Criminal Court imprisons murdered child’s mother for six months over negligence

A woman arrested in connection with the alleged sexual abuse and murder of her eight-month old child has been sentenced to six months imprisonment by the Criminal Court after being found guilty of  negligence.

The woman, who was identified as Noorzaadha Ali, of Addu Atoll Hithadhoo, was not herself charged with murdering or sexually abusing the child, although the court ruled that she was in violation of elements of the Penal Code.

According to local media, the presiding judge said that the suspect had not vaccinated the baby or taken proper care to clean the child and failed to explain internal and external injuries to the victim.

On the basis of these findings, the judge declared that Nooruzaadha had neglected her duties as a mother.

Her boyfriend, Mohamed Waheed, stands accused of murdering the child, though the outcome of that trial has not yet been concluded.

The eight-month-old baby boy died in the intensive care unit of Indira Gandhi Memorial Hospital (IGMH) back in June 2009.

Three suspects were arrested in connection with allegations that he had been physically and sexuallly abused.  These suspects included the victim’s mother, Nooruzaadha, 28[then], from Addu atoll Hithadhoo, her boyfriend Mohamed Waheed, 46[then], from Male’, and a third man whose identity has not yet been revealed.

Addressing media at the time, Inspector Hamdhoon Rasheed, head of the police investigation unit, said initial test results revealed the baby had extensive injuries, as well as showing signs of having been sexually abused.

Rasheed said that the boy had suffered head and neck injuries, and was covered in scratches. The hospital reported the case to police after Waheed took the baby in for medical care.

Nooruzaadha had a long history of criminal activity, according to both police and the prosecutor general’s office.

She was arrested twice in 2002, once for sexual misconduct and the second time for prostitution, said Deputy Prosecutor General Hussein Shameem.

She was sentenced to eight months house arrest for the first offence, which she breached, and six months imprisonment for the second.

The same year, she was put under house arrest for disobedience of order, which she violated and was fined Rf150 (US$12). In 2006, she was arrested on the same charge and was ordered to spend two months in jail.

In 2004, Nooruzaadha was handed a six-year sentence for possession of drugs and in 2005 and 2007, she was given two 12-year sentences on each occasion for drug possession.

  5. She was released on parole to give birth to the baby she murdered with her lover. It is sad that the report does not bring to light the parole board and its membership who were responsible for this.

  7. 6 months? This isn't a joke; this is something which has to be taken ‘seriously'!
    This is the reason, today in Maldives the crime rate goes so high! Because, we don't give the 'deserving' right punishments.
    How lucky is she? She will again get pregnant and give birth to an innocent child, abuse him and then kill brutally. Why not? She then has to spend a 6 months’ vacation time in a jail. With food and all the 'living needs'.. free!
    Wake up MALDIVIANS! This is something we should strike for! But unfortunately, nobody will because, they always need some PARTY decorations.

  11. We are all crazy, fools, dumb asses and hypocrites to believe the systems that allow murderers go free and punish the timid who may have done something petty!

    And all what the parliament and the opposition does is, sit back, encourage these judges to be lenient their constituency people so that they can get a vote!

    Birds of a feather will flock together they say; and that is right.

    The parliamentarian, the politician and the judge will all share common boots no doubt!

  14. What a joke.. 6 months for murder and molestation of an inoccent 8 month old. Is this how our system works? 3 to 6 months jail or a fine of Rufiya 1000 for murder, rape, child molestation and so on..

    No wonder this is rampant in the Maldives. All this must have a minimum life sentence to death penalty. I call on all fellow Maldivians to come out and voice this concern.

  18. Yeah thats why they say most judges go to hell,,but this is an easy case..Why didnt the jugde just put them both on life sentence with no parol..!!What a system..and yet we talk about change ,,a great change indeed..!!!

    On the contrary, this is precisely why we cannot implement death penalty in this country.

    The justice system is a bloody joke, and courts appear to be populated by medal wearing fools of the first order.

    A man gets sentenced to 30 years for possession of some grass, but this woman, with a criminal past, whose actions have resulted in the abuse and death of an infant gets off with six months?

    And you want to entrust these utterly incompetent imbeciles with the power to sentence you to death? Are you kidding, mate?

    Not to defend the woman. But ... she was not the murderer. And this case shows good reason why people should be "sentenced to 30 years for posession of some grass." If she was in jail, she would not have to take care of a child who she obviously could not take care of.
