Home Minister Umar Naseer orders preparations for death penalty

Minister of Home Affairs Umar Naseer has released an order on the Maldives Correctional Services mandating the implementation of the death penalty.

“I order the Maldives Correctional Services [MCS] to implement the death penalty – as sentenced by the Supreme Court – through the use of lethal injection, and to make all necessary arrangements for the implementation of such sentences, and to obtain all necessary equipment for the implementation and maintain the set-up at the Maafushi Prison,” read the order signed by Naseer and made public at a press conference today.

The home minister’s decision comes just days after a death sentence was handed to Hussain Humam Ahmed on charges of murdering the moderate religious scholar and MP Dr Afrasheem Ali in October 2012.

The order was received by MCS Commissioner of Prisons Ahmed Shihan at today’s event.

Naseer stated that the order is in alignment with the draft bill on death penalty implementation which the state has made ready for submission to the parliament. He confirmed that advice had been sought from the attorney general prior to the signing of the order.

“We will not wait for laws to be drafted and passed. The law allows for implementation, and it is at the discretion of the home minister to order implementation,” Naseer said, adding that – should a relevant law be passed in the future – the state would then abide by the new laws.

Implementation only after appeals

The home minister further stated that the death penalty will be implemented only after all appeal processes are exhausted. If the sentenced fails to appeal his case, the state itself will initiate all avenues of appeal prior to the implementation of the sentence, he added .

Naseer said that while the order applies to all pending death sentences, and not just the ones that come after the issuance of the order, the state will not seek to expedite any of the existing appeal cases.

“The government will not interfere with the work of the judiciary, either to expedite or slow down a process. The bottom line is, the death penalty will only be implemented once all the appeal processes are completed,” he stated.

“Regulations on how this penalty will be implemented have already been compiled. Media will have access to the centre of implementation, but not will be allowed inside. The MCS now must run training programs for those who will be involved in this work and they will also begin work on establishing the necessary set up,” he continued.

“While this order does not detail a specific deadline for completion of this task, the MCS will have everything ready by the time we will need to implement such a sentence.”

The minister added that, in the case of minors sentenced to death, “I think the rule is to wait till they turn eighteen for implementation of the sentence. It will be done in accordance with international treaties we have signed”.

Naseer stated that, as Home Minister, he would need to sign a specific order to authorise the execution of each individual person sentenced to death.

A source at the Home Ministry stated that, although there are approximately twenty individuals currently sentenced to death, all cases are being appealed at the High Court and have not yet reached the Supreme Court.

Background

While death sentences continue to be issued in the country, these have traditionally been commuted to life sentences by presidential decree since the execution of Hakim Didi in 1954 for the crime of practising black magic.

In May last year, the UN country team called for the abolition of death penalty in the Maldives, stating: “in view of the country’s more than 50 year moratorium, the United Nations call upon the Maldives to take the opportunity to reaffirm its commitment to its international human rights obligations, and abolish the death penalty”.

Earlier in 2013, calls for presidential clemency to be blocked resulted in then Attorney General Azima Shakoor asking the High Court to decide upon the matter.

Azima further drafted a bill in December 2012 favouring the implementation of the penalty via lethal injection. This was met with opposition from religious groups including Jamiyathul Salaf, which called for the draft to be amended in favour of beheadings or firing squads.

In June 2013, Dhivehi Qaumee Party MP Riyaz Rasheed submitted a bill asking for death penalty to be implemented by hanging. The bill was rejected by 26 votes to 18, with no abstentions.

During campaigns for 2013 presidential elections, incumbent President Abdulla Yameen stated that “murder has to be punished with murder”. Yameen revealed that, although he was previously not an advocate of the death penalty, he “had a change of heart” due to “murders that have become too commonplace”.

Defence Ministry audit reveals MVR6.78 million worth unlawful purchases

The Ministry of Defence and National Security audit report for the year 2011 has revealed that the ministry unlawfully purchased goods worth MVR6.78 million through Maldives National Defence Force’s (MNDF) cooperative society SIFCO.

The report states that MVR4.7 million worth goods were purchased through SIFCO, contrary to article 8.14 of state finance regulation which states that goods and services below MVR25,000 should be purchased only after reviewing proposals from at least three interested parties, and with an official written justification for the choice made.

It also said MVR2 million worth goods were purchased against article 8.15 of the regulation, which states goods and services above MVR25,000 should be purchased through a publicly announced competitive bidding process.

The auditor general (AG) recommended action against responsible persons as per the Public Finance Act

The report also highlighted that MVR1,200,324 was paid to military personnel on leave, particularly to those studying overseas, against relevant rules and regulations.

Salary and allowances worth MVR344,299  was said to have been paid to a defense adviser posted at the Maldivian High Commission in India for days without any record of attending work.

The AG’s opinion given in the report said the ministry’s 2011 budget was not spent within the set limits set, nor was it spent to fulfill the given activities and objectives.

The AG also questioned the validity of financial statements declared by the ministry, stating that the “statement of liabilities” and “statement of assets” declared “does not truthfully reflect” the actual assets and liabilities of the ministry.

The ministry’s figures were MVR39.8 million as assets and MVR29.8 million as liabilities for the year 2011.

The document highlighted that resources donated for the SAARC summit, which can be considered as tangible assets, were were not valued and included in the financial statements, and that special military equipment which could be considered the same were also not included in the statements.

In addition to that MVR122.7 million which should be included in capital expenditure were included as recurrent expenditure (as spent on seminars and meetings).

The final budget for the ministry in 2011 was MVR834 million, of which MVR789.47 million was spent within the year.

Q&A: MP Ahmed Abdulla – Ihavandhoo constituency

In a series of interviews to lead into the the 2014 parliamentary elections – scheduled for March 22nd – Minivan News will be sitting down with incumbent MPs.

All 77 sitting members have been contacted, from across the political spectrum, to be asked a standardised set of questions with additional topicals. The interviews will be published as and when they are received.

As part of the series, Minivan News talked to MP Ahmed Abdulla.

MP Ahmed Abdulla represents the Ihavandhoo constituency in Haa Alif atoll, and is a member of the opposition Maldivian Democratic Party (MDP).

Ahmed Naish: What made you enter the political arena and how?

Ahmed Abdulla: I entered the political arena at a time when citizens began efforts to make changes to the government after a long autocratic rule. I actually started working in the political arena before political parties were introduced in the country. But back then, we had to work individually or alone and very much in hiding. I got into politics before political parties were formed and started functioning. I was in government but left because of dissatisfaction with how things were back then and started working in politics.

AN: Based on your attendance and work in the last term, how would you judge your performance as an MP?

AA: I believe I have quite adequately fulfilled the responsibility entrusted to me by the people. I have attended Majlis sittings without fail. I took leave for very few sittings. In terms of attendance, I am among the MPs with the best attendance records. If we consider the Majlis’ performance, on every bill or every issue I raised my voice and said what I had to on that issue in the national and public interest. Especially on matters related to my constituency, I worked that way. So I am satisfied with my performance. The public also accepts my performance.  

AN: What are the main committees you were acting on? What particular bills did you focus on?

AA: My work is done mainly on the rules committee. As you know, the rules committee reviews regulations concerning the work of all government institutions and ministries and decides on changes. I have done a lot of hard work especially on regulations about tobacco, children, housing and a number of other regulations. I have chaired the rules committee as well during a lot of meetings. Majlis records will show how our work proceeded in those meetings that I chaired.

The second committee is our independent institutions committee. In that committee as well, I have worked to ensure independence for institutions, facilitate their functioning independent of government influence, and encourage them not to bow to pressure or restrictions from the government. We saw the results of that work. For example, we especially saw with the Elections Commission, as a result of our encouragement to work independently without bowing to the government, that they worked very independently in the last presidential election. That was the work of our committee and I performed my role well.

My biggest concern when I came into the People’s Majlis was the state of the Maldives’ property laws and the mortgage bill as well as various other laws dealing with child sexual abuse and gang crimes. I was the one who submitted the political parties bill. When political parties formed and became active, I believed they did not have the space legally to function optimally. I submitted the political parties bill to the Majlis, in accordance with the views of our party. I also submitted the mortgage bill. The political parties bill has now become law. The mortgage bill is in the process of becoming law. Efforts are also underway to amend the property laws to make citizens landowners, allow them to register their property and get rid of obstacles or difficulties in registering land. That bill has been drafted and, God willing, it will be submitted during the next session.

AN: What would you say are the biggest achievements within your term; in terms of what you have accomplished for your constituency and the country as a whole?

AA: I believe I did a lot of work on the gang crimes and weapons bill as well as on the research part for the child sexual abuse bill, especially regarding punishments for child sex offenders in light of the expert technical assistance we got for the bill. I worked hard to ensure that the punishments would be harsh and could not be reduced. God willing those efforts were successful. As a result, we made significant advances in ensuring legal protection for children. Likewise on the political parties bill, my thinking was to ensure that a party is empowered and able to be active in the political sphere. For that there has to be a sufficient number of people as members of a party. It was my initiative, my proposal, to require a certain number of party members and determine factors to be considered by the state before providing funding. I took the lead with these efforts and communicated with different parties. As a result, I believe the efforts were successful and the bill was passed the way we wanted and in line with our proposals.

AN: What would you say is the biggest mistake or worst step you have taken in your career? Why?

AA: I do not believe I have made a mistake in my work in the Majlis. As I am someone who is always mindful of present circumstances and prioritises progress for citizens, I do not believe I have made a mistake. Neither my constituents nor any others have brought something specific to my attention as a mistake I have made. So I believed I have worked adequately and well enough.

AN: Are you taking the optional committee allowance of an additional MVR 20,000? Why or why not?

AA: I did not support taking the committee allowance. I did not vote for it. However, as you know, the work of the People’s Majlis is concluded by the will of the majority and its decisions are approved by the majority. So when it was decided to provide a committee allowance, I don’t really want to not take it. I take the allowance. However, based on the income I receive from the People’s Majlis and given the way my work is organised, the true benefit [of the committee allowance] will be for the people.

AN: What is your view about parliamentarians and other public servants declaring their financial assets publicly for the electorate to be able to refer to?

AA: I have no problem with [publicly declaring assets]. I have nothing to hide. It is not a problem at all for me for the public to know what I own or do not own.

I believe we are the representatives of the people. I believe the public should know of our affluence or our financial capability and our wealth when we came into Majlis and how much it changed after we [became MPs] – I believe the public has a right to know these things. I don’t believe our affairs should be hidden from the public.

AN: Are you re-contesting in the next elections? What do you hope to accomplish should you be elected for a new term?

AA: Yes, I am contesting for the same constituency. I have received cooperation and assistance from my constituents and I believe I have their support as well.

In truth, I want to see Maldivian citizens enjoy complete domestic or internal independence. I do not believe our citizens have proper domestic independence or freedom at present. We have to do a lot of work to that end. In addition to that, we have work to do to ensure financial independence for citizens. Our economic policy and business policies should be framed to ensure financial independence for citizens and the required legal framework should be completed. If we are unable to work to that end, I do not believe we can save our citizens from financial slavery. I believe as long as citizens are not free from financial or monetary slavery, they will not be able to vote freely the way they want. So I believe we have a lot of hard work to do to achieve this. We have to shape the economy and our policies to ensure positive changes to the standard of living for the people. This is necessary for a free and fair election and ensuring the right to vote freely. So I believe these things need to be done in the country despite the challenges.

AN: What improvements do you feel the 18th parliament will need to make to improve as an institution?

AA: To improve the Majlis as an institution, we need to learn to work professionally. The progress that our citizens want to see is unlikely to be achieved if we cannot learn to work professionally. Under some circumstances, there are certain challenges to working that way. That might be because our democracy is in its infancy or it could be a problem we face because we are not fully ready or mature for democracy. But I believe the 18th Majlis will be one where we work professionally, more actively and with a better discipline than at present.

AN: What are your thoughts on party switching – do you think it undermines the party system?

AA: I believe switching parties is a betrayal of the public. That betrayal is not something we can accept. I certainly do not believe that changing parties is something that could be done. There are lots of reasons. For example, a candidate contests on an MDP ticket for a Majlis seat. A lot of people does a lot of hard work with that person, including the hard work and money of a lot of people who are loyal to the party. We have to respect those people. They would not want to see the result of their hard work being the MP going to another party when he is elected. So I believe there should be legal obstacles to it as well and that discipline must be maintained to respect the public. I do not support changing parties at all. I do not think [MPs] should be able to do it either.

AN: What is your view about the current judiciary and what steps do you believe can be taken to improve it?

AA: The judiciary is an institution that needs to gain public confidence. The public perception of the judiciary today is poor, unfortunate and sad. The public senses that it is a place more likely to commit injustices than provide justice. If this is the case, it’s a loss to the nation in every sense. The lack of the means to establish justice impartially among the people is a serious misfortune. Likewise, if we consider investors, there are problems that arise due to the weakness of the judiciary.

People are reluctant to invest in the Maldives. So considering all this, we need to establish a sound judiciary in the country. To do that, we need to reshape the system to ensure justice. I do not believe there is room to work independently of political influence because of the way the judiciary is organised and because of the composition of the Judicial Service Commission (JSC). Given the composition of the JSC, there are a number of members who could only remain in the commission with the approval of politicians. So I believe we need to change that situation. There must be a way to work in the JSC without being subject to the influence of politicians.

The parent institution for judges is the JSC. Judges exert strong influence on the JSC, too. If this is the case, they would face obstacles to working independently. We need big changes to the system to reform all this – changes to the rules governing hiring, the appointment and dismissal of judges. We need to make the JSC an institution that can work independently and free of external influences. There is a lot of work to be done to reform the judiciary. It will not be easy. But it is something that has to be done for the future of the country and the prosperity and contentment of future generations. I wish to see the judiciary reformed and functioning properly.

Deputy PG seeks Supreme Court assistance in Criminal Court dispute

Deputy Prosecutor General Hussain Shameem has written to the Supreme Court regarding a decision made by the Criminal Court to halt all pending cases until a new prosecutor general is appointed.

Shameem said that the letter was sent last week but that the Supreme Court had not responded to it.

“It was a complaint letter we sent because the Supreme Court had previously ordered the Criminal Court to continue its functions as normal,’’ he said. “But the Criminal Court had not implemented the order, and is refusing to accept new cases.’’

According to Shameem, the Criminal Court’s decision was appealed at the High Court but the court’s registrar decided not to accept the appeal, asking the High Court’s Judges panel to review the decision.

Shameem reported that, thus far, no progress had been made on the issue.

He said that there were more than 150 cases pending in the Prosecutor General’s Office which are to be sent to the Criminal Court, some of the cases concerning people held in pre-trial detention until their case is concluded.

Shameem said that he was expecting a response from the Supreme Court before this week ends.

“If they do not respond by then, then we will have to look for other ways to solve this issue,” he added.

On November 25, former Prosecutor General (PG) Ahmed Muiz submitted his resignation, shortly before parliament was set to debate a no-confidence motion against him.

On January 8, the Criminal Court decided not to accept any cases submitted by the PG’s Office and to halt all existing cases because the position of PG has been vacant for over 30 days

At the time, Shameem said that the laws did not prohibit the Deputy PG from taking over the responsibilities of the PG in a case where a new person is not appointed within 30 days.

He also expressed concern that there were people held in pre-trial detention who are to be kept there until their trials were concluded.

“So what do they do now, it would not be fair to keep them in there until the parliament comes back to work from recess after three months and appoint a new PG,’’ Shameem said.

On December 10, President Abdulla Yameen proposed his nephew Maumoon Hameed for the post of Prosecutor General and submitted the name to the parliament for the MPs to approve.

The issue was sent to parliament’s independent commissions committee and the committee decided to seek public opinion before sending his name to the parliament floor for voting.

However, the parliament is now on recess and will not re-commence work until March.

On January 9, the Supreme Court had ordered the Criminal Court to continue pending trials in the court.

The Supreme Court said it had told the Criminal Court that the criminal justice system must proceed in order to maintain constitutional rule.

India failed Maldives, MP Hamid tells Indian media

“Howsoever much India talks about democracy but it failed the people here,” opposition Maldivian Democratic Party (MDP) MP Hamid Abdul Ghafoor told India’s Zee News this week.

The comments came as the Indian and Maldivian governments prepared to celebrate bilateral ties with a week of cultural events.

The Dosti-Ekuverikan week also follows the recent state visit of President Abdulla Yameen to India.

Speaking at the inauguration of the week’s events on Monday (January 20), Vice President Dr Mohamed Jameel Ahmed praised the “long-standing historical bonds” between the two states.

“India can surely count on the sincere gratitude of our people for the ever-present, ever-reliable friendship, support and assistance,” added Jameel.

Upon President Yameen’s return from India earlier this month, one coalition member described the trip as “the most successful trip a Maldivian leader has ever made to India”, with the vice president suggesting that all recent tensions between the allies had been resolved.

Conversely, Hamid told Zee News that recent events in Maldivian politics are a “disgrace to Indian democracy”.

“People of Maldives do not think that India is that ‘great country’. We have been disappointed, we have been hounded,” the MDP’s international spokesperson told the Hindi news channel.

Hamid recently spent four weeks seeking refuge from arrest in the People’s Majlis. After spending time under house and a short period in jail, Hamid’s charge for failing to attend the court was quashed by the High Court.

“As a politician, especially as an MDP person, I get disappointed whenever I hear such sentences like ‘we are with the people of Maldives’; it just makes me sick. No one is with the people of Maldives because if they were with the people of Maldives, then they would have come to help us in this violent coup.”

“You know, we had no choice [but to accept the presidential election result]. The international community, Commonwealth endorsed the coup. It is similar to what the British did in India, we too have something called CONI reports (Commission of National Inquiry),” he continued.

Hamid repeated his party’s initial pledge to behave as a responsible opposition, although relations with the new administration have begun to appear strained. Attempts to pass revenue raising measures in the Majlis – necessary to finance a record budget – were stymied by MDP representatives last week.

More recently, following local council elections, former President Mohamed Nasheed expressed his intention to seek the new president’s impeachment.

Asked about India’s GMR company – ejected by the previous administration part-way into their US$500 million development of Malé’s international airport – Hamid suggested that GMR had not been backed by the Indian government.

During Yameen’s state visit, Indian PM Dr Manmohan Singh asked for the dispute with GMR – currently the subject of billion dollar arbitration proceedings – be resolved amicably.

The president’s trip included meetings with the Indian business leaders, with the coalition reporting the promise of one billion dollars through the State Bank of India. Yameen has also welcomed the return of GMR investment, though he has ruled out further involvement in the airport.

Dismissed MNDF Captain seeks reinstatement

Former Maldives National Defense Forces (MNDF) Captain Abdul Muizz Musthafa has filed unfair dismissal charges against the military at the Civil Court.

Musthafa is the first of the nine senior officers who were dismissed in November to press charges. The nine fired were accused of sowing discord within the military during Maldives’ presidential election, 2013.

Musthafa has said he was dismissed without due process, and in violation of the constitution as the MNDF had not taken any prior disciplinary action against him.

He is seeking reinstatement and has asked the Civil Court to order MVR6 million (US$389,105) in compensation for damages.

Musthafa is accused of collaborating with former Brigadier General Abdulla Shamaal in collecting signatures from MNDF officers on a letter which had been prepared “in the guise” of supporting the Chief of Defense Forces Major General Ahmed Shiyam.

A copy of the letter leaked on social media expressed concern over delays in the presidential elections in 2013, and the repercussions should a president-elect not be determined by the end of the presidential term on November 11.

A statement by the military said Shamaal had leaked the letter on social media “in order to reveal dissent within the military,” and accused Musthafa of aiding Shamaal and planning “to commit dangerous acts using the troops under his captainship.”

The presidential elections of 2013 were marred by repeated delays after the Supreme Court annulled the first round of polls held in December.

Following the MNDF’s first letter of concern, the force amended its regulations to punish officers who promoted “upheaval and chaos”. Several officers were suspended and Shamaal was removed from his position as the commandant of training and doctrine.

In mid November as the possibility of holding presidential polls by the end of the presidential term dimmed following police obstruction and Supreme Court orders to delay the second round of election, 73 mid ranking officers circulated an appeal calling on fellow soldiers not to obey any “unlawful” orders issued by then President Dr Mohamed Waheed or his political appointees.

Shortly after President Abdulla Yameen was inaugurated, nine senior-ranking officers were dismissed.

At the time, the opposition Maldivian Democratic Party (MDP) condemned the dismissals as “politically motivated and unjust,” and noted that no action had been taken against the soldiers who mutinied on 7 February 2012.

“On 7 February 2012, some uniformed soldiers publicly called for the resignation of the President and Commander in Chief and protested along with the opposition at the time. They have publicly violated global norms of military discipline. The CONI report has highlighted this act and called for action against them.”

Instead of penalising mutinying soldiers, the Ministry of Defense awarded them promotions, the MDP said.

“Such actions politicize the military, undermine professionalism and demean the institution,” the MDP added.

In September, the Civil Court ordered the Maldives Police Services to reinstate former Head of Intelligence Mohamed ‘MC’ Hameed who had been dismissed by the police’s disciplinary board for unspecified offenses.

Local media at the time said Hameed dismissal was related to a report published by MDP on the controversial transfer of power.

The police have said they will appeal the case.

Party members contesting as independents cost seats: President Yameen

Members of the Progressive Party of Maldives (PPM) who contested the local council elections as independents cost the government coalition a number of seats, President Abdulla Yameen has said.

Speaking to reporters this morning prior to his departure to Sri Lanka on an official state visit, President Yameen said more than 85 percent of independent candidates were PPM members.

“We lost seats in large constituencies – Malé and Addu City – we lost seats from these two cities. But that is how things will happen inside a coalition, not just our present coalition,” he said.

PPM members decided to contest as independent candidates in constituencies reserved for coalition partner Jumhooree Party (JP), Yameen explained, despite instructions from the party.

“Similarly, a JP member contested as an independent for the Addu atoll mid-constituency where our candidate got the ticket and contested,” he added.

Opposition Maldivian Democratic Party (MDP) candidates won in such cases where the vote was split among government-aligned candidates, Yameen said.

As voters considered family connections more than party affiliation in choosing candidates for councils, Yameen said government supporters contested as independents despite the best efforts of the party leadership to field single candidates representing the ruling ‘Progressive Coalition’.

Preliminary results show that the MDP has won eight out of 11 seats on the Malé City Council and all six seats of the Addu City Council.

Complete preliminary results are expected within the next two days.

President Yameen noted that the three seats won by PPM candidates in the capital was an improvement on the February 2011 local council elections, in which the then-opposition took two seats to the MDP’s nine.

Yameen further contended that the results of the council elections showed “huge support for our coalition” as the majority of independent candidates were from the PPM.

“So I am satisfied. [But] we could have put in a better effort,” he said.

Discussions were meanwhile underway among leaders of the PPM, JP, Maldives Development Alliance and the Adhaalath Party to avoid similar issues in the upcoming parliamentary elections and to decide how to divide the 84 constituencies among the coalition partners, Yameen said.

Party leaders would meet the press together and give joint interviews to explain the situation to government supporters in constituencies where there were disputes over choosing candidates, he added.

“I believe party spirit will be stronger in the parliamentary elections than the local council election,” he said.

At a press conference hours after polls closed, former President Mohamed Nasheed meanwhile predicted victory for the MDP in the parliamentary elections scheduled for March 22, based on the outcome of Saturday’s local government elections.

Nasheed was narrowly defeated by PPM candidate Yameen in November’s controversial presidential election, winning 48.61 percent of the vote (105,181) to Yameen’s 51.39 percent (111,203) – a difference of just 6,022 votes.

Q&A: Minister of Tourism Ahmed Adeeb

Minister of Tourism Ahmed Adeeb Abdul Ghafoor speaks to Minivan News about his mandate, his aspirations for his five year term in the cabinet position, and his political career.

Adeeb served in the same cabinet post during the previous administration of former President Dr Mohamed Waheed. He is also currently the elected Deputy Leader of ruling Progressive Party of Maldives (PPM).

Political Career

Mariyath Mohamed: What are the main things you hope to achieve in these five years as Tourism Minister?

Ahmed Adheeb: As you know, I initially became Tourism Minister in the last government, with the endorsement of PPM, with about two years left of the term when I assumed office. At the time, we worked to complete some of the then-existing work, for example completion of the Fourth Tourism Masterplan.

There were also many other legislative issues. As an example there is the case where tourist resorts were being formed under the old law on uninhabited islands. Then there were other resorts which had not been completed as agreed, and many islands from which the government was not receiving due payments. I believe that I was able to sort out a lot of issues like this.

At the time, it was not a PPM agenda that we were following, and the government was a rather large mix. Our aim at the time was to sustain tourism. As you know tourism is a sector which is very much connected to the country’s economy. When I assumed office, the political turbulence had caused the cancellation of many bookings, including charter flights from China. Maldives is a place which usually has bookings made two or three months ahead of the estimated date of arrival, and so booking cancellations mean that the rate of arrivals were dropping.

I came and made a set up to deal with the issue. The civil service team at the Tourism Ministry has a lot of experienced personnel with long term institutional memory. They have a lot of practical experience, for example in how they tackled the 2004 tsunami disaster and the effects of the Gulf War, and many other such incidences.

As I see it, I assumed office in the middle of a crisis too, so I pulled together the crisis management team and we made a cell to deal with the matter. We had the resorts report back to us on a daily basis with records of how many booking they had made and how many bookings had got cancelled every single day. We used this as a barometer at the time, and commenced work. I went to the ITB fair in Germany as well as the WTM in London and held press conferences.

I believe it is crucial to face press and respond to their enquiries. At that time, the opposition was raising its voice, accusing us of having come to power through a coup d’etat and we addressed those allegations. What I mean by that is, I pointed out that a Commission of National Inquiry had been established with Commonwealth intervention on mutual agreement and called on the opposition to not draw conclusions while the investigation was pending. I called on them to give us time until the investigation was completed. And in any case, I don’t believe tourism must come to an end regardless of the political volatility, as it is something closely knit with the livelihood of all Maldivian citizens and the country’s economy. We said that more than a political agenda, our focus is on marketing tourism. It was well accepted and if you check headlines from then you will find our interviews in the Telegraph and other such news agencies.

I believe we were able to sustain the tourism industry within those two years. In 2012, I worked hard to reach a target of 1 million tourist arrivals, but were able to reach 965,000. However, last year we reached the target. I am happy with the 1.2 million arrivals, I believe we were able to reach a good target.

This government has recently come into effect and as PPM’s deputy leader, I too did a lot of work on our manifesto, mainly on the economic sector. Our plan is to create three special economic zones, and to develop even the tourism sector through these. The model in mid-Maldives, of Malé and the atolls connected within the seaplane’s zone, is a very ideal one to be replicated in North and South of the country. This can only be achieved by building certain infrastructure in these zones. A law on economic zones needs to be drafted.

Additionally, we need to explore what needs to be done to implement what is in the Tourism Masterplan. Whether we should increase beds, and how to do that, and so on. As you know, the current bed capacity of the country is 25,000 and I believe this needs a fast-paced increase. During the new year season, there was a fall of about 2000 beds due to overbooking. There’s also the Chinese New Year. So I believe we need to very quickly increase bed capacity, whether it be in resorts, city hotels or other new products.

I especially want to also note that the real estate market in Maldives is also something we can promote through tourism.

MM: After having previously worked in the Maldives Customs Services, and then the Chamber of Commerce, how did you enter the political arena?

AA: I worked in the Air Cargo department of Maldives Customs Services for three years. During my time there, I became familiar with trade and import. All imports into Maldives, including even seafood, is usually brought in by air freight. I became familiarised with trade and at the time decided to go abroad for further studies.

After completion of my degree, I worked in stock exchange in Sri Lanka. I then completed my Masters programme, returned to the Maldives and worked in private consultations. In 2009, on invitation of the existing board of Chamber of Commerce, I contested for a post on its board of directors. I served as a board member then, and as its treasurer. I stayed there since about 2011.

I believe that as people who research the economy, we all have our views and certain set principles on everything, including privatisation, foreign exchange, and how an economy must be moulded. That, I believe, is our ideology. I believe in openness, Maldives is a very open country. Maldives cannot develop at its best unless it is opened up for investments and we need to bring about certain economical reforms.

If we look at the last five years, it is mostly political reforms that have been brought, and that too at a very fast pace. Meaning, for example, we can now say Maldives is one of the countries where press freedom is granted most openly. However, in an economical perspective, reforms have not been brought yet. Being a country with a low population and with low savings, foreign investments are very important.

In that sense, the Chamber of Commerce is a very political organisation internally, in that we fight for businessmen’s rights, and lobby for changes. I was involved in this, and was often invited to TV shows and other media programmes. I often did research for various businesses, and this always includes economic research of the Maldives. With these updates, I was always outspoken about any issues we may have with the policies of the government then in power. I have always given opinions on these matters to media in my own name. For example, when the government implemented the change in dollar rates, I revealed my view in my own name in the media. Our prediction proved more true than the estimates of the government’s policy makers at the time, for example they were unable to solve the foreign currency issue by the introduction of a dollar band. We said even then that it was a wrong step and called on them to reverse the decision.

Although I am junior by age, I have conducted a lot of research and work. For example, back when current President [Abdulla] Yameen was in People’s Alliance, I did a lot of technical work for the party, including budget reviews, analysis, and providing details of these to the party’s parliamentarians. I used to debate a lot on economical matters with Yameen at the time. He is a very academic and technical person in the field.

It then led to Yameen inviting me to take on the responsibilities of a cabinet minister during the change in government in 2012. I responded that I cannot take on responsibilities of a cabinet minister unless it is in my field of expertise, i.e in the business area. That I would not know how to handle something like the health or education sector. That if it was in the business sector, I would know well to take policy decisions. So I accepted the post of tourism minister and took it as a challenge. I was 29 years of age then.

Many friends and family members advised me to not take up the position, owing to the political atmosphere of the time. However, as I see it, it is very easy to stand outside and criticise matters. But when one has to actually implement things within the legal framework, it is a completely different experience.

Every decision we must make in a position like this is a tough one, but needs to be taken firmly. It is impossible to please everyone with any decision we make. We must also be able to digest criticism levied against us by media or other sources.

There are certain things I have observed since I assumed this post. Cabinet ministers are policy makers. The policies we decide on must be implemented by the civil service, but it is the Permanent Secretary that will deal with the day to day management of civil servants. I will not engage in the hiring and firing of civil servants. I distinguish between the two.

The other thing is I believe every tourism minister must maintain good public relations. We cannot solve the existing issues without building rapport with all investors. I work to understand their concerns, and to get win-win results for the government through the understanding of these concerns. And in that way I gained their acceptance.

I also always ask elders and more experienced persons for advice, including policy makers and former presidents. I believe in treating them respectfully.

A lot of people were of the mindset that I would not be up for this challenge as I was appointed at such a young age. I took it up as a challenge and have been careful in my work. This is because I realise that if I fail, it will reflect not just on me alone, but there will be a reluctance to appoint young ministers in the future.

I do get a lot of criticism, but I believe getting criticism from the opposition is a success in its own right. I also strongly believe that criticism that comes for my decisions is not out of a dislike of me personally, but something that comes along with the cabinet position. So I take it all professionally, as it is an indication that I am doing something right. I have always been told that one will have enemies if they stand up for something.

I don’t differentiate between people of different political ideologies. I believe a person’s political affiliation is a very personal thing and we must be willing to work alike with everyone. I have been trained in politics through the democratic system, and so find it easy to handle the criticism and work through it all.

MM: How do you currently manage time between fulfilling the responsibilities of being both a cabinet minister, as well as the Deputy Leader of PPM?

AA: A deputy leader of a party is also a policy maker there. If the party’s president is unable to attend councils or larger committee meetings, I chair them. Council meetings are normally held once a month unless there is an election approaching. But in these we just decide on policies.

I always differentiate between policy making and implementation. Once we decide on policies to observe, and for example ways to obtain funds, it is the office staff and volunteers who will then work to implement these. I never micromanage things. So it is easy to manage time at a policy making level.

The difficulties arise because once you become a high level politician, either in state level or party level, a lot of individual citizens want to contact you directly. It is often difficult to respond to them in a timely manner, but I do attempt to call them back even if later. But I believe that this is something I need to improve on.

MM: Are you able to fulfill both responsibilities at your best capacity?

AA: I believe I do. If you ask other party members, or council members or parliamentarians, they too will tell you that since I adopted this position as deputy leader, I have taken up huge responsibilities within the party. Even if you ask the former president of other cabinet colleagues, they will tell you that I am a man who always stands up and remains firm even during difficult times and through chaotic times. As I see it, you have to be courageous in taking up responsibilities, and should not shy away from the repercussions that come your way.

MM: What are your future plans for your political career?

AA: A lot of people ask me that. I am only turning 32 this year. I am definitely not a presidential candidate. Even in 2013, a lot of people asked me if I was going to be a running mate or candidate of some party or other. I responded even then that I am not that ambitious. I only consider things as they come to me through given opportunity. I don’t proactively look for positions. My political career will be built on the next five years. Implementation of our economic policies is a huge dream of ours, and that is what will give me the most satisfaction. I see the achievement of this dream as far more important to me than attempting to get higher positions than the one I am in now. This is also the party president’s vision.

As I see it, we have only recently gained the opportunity to show our own results. It is through the results that we manage to show in these five years that my political career, too, will be shaped.

The country has a huge youth population. While there was a difference of opinions when I was appointed during the former administration, due to my young age. But Yameen well understands that with the huge youth population in this nation, it will be difficult to develop the country without youth inclusion.

What I have to say to youth is, if you have a dream, show your capacity and exploit your potential. Being a country with a small population, there is a lot of vast opportunity here.

Section Two: Tourism Policies

MM: The current cabinet is split into economic and social councils. What are your responsibilities on the Economic Council and which other colleagues sit on it?

AA: The economic council has five ministers, including the youth minister and is chaired by the President. I am the co-chair.

There is a Social Council and the Economic and Youth Council. Even in previous governments, there were separate committees, but the cabinet also met on a regular basis, which led to these committees meeting less frequently. But as the president wants to reach results at a fast speed, he holds the council meetings every single day. I believe that with about ten years of cabinet experience, this initiative by the president adds to added effectiveness and better time management. Now each cabinet minister can better focus on matters that directly involve them.

However, on major issues that involve the full cabinet, there are full cabinet meetings.

MM: What are the government’s plans for establishing guest islands? Are these to be on uninhabited islands alone? What then is the distinguishing factor between a guest island and a tourist resort?

AA: Yes, it is targeted mostly to uninhabited islands. The thing is, it is a huge infrastructure investment to build a tourist resort. It becomes an expensive place to go to when they invest in water set-ups, sewerage systems and all before building rooms. We at advanced stages of making a model where we are speaking with MWSC to make water set-ups, sewerage systems and electricity set ups in an island, after which we can give plots to individual businessmen. For example, common restaurants can be managed by one party, water sports by another party, twenty rooms by one company, another twenty rooms by another company and so on. In that way, we are creating numerous businesses there. We are planning to introduce this as a test model to see if many mid level businesses can co-exist and run a guest island in this manner. MWSC is already on board to set up the utilities, and the businesses will just need to pay monthly bills to them.

While it will be difficult for a small business to invest in a full resort, there are many small and midlevel businesses that can invest in small sections of an island. We can even replicate this in uninhabited areas of large inhabited islands. First we intend to test this on an uninhabited island. We plan to begin implementation around March this year.

MM: The government has also recently announced that permits to run guesthouses will only be given if the said guesthouse is to be built on an island with existing water and sewerage systems. Will this cause more income to islands which are already somewhat developed, while marginalising less developed islands which may perhaps even be better suited for tourism in other manners?

AA: There is a lot of confusion around this matter. There are four tourism sectors: tourist resorts, tourist hotels, guest houses, and yacht marinas. Under the Tourism Law, tourists are not allowed to spend nights at any place other than places registered under one of these sectors. This is not to say that one cannot invite a friend to stay over at their house, but it cannot be done commercially. This is also for the protection of tourists as well.

We often get proposals to build city hotels. What we are saying is, how can you build a city hotel without an investor also building a sewerage and water system there. How can it be managed otherwise?

What we are encouraging is for people like those councils from large islands that ask for state land to be leased to build a city hotel to also condition investors to build utility systems there. The opposition is, however, often confusing this with the guesthouse licenses which we already do authorise.

Under a law, we have to authorise the opening of guesthouses on any private land as long as it fits in with the set guidelines. Former President Nasheed had released about twenty licenses, and even I have released about a 160 licenses since then. That is going steadily forward and we encourage it.

We even assist in solving any issues that may have. For example, to assist the guesthouse community in Hulhumalé, we authorised some cars to carry tourists from the airport to Hulhumalé over the connecting road. Even in Maafushi, we have addressed many issues.

The thing is, we just don’t talk about guesthouses so much. The thing is, from a marketing perspective, we have positioned the Maldives as a high-end destination. A-category guests will continue coming for as long as we market the country as an A-category destination. Guests for B,C,D and E categories are something we automatically get. Even guesthouses are able to get guests to stay for 80 or 90 dollars because Maldives is marketed as a high end destination and for guests it is a dream come true to be able to stay here for that price. If the government begins to market tourism at guest house level, this will drop down drastically. This is the strategy we employ.

Even locally, culturally, people get disheartened when we talk about guesthouses. So although I don’t much talk about it, guesthouse owners are aware that they have my full cooperation. The circular was meant to let investors know that it is feasible to run a 20 room hotel only if the utility services are also set in place.

MM: What is the implication of the cancellation of charging bed tax, which has been in effect from January 1? What is the government’s plan of action to make up for this loss in revenue?

AA: The bed tax is supposed to be cancelled from January 1 this year, but this is not considered when the budget is expanded. We are asking for an extension until June.

Normally, budget and government revenue earning bills are passed together. But here, the parliament goes into recess after passing the budget, leaving the income bills pending for after that. And even then, they often just fail.

This causes the budget to expand, but there’s no way for the government to earn enough to implement it. The T-GST [Tourist Goods and Services Tax] matters even more to the state income. The state keeps expanding, the allowances and salaries keep increasing, but the income for all of this still depends on the 25,000 tourist beds. Unless we expand this, how can we increase what we earn? We can’t keep expanding the state, and then squeezing the existing tourism sector without expanding it.

MM: As a low lying island state, do you think climate change is a serious threat to the Maldives, and may have large adverse effects on tourism? Does this ministry have any existing plans to deal with these effects?

AA: After the 2004 tsunami, the country now has a good response system to disaster. Each resort has a high rise shelter in case of such an emergency and evacuation plans for all guests to see. The tourism sector, in developing resorts, pays attention to sustainable development and prioritises the environment.

The current government does not believe Maldives needs to be a guinea pig for the climate change cause. I mean, it is not the Maldives that conducts activities which are harmful to the environment.

However, we cannot go around saying Maldives will sink in 20 years and then ask for investments of 50 years in the tourism sector. This causes investors to be reluctant to invest in the Maldives. We do not believe we are at risk of suddenly sinking and think in a perspective of protecting investments.

Although we don’t speak about this at a marketing level, we do want to make Maldives a model in sustainability. We do take action on the matter though we do not speak of it much at a marketing level. We do not want investors to lose confidence, so we cannot do both. Let us first develop to this stage.

Government reveals foreign policy for next five years

President Abdulla Yameen has revealed his government’s foreign policy today, stating that the most important objective was to increase economic self-sufficiency, describing this as a requirement of independent foreign policy.

“The foreign policy of my government will be based, just as those firm policies of President Maumoon, on the principle of mutual respect between countries, respect for the sovereignty of countries,” Yameen said.

He said that a well-thought foreign policy is necessary “for a small Maldives to travel safely amidst the turbulent political currents”.

“The foreign policy of Maldives will protect and sustain Maldives’ selfhood and Islam. [It is] a policy that will sustain the independence, security and sovereignty of the the Maldives. A policy that will open opportunities abroad for Maldivians to benefit from,” Yameen said.

The foreign policy revealed today has six main targets: protecting national independence and increasing national security, protecting the Islamic unity of the country and promoting Islamic characteristics internationally, increasing economic self-sufficiency, increasing South Asian regional cooperation, providing quality services for Maldivians living abroad, and the strengthening and development of foreign services.

In terms of protecting national independence and increasing national security, the government plans to increase cooperation with Indian ocean states in combating terrorism, piracy, and other non-traditional security threats, and get more involved in keeping world peace.

In addition to this, the government aims to improve relations with international civil society organisations and think tanks, and to improve the reporting for conventions to which the Maldives is a party.

Speaking at the ceremony held to reveal the policy, Minister of Foreign Affairs Dunya Maumoon said the Maldives’ role in achieving regional and international stability will increase in the coming five years and that Maldives will especially speak out on challenges faced by small states and on climate change.

Economic self-sufficiency

On increasing economic self-sufficiency, Dunya said the ministry will work towards finding more markets for Maldivian products and increase the number of tourists and investors that visit the country. She particularly highlighted finding new markets for fish exports within the year.

Such new markets was something the government announced last year when the European Union declined to extend the duty-free status of imported fish from the Maldives for non-compliance with international conventions concerning freedom of religion.

“We should think about who gives [foreign] aid and what their intentions are. We should accept that [they] will not give without expecting something in return” Dunya said.

The foreign policy published today states “finding funding for development projects” and to “invest more in renewable energy” as strategies for increasing economic self-reliance.

Speaking at the ceremony Minister at the President’s Office Mohamed Hussain Shareef also highlighted the importance given to commercial diplomacy in the government’s foreign policy, and the need for creating a name internationally as a safe destination for investors and businesses.

Foreign service restructured

The government revealed that many steps have already been taken to strengthen the foreign service, including the establishment of Foreign Service Institute of Maldives (FOSIM) within the Ministry of Foreign Affairs last week.

This institution is mandated with providing training for foreign service employees and youth who wish to pursue a career in the foreign service. It is also to conduct academic research required for the formulation and implementation of foreign policy.

A Foreign Relations Advisory Council (FRAC) – composed of experienced persons who have previously served in the foreign service – was also created to advise the institute and a policy department.

In addition to this, President Yameen announced that a Foreign Service Bill will be sent to the People’s Majlis within the first hundred days of his government.

In the Foreign Minister’s speech she noted that foreign policy is much more than “getting as much aid from as many countries” and highlighted some achievements of Maldives foreign service.

“In 1965 many countries were against the UN recognizing Maldives as an independent sovereign state, however today those countries have accepted Maldives as a country that can work alongside at the same level,” Dunya said.

Lauding this as a great achievement, she said the Maldives was currently an active partner and a leader in many global issues such challenges faced by small states, protection of human rights, democratisation and climate change.
