IPU requests parliament proceed without obstruction

The Inter-Parliamentary Union (IPU) has called on all political parties in the country to ensure that parliament is not impeded when the People’s Majlis reconvenes tomorrow.

Parliament is set to open  for the first time since members of the Maldives Democratic Party (MDP) obstructed the session from opening on March 1.

In a day of ongoing international developments regarding both the legitimacy of the government of Mohamed Waheed Hassan and the functioning of the People’s Majis, the IPU held a press conference today in Male’ calling for a peaceful resolution to the political stalemate resulting from a controversial transfer of power last month.

The Inter-Parliamentary Union is the world organisation of parliaments and was established in 1889. It works to foster coordination and exchange between representative institutions across the globe. The IPU also offers technical support to affiliated nations. The Maldives has been affiliated with the organisation since 2005.

Amidst ongoing allegations by the MDP that President Dr Mohamed Waheed Hassan has replaced Mohamed Nasheed through a “coup d’etat” assisted by a mutiny among sections of the police and military, the party’s leadership has said it is committed to continuing to obstruct the Majlis until early elections are first agreed upon.

The increasingly fractious and partisan atmosphere within Maldivian political circles led to MDP MPs on March 1 preventing President Waheed from performing his constitutional duty of opening parliament with a state of the nation speech.

Former President Mohamed Nasheed has said that his party intends to continue efforts to block the Majlis from opening until President Waheed bows to international pressure from bodies such as the Commonwealth and the EU and sets a date for early elections to resolve the questions of his legitimacy democratically.

Amidst the stand off, Martin Chungong, Director of Programmes for the IPU, told the gathered media that it was vital for parliament to preserve its integrity by continuing to function correctly as well as calling on all parties to avoid inciting or committing acts of violence during the session.

The IPU delegation said that their remit within the Maldives remained to try and facilitate a peaceful resolution to the political upheaval faced by President Waheed since he controversially came to power on February 7.

To this end, Chungong said he believed that it was for the Maldivian people, and not an external party, to provide a solution to the current political stalemate.

Despite calling for a peaceful resolution, the IPU delegation stressed that it was ultimately down to the parliamentary speaker to enforce any decision to remove MPs who were openly trying to obstruct tomorrow’s session from taking place.

Meanwhile, newspaper Haveeru has reported that following fierce debate today amongst its leaders, the MDP had decided to prevent President Dr Mohamed Waheed Hassan from entering the chamber tomorrow, in fulfilment of his constitutional obligation to address the opening of the People’s Majlis.

The party’s democratic group has reportedly agreed to allow Speaker Adbullah Shaheed to enter the People’s Majlis after having barred his access on March 1. The group has also agreed to allow a minute’s silence in commemoration of the former Foreign Minister Fathullah Jameel who recently passed away.

After this point in tomorrow’s proceedings though, MDP MPs have pledged to begin their protests despite concerns also being raised by the the Commonwealth Ministerial Action Group (CMAG) about obstructing parliament from functioning.

Speaking to Minivan News earlier today, MDP spokesperson Hamid Abdul Ghafoor said that within the current climate, continuing to try and block the Majlis was a “thorny issue,” but that he believed that the party could viably continue its attempts to block parliament.

He added that from the MDP’s perspective, the party had little choice but to continue to try and prevent parliament from continuing in order to “protect” the integrity of the Majlis.

Despite CMAG’s criticism of efforts to block parliament from functioning, Ghafoor claimed that international calls from groups like the Commonwealth for early elections and constitutional reforms showed that there were questions to be answered over the legitimacy of the present government.

“We do not believe Dr Waheed to be a legitimate leader,” he said. “The MDP’s position is to try and find a political situation to agree on an election date and the corresponding constitutional reforms required to do this before opening parliament. This was highlighted and agreed by MDP members, but rejected by the opposition.”

Ghafoor claimed that the MDP has been working with the government and opposition politicians to try and secure an end to the current political deadlock.

Parliamentary Group leader Ibrahim Mohamed ‘Ibu’ Solih, has previously expressed concern that Dr Waheed was not open to finding a potential solution on a timetable for elections.

Nasheed on front lines

Former President Nasheed told his supporters that he himself planned to be on the front lines of the protests outside the reconvened Majlis session tomorrow and claimed that authorities “would have to shoot him” before they could proceed with the opening.

In responding to the MDP’s comments, President Waheed’s spokesperson Abbas Adil Riza called on former President Nasheed to “stop advocating violence” particularly among young people, in regards to blocking the Majlis and opposing the government.

“More than 200 youths currently face charges for torching public buildings since February 8,” he added.

Though Riza said that the public would be free to gather on some of the capital’s roads to protest, he added that inside the parliament chamber, it was for the Speaker of the Majlis and not the government to ensure parliament functioned correctly.

The government spokesperson added that just as under the government of Mohamed Nasheed, the speaker had control of 60 Majlis guards that had the power to remove disruptive elements from the parliamentary floor.

Maldives may reconsider Commonwealth membership

The Maldives government has said it may “consider” its membership in the Commonwealth in the future after the body’s Ministerial Action Group (CMAG) repeated calls for early elections in the country.

President Waheed’s spokesperson Abbas Adil Riza told Minivan News today that although the government was not currently looking to re-assess the country’s role as a member of the intergovernmental organisation, it was concerned over the language used in a statement by the Commonwealth Ministerial Action Group (CMAG) on Friday.

“The government is concerned at the language that has been used by the Commonwealth [in the latest statement] and we condemn it. The foreign minister has conveyed this as well,” he said. “If this language continues, we will look to consider our position [in the Commonwealth].”

Riza added that the government would also forward its concerns about the language of the CMAG statement to the Commonwealth’s Special Envoy, Sir Donald McKinnon, who arrived in the Maldives on Friday.

Commonwealth role

Debate over the role of the Commonwealth in the Maldives has intensified over the last week following the political uncertainty generated by the ongoing controversy over the transfer of power that saw Dr Waheed replace Mohamed Nasheed as president on February 7, 2012.

In Friday’s statement, CMAG said it “continued to be strongly of the view that the earliest possible expression of the will of the people was required to establish universal faith in the legitimacy of those who govern the [Maldives].”

The government has since responded that discussions, road map talks, and other constitutional amendments designed to set out plans for any early elections remained an “internal issue”. Riza therefore called on the Commonwealth to refrain from issuing further statements with “language like that”.

Speaking yesterday about the elections calls, Foreign Minister Dhunya Maumoon said that CMAG, which serves as the Commonwealth’s democracy and human rights arm, had shown some bias in its comments. However, she added that the statement had been positive about some of the government’s initiatives to try stabilise the country’s fractured political structure.

“The statement somewhat promotes the interests of a certain party or a certain individual. But I don’t want to say that exactly. Because there are many statements that are positive towards the government,” the foreign minister told reporters.

Majlis concerns

Meanwhile, the Maldivian Democratic Party (MDP) has said it will continue to try and prevent the Majlis from functioning until a date for early elections is set.

The CMAG had raised concerns regarding the obstruction of parliament by MDP MPs during the opening on March 1. It expressed regret over the disruption of parliament on March 1 and urged “all parties to engage in dialogue without delay, in earnest and in good faith with a view to achieving agreement on the date of early elections”.

MDP spokesperson, Hamid Abdul Ghafoor said continuing to try and block the Majlis was a “thorny issue,” but believed the party could viably continue its attempts to block parliament.

He added that from the party’s perspective, it had little choice but to continue to try and prevent parliament from holding its opening position to “protect” the integrity of the Majlis.

“The moment we allow a coup leader to address parliament, the public will begin to question the integrity of the Majlis,” he claimed.

Constitutional requirement

Government dismisses Commonwealth’s “biased” early election calls, fears “civil war”

The Maldives government has dismissed the Commonwealth Ministerial Action Group (CMAG)’s call for early general elections as biased, claiming the nation is not capable of holding a free and fair vote at present.

The CMAG on Friday reiterated its call for early elections after former President Mohamed Nasheed accused the government of his successor, Mohamed Waheed Hassan, of coming to power in a “coup d’etat.”

CMAG said it strongly believed “that the earliest possible expression of the will of the people was required to establish universal faith in the legitimacy of those who govern the [Maldives].”

However, at a press conference today, State Minister for Foreign Affairs Dhunya Maumoon criticised CMAG’s statement, which she alleged served to promote the interests of specific parties or individuals.

“The statement somewhat promotes the interests of a certain party or a certain individual. But I don’t want to say that exactly. Because there are many statements that are positive towards the government,” she told reporters.

The state minister added that she was “astonished” by CMAG’s continued call for early elections, calling the transfer of power to President Mohamed Waheed Hassan as “legitimate”.

Early elections in the Maldives without sufficient parliamentary-mandated reform could potentially lead to “civil war,” she said.

“We have to build a peaceful and secure atmosphere. We have to strengthen our institutions so that they are independent. Otherwise, I have no doubt that if we hold elections, the political situation of the country will deteriorate further. It is already quite divided. If there is an election, and if some people do not accept the election results, I cannot say there won’t be a civil war. I do not want to see such a thing happen in the Maldives,” she said.

Dhunya added that no other international body other than the Commonwealth has expressed concern over the current political uncertainty in the Maldives.

The EU has also raised issues over judicial reform and the exact nature of how President Waheed come to power last month.

“My hope is that the UN and other neighboring countries help the Maldives on its request. Not for them to impose their interests on us,” she added.

The government will also support the Commonwealth’s Special Envoy to the Maldives Sir Donald McKinnon, she said.

Positive aspects

However, she conceded that CMAG’s statement wasn’t entirely “biased” against the current government’s actions, claiming it was positive about some aspects of the executive’s work.

“There are many statements that are positive towards the government, such as the initiative for all-party talks, and other statements. Also, they have expressed concern on the obstruction of parliamentary proceedings,” the state minister added.

The State Minister for Foreign Affairs comments were reportedly shared by PPM MP Abdul Raheem Abdulla, who yesterday accused CMAG of favouring certain political parties in the country and failing to recognise the need for  wider judicial reform as part of all-party road map talksdesigned to secure fair presidential elections.

A coalition of political parties including the PPM and DRP have boycotted the road map talks, designed to overcome the current political stalemate at present, in response to the Maldivian Democratic Party blocking a parliamentary sitting earlier this month that prevented President Mohamed Waheed Hassan from delivering his inaugural speech.

The MDP maintains that President Waheed came to power in a “coup d’etat” sponsored by opposition figures, certain business leaders and sections of the military and police force, leading to calls for early elections to settle the dispute that saw President Mohamed Nasheed “resign” from office.  Nasheed later alleged he had been forced into resigning under military pressure.

Abdulla told reporters gathered at yesterday’s press conference that CMAG’s calls for early elections were unrealistic without securing further talk on amendments to the country’s constitution and judiciary – issues he said would be vital in ensuring an “appropriate environment” for elections.

“I also note that their [CMAG’s] statement is biased and that it harbours the interests of a particular individual” he was quoted as saying.

PPM members Ahmed Mahloof and Ahmed Nihan were unavailable for comment when contacted by Minivan News at the time of going to press over the exact nature of the judicial and constitutional reforms called for by MP Abdulla.

Adding that the roadmap talks were designed to establish the correct preparations for any early elections, Abdulla claimed that CMAG should be issuing statements free from “predjudice” that would serve the interests of the whole nation rather than certain individuals, Haveeru reported.

CMAG investigation

Following a fact-finding mission in February and an extraordinary meeting on the situation in London, the Commonwealth suspended the Maldives from participation in CMAG and called for an internationally-assisted independent inquiry into the circumstances surrounding the change of government on February 7.

The Commonwealth also expressed concern about early efforts on behalf of Dr Mohamed Waheed Hassan’s new government to arrest former President Nasheed, following the issuing of an arrest warrant in the immediate days following the change of power.

In its most recent statement, CMAG expressed regret over the disruption of parliament on March 1, and “urged all parties to engage in dialogue without delay, in earnest and in good faith with a view to achieving agreement on the date of early elections, and the processes required to do so, including any necessary constitutional amendments and supporting legislation.

“The Group also noted that the Commission of National Inquiry in Maldives had commenced its investigation into the events between 14 January and 8 February 2012, but that it had not secured cross-party support.

In this context, CMAG acknowledged that international assistance for the investigative mechanism has been requested, and noted that the Commonwealth could be of potential assistance. It reiterated its strong belief in the importance of the work of the Commission and the conviction this should carry in Maldives and internationally.”

EU targets judicial reform discussions with President Waheed

The European Union has said it will continue trying to work with Maldivian authorities to reform the country’s judiciary following requests for assistance made by Mohamed Nasheed “shortly” before Dr Mohamed Waheed Hassan became president this month in an alleged “coup d’etat”.

Nasheed was replaced by his Vice President Dr Waheed after “resigning” his presidency on February 7 – a decision he  later claimed had been forced upon him by opposition figures  and security forces unhappy, in part, with his commitments to reform the nation’s judicial system.

A spokesperson for Catherine Ashton, the Union’s High Representative for Foreign Affairs, has said the bloc now hoped to open discussions with Dr Waheed’s government over judicial reform on the back of concerns raised by former President Nasheed about the conduct of the nation’s judges.

“Shortly before the events of February 6 to February 7, we were asked for assistance [with judicial reform], as were the UN and Commonwealth. We were ready to look into this matter and hope to discuss the matter further with the Maldivian authorities,” added the spokesperson for High Representative Ashton.

“The HR/VP’s spokesman has already reiterated the importance we attach to the correct functioning of the democratic institutions in the Maldives; we had previously offered the Nasheed government support under the Development Cooperation Instrument for the improvement of governance across the board.”

The country’s judges and their conduct became a major focus for President Mohamed Nasheed in the run up to him being replaced by Dr Waheed earlier this month.  Nasheed had raised concerns over allegations of perjury and “increasingly blatant collusion” between senior judicial figures and politicians loyal to the former autocratic President, Maumoon Abdul Gayoom.

However, Nasheed came under criticism from some international bodies after detaining the Chief Judge of the Criminal Court, Abdulla Mohamed.  The former president claimed the detention was designed to prevent the judge from sitting on the bench whilst charges against him were investigated.

Last year, the International Commission of Jurists (ICJ) unveiled findings suggesting that the Maldives’ legal system was failing to serve its citizens despite many “positive developments” that have been made in an effort to depoliticise the courts; with many of judges found lacking in qualifications and independent attitude.

Catch-22”

Nasheed’s government had eventually consulted international organisations like the UN, the Commonwealth and the EU after describing itself in a “Catch-22 situation” in terms of a lack of mechanisms to investigate the judiciary independently. In November, the national court watchdog, the Judicial Service Commission (JSC), was ordered to cease an investigation into Judge Abdulla Mohamed by the civil Court under an action he himself instigated.

Amidst the violent upheaval and pro-government and anti-government protests that have taken place since President Waheed came to power, the EU has said the issue of the country’s judiciary was among a number of concerns foreign governments wished to investigate in light of the transfer of power.

Judicial interference

In an interview with local and foreign media on Friday, President Waheed confirmed that Judge Abdulla Mohamed had taken a month’s leave from his post for “personal issues”, but did not elaborate whether he had been reinstated to the bench.

“It is for the judiciary to decide what to do with him, not for me. I don’t want to interfere in the judiciary. I want our constitution to be respected, and work with everybody to make our constitution work. This is a new constitution, and it is the first time we are trying it out. And so there are difficulties in it,” the president claimed.

“We need to find ways of solving it. It is time for us to work together, and if there are problems with the judiciary we need to work together to solve them – they are intelligent good people in the judiciary and the Judicial Services Commission (JSC). We welcome assistance from the Commonwealth and United Nations to develop programmes and build the capacity of the judiciary.”

EU position

While currently preparing an official statement on the main concerns the EU holds over the ongoing political disputes facing the Maldives, the spokesperson for High Representative Ashton said the bloc hoped to see more consensus by rival political groups including the MDP to move forward democratically.

“It is essential that the business of government can continue and that multi-party democracy and the constitutional checks and balances are preserved,” the spokesperson added. “The army and police should exercise maximum restraint in the execution of their duties which must remain strictly within their constitutional mandate. Further violence must be prevented.”

The spokesperson claimed that the EU continued to support calls for an impartial investigation to ascertain whether President Waheed came to power legitimately or under a “coup”, though provided no details of how this may be achieved within the country’s highly partisan political arena.

“The EU supports an impartial investigation on this. In the mean time we hope there is a general understanding, following our Heads of Mission (HoMs’ ) visit to Malé, that all parties, including Mohamed Nasheed’s party, the MDP, need to cooperate to prevent the country falling victim to political factionalism, which can only lead to further unrest,” the spokesperson added.

In a statement released earlier this week by the European Parliament’s Delegation for relations with South Asia, “deep concern” was expressed by the group’s chair Jean Lambert over a “sword of Damocles” he said was hanging over ousted President Mohamed Nasheed.

“The European Union had deployed a team of experts to observe the first democratic Presidential elections held in the country in 2008; a sword of Damocles now hangs above the winner of these elections, with his arrest warrant already issued on unspecified grounds,” said a statement from Lambert.

“We understand a number of MPs and local councillors have also been detained or are in hospital following continued police violence,” Lambert added, further noting that several EU countries have issued travel advisories for the Maldives as “public resentment and violence are now spreading well beyond the capital.”

Since the statement was made, Dr Waheed has denied setting a deadline for the MDP to join with other parties in forming a “unity” government up until the next general election presently scheduled for 2013.  The MDP has maintained it’s belief that Dr Waheed’s government is “illegitimate” and called for power to be transferred to the parliamentary speaker ahead of early elections.

Labour authority plays down expatriate worker culture-clash claims

In the second of a two part article, Minivan News looks at the challenges facing skilled expatriates coming to work in the Maldives and the current systems in place to prevent both employees and employers from suffering workplace malpractice. Read part one

The Minister of Human Resources  Hassan Latheef has said that the country’s Labour Relations Authority has not received notice of any cultural difficulties between expatriate staff and local employees in the Maldives. However, the country is planning amendments to employee rights.

Amidst complaints from some expatriates about alleged difficulties and mistreatment from local employers, Latheef suggested that in some cases, language and legislation were key barriers to ensuring workplace harmony.

Several European and Australian skilled expatriates who spoke to Minivan News criticised certain employment practices that they claimed led to clashes with their employers. These clashes are said trigger premature job dismissal, and in some instances force employees to flee the country.

Minister Hassan Latheef, speaking to Minivan News earlier this year, rejected suggestions that any cultural clashes were occurring between foreign workers and their employers, at least as reported by the Labour Relations Authority.

“In the work place, I do not see any cultural differences that are being brought up and creating issues [between expatriate workers and employers],” he said.

According to Latheef, however, the Dhivehi language was seen as a major potential barrier to harmony between foreign workers from outside the region and their local colleagues and employers. He said workers from countries like Sri Lanka, India and Bangladesh did not generally face this barrier.

“There is one thing in common for an Indian worker, a Sri Lankan worker or a Bangladeshi worker who is working in the same site doing the same work – their language of communication is Dhivehi. That keeps them not so much nationalistic,” he said, referring to any potential difficulties foreign workers are said to face. “We haven’t come across any cases [of cultural discrimination] as such and this has not been raised as an issue by anybody so far – fortunately.”

The minister did advise caution when addressing the treatment of workers, either national or foreign. Preventing potential widespread difficulties in the future, or culture clashes between bosses and their staff, was important, he said.

“I do sense that if we neglect [the issue of treatment of foreign worker] or keep our eyes shut, this could create problems because you know with Bangladeshis [working in the Maldives], I’m sure they face a lot of things that are not common in other countries,” he said. “So if we don’t keep in our minds that this could be an area that someday might create problems, we always have to be cautious of the issue that these workers are of different nationalities. I know I’m very cautious of that.”

Latheef claimed that legislation –particularly in areas like labour relations – was another key area that the government had pledged to address.  With an estimated 100,000 expatriate workers believed to have been hired in the Maldives, 45,000 are thought to be skilled, semi-skilled and unskilled workers from Bangladesh. According to Latheef, the High Commission for Bangladesh based in Male’ has worked with the ministry on numerous occasions to resolve any humanitarian concerns or workplace issues that have occurred with its nationals in the Maldives.

Both Former Bangladeshi High Commissioner to the Maldives, Professor Selina Mohsin, and the serving Controller of Immigration Abdulla Shahid have previously told Minivan News that failures in immigration policy left foreign workers vulnerable to substandard treatment and workplace malpractice.

Latheef claimed that concerns over employee treatment were being addressed. Legislation was awaiting approval for local and foreign workers alike that was aimed to cover a wide variety of issues relating to staff and employer rights.

“There is a bill being drafted, a very comprehensive one on industrial relations that would have provisions for making trade unions and everything to do about lockouts, picketing and striking, regulatory bodies’ functions and the Labour Relations Authority – it’s very comprehensive,” he said.

Echoing comments from the country’s employment tribunal, which is independent of the Human Resources Ministry and the Labour Relations Authority that falls under its remit, Latheef said that the majority of complaints received were from local workers, particularly in the country’s tourism industry.

Latheef added that about 95 percent of complaints received by the Labour Relations Authority from expatriate workers involved the alleged failure of an employer to pay wages. He said living conditions or overall treatment were not a commonly raised issue. But the minister believed local workers differed from their expatriate colleagues.

“Maldivians rarely complain about the pursuit of [unpaid] salaries – most of the time, they complain about the conditions at work or their living conditions. Most of the complaints I should say come from resort workers,” Latheef said. “Their complaints come from not being paid a service charge they are entitled to, to conditions of their accommodation and alleged discrimination from senior management.”

Among proposed changes to labour laws, the government last month invited comments on amendments to the Employment Act targeted at setting new living standards for foreign and local workers. These standards aimed to align with International Labour Ogranisation (ILO) recommendations.

The Human Resources Minister claimed that many potential problems currently facing expatriate employment in the country were expected to be eradicated by next year. He anticipates new systems for hiring foreign workers will be in place as well.

The claims were made after the Maldives National Defence Force (MNDF) assumed the duties of front-line immigration staff and Human Resources Ministry officials handling employment for a several weeks in June, following allegations of corruption in the work permit process.

The controversial decision, criticised by opposition MPs, was said to have Lateef’s support. Lateef believed military assistance was vital to reforming the processes of immigration and hiring expatriate labour.

“I don’t see the problems we have now will be there in 2012,” he said. “For instance we have a backlog of roughly 40,000 expatriates working here illegally,” he said. “The scenario would be very different in dealing with the ways we think of and the manner we act [to employees] on a happy day. But it is not a very happy day for us.”

The country’s Employment Tribunal, formed in 2008 to rule on disputes between employees and employers, previously said it had not received any complaints of alleged workplace discrimination. It also said expatriate cases represented a minority of the overall complaints received.

A tribunal spokesperson, who wished to remain anonymous, added that although the tribunal had not dealt with cases such as forced labour or discriminatory behaviour from employers, “this does not mean it is not taking place fairly openly.”

“I think it is all happening in the country, even if we do not receive such cases. Anybody who is in this society knows it is happening in the country,” the spokesperson added, emphasising that employment laws were designed to treat local and foreign workers equally regardless of their nationality.

The tribunal itself is not currently able to enforce its decisions through the courts, even by ruling against breaches of contractual or legal obligations without additional amendments to the Employment Act.

Accepting this current lack of enforcement capabilities, the tribunal spokesperson added that the Labour Relations Authority did have a legal mandate to take action against employees deemed to be in violation of employment rights.

The spokesperson said it was therefore vital to ensure that inspections of work premises and practices were being carried out efficiently  “[The Labour Relations authority] has the mandate to go to workplaces to supervise and inspect and see if it’s all according to the Employment Act and they can also take action if it is not. Like for example, if the work conditions are not good enough as per the law, if they don’t have a contract, or if they are receiving a salary or not, these people can check on that, but we can’t,” the spokesperson said. “We are more like a court, so we can only attend to the claims submitted to the tribunal and only go on with those cases. I think if the (Labour Relations Authority’s] inspections are conducted well there will be less problems, the institution would be better actually.”

The spokesperson added that ultimately employers and employees alike could come to the tribunal with allegations of breaches of contract, but claimed workers in the Maldives were not aware of their rights or the process of getting a verdict from the tribunal.

“A claim has to be submitted within three months if there is a dispute,” the spokesperson said. “I think awareness [of the tribunal’s work and requirements] is very important especially for foreigners, though locals also have the same problem.”

Government pursues Sri Lanka currency exchange as devaluation deadline passes

Maldivian financial authorities are reportedly in negotiations with Sri Lanka to try and establish a currency swap mechanism in an effort to stabilise the value of the rufiya against the US dollar – a move opposition MPs claim is at best, a short-term relief.

Sources linked to the country’s financial sector have told Minivan News that a deal between the Maldives Monetary Authority (MMA) and the Central Bank of Sri Lanka was “in the pipeline” in order to try and create a system for a direct exchange between the rufiya and the Sri Lankan rupee.

Mahmood Razee, the Maldives’ Economic Development Minister, did confirm that talks were taking place over a possible exchange movement with Sri Lanka, reflecting the government’s intentions to try and stabilise the local currency against high demand for the dollar.

While claiming to welcome government initiatives for economic stabilisation, a spokesperson for the opposition Dhivehi Rayithunge Party (DRP) said that although a currency exchange may provide “short-term” relief for dollar demand, the government would be required to show shrewd financial management to maintain confidence in the rufiya in the long run.

Income aims

The currency swap is the latest development in the government’s plan to boost income of foreign money that has maintained a lucrative blackmarket for the US dollar in the country. Three months ago, the government began pursuing a controversial plan to devalue the rufiya. The local currency, which was pegged at an exchange rate of 12.85 to the dollar since July 2001, was this year amended to within 20 percent of this figure to try and bridge a limited national supply of foreign money in circulation.

The devaluation stance was welcomed at the time by the International Monetary Fund (IMF), yet was domestically met with derision by opposition politicians and a week of public protests across the capital during April over fears about the resultant rises in living costs.

Despite accusing certain opposition parliamentarians of manipulating protests and media coverage for their own political gain, financial authorities requested patience for three months for the dollar demand and supply to stabilise – a deadline that passes this month.

With local news reports  claiming the local currency was trading at up to Rf16.5 to the dollar on the country’s black-market, Mahmood Razee said at the time that authorities could consider additional support measures such as currency exchanges if its stabilisation aims were not met.

While discussions are said to have been ongoing for sometime over trying to establish methods to exchange currencies with other nations, a report in the Pakistan Observer newspaper today cited Razee as claiming discussions were very much continuing between finance heads in Sri Lanka and the Maldives.

However, a source with knowledge of the discussions who wished to remain anonymous told Minivan News that “figures” at the very top level of the MMA were involved in ongoing talks with the Central Bank of Sri Lanka to provide a currency exchange system.

Talking to Minivan News today, Razee confirmed that talks were ongoing, though he said he was unsure as to what stage they had currently reached. The economic development minister claimed that although the currency exchange talks had begun before the decision to devalue the rufiya, he added that it did form part of the government’s response for trying to balance local dollar demand.

However, with the initial three-month target period to introduce economic stabilisation now passed, Razee said that he believed the finance ministry was limited at present in terms of additional support measures that could be introduced to the economy, particularly during the low-tourism season and its impact on government earnings.

“At present, I’m not so sure the Ministry of Finance will be able to undertake any urgent [new] measures to ensure stabilisation,” he said. “It would be more difficult at the moment to introduce these measures due to the low tourism season.”

Since January this year, the government had pledged to try and balance its books with a focus on generating direct revenue through the gradual introduction of taxation schemes. These schemes have included a Business Profit Tax scheduled to be launched this week for higher income enterprise and the tourism Goods and Services Tax (GST) introduced over the new year.

DRP Spokesperson Ibrahim ‘Mavota’ Shareef claimed that although the opposition party welcomed stabilisation measures from the government, it did not believe that longer-term measures had been successfully planned by authorities to bridge the dollar demand. However, Shareef said that the black market was testament to the fact that dollars did exist in the country, but that they required sufficient management to ensure they are finding their way into wider circulation.

“Any measures that encourage financial stabilisation we would welcome. This is more a national than political issue. But we do not see [stabilisation]happening yet,” he said. “If we are all spending more than we earn, especially the government, then we cannot balance the economy. These currency swaps are a short-term solution to achieve this.”

Claiming that the government had shown limited long-term measures to protect the economy, Shareef said he believed that there was a danger many local people would not want to keep savings in the form of rufiyaa as a result of “deceptive” government policy.  “When the government said that three months of the [rufiyaa float] policy would bring stabilisation people believed them,” he said.

Yet with government earnings expected to increase on the back of taxation drives, Shareef said that there were reasons to believe stabilisation was possible and that the tourism industry was a strong example of where sufficient foreign currency revenue could be generated.

“This depends though if the market is well managed. When the government first decided to manage the ruifya float [devaluing the currency against the dollar] they should have calculated the availability of foreign currency,” he said. “Dollars are clearly available on the black market and it is the duty of the government to supply them to [society].”

As such, Shareef claimed that it was therefore the government’s responsibility to have managed the devaluation “properly”, alleging that it had instead hoped for a positive outcome for finance rather than ensuring correct measures were available.

Troubled paradise: Skilled expatriates falling foul of workplace challenges

In the first of a two part article, Minivan News looks at the challenges facing skilled expatriates coming to work in the Maldives and the current systems in place to prevent both employees and employers from suffering workplace malpractice.

A growing number of expatriate workers in fields ranging from education to project management have told Minivan News they are considering leaving the Maldives, and in some cases have already left the country, amidst difficulties and desperate circumstances linked to “cultural clashes” and discrimination from local employers.

Several foreigners who have worked in the Maldives have spoken to Minivan News of the more negative experiences they have had with local employers, who they allege in cases have been “suffocating”, “scary”, and even deceptive in their treatment of expatriate staff, leading them to leave their posts prematurely and in some instances flee the country.

Statistics

Despite these claims, statistics from government organisations upholding the country’s employment act suggest that the number of official complaints from expatriates regarding their work situation were significantly less than the complaints received by local staff.

The Employment Tribunal told Minivan News that between 2009 and 2010, the proportion of complaints received from expatriates regarding poor or illegal treatment represented less than 10 percent of its total cases.

A tribunal spokesperson, who wished to remain anonymous, said that it had yet to receive a single case of alleged workplace discrimination facing foreign workers, although it accepted the practice undoubtedly occurred and that foreigners required greater recourse should they face illegal treatment in their work.

The Ministry of Human Resources, Youth and Sports, which has the Labour Relations Authority under its remit, said it had not been made aware of significant concerns among expatriates – particularly those from Europe and Asia Pacific – of widespread difficulties or a culture clash experienced working with local employers.

Senior government sources have in recent months outlined concerns about the treatment of huge numbers of unskilled labourers from countries like Bangladesh that are often illegally trafficked into the country, though skilled workers from abroad also appear to have issues with work practice.

While the number of expatriate staff complaints is statistically limited in comparison to the number of concerns received from local employees, foreigners who have sought career development in the Maldives have raised concerns about a pattern of experiences they fear others may face.

One Australian teacher, who spent a year at an international school in the Maldives, found that after years of working across Asia the Maldives was the most “personally challenging”.

The teacher said that while not regretting his experiences in the Maldives, there was very little information on what workers should expect and a seeming lack of interest and acceptance of the foreign experience he had been employed to provide.

“I found work in the Maldives extremely challenging from the point of view of trying to initiate and foster an ‘international education’, with huge limits being put on what could be facilitated in the classroom in terms of curriculum and content – mostly due to ‘culture clashes’,” he said.

“I found many levels, from management, staff and the local community down to students themselves, very unyielding in accommodating ‘international quality teaching and learning’.”

Although working in a very different industry, one UK expatriate – employed for several months as a project coordinator for a high-profile reclamation and construction project before opting to leave the country and her job – said she felt her position was ultimately untenable and that she had put too much faith in the word of her employer before arriving in the Maldives.

“The owner informed me that I should not compare myself to other expatriates from Europe and that expats should work weekends and holidays as they do not have a social life,” she claimed.

“My advice to anyone moving to the Maldives would be to make sure you have a contract that is legally recognised in the country, including the provision of allowances, medical insurance and a job description before you commit. Promises can turn to dust and someone’s word is not necessarily their bond.”

Another employee from the UK, bought to the country to work as a travel journalist and writer after several years working in the Middle East, claimed that she was also unprepared for office life in the Maldives. The employee said her employer led her to feel powerless from treatment she believed amounted to bullying.

“[I] began to feel I was being watched at every step at work. Despite there being one rule for Maldivian staff – keeping whatever hours they pleased, turning up in the afternoon and going to meetings through the day – they brought in a performance management system especially for me, increasing my workload and making me work six days a week,” she said.

Speaking to Minivan News, a representative for the Maldives Employment Tribunal – formed in 2008 to ensure companies were fulfilling their obligations to the country’s labour laws – said that the Maldivian Employment Act was designed to protect both local and foreign workforces equally.

However, the tribunal spokesperson added that the formation of a special union or workers’ associations to protect the interests of foreign employees would no doubt be beneficial to foreign staff, particularly those not fluent in Dhivehi or English.

“If there is a union that can represent foreigners on their behalf, or a workers’ association or something that can represent [foreign workers], then it will be easier to give them access to the tribunal,” the spokesperson said.

According to the tribunal’s figures, in 2009 a mere eight percent of complaints received regarding workplace mistreatment were from expatriate workers, despite these workers constituting a third of the country’s population. In 2010, this figure halved to four percent.

No enforcement

At present, employers in the Maldives are not bound by decisions of the tribunal even if they were found to have breached their contractual or legal obligations, the spokesperson said.

The tribunal is awaiting changes to the Employment Act that will allow edicts to be legally enforced by the country’s Civil Court. A true reflection of of the number of disgruntled foreign employees was likely to follow, the spokesperson said.

“The tribunal itself and the Employment Act is silent on enforcement, so if we issue a verdict and no one enforces it, there is nothing we can do on this,” the spokesperson said.

“Maybe this is why people do not want to go through the hassle of [the tribunal]. If the decision is not implemented, what do they get at the end of the day? We have proposed the Employment Ministry amend the act so that enforcement power could be given to the Civil Court. But these amendments are still going on.”

Local considerations

The tribunal spokesperson said that there was little difference in the standard and type of complaints coming from either local or foreign employees, with few cases concerning discrimination.

“We normally get complaints about unpaid wages and unfair dismissal so it’s sort of the same. It’s basically unfair dismissal and unpaid wage that we receive, even from locals. We get very few cases of discrimination,” the spokesperson claimed.

The tribunal had not dealt with cases such as forced labour or discriminatory behavior from employers, she said, “although this does not mean it is not taking place fairly openly.”

Foreign workers in their own words

Three expatriate employees who have all moved on from their posts recount their experiences of working in the country. The names of the individuals have been changed to protect their identities.

Michael, 28, Australian teacher

“I found working in the Maldives to be a thoroughly challenging, but rewarding experience. Unlike other regions of the world, which provide you with a plethora of websites, books and other resources to enhance your knowledge of what the country will be like to live and work in, there was little to go on before leaving – apart from the Lonely Planet guide (which is more of a resort guide than a window into the inner workings of the country itself).

So going there I had little idea of what living and working in the Maldives would be like. Early challenges included the ‘norm’ for ex-pat life abroad – finding suitable accommodation, getting acquainted with new work conditions and new colleagues, finding friends and generally finding your feet in a new place. I lived in Hulhumale’, which is a swift ferry ride away from the capital city of Male’ – this provided the quiet I desired, but I was close enough to experience Male’ when I had to or wanted to.

I was employed as an English teacher at an international school, which is my profession in my home country. I found work in the Maldives extremely challenging from the point of view of trying to initiate and foster an “international education”, with huge limits being put on what could be facilitated in the classroom in terms of curriculum and content – mostly due to ‘culture clashes’.

I found many levels, from management, students themselves, staff, down to the local community, very unyielding in accommodating “international quality teaching and learning”. To me this is what an international school should provide – opportunities for students to develop holistically and develop critical thinking skills, with an empathy and understanding for different cultures and lifestyles.

The culture of the Maldives and its unwillingness to broaden its horizons and be open to outside influences made school life extremely challenging, not to mention the management of the school ( European in origin) not being open to “local interests and desires” for a child’s education.

The Maldives can also be quite a ‘suffocating’ place, especially for foreign women – Maldivian males are quite primitive in some of their behaviour and I have both witnessed and heard of gross misconduct and harassment on many levels towards Western women. As a male, the country is without doubt an easier beast to handle, but foreign women definitely have cause for concern when dealing with locals at times.

On the whole, once settling into a vastly different style of ex-pat life that I had been used to, I really enjoyed living and working in the Maldives. It is quite a shock to begin with, with rigid cultural and religious elements, quite foreign to many western day-to-day lives, having to be adhered to.

Outside of work there is plenty to do if you have a thirst for everything outdoors. I wouldn’t trade my year there for anything, I met some wonderful people – both local and international, and would recommend people give the Maldives a go.”

Natalie, 47, British project coordinator

“Recruited by a Sri Lankan businessman in the UK to work as a project coordinator in the Maldives, I was very excited about finding what seemed to be an excellent opportunity for my career development, working on a reclamation and construction project.

Having thoroughly researched the UK company, I accepted the job offer to work for the newly established Maldivian company, set up specifically for the project. With what I understood to be tight project timescales, I relocated within a month having the draft of a skeleton contract in email, trusting the owner of the business that the company and its employees were like a family; we could finalise the details of the contract at a later date.

Once there the owner informed me that I should not compare myself to other expatriates from Europe and that expats should work weekends and holidays as they do not have a social life. My advice to anyone moving to the Maldives would be to make sure you have a contract that is legally recognised in the Maldives, including allowances, medical insurance and a job description before you commit. Promises can turn to dust and someone’s word is not necessarily their bond.

Life in the capital of Male’ for a woman is not an easy one. Despite respecting the culture and religious beliefs, wearing suitable clothing and behaving appropriately, the Maldivian men do touch and grab women inappropriately.

There is a great deal of resentment from some Maldivians towards expats and contractors from Europe and the Americas. Fortunately though, some recognise the potential for change to achieve future growth and prosperity in a greener and more international culture.

My experience is something I do not regret. I had the pleasure of meeting His Excellency the President on more than one occasion and was fortunate to make good friends and business associates. Lessons have been learned: such is life.”

Dana, 30, UK journalist

“I have lived and worked on respected publications in the Middle East, I was used to cultural differences and striking harmony between the two ways of working. I believed I was well prepared for the challenges of working in a society with similar beliefs to the Maldives, but nothing prepared me for the challenges that lay ahead.

I was at first pleasantly surprised with the apartment where I would be living. It was a three-bedroom flat with all mod-cons. Upon arriving, the publisher asked me which room I wanted to take and then proceeded to lock the other rooms, he retained a key for the flat and left.

The next morning, for my first day at work I had a rude awakening. The office boy who had collected my luggage was standing above me saying “madam, madam wake up!” Frightened out of my mind, I screamed at him to get out of my room. It was a strange and scary start to the day.

Any newsroom is supposed to be buzzing with reporters going in and out the office and colleagues coming in and out. Instead the publisher wanted it to be like a factory, rehashing press releases. He even had the general manager prepare us job descriptions, though it was clear that he hadn’t the first clue about journalism and was contending with staff with more than five decades of media experience between them.

Increasingly I also began to feel I was being watched at every step at work. Despite there being one rule for Maldivian staff, keeping whatever hours they pleased, turning up in the afternoon and going to meetings through the day, they brought in a performance management system for me, increasing my workload and making me work six days a week.

The office itself was dangerous and there were no health and safety regulations. The unlit entrance to the office had live cables swinging above the off the stairs and water on the bathroom floor. A campaign to bring it up to safe standards fell on deaf ears.

The general manager took me aside and tried to blacken the names of my colleagues, telling me they were not acting professionally in his eyes, but that he liked them and would give them more chances to improve.

Why was he telling me this I thought? I didn’t want to get involved, being such a newbie. Then he tried insinuate if I played by the rules I would do well. I didn’t like his tone or his allusions. It was as if he was trying to see what side I was on and divide and conquer. Baffled, I said that my colleagues had showed me nothing but kindness and respect and I didn’t want to be part of anything he was insinuating. I felt really uncomfortable with all of this.

I told my colleagues about his strange behaviour and bribes. They said they were not surprised. At various times he had tried the tactic with them all.

This alarmed me. Understandably at this point I was scared because I did not know what I had got in to. I only took the job because I thought this was an opportunity to further develop myself after my Middle East experience. I didn’t have the resources to move on.

Strangely, there was another power struggle going on between the publisher and the GM, who used to turn up late in the afternoon. Overall their attitude was arrogant and disdainful towards us and they showed no recognition for how hard the staff had been working to make their product
a success. Morale was so low in the office and all the energy and enthusiasm I had brought with me was being sapped. I felt I had served a lifetime, though barely a week had gone by.

There was a clocking in machine and we were required to clock in between 9am and 5pm and soon our interviews were being classed as time out by the publisher and his minion. I couldn’t believe their method of thinking!

We had contacts begging us to go out and visit them, yet we were ‘trapped inside the office.’ We tried everything to convince the publisher in the value of letting us out of the office. Yet he turned it into a punishment, banning press trips from the second week.

The day after Halloween, I received a phone call from my colleague who said she had just been fired. I was running late into the office from a meeting, so I couldn’t quite process it, she said that she had not been given any reason for the dismissal. My editor and the other reporter were in the office when I arrived and you could cut the atmosphere with a knife. It was such an awful morning. My macabre mood suited the topic of my writings that day a feature about ghouls and jinnis of the Maldives for a Halloween special.

We met outside for lunch and one of the reporters revealed that he was tendering his resignation on principle. The editor said he was looking for other jobs abroad but he would need to stay in this job for as long as possible. I felt for them and for the nightmare struggle they must have had so far. I felt suicidal after a few weeks, how about these poor souls?

I began to feel increasingly fearful as I did not want lose my job and have to go home. Not after all the struggle to get here. All those hours spent working in three menial jobs back to back, and taking on limited freelance contracts over the summer just to manage the airfare to the Maldives. I had no option, I was trapped, without enough money to go forward or back.

A few days later all hell broke loose. First the reporter who had tendered his resignation was called in and told that he was going to be dismissed that day, even though he was owed 30 days notice.

Then the editor was called in – luckily he had also just written his notice and handed it in before he could have the satisfaction of dismissing him. Two bully security guards were called in to almost forcibly remove them. I was so upset and shocked by the whole events which were unfolding. It was all going too fast – I couldn’t compute.

My state of mind was in tatters at this point imagining the worst, wrestling with my conscience, my pride and my dignity. My home was part of the work package so could not leave the company and try to find another job.

I didn’t have a choice. At this stage still hadn’t even been paid. I was also running out of cash and there was no one to help back home.

So I stayed… but at this point I still hadn’t even received my visa, and was required to leave the country and go to Sri Lanka. Still with no money, I asked the publisher to pay my expenses, but he said he would only pay for the airfare. I asked for an allowance to spend but he refused. Instead he turned out his moth-eaten wallet with £5 GBP and 15 rupees he said I could exchange.

In the meantime my colleagues had an awful time of it having to shift from place to place, but with the help of friends they got by and began setting up their own plans for the future. I tried to support them where I could.

Then I was called into the office and the publisher said he had been told that someone was else living in the flat and there were people visiting me. So what? I felt violated and angry as he had just admitted he been watching my flat. He said that he needed to give permission for anyone to stay. Another control mechanism.

The wheels were already in motion for my own removal. My visa was still in the process of being arranged and they had my passport. Less than 10 days later my fears were realised. I was called into the office and told that they would no longer continue with my employment and when I asked about my passport I was told I had to go to the immigration building to collect it.

I called one of my friends who had contact with immigration and I was told to come down to the office, they had my passport and tickets for me to fly out with Qatar within two days. I filed a case
with the employment tribunal and got my passport back.

The employment tribunal was a long and arduous process and in the end they ruled against me, as I hadn’t worked there long enough so I could not receive any compensation for the trauma of the last few months. Despite a ruling by the court to issue a one way ticket to the country of my choosing, I still have to receive that ticket from the employer. Along the way he pulled all sorts of nasty tricks including putting holds on empty tickets so that he would look good in court, and gazumping me when I went to buy a ticket at the same travel agent.

Overall, I felt an overwhelming feeling of freedom. I want to help people from making the same mistakes as me.”

Opposition expects government will transfer state media assets in spite of High Court ruling

Opposition MPs remain confident that the government will eventually hand over key assets of the Maldives National Broadcasting Corporation’s (MNBC) TV and radio operations, despite a High Court decision yesterday to suspend an existing lower court ruling requesting such a transfer.

Back in May, the Civil Court appeared to have ended a year-long tug of war between opposition MPs and the government over state media by ordering the MNBC to transfer assets and staff from its radio and tv operatons to the parliament-established Maldives Broadcasting Corporation (MBC).

Despite Yesterday’s High Court ruling to withhold the Civil Court’s earlier verdict on transferring Television Maldives (TVM) and Voice of Maldives (VOM) to MBC, Dhivehi Rayyithunge Party (DRP) MP Dr Abdulla Mausoom believed the government would in the long-run have to hand over the broadcast assets.

“The government has to follow the rule of law on this issue,” he said. “I think ultimately the government will have to hand over the [MNBC assets] as has been required under the [Majlis] legislation.”

The High Court had now ruled in favour of the government over the dispute, announcing that any transfer of assets from the MNBC would be withheld until it ordered otherwise.

According to Mausoom, the High Court’s decision was presently being seen as a temporary ruling, claiming the judiciary had already had the final say on the fate of TVM and VOM after the lower court ruled that the MNBC was legally obligated to hand over the assets.

However, online local news service Sun has reported that upon passing the High Court judgement, Chief Judge Ahmed Shareef claimed he had acted on “legal” and “equitable considerations” in withholding the Civil Court decision, a decision he claimed was made on the basis of reasons provided by the MNBC.

The case had been ongoing for over a year and become an increasing contentious issue following an initial government decision to transfer the assets and staff from Television Maldives (TVM) and Voice of Maldives (VOM) to the 100 percent government-owned corporate entity MNBC.  TVM is now broadcast as the MNBC One channel.

By April 2010, the opposition-majority parliament had taken action to create MBC and passed an order for the government to transfer MNBC’s assets and staff to this body.

MNBC has been labelled pro-government by critics, while proponents argue that as most other mass media is owned by senior opposition political figures and favours the opposition, the government had no alternative voice. In being formed by parliament, the MBC has a board appointed by the Majlis, to which it is also answerable. The government has claimed this structure serves only to ensure political influence in the running of the state broadcaster and refused to comply with the legislation on these grounds.

Opposition figures and high profile political activists such as Umar Naseer, a dismissed Deputy Leader of the DRP, have held protests requesting the “freedom” of state media from what they allege is government control and influence.

Aviation authorities await seaplane crash report before considering safety review

The Civil Aviation Department has said that it will wait to complete an investigation into the crash landing of a Trans Maldivian Airways (TMA) seaplane near Biyaadhoo Island Resort during a training flight this morning, before considering amendments to flight policy in the country.

The aviation body’s Director General, Hussein Jaleel, confirmed to Minivan News today that no injuries were reported to the two pilots involved in the crash – reported to be the only people on board at the time. The spokesperson said that investigators currently believed the crash had resulted only in structural damage to the seaplane after it came down near an assigned landing point in a reef by the South Male’ Atoll resort.

Jaleel said that he was presently unable to presently reveal many details about the collision, other than that the Civil Aviation Department’s Accident Investigation Committee were now interviewing the pilots involved in the flight as part of ongoing investigations into a possible cause of the crash landing.

An official spokesperson for TMA – which is one of the country’s two largest operators of seaplane services along with Maldivian Air Taxis – was unavailable for comment when contacted by Minivan News at the time of going to press.

However, in terms of the possible need to implement changes in regulation or seaplane policy following the crash, Hussein Jaleel said authorities would wait for investigations to be completed on today’s incident before making any changes. “However, if it is revealed that new policies are required we would ensure we did this,” he added.

Seaplane incidents

When asked about the number of incidents investigated in relation to the country’s seaplane operations from the start of this year, Jaleel said he did not have the exact figures on him at the time of going to press as aviation authorities investigated incidents of varying severity in the course of their work.

However, the aviation department director general told Minivan News that in terms of events like a crash landing, this was believed to be the first case of such an incident occurring in 2011.

Back in December 2010, the Civil Aviation Department confirmed that a collision had occurred between a Maldivian Air Taxi seaplane and another aircraft at Male’ International Airport that resulted in no injuries or major damage being recorded.

Authorities said at the time that investigators had found the collision to be a minor accident involving the wingtip of an aircraft colliding with another craft, an event which was not seen as “a major safety concern” for future operations.
