published by the Maldives Ministry of Tourism, 26,199 tourists from India have arrived in Maldives during the period January – November 2012,” the commission’s own statement read.

“Regarding the deportation of Indian travellers from Male’ International Airport, the High Commission of India stands by its figures. The high commission urges that the above figures may be verified and, the general public may be apprised of the correct facts.”
