Power failure disrupts court proceedings

Multiple Court proceedings were disrupted this morning by a power failure at the justice building in which a number of courts are based .

Speaking to local news outlet CNM, a media official from the Criminal Court said that the power failure happened between 10am and 11:30am this morning.

“Some of the cases were cancelled today because it was impossible to continue the court proceedings during the power failure,” said the official.

Twenty different hearings were scheduled at the Criminal Court alone during the period of the power failure, including a hearing on the murder of Abdul Muheeth (Bobby), a 21-year-old who was stabbed to death near the finance ministry in 2012 in a case of mistaken identity.

Juvenile Court sentences two 18 year-olds to death for murder of Abdul Muheeth

The Juvenile Court has issued the death sentence to two 18 year-olds found guilty of the February 18, 2012 murder of Abdul Muheeth of Galolhu Veyru House.

Three minors were charged in the case, and one was acquitted by the court. The two sentenced to death are both 18 years-old, although both were underage and minors at the time of the murder, according to local media.

A Juvenile Court spokesperson told the local media three male witnesses told the court they witnessed one of the minors attacking Muheeth.

The two minors were seen at ADK hospital the same night with some other suspects in the case.

All Muheeth’s heirs had approved the death sentence if the courts found the suspects guilty of murdering him.

Last year Police Inspector Abdulla Satheeh told the press that the investigation into Muheeth’s death showed that he was not attacked for any involvement in gang related crimes, and that he had no police record.

He also noted that Muheeth was not a member of any gang, and was working in a responsible job at the time.

Muheeth was rushed to Indira Gandhi Memorial Hospital (IGMH) after he was stabbed at 1:45am near the Finance Ministry building. He later died during treatment.

The three suspects were identified at the time as Muhujath Ahmed Naasih of Abulagee Ge on Gahdhoo in Gaaf Dhaal Atoll, Mohamed Maimoon of Zaithoonige, on Naifaru of Lhaviyani Atoll and Ali Mushahfau of Sultan Villa on Maradhoo in Seenu Atoll.

High Court rules against keeping Muheeth murder suspect under house arrest

The High Court has overturned a previous Juvenile Court ruling to keep the main suspect in the murder of Abdul Muheeth under house arrest, declaring that the minor should be detained in accordance with the Home Ministry.

The High Court said yesterday that it had been notified by the Prosecutor General (PG’s) Office that the original Juvenile Court decision had not properly considered the present charges against the suspect or his criminal record.

In overruling the Juvenile Court, the High Court said the minor might become a threat to the society if detained under house arrest.

The PG also claimed during the High Court ruling that the Juvenile Court had not properly considered that the suspect, who is a minor, might influence the trial’s witnesses should he be released from police detention.

It was noted yesterday that the Juvenile Court has issued five warrants related to the case, with the most recent requesting that the suspect be put under house arrest.

The four previous warrants issued requested the suspect be kept in a place determined by the Home Ministry over concerns he might influence witnesses should he be released from detention.

The High Court said that when keeping a suspect in detention, the presiding judge in the case is required to refer to several different factors, such as the crime involved and the challenges faced in investigating the offence.

Other factors a judge needed to consider were the number of persons involved in the crime, the nature of the crime, the penalty for the crime, the probability that the accused might flee and the probability of influencing witnesses.

The High Court stated that the suspect had a criminal record with five previous offences.  The court said that these cases included involvement in an unlawful gathering whilst in possession of a violent weapon, a charge of assault using a violent weapon and one case of terrorism. In considering the suspect’s record, the High Court said it could be believed he might be a threat to the society if released from detention.

The PG requested the High Court to keep the minor in pre-trial detention until the court reaches a verdict on the case.  However, the High Court said the police had earlier requested the Juvenile Court grant an extension of detention for 15 days and it could only refer to police requests made at that time.

Muheeth, of G. Veyru, was stabbed to death near the Finance Ministry building on February 19.  Five suspects were arrested in connection with the case.

Police Inspector Abdulla Satheeh has previously told local media that the investigation into Muheeth’s death showed that the victim had not been involved in gang related crimes and this was not being considered a motive for the attack.  Satheeh added that the victim had no police record and was working in a responsible job at the time.

Prosecutor General recieves cases against five suspects in Muheeth’s murder case

The police have forwarded the case of 21 year-old Abdul Muheeth’s murder to the Prosecutor General’s (PG) office, requesting five suspects be charged in connection to the attack.

Muheeth, of G. Veyru, was stabbed to death near the Finance Ministry building on February 19.

Police have released the pictures and names of three suspects, while the identity of two other suspects linked to the murder were withheld as they are minors.

A statement released by the police says that cases have been forwarded against Muhujath Ahmed Naasih of Abulagee Ge on Gahdhoo in Gaaf Dhaal Atoll, Mohamed Maimoon of Zaithoonige, on Naifaru of Lhaviyani atoll and Ali Mushahfau of Sultan Villa on Maradhoo in Seenu Atoll.

According to police, Muheeth was allegedly murdered by the gang in a case of mistaken identity.

Police Inspector Abdulla Satheeh earlier told the press that the investigation into Muheeth’s death showed that he was not attacked for any involvement in gang related crimes, and that he had no police record.

He also noted that Satheeh was not a member of any gang, and was working in a responsible job at the time.

Satheeh added that there was enough evidence to prosecute the suspects, but said police were still working to collect more evidence.

He said that police gave high priority to such cases and assured the public that the case was proceeding at a fast pace.

A close friend of Muheeth told Minivan News that Muheeth was attacked by the gang because he was a close friend of the person they wanted to attack.

‘’It was a week after the person they wanted to attack had left the country to study and was killed,’’ he claimed. ‘’I say the assailants should receive the death penalty, and the police should also make them apologise to his mother and father,” he said, on condition of anonymity.

Almost two months after Muheeth’s murder, a 33 year-old man was was stabbed to death. Police have arrested five people in connection with the murder of Ali Shifan ‘Tholhi Palay’ of M.Fairy Corner. The case is currently being investigated.

Meanwhile, the courts are hearing cases against six suspects, including who have been charged with brutally murdering 76 year-old Ali Hassan, who was discovered with multiple stab wounds in an abandoned home on Kudahuvadhoo of Dhaalu Atoll in January.
