“The current government is failing”: government-aligned PPM

The government has come under fire from Progressive Party of the Maldives (PPM) potential presidential candidate Abdulla Yameen, who has claimed institutions are both failing and corrupt.

Speaking at a rally on February 7 to mark the anniversary of former President Mohamed Nasheed’s removal from power, Yameen called for President Mohamed Waheed Hassan Manik to “set things right”, adding that the current government had come to a halt.

Despite PPM being part of the current government coalition, local media reported Yameen as criticising a number of issues he claimed the government was responsible for.

“What we’re seeing today, and it is with sadness I say this, is the current government failing. The institutions are now incapable,” Sun Online quoted Yameen as saying.

Yameen, who is the half-brother of former autocratic ruler Maumoon Abdul Gayoom, further claimed that Maldivians will not believe they have achieved democracy unless laws are properly implemented by the government, local media reported.

“Major crimes are being committed on the streets. Rights are being invaded and violated. We want a clean, bold and a just government. A government with our support.

“Unless laws are being implemented, the Maldivians won’t believe that they have achieved democracy. They won’t believe a dictatorial rule had ended. We don’t see a difference,” local newspaper Haveeru quoted Yameen as saying.

Yameen’s comments come less than one month after the PPM appointed former 30-year ruler Gayoom – who many claim ran the country as a dictator – as its party President.

The PPM presidential candidate further criticised foreign interference with internal issues in the Maldives, claiming that the government was making it possible for foreign parties to do so.

“Foreign countries are interfering with internal issues of the Maldives to a greater extent than we’re comfortable with. The government is giving them that opportunity,” Yameen was quoted as saying in local media.

Yameen’s critical remarks were met with backlash yesterday (February 8), including from the government-aligned Dhivehi Rayyithunge Party (DRP).

DRP Parliamentary Group Deputy Leader Abdullah Mausoom told local media the PPM was willing to take credit for the government’s success, but distanced itself when the government faced criticism.

“If the government achieves something, they’d say it was them, they want to be the ones who sustain the government. But if the government is being harmed in any way, they are not part of it. If the government gets recognised for something, they take credit for it,” he told Sun Online.

Mausoom said that PPM had obstructed the government on two occasions, expressing concern that the party still continues to criticise the government despite the challenges faced due to the obstructions.

Speaking to local media, he said that whilst the budget is the most important part of providing public services, the PPM and Maldivian Democratic Party (MDP) had reduced it by MVR 2 million, and that it would not be “wise” to criticise the difficulties this may cause.

Furthermore, Mausoom claimed that the Executive Oversight Committee (EOC) – currently investigating the Commission of National Inquiry (CoNI) report – is held by a Maldivian Democratic Party (MDP) majority and that this was facilitated by the PPM.

Mausoom said that the former Parliamentary Leader of the People’s Alliance – Abdulla Yameen – had given up the party’s spot in the EOC when he joined the PPM, giving the MDP a majority.

President’s Spokesperson Masood Imad, and Dhivehi Quamee Party Leader Hassan Saeed were not responding to calls from Minivan News at time of press.

Jumhoree Party (JP) Spokesman Moosa Ramiz said he needed to discuss Yameen’s comments with the JP’s leader, resort tycoon Gasim Ibrahim, before giving the party’s official view. Minivan News was awaiting his response at time of press.

Cracks are starting to appear: MDP

Speaking to Minivan News today (February 9), MDP Spokesman Hamed Abdul Ghafoor said Yameen was “expressing discontent” within the government’s ranks, and that cracks were beginning to appear within the coalition.

“There are two issues that seem to disturb them at the moment. The EOC coming up with evidence supporting that there was a coup, and the other being President Nasheed’s court case.

“It is looking like they are also trying to get Nasheed out of the [Presidential elections] race,” Ghafoor said.

In regard to the EOC’s investigation into the CoNI report, Yameen was quoted as saying during Thursday’s rally that the investigation was “determinably illegal” and that it was being spearheaded Parliament Speaker Abdulla Shahid.

The investigation by the Executive Oversight Committee has so far seen senior military and police intelligence figures give evidence alleging that the transfer of power on February 7 “had all the hallmarks of a coup d’etat”, whilst claiming that the final CoNI report published last year had not reflected their input.

Speaking at the rally, Yameen said the government had no legal obligation to cooperate with the EOC in regard to the CoNI investigation, local media reported.

“As Parliamentary Group Leader of PPM, I have told the President that the government does not have to cooperate with the Majlis Committee investigating CoNI Report. The executive shall run according to the legal instruction of the Attorney General and not a Majlis Committee.

“[Parliament Speaker] Abdulla Shahid is now investigating the CoNI Report, and I wonder what he has in mind to do. On behalf of PPM, I would emphatically say that they are undertaking an illegal work. They cannot do it”, Sun Online reported Yameen as saying.

No “definitive answer” from US delegation over government’s failure to act on CoNI recommendations: MDP

The US delegation who visited the Maldives last week gave no “definitive answer” to political issues raised by former President Mohamed Nasheed, the party has said.

The delegation, consisting of Deputy Assistant Secretary of State James Moore, Deputy Assistant Secretary of Defense Vikram Singh and Deputy Assistant Secretary of State Jane Zimmerman, met with the former president on Thursday (January 31).

According to local media, Nasheed informed the delegates that the present government had failed to act upon the recommendations made in the Commission of National Inquiry (CoNI) report, claiming there had been a “lack of effort” to reform the judiciary.

However, MDP Spokesman Hamid Abdul Ghafoor said the US delegation were unable to answer the issues raised by Nasheed, and that their interest was focused on the implementation of free and fair elections later this year.

“The issue was a difficult question for them and we could not get a straight answer. Their purpose was to highlight the importance of implementing free and fair elections over here, but we wanted to find out how aligned they were with other issues,” Ghafoor added.

According to local media, the US delegation was set to meet various political parties and senior government officials to discuss the current political situation in the Maldives.

Issues including labour laws and the protection of worker’s rights were also a topic of discussion between Nasheed and the delegates, local media reported.

James R Moore is a Deputy Assistant Secretary of State in the Bureau of South and Central Asian Affairs since September 2010, and previously the Deputy Chief of Mission of the US Embassy in Colombo from 2006 to 2009.

Jane B Zimmerman is a Deputy Assistant Secretary of State in the Bureau of Democracy, Human Rights, and Labor, responsible for South and Central Asia, the Western Hemisphere, and International Religious Freedom.

Vikram J Singh is Deputy Assistant Secretary of Defence for South and Southeast Asia within the Office of the Assistant Secretary of Defence for Asian and Pacific Security Affairs.

Singh also serves as the principal adviser to senior leadership within the Department of Defence for all policy matters pertaining to development and implementation of defence strategies and plans for the region.

Budgetary constraints temporarily halt efforts to bring in foreign experts for CoNI report review

Efforts to bring in two international legal experts to review the Commission of National Inquiry (CoNI) report have been put on hold due to budgetary constraints, local media has reported.

The parliament’s Government Accountability Committee had attempted to seek the legal experts in order to look into the report of the controversial transfer of power in February 2012.

Parliament Secretary General Ahmed Mohamed was quoted as saying that there were no funds available to the committee in order to bring in the foreign experts.

The committee had earlier chosen a legal expert from Denmark’s Copenhagen university and two lawyers to review the report, who were scheduled to start on Friday and work for seven days, local media said.

Maldivian Democratic Party MP Ali Waheed said that the committee will make a decision and set a date based on “what is decided by the Parliament Speaker on the budgetary issues”.

Parliament Speaker Abdulla Shahid is currently abroad and is expected to return next week, according to local media.

India and US were never going to donate border control system: Immigration Controller

Controller of Immigration Dr Mohamed Ali has dismissed claims that India and the US had proposed to donate a border control system to the Maldives.

According to local media, the Anti-Corruption Commission (ACC) had previously stated that India and the US had proposed to set up a border control system free of charge.

The current border control system project contract has been awarded to the Malaysian company Nexbis for a period of 22 years by the previous government, however last month parliament voted unanimously to terminate the agreement over allegations of “foul play”.

Speaking on Television Maldives (TVM), Ali said the Foreign Ministry had confirmed that neither America nor India had proposed to donate the border control system.

“No country has proposed such a system free of charge. I have written to the Foreign Ministry last week and have got it in writing. They said that no country has made such an offer,” Ali was quoted as saying in Sun Online.

According to Ali, the Maldives is currently using US$2.3 million worth of passport reading machines installed in 2003. However the machines are incapable of reading the required software, so Nexbis had won a bid to upgrade the current system.

“The meaning of border control is that, when a foreigner enters the country, we are able know his whereabouts, know when he checks out of one hotel and checks into another, and know how long the person has stayed so that all this will be notified to MIRA, and whatever taxes the person owes can be duly collected.

“For the construction worker, we need to know who brought him into the country, and the site where he is currently working. [The system] has to provide all this,” Sun Online quoted Ali as saying.

Last week the Ministry of Foreign Affairs stalled the handover of 8000 passports to their respective High Commissions claiming that details regarding the owners’ whereabouts still needed to be obtained by immigration authorities.

State Foreign Minister Hassan Saeed said the Foreign Ministry would only deliver the passports to the respective consular authorities once immigration clarified the location of the owners, a task described as “huge” and “difficult” by Immigration Controller Dr Mohamed Ali.

In December last year, parliament voted unanimously to instruct the government to terminate the border control project agreement with Nexbis.

All 74 MPs in attendance voted in favour of the Finance Committee recommendation following a probe into the potential financial burden placed on the state as a result of the deal.

Presenting the Finance Committee report to the floor, Committee Chair MP Ahmed Nazim explained that the “main problem” flagged by the ACC was that the tender had not been made in accordance with the documents from the National Planning Council that authorised the project.

The documents were changed to favour the chosen party and facilitate the deal, Nazim said, which the ACC considered an act of corruption.

Nexbis is “systematically denying” any allegations of corruption, according to a company source, adding that if there was any foul play within the contract “we were unaware of it”.

Earlier this month, Vice President for Nexbis Nafies Aziz told Minivan News that “intelligence” received by the company suggested groups backing the country’s lucrative human trafficking industry could be seeking to stymie the introduction of its border control system to undermine national security controls.

Meanwhile, a source with knowledge of the present immigration and border control system said that should parliament’s termination decision be upheld, the Immigration Department would be returning to “a pen and paper system” for monitoring arrivals to the country.

The Ministry of Foreign Affairs inaugurated an initiative targeted at raising awareness of the issue of human trafficking in the Maldives at the beginning of January.

The Maldives has come under strong criticism internationally in recent years for the prevalence of human trafficking, and the country has appeared on the US State Department’s Tier Two Watch List for Human Trafficking three years in a row.

Housing Ministry orders police to clear MDP protest site at Usfasgandu

The Housing Ministry has sent a letter to police instructing them to clear the opposition Maldivian Democratic Party (MDP)’s protest site at Usfasgandu, the plot of land in the south of the city behind the State Electric Company (STELCO) building.

Police Sub-Inspector Hassan Haneef today confirmed to Minivan News that police had received the letter.

‘’We are currently reviewing the case. We haven’t decided [to act] on it yet,’’ Haneef said, refusing to comment further on the matter.

On January 20, 2013, Male’ City Council was ordered by the Civil Court to “hand over” the land used by the MDP for its political rallies to the Ministry of Housing within a period of seven days.

The Civil Court’s ruling also states that the city council’s current use of the area contradicts the agreement made between the council,  the Ministry of Housing and Infrastructure and the Ministry of Finance and Treasury.

However, Male’ City Council has appealed the ruling in the High Court, which has yet to reach a verdict in the appeal case.

Male’ City Council Mayor ‘Maizan’ Ali Manik today said that he had not officially heard about the issue and would not like to comment on the matter.

Meanwhile, MDP Spokesperson MP Hamid Abdul Ghafoor said he had not been informed about the letter sent by the Housing Ministry to police.

Male’ City Council (MCC) leased the Usfasgandu area to the ousted ruling party for three months, prompting repeated attempts by the government to reclaim the area on the grounds it was being used for criminal activity, including the practice of black magic.

The MDP moved a few dozen metres down the road to the site after its protest camp at the tsunami monument was dismantled and completely repainted on March 19 2012 by the police and military.

On May 29, police raided the Usfasgandu site after obtaining a search warrant from the Criminal Court, ordering the MDP to vacate the area before 10:00pm. The Maldives National Defence Force (MNDF) then began dismantling the protest camp.

The Civil Court however issued an injunction ordering security forces to halt the operation after the MDP challenged its legality. The injunction was to stand until the court reached a verdict and was later upheld by the High Court.

In August 2012, the Civil Court ruled that the police did not have the legal authority to order the opposition MDP to vacate the area. The government has since tried to transfer the land from the council – dominated by MDP councillors – to the government-controlled Ministry of Housing and Environment.

Male’ City Council refused to hand over the land and insisted that the area was “temporarily leased” to the former ruling party in accordance with the Decentralisation Act, and contended that the ministry does not have the legal authority to reclaim council property.

Foreign Minister admits Maldives’ ties with India weakened after GMR Dispute

Foreign Minister Abdul Samad Abdulla has admitted relations between India and Maldives have deteriorated following the premature cancellation of the GMR airport development contract.

Samad’s comments came after Maldivians were left struggling to obtain Indian visas following a clamp down by Indian authorities, shortly after GMR was ousted from the Ibrahim Nasir International Airport.

Speaking at the parliament’s Government Accountability Committee, Samad was reported by local media as saying that despite official assurances that ties between Maldives and India remained unaffected, “the ground reality is to the contrary”.

“Maldives and India has long existing close ties. But the recent tensions especially the GMR spat has affected the relations even though both sides have not said so officially.

“After these things surfaced we have been anticipating the backlash. I don’t want anything unexpected to come to pass that causes difficulties for Maldivians. We are working in two ways. One is to repair the damage done to the relations and come to a mutual agreement on certain things,” Samad was quoted as saying in local newspaper Haveeru.

State Foreign Minister Hassan Saeed said that during the weekly sit-downs with the Indian High Commission in the Maldives, unilateral actions on the part of Maldives were constantly highlighted.

Maldives must pay India US$50 million next month: Finance Minister

The Maldives government has to pay US$50 million to State Bank of India (SBI) next month, Finance Minister Abdulla Jihad has stated.

In December 2012 the Maldives government paid US$50 million to SBI, who refused to extend the period of the treasury bonds issued by the bank during the previous government, local media reported.

Speaking to local newspaper Haveeru, Jihad said the government is yet to come to an arrangement to pay the next US$50 million installment to SBI, explaining that the money will have to come from the Maldives Monetary Authority (MMA).

“The US$50 million due in February will have to be paid from the reserve. We have been ordered to pay the amount. There has been no change to the order so far. So it must be paid,” Jihad was quoted as saying in local media.

Following increased tensions between the Indian government and Maldives government over the airport dispute with Indian infrastructure giant GMR – which was evicted from the country by the present government in December 2012 – India turned down a request to extend the treasury bond period.

Payment of the debt will see the state’s reserves fall below US$140 million – less than a month of imports.

On top of the debts due to SBI, GMR is currently seeking compensation for the contract termination in the Singapore Court of Arbitration, which it has calculated at US$800 million.

The company’s lenders, including Axis Bank, have meanwhile called in their loans, for which the Maldives’ Finance Ministry is the guarantor.

Attorney General Azima Shukoor recently claimed that although the previous Attorney General may have signed the guarantor document, the government would argue that is could not act as a guarantor under the Public Finance Act without  parliament’s approval, which was allegedly not obtained.

“The State is acting as the guarantor to the loans taken based on the transactions between GMR and Axis Bank. I believe that is not something permitted under the Finance Act. It is like a blanket sovereign guarantee,” Shukoor told local media in December.

Maldives’ future “a cycle of failed governments”: report

The most likely short-term political future of the Maldives is a cycle of failed governments, according to a report produced by local NGO the Raajje Foundation, and supported by the UNDP and the US State Department.

“The Maldives finds itself at a critical juncture in its political development. The high hopes for the country after the new Constitution and first ever democratic election in 2008 have been tempered by the events of February 2012, in which President Nasheed resigned from office under claims of duress following weeks of public protests and increasing political tension,” writes Professor Tom Ginsburg from the University of Chicago Law School.

“This has led some observers to consider Maldives as a case of a broken transition to democracy, and there is growing disagreement among Maldivian commentators on what might the best or most desirable route forward.”

Democratic development in the Maldives is hampered by challenging conditions, including “a political culture that emphasises recrimination over reconciliation, a thin inchoate civil society, nascent higher education, limited transparency, a long tradition of patronage, massive wealth inequalities, difficult population demographics, weak politicised institutions, distorted labor market, and a narrow economy vulnerable to external shocks,” states Ginsburg.

“At the same time, the country is also confronted with major economic and social problems, such as the prospect of national insolvency and a young generation wracked by drug abuse, that would challenge much stronger states and more institutionally developed societies. This all renders the current moment one of very high stakes.”

The report documents an incendiary background for future political upheaval, noting that the 40 percent of the Maldives’ population aged under 21 are “not being integrated into traditional social and economic structures.”

Resulting issues included widespread youth delinquency and heroin addiction, affecting as much as eight percent of the population, the report notes.

“There are also other unstudied issues such as the slum-like overcrowding in the capital, increasing religious extremism, and a large illegal immigrant population, many of whom are believed to be trafficked as part of an organised racket in which the state seems either complicit or unable to control. Expectations are high but government capacity to deliver is low and a looming budget financing crisis means that there is very little room to maneuver,” it adds.

Researching such problems from the outside is difficult, Ginsburg writes, due to state obfuscation “by endlessly referring enquiries from one government office to another. Scholarship, policy analysis, and social data on the Maldives are almost nonexistent. It has for many been a very difficult country to learn about.”

“There is also very limited capacity in the Maldives for policy analysis outside a very few select government ministries. Indeed, there does not seem to be a culture of reasoned justification but rather any effort to provide a neutral perspective is assumed to be and is viewed as politically partisan.”

The report analyses the economic crisis facing the country, noting that ballooning public expenditure had reached the point where 10 percent of the population is employed by the government, and commented on the lack of an independent pay commission to prevent parliament and other commissions from effectively raising their own salaries to those akin to developed countries.

Independent commissions were in a position where they faced either accusations of selective enforcement based on politicisation, “or focused on fact-finding and other activities to keep them out of the heated political conflicts of the day.”

The Judicial Services Commission (JSC)’s mission to ensure the new judiciary was was clean, competent, and protected from political influence, “has sadly gone unfulfilled.”

“The courts have essentially been able to capture the JSC so as to ensure that the old judiciary remained in place under the new constitutional order,” writes Ginsburg.

“While the 2008 Constitution does include a provision allowing for five year terms for current judges before appointing them for a life term till the age of 70, presumably to allow some transition from the old regime, it is now not clear this provision will be exercised without some dramatic and unexpected change in circumstances.”

A raft of new civil society organisations which sprang up after 2008 were meanwhile accused of being “aligned with various political agendas”, while “a few organisations have obtained an effective chokehold on international funding and support, inhibiting the overall growth and competence of the sector.”

Three scenarios

Against this backdrop – “a cascade of serious structural weaknesses that undermine continued democratic development” – the report outlines three potential scenarios for the country: a cycle of failed governments; dominance of one hegemonic faction; and an eventual move towards constitutional democracy.

Scenario one: Cycle of failed governments

This scenario would be most likely to result ”if the current government pursues its legal case against former President Nasheed in a shortsighted and headstrong manner, or if Nasheed escalates conflict to try to ‘overthrow the government’,” Ginsburg writes.

In this scenario – the most likely – “personalities rather than policy differences continue to define the party system and alliances of political aspirants shift back and forth among two or three factions competing to secure access to state resources.

“These personalities, when in government, will therefore always have the incentive to stymie critically needed reforms for fear of cutting down the very patronage networks that sustain them and allowing their opponents to promise to restore this largess.

“In this scenario, true national leadership becomes the casualty. No one will be willing to take the tough decisions to put through the needed legislation, undertake essential bureaucratic rationalisation, and get the government on a proper fiscal footing. One government after another will find itself unable to do what is required in order to break through the cycle of repeated failure.”

With the state paralysed, “There will be almost no chance for the unanimous consensus required to make the constitutional changes needed to reintroduce rigorous judicial accountability or even rewind the country back to its transitional period.

“Given the politically weak bargaining power of the general public, and the large and still growing youth demographic in particular, radical ideologies and charismatic anti-establishment figures may become more popular with a frustrated but disempowered population,” Ginsburg predicts.

Scenario two: Dominance of a hegemonic faction

“Some already talk openly about a ‘Singapore option’ in which a single political party takes leadership and empowers a technocratic state apparatus to provide for the public good,” writes Ginsburg.

“The permanent collapse or suppression of one faction to another does not seem likely to occur without a use of force which would put Maldives in clear violation of its treaty obligations and basic international norms. Consequently, efforts to attain hegemonic control would actually likely lead to an even more adversarial version of the cycle of failed governments scenario in a way that is perhaps reminiscent of Maldives’ present situation,” he warns.

“With a still politically disempowered public unable to truly hold government to account, this scenario may similarly also lead citizens to look to more radicalised religious and non-establishment actors who claim to offer more equitable alternatives to the status-quo.”

Cautioning against comparisons with Singapore, the report notes that the Maldives “is coming from a completely different context and, more significantly, does not have a potential leader who could command the respect that Lee Kuan Yew earned in Singapore.

“Pursuing a strategy premised on the promise of enlightened leadership is thus risky and likely to fall back into a cycle of failed governments. It is also what the Maldives had sought to move away from in the first place by not supporting a continuation of its prior tradition of autocratic governance.”

Scenario three: Constitutional democracy

The most internationally-desirable forecast for the Maldives “is also the least likely”, writes Ginsburg.

“This would involve potential alternation in power among political groups, a focus on policies as the basis for political decision-making, along with a deep infrastructure to support the development and implementation of policies, significant constraints on extra-constitutional governmental action, and a sense of political maturity that has heretofore been lacking,” he states.

The report outlines a number of recommendations to achieve this scenario, particularly constitutional education to encourage the kind of public pressure “that ensures that politicians and government agents comply with the orders of courts, independent agencies and the intent of the Constitution.

“Ignorance of the public on their own Constitution is by far the most obvious gap within the Maldives’ democratic transition,” the report suggests.

In terms of judicial reform, “There must be mechanisms to ensure that the judges obey the law and apply it consistently. there are reasons for concern about the current situation, in which the legal framework is underdeveloped and the Supreme Court has foreclosed many of the extant channels of ensuring accountability.”

Ginsburg proposes a more active and independent, self-regulating bar association, with lawyers freed from the requirement to be registered through the attorney general’s office. He notes that the International Bar Association “has repeatedly offered its assistance”, but suggests that the prospect is unlikely “given the politicisation of the various groups who would have come together for such a purpose.”

Programs such as citizen-initiated ‘court-watch’ initiatives, common in other countries, were hampered by the lack of open courtrooms. Moreover, “rules squelching discussion of court decisions form a major barrier to this or any other channel of accountability.”

The report proposes the use of laymen in adjudication, with four to five citizens “sitting with two to three judges in serious criminal cases such as murder.” However, “the challenges of implementing such a system in the Maldives with its dense network of family ties should not be underestimated.”

The report cautions that donors supporting the development of judicial capacity in the Maldives “must tie this to developing enhanced mechanisms of accountability.”

“We have been off the streets for some time – now we are back”: MDP

Maldivian Democratic Party (MDP) supporters marched through Male’ on Tuesday (January 22) for the first time in several months to protest against the current coalition government.

The protest was the first large-scale march through the city since the Freedom of Assembly Bill was ratified by President Mohamed Waheed Hassan Manik earlier this month. The party claimed over three thousand attended.

MDP Spokesman Hamid Abdul Ghafoor told Minivan News that the party plans to hold more assemblies and protests in next coming months around Male’.

“The MDP have been off the streets some time, we had taken a break. Now we are back. We have too many options and ideas opening up and people need to know what’s going on,” Ghafoor added.

The demonstration took place the same day former President Mohamed Nasheed called on parliament to create an interim, caretaker administration following a week in which senior members of the defence and military gave evidence alleging the transfer of power on February 7 “had all the hallmarks of a coup d’etat.”

Minivan News observed the protest as it moved down through Majeedhee Magu at around 5:00pm on Tuesday evening.

Despite the large turnout of protesters and disruption caused to traffic, Minivan News witnessed only four police officers observing the march from down a side street off Majeedhee Magu.

Asked as to why police presence had been limited during the protest, Maldives Police Service (MPS) Spokesman Hassan Haneef said police had been “observing the protest”.

“Under the Freedom of Assembly Bill there are guidelines for protests. We made no arrests and I do not see why there should be a problem if there is no trouble caused,” Haneef added.

Minivan News witnessed only one incident of confrontation when a protester threw a handful of Maldivian rufiya notes at the face of a police officer – who did not react.

As protesters walked passed two police stations on Ameene Magu they began to chant “Baghee” to officers watching from outside.

“When you compare to how the police have reacted to us in the past, it was very different today. I still do not believe that the whole of police and Maldivian National Defence Force were involved in the coup,” Ghafoor said yesterday.

“In the past there is only trouble from police when we move into areas where they get nervous. They do not confront us as long as we keep away from those areas,” he added.

President’s Office Spokesperson Masood Imad and Police Commissioner Abdulla Riyaz were not responding to calls from Minivan News at time of press.

Usfasgandu handover

The protest took place a day after Male’ City Council (MCC) Mayor ‘Maizan’ Ali Manik appealed to High Court to suspend a Civil Court ruling ordering it to hand over the MDP protest site – Usfasgandu – to the Ministry of Housing and Infrastructure.

“The government want the MDP to go onto the streets, that way they can say there is no stability in the country and preventearlyelections from being held,” Manik alleged to Minivan News on Monday.

Responding to the Mayor’s allegations, President’s Office Spokesperson Masood Imad claimed the mayor needs to be more “Male’ mayor” than “MDP mayor”.

“Who is to say the MDP will start protesting on the streets if Usfasgandu is handed over? Why do some people think the [MDP] always protest?

“Contrary to what Mayor Manik thinks, I don’t think they go around making protests, I think the MDP are good guys,” Imad said.

Freedom of Assembly

The recently ratified Freedom of Assembly Bill imposes a number of restrictions on protesting from both protesters and police alike.

Among the key features of the Freedom of Assembly bill is the outlawing of demonstrations outside private residences and government buildings, limitations on media covering protests not accredited with the state and defining “gatherings” as a group of more than a single person.

One of the main stated objectives of the legislation is to try and minimise restrictions on peaceful gatherings, which it claims remain a fundamental right.

Under the legislation, demonstrations will be outlawed within a certain distance of the residences of the president and vice president, tourist resorts, harbours utilized for economic purposes, airports, the President’s Office, the courts of law, the Parliament, mosques, schools, hospitals and buildings housing diplomatic missions.

Earlier this month Ghafoor told Minivan News that the MDP stood against the principles of the Freedom of Assembly Bill, alleging its ratification is a response to the ‘Ingilaab’ proposed by former President Mohamed Nasheed last month.

Speaking at yesterday’s protest, Ghafoor said that the MDP had obtained permission from Male’ City Council to protest. MCC Mayor ‘Maizan’ Ali Manik also took part in the protest.
