MDP primaries restart after cancellation of disorganised first poll

The Maldivian Democratic Party (MDP) has restarted voting in 18 parliamentary primaries after polls were cancelled yesterday following administrative and voter registry issues.

Minivan News observed large and orderly queues at Dharubaaruge today where voting for 12 constituencies is currently proceeding. Ballot boxes for the remaining 6 constituencies have been placed at Malé City Hall and party offices in Hulhumalé and Villingili islands.

Candidates and voters complained of  fluctuations in the voter register, but MDP Chairperson and primary candidate ‘Reeko’ Moosa Manik said he did not notice significant changes in his own constituency.

According to MDP media official and MP Ali ‘Alibe’ Mohamed, voting was cancelled yesterday due to “unmanageable” large crowds, with the MDP having scheduled voting for 58 constituencies at Dharubaaruge for all party members registered in Malé. Voters also took issue with their names not being present on the party registry, he said.

“The MDP has a very large membership. We were unable to accommodate such a large number of people at Dharubaaruge all at once yesterday. Many voters also complained over their names not being present on the voter list,” Alibe said.

The MDP is the largest political party in the Maldives with 43,277 members registered at the Elections Commission.

Eyewitnesses described the scene as a “bureaucratic nightmare” and accused ruling Progressive Party of the Maldives (PPM) members of disrupting the vote.

A 10 member committee – which includes former President Mohamed Nasheed and parliamentary group leader Ibrahim ‘Ibu’ Mohamed Solih – has been set up to oversee polling.

Candidates in 27 of the 85 constituencies have won the MDP ticket without a primary. They include Eva Abdulla for Galolhu Uthru, Ali Azim for Henveiru Medhu and Imthiyaz Fahmy for Maafannu Uthuru in Malé.

Voting was completed for Kulhudhufushi North and Dhuvaafaru constituencies yesterday. The party hopes to schedule polls for the remaining 38 constituencies in the upcoming week, Alibe said.

Nightmare

Candidate for Machangoalhi Uthuru Aishath Velezinee described the large crowds at Dharubaaruge yesterday as “suffocating.”

“There were too many people, too many ballot boxes. Even I left without voting. People were really cheerful yesterday. Quite a few are elderly and some of them were sick. So they got tired and left without voting. I’m hoping all of them return today,” she said.

Ahmed Hameed, 29, said his name was not present on the voter registry despite having submitted a membership form in February 2012. He also claimed he saw PPM members at Dharubaaruge to disrupt the vote.

“We know faces. Very well known PPM members were there. They were pushing and shoving people. MDP members are not like that. There was so much aggressiveness,” he said.

Polls had originally been scheduled from 2:30 pm to 8:00 pm, with ballot boxes set-up in every island and in Malé. At 4pm, however, the MDP announced it was cancelling the vote and rescheduling polls for 12 constituencies between 9:00 pm – 12:00 pm in Malé.  The party was subsequently unable to proceed with this vote, eventually rescheduling a new vote for 18 constituencies today.

These 18 constituencies include 10 Malé City seats and eight atoll constituencies – Addu Meedhoo, Addu Hulhudhoo, Nilandhoo Meedhoo, Mahibadhoo, Hithadhoo Uthuru, and Hoarafushi constituencies.

According to the MDP, voting had proceeded smoothly in only these eight constituencies yesterday, and today’s polls would allow constituency members residing in Malé to vote.

Despite the cancellation of polls yesterday, MDP members remain positive. Zubaidha Mohamed, 29, said the experience was a learning process for the MDP.

“We are the only party in the Maldives to hold primaries on such a large scale. This is a learning process. I think today’s voting will go well,” she said.

Ahmed Ikram, 22, said voting was proceeding smoothly, but expressed concern over the voter registry.

“Things are going well today. But there are still several complaints regarding names not being present on the voter registry. Some people who voted in the primaries for local councils say their names are not present on the list,” he said.

Double voting

The MDP had published an updated voter registry on January 10, which included all membership forms submitted to the party offices up until December 19.

A press release at the time said the party had received 10,518 new membership forms in the period between December 10 and 19. Of that number, 5,464 forms were received on December 19. The final list was published on the party’s website on January 10.

The party opened up a ten-day window from January 7 – 15 to allow voters to register. According to the MDP’s election committee member Ibrahim Waheed, members were required to register if they were voting in a location different to the one registered for the nationwide local council elections held on January 18.

After members complained of their names not being present on the voter registry, the MDP has now opened up voting for all MDP members without registration

Election committee member Ali Niyaz has expressed concern over room for double voting, but said he hoped candidate’s representatives at polling booths would monitor repeated votes.

The MDP will also crosscheck lists of those who voted in their constituencies and in Malé to ensure no double voting took place, Niyaz said.

Changing lists

Candidates and members alike have complained of frequent changes to the party registry.

“I have been carrying out a targeted campaign. I initially received a list with 588 members. Now there are 846 members on the list. There are entire households on the list who told me they are not MDP members when I visited them,” Velezinee said.

Meanwhile, MDP member Ahmed Hameed said he believed several candidates had submitted new membership forms to manipulate the vote in order to win the party ticket.

“Many MPs have submitted forms just to win the party primary. That is not good for the party. The party membership will not be genuine or healthy. I think the vote should be delayed until all issues are resolved. Otherwise people may question the validity of the vote,” he said.

However, MDP Chairperson and primary candidate ‘Reeko’ Moosa Manik said he did not notice significant differences in the voter registry.

Candidate for Machangoalhi Dhekunu Noorban Fahmy said she did not want to comment on the registry, but said she hoped voting would proceed smoothly today.

Minivan News was unable to reach MDP’s membership committee chair Ali Shiyam at the time of press.

Nasheed threatens impeachment after MDP wins in Addu, Malé cities

Following the opposition Maldivian Democratic Party’s (MDP) win in Malé and Addu cities, former President Mohamed Nasheed has predicted an MDP majority in parliamentary elections scheduled for March and threatened to impeach President Abdulla Yameen.

MDP appears to have won all six of the local government seats in Addu City and eight of the 11 Malé City seats. Results for the remaining 1083 island and atoll council seats are rolling in.

Speaking at a press conference tonight, Nasheed predicted the MDP will win approximately 700 of the 1100 local government seats and said he believed the Maldivian citizens continued to hope for an MDP administration.

“The Maldivian citizens still want an MDP government, and for Maldives to be ruled according to MDP’s philosophy. I would like to tell the Maldivian public, do not be disheartened. God willing, without much delay, we will take over the government,” he said.

Nasheed had lost November’s controversial presidential elections narrowly, winning 48.61 percent of the vote (105,181) to Yameen’s 51.39 percent (111,203) – a difference of just 6,022 votes.

The 2013 presidential elections were marred with repeated and controversial delays after the Supreme Court annulled a widely commended first round of polls.

The apex court then imposed a 16-point electoral guidelines on the Elections Commission (EC), which critics say limit the independent commission’s authority to administer elections and allow political parties and candidates to veto elections.

Nasheed’s threat of impeachment comes after allegations of electoral fraud involving fake national identity cards in the presidential polls.

Elaborating further tonight, Nasheed said: “There are many ways to legally change a government. One of them is through the People’s Majlis. I believe the local council elections indicate the direction the People’s Majlis will go. I believe Maldivians want an MDP majority in the country, and an MDP government in the country.”

“The laws state two methods for changing a government. That is through an election or through a no confidence vote followed by an election. If the Maldivian citizens give us a majority in parliament, then we will be forced to take that no confidence vote,” he continued.

Earlier today, Nasheed said the non-existent voters had been added to the voter registry as part of “efforts to rig the election through the Supreme Court.”

The Supreme Court’s guideline included a clause ordering the EC to discard its voter registry and compile a new list based on the Home Ministry’s Department of National Registration’s (DNR) database.

Speaking to the media this afternoon, Nasheed said the DNR’s list contained hundreds of eligible voters without photos.

“We suspect very strongly that those without photos are non-existent people. However, they voted in the presidential election,” Nasheed said.

EC President Fuwad Thowfeek told parliament’s Independent Institutions Committee on Thursday (January 16) that the first list with ID card photos provided by the DNR was missing photos of more than 5,400 people.

However, the DNR provided photos of about 4,000 voters two weeks ago, Thowfeek told MPs, which left the final voter lists without the photos of 1,176 people.

Asked if photos could have been repeated in the DNR list, Thowfeek said the EC could not check and verify the information.

Commonwealth observers recommend Majlis examine “consistency and workability” of Supreme Court guidelines

The Commonwealth Observer Group who monitored the 2013 presidential polls has recommended that the People’s Majlis examine the consistency and workability of the Supreme Court’s 16-point electoral guideline.

The guideline, issued following the annulment of the September 7 first round of polls, “appeared to undermine the authority of the Election Commission, were inconsistent with or contrary to electoral law, and were at odds with the Constitution,” the Observer Group said in its final report.

The report obtained by Minivan News also condemned the Maldives Police Services’ obstruction of the October 19 presidential polls as “unacceptable.”

The Supreme Court annulled the September 7 presidential poll citing widespread electoral fraud despite international and domestic praise of a free and fair vote.

The Elections Commission (EC) has criticised the guidelines as “restrictions” that limit the power of the independent state institution. The guidelines give candidates veto over the elections as their signature is mandated on the voter registry.

The ruling Progressive Party of the Maldives (PPM) and 295 independent candidates have failed to approve the voter registry for the local council elections scheduled for Saturday. However, the EC has decided to proceed with polls.

The Commonwealth Observer Group found the 2013 presidential polls credible despite the Supreme Court’s constraints, the report said.

Guidelines

The Chairperson of the Commonwealth Observer Group Dr Lawrence Gonzi said many of the Supreme Court’s guidelines were “incompatible with existing Maldivian electoral law, and in our view, do not conform with electoral best practice.”

Several national stakeholders had told the group that the guidelines were “cumbersome and impractical.”

In international best practice, no significant changes should be made to the electoral framework six months prior to an election, the report said.

“The Group was therefore particularly concerned that the guidelines given by the court in effect changed the electoral procedures in the middle of the electoral process, creating a great deal of unnecessary uncertainty and confusion,” the report read.

If the legislative and regulatory framework governing the electoral process is to be changed, the legislature instead of the judiciary must undertake the task, the report said.

The group called on the Majlis to make amendments it believes necessary to the existing law to ensure all future elections are conducted “according to the proper legal framework.”

Further, the group has recommended that the mandate and the statutory constitutional independence of the EC be recognised.

Annulment

The Supreme Court’s annulment of the September 7 election and cancellation of three subsequent elections “severely tested the democratic process in the Maldives,” the report said.

The group reiterated that the first round of polls held on September 7 were “credible and consistent with the international standards to which the Maldives has committed itself.”

The report highlighted that the EC was not given access or right of response to a police forensic report based on which the Supreme Court annulled the election.

The annulment of the polls and the lack of predictability of the electoral timetable led to a deterioration of the “largely positive political environment observed in early September” while political parties reported a negative effect on their ability to campaign, the report said.

It also noted that EC members and staff were subject to death threats and verbal harassment over alleged vote fraud.

Voter registry

In the Supreme Court verdict, four of the seven judges invalidated 5,623 votes claiming they were repeated votes, votes cast by dead people, and votes cast by people who had discrepancies in their names and addresses.

The court then ordered the EC to discard its registry and rely on the Home Ministry’s Department of National Registration (DNR) to compile a new voter registry.

However, the Commonwealth Observer Group has praised the EC’s voter registry noting that the EC “took steps to ensure accuracy of information and transparency in the administration of the process.”

The EC had engaged the electorate, providing two periods for verification of information and amendments, the report said.

Furthermore, “fears expressed by some political parties regarding possible large numbers of deceased voters remaining on the list and voters registered in the wrong geographic area seem to be unfounded,” the report added.

The group has recommended that the EC maintain a separate voter registry and said that it “should have sole responsibility for, and be empowered to ensure, the credibility and accuracy of that register in accordance with the 2008 constitution of the Maldives.”

The report said the group was consistently “impressed by the enduring commitment of the Maldivian people to the democratic process, who on each occasion have turned out to vote in very high numbers.”

Further, the group said it is “impressed by the professionalism of the Elections Commission and its staff, who have shown a great determination to fulfill their mandate in extremely challenging circumstances.”

Former President Mohamed Nasheed has meanwhile warned of collusion between the ruling Progressive Party of the Maldives (PPM) and the Supreme Court to subvert the local council elections.

“We clearly know political party leaders are bribing judges,” said Nasheed, stating that the Supreme Court’s attempt to “steal elections” and “destroy the Maldives” will be written in history.

Majlis will reconvene to discuss revenue raising measures

The People’s Majlis has agreed to return from recess on Tuesday (January 14) in order to discuss urgent amendments to tax and tourism legislation that will enable the government to raise vital revenue.

Local media has reported that the session will begin at 9am.

President Abdulla Yameen last week called upon the legislature to reassemble in order to facilitate the record MVR17.95 billion budget passed last month – of which MVR3 billion is reliant on new revenue raising measures.

“God willing, when the revenue related bills are passed next week the projects in atolls will speed up”, he said.

The measures include hiking Tourism GST from 8 percent to 12 percent, revising import duties, continuing tourism bed tax for one more year, raising airport departure charge for foreign passengers from US$18 to US$25, leasing 12 islands for resort development, introducing GST for telecommunication services, and obtaining resort lease payments as a lump sum.

Following the Majlis’s failure to extend tourism bed tax before the start of the current recess, Finance Minister Abdulla Jihad told local media that the resulting losses to state revenue would be MVR100 million a month.

Supreme Court orders Criminal Court to restart trials

The Supreme Court has ordered the Criminal Court to restart trials following the court’s decision to suspend all cases in the absence of a prosecutor general (PG).

In a statement today, the Supreme Court said it had told the Criminal Court that the criminal justice system must proceed in order to maintain constitutional rule.

The apex court ordered the Criminal Court to “continue with all ongoing cases without any obstruction, and continue issuing rulings such as that on [pre-trial] detentions as before.”

The Criminal Court had announced yesterday it will halt all ongoing cases as the PG’s position has been vacant for more than 30 days.

Former PG Ahmed Muizz had resigned from his position shortly before the parliament was set to debate a no confidence motion against him.

Speaking to Minivan News, deputy PG Hussein Shameem condemned the Criminal Court for its decision, alleging the court had not discussed the matter with him or the parliament.

Further, people held in pre-trial detention may have to stay in remand centers if cases do not go ahead, Shameem said.

“So what do they do now, it would not be fair to keep them in there until the parliament comes back to work from recess after three months and appoint a new PG,’’ Shameem said.

“That is one of my biggest concerns over this issue, it is a responsibility of the PG office to uphold constitutional rights of the people.’’

There were no laws stating that the deputy PG cannot fulfill the responsibilities of PG in the case of the position being vacant, Shameem added.

He argued that PG’s office’s work must not come to a halt because the parliament had failed to appoint a new PG.

On December 10, President Abdulla Yameen proposed his nephew Maumoon Hameed for the post of Prosecutor General and submitted the name to the parliament for the MPs to approve.

The issue was sent to parliament’s Independent Commissions Committee and the committee decided to seek public opinion on him before sending it to the parliament floor for voting.

However, the parliament is now on recess and will not start work until March.

President calls on Majlis to expedite revenue raising measures

President Abdulla Yameen has said development projects can only be spoken of after the People’s Majlis passes revenue raising measures.

Yameen said  that in order to speed up the bills, a request for parliament sittings during this recess period had been submitted with signatures of twenty six members of parliament.

“God willing, when the revenue related bills are passed next week the projects in atolls will speed up,he said.

The Majlis in December passed a record MVR17.95 billion budget of which MVR3 billion is to be realised only after the parliament approves revisions to existing legislation.

Q&A: Hamid Abdul Ghafoor MP – Henveiru South constituency

In a series of interviews to lead into the the 2014 parliamentary elections – scheduled for March 22nd – Minivan News will be conducting a series of interviews with incumbent MPs.

All 77 sitting members have been contacted, from across the political spectrum, to be asked a standardised set of questions with additional topicals. The interviews will be published as and when they are received.

As part of the series, Minivan News interviewed Hamid Abdul Ghafoor, MP for the Henveiru South constituency.

Ahmed Rilwan: What made you enter the political arena and how?

Hamid Abdul Ghafoor: In my case it was more about what I could do for the party. When I joined the MDP the first question I asked was what can I do for you. So I have been doing what the party – as collective – felt was the best thing I could do for the party. They recognize what I could do collectively.

I was studying in New Zealand when MDP was formed. I kept in touch through the internet, because I shared the same ideology.  In 2005 I returned to Maldives and when President Mohamed Nasheed started registration for the party at ‘Dhunfini Haruge,’ [MDP office] I signed on the first day.

AR: Based on your attendance and work in this ending term, how would you judge your performance as an MP?

HG: The biggest and most important privilege I had during my term was to introduce the Decentralisation Bill on the party’s behalf and to push and get it through. Because of that we came to have local councils, and that changed this country.

That the MDP tasked me with the lobbying of such an important bill shows its confidence in me. We got about 70 percent of the bill through, but we still have thirty percent more to go. For instance there is no fiscal decentralisation, it is a problem that I am very concerned about. Decentralisation is key to democracy and economic development.

We stood up against the coup, risking ourselves, even in terms of reputation. I believe even in future there is a role for activism, we are not beyond that. Some people find it difficult to understand MPs as activists, but I define myself as an activist even though I am an MP.

As an MP I stood up for members’ privileges. I’m not a supporter of material privileges, but the protecting the votes of citizens is more important for me. I see the vote I cast as a vote from my constituents. I was standing up for the legal protection of the members against their attempts to minimize the influence of MDP after the coup. They had charges against one third of our parliamentary group at different stages – with police, prosecutor general and in the courts. I stood up against that. I stayed 27 days in parliament, 10 days in house arrest and 2 days in jail

A great achievement of the MDP, myself included, is taking a parliament that was in an undemocratic culture into a democratic one. We contributed to establish a democratic culture with a democratic outlook.

This People’s Majlis passed more bills than any other in the parliamentary history of Maldives. This was a historic People’s Majlis. People became more aware of the role of MPs in national development, and I suspect it could be because of this that the opposition tried to damage the reputation of the Majlis and targeted its members. If there is an undemocratic culture they will target MPs, and standing up against this was an important achievement for me.

I worked in the Committee on Independent Institutions and the Social Affairs Committee, I was the Secretary General of the MDP Parliamentary Goup – to which I was elected each year for the past five years, I was the Chair of Media subcommittee in the Committee on Independent Institutions and the Social Affairs Committee, and the MDP disciplinary committee chair.

Within the party, in addition to being the former secretary general, I was a member of the Foreign Policy Committee and the party’s international spokesperson. I am the vice chair of the MDP Policy Committee, and currently chair of the  Disciplinary Committee.

All these is an indication of the amount of trust the party has in me. I believe that the party is bigger than the individual. I am one of many people who define this party. Changes can be brought not by myself individually, but collectively through working with others. I am a hundred percent party person.

AR: What are the main committees you were in? Which bills did you focus on?

HG: I am in two committees; one is the  Committee on Independent Institutions where I have lobbied for more funding for independent commissions because democracy will not kick in without empowerment of independent commissions. We need a democratic culture in the Maldives, and independent commissions play an important role in creating this. Their mandates were very narrow because the parliament came from an undemocratic culture.

MDP initially did not have a majority in this committee, but when the judicial transition went wrong – especially by making their qualifications a symbolic issue – the independent institutions committee was equally divided between MDP and the opposition, with independent MP Mohamed ‘Kutti’ Nasheed as chair. But considering the circumstances, the committee was reasonably successful.

The other one is the Social Affairs Committee. It was an opposition dominated committee, and I am critical of that committee. It was slow and dull, we couldn’t perform well within that committee. But we were able to dilute issues, and that is our achievement. We stopped many unacceptable actions.

After the coup, for instance in the health sector is the Thalassemia Bill. It was passed by this committee to dismantle the decentralised system. It was hard for us to promote liberal thinking with regards to labor rights within that committee because of the conservative attitude within the committee.

The decentralisation bill was the main bill I focused on. I was involved in lobbying for other bills such as the tax bills and social protection bill. These bills brings about major policy changing laws. I was very vocal in lobbying for social protection.

We had to work against a tide of centralisation and money politics of big businesses. We fought very hard against this. We promoted ethical and democratic values to the Majlis.

AR: What would you say are the biggest achievements within your term; in terms of what you have accomplished for your constituency and the country as a whole?

HG: For my constituency, the biggest contribution was to get them more representation through decentralisation bill and further democratisation and empowerment of the constituents. Another thing is housing, a lot of my constituents got flats. This was a relief for many who were living in highly congested houses. But because of the coup many of the flats that could have been theirs were taken away.

Annually, nearly MVR5 million (US$324,254) worth of assistance is provided for my constituents under social protection programs. The recipients include elderly, orphans, persons with disabilities and single parents. Education and training opportunities were also provided for constituents under MDP policies.

AR: What would you say is the biggest blunder/mistake/worst step you have taken in your political career, why?

HG: There is no big blunder that I know of, I think it is for others to say. My biggest regret, however, is not getting the chance to make significant contributions towards the development of the People’s Majlis, mainly because I was focused on other issues.

AR: Some people see your actions following the Hondaidhoo case, especially taking refuge in the parliament as bad decision, what do you say to this?

HG: It was done against the judiciary, in defense of the right of the people to be represented in the parliament. It was not a bad decision, I am happy about it.

AR: Are you taking the optional committee allowance of an additional MVR20,000? Why or why not?

HG: I don’t take it, and I voted against it. However I believe they should be well paid in order to reduce the chances for corruption, especially to counter money politics. I voted against it because under that government it wasn’t necessary. But after that government they were trying to harm members of the parliament. With the coup I changed my mind about that.

AR: What is your view about MPs and other public servants declaring their financial assets publicly for the electorate to be able to refer to?

HG: I believe we have in our parliament, people who cant distinguish their personal property with state property. People who have an incestual economic relationship with the state. Assets should be declared. I support that.

AR: Are you re-contesting in the next elections? What do you hope to accomplish should you be elected for a new term?

HG: Yes, I am. First thing I would target is judicial reform, then significant economic reform and then social reform. These are the major hurdles we face. Without judicial reform we cannot do anything, there is no hope without it.

AR: What improvements do you feel the 18th Majlis will need to make as an institution?

HG: If I get re-elected I will work for a total overhaul of the parliament. The Majlis budget is relatively small for one of the three powers of the state. Manpower and buildings are needed for the parliament. We need a lot of qualified people in there. We need to increase the institution’s technical capacity too.

AR: What are your thoughts on party switching – do you think it undermines the party system?

HG: It is a very common practice in an emerging democracies. It is connected to the social fabric of the place, to the absence of good governance and to money politics. It is an obstacle for the parliament and the whole system. We do not hear of this so often in advanced democracies. This can be dealt with through legislation and a culture of good governance. We have a two thousand years of written history, we did not have a democratic system or a culture. But considering the scale at which it (party switching) is happening, we should confront it and consistently fight against it.

It will continue to happen here, but I think it will settle in a near future. Because people of Maldives learn really fast. Considering the changes within the past eight years, I am very optimistic.

AR: Anything else you want to add about what you want to see in the coming years as an MP if you are elected, or as a member of MDP?

HG: My urge is to sustain our democratic gains and to improve upon it, without losing any. Democratic gains include taxation, economic reform, decentralisation, separation of powers, setting up of independent institutions. We are not moving back, we are moving forward.

MDP reveals candidates competing in Male’ area primaries

The Maldivian Democratic Party (MDP) has announced the names of candidates competing in its parliamentary primaries for thirteen Male’ City constituencies.

The party also announced that three candidates won the ticket without a primary because they were the only candidates contesting in primaries for those seats.

The three candidates in question were Medhuhenveiru MP Ali Azim, Galolhu Uthuru MP Eva Abdulla, and Maafannu Uthuru MP Imthiyaz Fahmy, who contested for the constituencies they currently represent.

Among other sitting MP s who are contesting in the primaries are Hulhuhenveri MP ‘Reeko’ Moosa Manik, Medhuhenveriru MP Ali Azim, Henverirudhekunu MP Hamid Abdul Ghafoor, and Machangolhi Uthuru MP Mariya Ahmed Didi competing for the seats they currently hold.

Majlis Chair and Keyodhoo MP Abdulla Shahid will compete for the newly introduced Henveiru Uthuru constiuency ticket and Maafannu Dhekunu MP Ibrahim Rasheed ‘Bonda’ for the newly introduced Maafannu Medhu constituency (formerly Villi Maafannu).

Candidates competing in the primaries for all constituencies other than the thirteen Male’ City areas were announced last month.

The only sitting MDP MP s who are not competing in the primaries are Maafannu Hulhangu MP Abdulla Abdul Raheem, Hoarafushi MP Ahmed Rasheed, Komandoo MP Hussein Waheed and Gaddhoo MP Zahir Adam.

In addition to sitting MPs, former members of the Majlis and the Constitutional Assembly, senior members in the MDP government, prominent party activists, and other famous national personalities will be competing in the MDP primaries scheduled to be held on 24 January.

The parliamentary elections are to be held on March 22 to elect the 85 members of the 18th Peoples Majlis for a five year term.

Majlis passes Right to Information Act

The People’s Majlis has unanimously voted to pass the Right to Information (RTI) Act.

The act – first introduced to the Majlis in 2009 – was passed as presented by the Social Affairs Committee with minor amendments with the support of the 67 MPs.

Introducing the bill to the floor, the committee chair MP Abdulla Maseeh Mohamed said the committee had sought assistance from local media and international experts in revising the bill

The bill was first sent to the People’s Majlis in 2007 but was rejected. It was reintroduced to the current People’s Majlis in November 2009, and underwent a complete overhaul at the Social Affairs Committee.

Local NGO TransparencyMaldives (TM) which has advocated for the act for a long time described its passing as “an important step towards increasing transparency of the state institutions, ensuring greater accountability of public officials, and fighting corruption”.

“Transparency Maldives hopes that President Abdulla Yamin Abdul Gayoom will expedite the ratification of the bill.We call on all actors and institutions to provide their full support towards successfully implementing the law once ratified” said the organization in a press released issued today.

Speaking to Minivan News today, Transparency Maldives’ Advocacy and Communications Manager Aiman Rasheed said the act was one of the best legislation  passed by the Majlis.

Once the bill is ratified, subsidiary regulations will need to be passed, an Information Commissioner will need to be appointed and a support structure will need to be implemented, Aiman said.

If ratified the act will bring about major changes to the Maldives access to information regime. Although the current RTI regulation introduced in 2008 through an executive decree applies only to government offices, the new act will apply to all state funded institutions including the parliament, judiciary and independent institution.

Other key features of the act include the establishment of an information office in all state institutions, instituting a seven day period of response for information requests and a thirty day period to proved the information or reason for failure to do so.

An independent Information Commissioner will also be appointed by the parliament from names proposed by the president. Issues with acquiring information can be appealed to the Information Commissioner.
