Adhaalath Party to decide on joining PPM tonight

Islamic Minister and spokesperson of Adhaalath Party Sheikh Mohamed Shaheem Ali Saeed has said that the party council will tonight decide whether to join the Progressive Party of Maldives (PPM) in the second round of the presidential election, due to be held on September 28.

Local newspapers reported that Shaheem said his party would have a council meeting tonight, make a decision, and have a press conference to announce its final decision.

He said confirmed that the party council members were discussing the matter.

On March 30, the GIP made a coalition agreement with the Adhaalath Party, however the party left the coalition and joined Jumhooree Party (JP) coalition in July.

Yesterday, PPM presidential candidate Abdulla Yameen said that the PPM was in discussion with Adhaalath Party and Gaumee Ittihad Party (GIP) – led by current President Dr Waheed Hassan – as well as the JP.

Nasheed faces “uphill battle” if he doesn’t win in first round: The Hindu

“As campaigning for presidential elections in the Maldives came to a close ahead of Saturday’s polls, the question is if former President Mohamed Nasheed will win conclusively in the first round,” writes R.K. Radakrishnan for the Hindu.

“Mr. Nasheed, and his supporters in the Maldivian Democratic Party (MDP) have no doubt that voters will give him the 50-per-cent-plus votes mandated in the Constitution for a victory in the first round. “I will meet you on 8th ,” he said.

The MDP organised two massive rallies in about a week to prove the point that Mr. Nasheed’s support base has only grown in the 18 months since he was ousted.

Friday’s concluding rally, in Majeedhee Magu, the main commercial street of Male, was a treat to watch. Mr. Nasheed walked the length of the street, waving to people, soliciting their votes.”

Comment: Revisiting the Maldives’ transition to democracy

The first multiparty presidential election of 2008 in Maldives saw an end to the 30-year dictatorship of Maumoon Abdul Gayoom and the adoption of a modern democracy for the first time in the Maldives. Nevertheless, as in many other nascent democracies, there is real doubt whether Maldives can sustain its democracy in its fullest sense, especially after the recent coup that ousted the first democratically elected president in February 2012.

Some scholars argue that the mode of democratic transition a country experiences proves to be a critical factor in determining the country’s democratic future. Hence, an analysis of the mode of democratic transition that occurred in Maldives may help in predicting whether democracy could be sustained in future.

Political scientist Samuel Huntington argues that the process of democratisation could be determined based on ‘the relative importance of governing and the opposition groups as the sources of democratisation’.

He identifies three broader modes of democratisation; (1) ‘transformation’ (from above) occurs when the regime itself takes initiative in bringing democracy; (2) ‘replacement’ (from below) occurs when opposition groups take the initiative and replace the regime by bringing democracy; and (3) ‘transplacement’ (through bargain) occurs when both government and opposition work together to bring about democracy.

My aim here is to analyse the process of democratisation in Maldives in terms of the theories offered by Huntington, and identify the modes of democratic transition that occurred in Maldives.

This in turn may help predict the future sustenance of democracy in Maldives. I will argue that no one particular mode of democratisation occurred in Maldives as none of them materialised fully. However, various efforts from the current opposition Maldivian Democratic Party (MDP), together with the leadership of Mohamed Nasheed, have contributed significantly to the process and facilitated negotiations with the regime leading to democratisation.

To achieve the stated-aim, I will discuss the major events that contributed to the democratisation process in Maldives by relating them to the modes of transition outlined above.

The initial period of democratic struggle – a period of near ‘replacement’

The initial period of the struggle for democracy in Maldives depicts characteristics of ‘replacement’ where citizens started to challenge the regime through various means and made attempts to overthrow the autocratic government. The first serious challenge to dictator Gayoom was in 1988, with a failed coup attempt carried out by Sri Lankan Tamil mercenaries financed by wealthy Maldivians. A year after the attempted coup, the election of western-educated young politicians to the parliament in 1989 resulted in increased pressure for democratic reforms.

However, many of them and their family members faced significant threats from the regime and some of them were imprisoned for various politically motivated charges[3]. The regime continued to suppress major opposition figures through arbitrary arrests. In 2001, Mohamed Nasheed – both a Member of Parliament and a major opposition figure – was arrested and imprisoned for two and half years. The same year, the opposition MDP made their first attempt to formally register themselves as a political party. The Home Ministry, mandated to register civic organisations, sent the petition to parliament where it was overwhelmingly rejected.

On September 20, 2003, civil unrest broke out in the capital Male’ sparked by the death of prison inmate Hassan Evan Naseem. Evan was tortured to death by security forces during an interrogation. News of his death led to riots in the prison and a subsequent shootout by the police that killed three more inmates and injured many others. The news spread throughout Maldives, becoming the major trigger for many to publicly demand democratic reforms.

Since the September unrests, Gayoom came under tremendous pressure from both domestic and international actors that compelled him to announce democratic reforms. On June 2004, during an informal meeting, Gayoom announced his proposed changes to the Constitution including two term limits for the president, direct election of the president, measures to increase separation of powers and removing the gender bar for political participation. Moreover, he urged citizens to publicly debate his proposals. The opposition were still very sceptical about Gayoom’s real intentions and raised doubts about whether he could bring about concrete reforms.

However, the reform announcement itself facilitated the opposition to organise more activities publicly. Matt Mulberry from the International Center on Nonviolent Conflict, argues that the reforms announced by Gayoom ‘technically gave citizens freedom of speech and freedom of assembly’. As a result, some citizens organised a series of “minivan debates” (‘minivan’ means ‘independent’ in Dhivehi) where they discussed the political issues facing the country. Unsurprisingly, the government sent police to disrupt these debates, eventually declaring them illegal.

Despite these repressive actions, the opposition organised a huge protest on August 12-13, 2004 to mark the death of Evan Naseem and demanded reforms, including the release of political prisoners. A record number of citizens took part in the protest which became the largest political gathering ever in the history of Maldives at that time.

The crackdown that followed the protest led to the arrest of hundreds of activists and injured many protesters. As a result, violence erupted in capital Male’ and other parts of the country. Despite the oppressed media, news of the regime’s repressive actions attracted the attention of many international actors. By then, President Gayoom faced immense pressure from the UK, US, India and Sri Lanka to bring about political reforms.

From ‘replacement’ to ‘transplacement’ – a period of joint action

The mounting international pressure and political instability in Maldives led to a new phase in the democratisation process as the regime agreed to have serious negotiations with the opposition. The willingness of joint action from both the regime and the opposition led to a period of ‘transplacement’ in the democratisation process. The regime agreed to sit with the opposition for the first time in the UK.

During the negotiations, the regime agreed to more reforms including formation of independent oversight bodies such as the Police Integrity Commission and the Judicial Services Commission. Moreover, informal talks between reformers within the regime and the opposition were held in Sri Lanka facilitated by the British High Commissioner.

However, the lack of true commitments from the regime led the opposition to realise that international pressure alone would not help bring down the autocratic leadership. Hence, they increased their efforts in organising more protests, speeches and sit-ins. As a result of the mounting support for the opposition’s cause, reformers within the government increased their efforts in pressuring Gayoom to implement urgent reforms.

The pressure from a few reformers within the government and the opposition MDP led to a period of ‘transformation’ where the regime was compelled to take reform actions. In April 2005, the then Attorney General Dr Hassan Saeed overturned his predecessor’s decision by issuing a formal legal opinion to allow the registration of political parties. In June 2005, the parliament unanimously voted in favour of a resolution to allow multi-party democracy for the first time in Maldives. The MDP – the main opposition party – led by Mohamed Nasheed was formally registered, along with several other political parties representing different views. In March 2006, the regime published a roadmap that ‘included 31 proposals for revision of the Constitution, a series of time-bound commitments on human rights, and proposals to build institutions and mobilise civil society’.

However, many still doubted whether the regime was committed to real reforms. Ahmed Shaheed (then Foreign Minister) later argued that, through the reform agenda, Gayoom was seeking to get rehabilitated and thereby stabilise his presidency. He argued that, by 2007, Gayoom had achieved his aim by gaining widespread domestic support and getting rehabilitated.

However, new cracks that significantly weakened the regime emerged as those most closely associated with the reform agenda left the government. On 5th August 2007, both Dr Hassan Saeed and Mohamed Jameel (Justice Minister) resigned from their posts. They claimed that working outside Gayoom’s regime was the only option to advance their reform agenda. Later on the same month, Ahmed Shaheed resigned from the post of Foreign Minister, accusing the government of stalling democratic reforms. These developments saw more public support for the opposition reform movement. After several disagreements with the Special Majlis (Special Parliament), Gayoom ratified the new Constitution in August 2008, allowing key democratic reforms and paving way for the first multi-party presidential election in October that year.

Democracy sustainable?

As evident from the discussion above, three modes of democratisation have contributed to the democratisation process in Maldives, though characteristics of ‘transformation’ are very little. Interestingly, there appears to be a correlation between each mode as the occurrence of one type led to the other. This observation therefore contradicts Huntington’s view that the three modes of democratisation are alternatives to one another.

However, it is important to note the significant role played by the opposition MDP, especially Mohamed Nasheed as the leader who never took a step back in his quest to bring democracy to Maldives. It is clear that MDP played the most critical role in the process of democratisation. I have previously argued that Gayoom is the major obstacle to sustaining democracy and the threat is heightened more than ever with his current political activeness.

Reflecting on the process of democratisation and the strong influence of Gayoom on many institutions till today, I still doubt sustenance of democracy in the Maldives. Similar to the 2008 election, this year’s election is very much a choice between democracy and autocracy.

Comment: Assessing the Presidential Elections

The outcome of any election is always uncertain.

According to reports, the winning party in the Maldives elections requires approximately 120,000 votes to secure the majority.

The MDP has the highest number of registered members; approximately between 45 – 50 thousand whereas the opposition – including the deceased members of Dr. Remote Controlled Waheed’s GIP and the Adhaalath with its recent drive to enlist 10,000 members – does not come close to the MDP’s party strength.

Despite the money (whether black or white is not known) Gasim and Yameen are prepared to spend to increase their voter base at the last minute, the ground reality is the combined forces of these two parties’ membership strength cannot compete with the MDP either.

The Adhaalath, at the moment part of the GIP coalition, is too factionalised and have lost the people’s support due to the fact that they have been promoting religion as a tool to woo the voters. Moreover there is no one in the party charismatic enough to swing the voters behind them despite their promotion of a religious agenda targeted at MDP’s Presidential candidate President Nasheed in order to denigrate him on religious grounds.

In fact the strategy has backfired on them. The people were too shrewd and saw threw their machinations. This can be gauged by the number of people attending Adhaalath’s rallies. According to certain reports, even the Majeediyya School band commands a larger following than the Adhaalath Party at present.

Blinded by power, the Sheikhs’ biggest blunder was the fact that they backed the wrong horse in the form of Dr Waheed and a few-die hard Gayoom loyalists in the military whose criteria for loyalty to Islam and the oath taken by them was dependent on the amount of money deposited in their bank accounts.

Dr Waheed, their professed spiritual leader, himself is under controversy over whether he knows how to recite Al-Fatiha, while his children are very much inclined to Hinduism and Christianity. As for Waheed’s religious leanings, while championing the Adhaalath’s hardline Islamic views, his personal beliefs are for anyone to guess.

This leaves the DRP led by Thasmeem – Waheed’s running mate – and the PPM led by former trade minister Yaameen alleged to have stolen millions of dollars of worth public funds – allegations believed by most Maldivians. Their combined strength of party members is again inadequate to challenge the MDP.

The MDP also controls the majority in parliament. The MDP’s biggest asset is the deposed President Nasheed, whose integrity has never been called into question. He has been personally denigrated by all sorts of dirty name calling, but even his most erstwhile enemy former President Gayoom is said to have acceded that Nasheed will not steal from the public coffer.

Whereas all other Presidential candidates, from Yameen to Gasim to President Waheed whom most believe is only warming the seat on behalf of Gayoom loyalists, are all tainted by the brush of corruption. Given half a chance, these people will swallow the entire economy of the Maldives as a whole leaving the middle and lower classes to live in abject poverty.

This has been evident during the past year when Gasim secured Maamigili airport for 99 years for tuppence through the back door, while Yameen’s backer Champa secured the Gan airport. The amount spent on the money for the coup, the alleged US$30,000, has already been recovered, albeit on a long term basis, by the backers of the coup.

The last year has also seen the economy take a nose dive, despite one of the biggest budgets in Maldivian history to be passed so far. Where the money has gone no one knows, but what is certain is the government is on the verge of bankruptcy. Even the police have run out of urine-cups.

When the coup government came in, according to Gasim Ibrahim it raised a billion dollars in selling treasury bills. The interest payable of these comes to US$100 million a year, leaving zero for development projects.

This leaves the silent majority on whom the election is truly dependent upon.

While the election campaign unfolds, certain facts are evident. Gasim, blinded by his hatred of Nasheed, is defaming him in public little realising it only calls attention to his personal shortcomings. Even his loyalist parliamentarians whose loyalty was secured by money no longer wish to associate with him.

Furthermore there are rumors circulating that President Waheed is going to file a case against Gasim for having been once lashed by the courts on grounds of fornication, which makes him ineligible for a Presidential candidate.

“Hate-mongering is counter productive,” says MP Abdul Raheem, former MP for Qasim.

Gasim and Yameen share a common trait: the belief that everyone has a price. When I first met Gasim after several long years, his first question to me was: “how much do you want?” I kept my face deadpan but inside I was seething with anger. Of course there are those who canbe bought but anything that can be bought has no real value. None of these people seem to have grasped this universal fact. Anything of value that can be acquired in this world is through love and struggle.

I’m quite sure the silent majority of the Maldives understands these basic truths. They may take Yaameen’s and Gasim’s money and contend with Waheed’s blackmail and threats of jail, but ultimately when it’s time for the vote to be cast, they will abide by their conscience and decide which is the only viable option for the Maldivians as a whole.

US government pledges US$9.7 million for Maldives climate change adaptation, election preparations

The United States government has pledged US$9.7 million (MVR 149 million) to the Maldives as technical assistance for climate change adaptation and election preparations.

The memorandum of understanding (MoU) between the two nations was signed yesterday afternoon (July 7) by the Maldives Ministry of Foreign Affairs Ambassador-at-large Abdul Azeez Yoosuf and U.S. Agency for International Development (USAID) Acting Mission Director Todd Sorenson.

The United States Ambassador to Sri Lanka and the Maldives Michele J Sison highlighted the importance of the agreement during the American Embassy’s Independence Day reception held last night (July 7) in Male’.

“The MoU will allow us to expand and enhance our bilateral cooperation, it is a truly special day… [it is my] sincere hope that the many ties that bind our two nations will grow ever stronger,” Sison stated.

Under the MoU, USAID will provide US$7.2 million for a global climate change adaptation project, and US$2.5 million as technical assistance for election preparations.

The Ambassador highlighted the importance of consolidating democracy and promoting the integrity of the electoral process prior to the September 7 presidential elections as the impetus for the US working with Maldivian partners to prepare for elections. One of the new programs covered under the MOU, through USAID, was launched by the U.S.-based International Foundation for Electoral Systems (IFES).

“These efforts will promote the integrity of the electoral process in Maldives in advance of the September 2013 presidential elections, but also support efforts aimed at the local council and parliamentary elections which are to follow [in 2014],” said Sison.

“The US has urged all parties all actors here to work together to chart a positive way forward that respects the Maldivian constitution, Maldivian democratic institutions, human rights and the will of the Maldivian people,” she continued.

“As such, we’ve called on all sides here to work closely together to ensure the elections in Maldives are free, fair, transparent, credible and inclusive and that the results are accepted by all stakeholders,” she added.

The US government in partnership with the UN is also “actively supporting” a small grants program for Maldivian civil society.

“Democracy – good governance – is not just about elections it’s about the process of governance and the interaction between the government and the people,” noted Sison. “Which is why… we are looking to support projects to enhance the democratic space and to effectively engage civil society organisations in promoting good governance.”

“The US is proud to be supporting Maldivian efforts to strengthen civil society and consolidate the democratic transition,” she added.

The Ambassador also reflected on the founding of the United States, the evolution of democracy within the country over the last 237 years, and the democratisation process in the Maldives. She noted the personal responsibility of citizens to strive toward a more perfect union by pushing forward, speaking out when there is injustice, and advocating for those who cannot advocate for themselves, as President Barack Obama noted in a 2008 presidential campaign speech.

“I thought of those words – both of our founding fathers and of President Obama – as I thought about the Maldives, because in the coming weeks and months ahead, reflecting the vibrancy of Maldivian institutions, the Maldivian people will once again make their voices heard in a democratic process,” said Sison.

The American Embassy’s other current initiatives include “robust USAID projects” aimed at increasing Maldivian capacity to cope with the impact of climate change and improving water security. USAID is also working with the Maldivian government to identify additional areas of cooperation related to climate change adaptation.

The US is also becoming “increasingly active” in the Maldivian economic and commercial sector.

“I’m happy to report that a number of other US companies are looking to expand their operations here, their presence and investment in the Maldivian economy,” noted Sison.

Furthermore, US initiatives have also been extend to the education sector with the “Access English Language” teaching program – with programs in Male’, Addu City, and Kulhudhuffushi in Haa Dhaal Atoll – and “Access Microscholarship”.

“The goal of these english language enrichment microschoarlips is to enable Maldivian secondary school students to pursue higher education and to increase their employment opportunities – we hope – in the job market,” Sison explained.

She also noted that US is “very proud” that the cooperation, joint exercises, and training endeavours conducted with the Maldives National Defence Force (MNDF) and the Maldives Police Service remain “very strong and robust”.

“The US knows that all of you are as committed as we are to the prosperity of Maldives, to the democracy of Maldives, and to the well being of Maldives. We hope to work together with you in a way that will inspire and benefit future generations of young Maldivians,” the ambassador concluded.

Maldives’ Minister of Defence Mohamed Nazim assured the attendees of the US Embassy’s independence day event – who included the Indian High Commissioner Rajeev Shahare, various UN agency officials, and Maldivian government ministers – that the government of Maldives was committed to ensuring elections were “free, fair and competitive”.

“Exactly two months from today maldives will vote in a historic election to elect a president,” said Nazim.

“Free and fair elections are the strongest and most visible manifestations of a country’s democratic development. The Maldives remains committed to moving forward to consolidating democracy,” he stated. “We are continuing to further strengthen our democratic institutions.”

“We are grateful to the United States for the Maldives election program 2013-14 which will contribute profoundly to strengthen the capacity of state institutions and civil society organisations in preparing for the presidential elections,” he added.

Nazim also highlighted other “key global issues of mutual concern” both governments and working closely on, particularly in the areas of national defence, promoting democracy and the respect of fundamental human rights, as well as climate change adaptation.

“The Maldives-US defence cooperation which has been vital in enhancing our national defence capabilities,” he noted.

“Climate change is an existential threat to the Maldives. As a low-lying state, no country is more vulnerable and none is more committed to increasing investments in renewable energy,” said Nazim. “I salute President Obama for his recent initiative aimed at finding a global solution to the question of climate change.”

“Climate change is too critical an issue to be left unaddressed. We need to find solutions and be ready to make hard decisions and hard choices,” he added.

“The relationship is based on a solid foundation of friendship, shared beliefs, and mutual respect. The US continues to be a close partner of Maldives through diverse spheres and greatly contributes toward the socio-economic development of the country,” Nazim concluded.

Transparency Maldives deploying 42 long term elections observers nationwide

Transparency Maldives (TM) has begun training 42 long term elections observers to be posted throughout every atoll nationwide to monitor the campaign landscape and misuse of public resources, and ensure elections are fair and credible.

The long term observers have been appointed  addition to 200 observers who will be present on election day.

TM staff began a three day training program for the long term observers on Saturday (July 6), with the assistance of experts and representatives from relevant state institutions including the Elections Commission (EC), Anti-Corruption Commission (ACC), and the Maldives Police Service (MPS).

Long term observers will be responsible for meeting regularly with all key stakeholders and monitoring activities including campaigning, pre-election electoral processes, voter education, vote buying and misuse of state resources in the run up to the September 7 presidential election.

This TM program marks the first time an NGO will conduct long term elections observations in the Maldives.

“We are excited to experiment the first ever systematic long-term domestic election observation in the Maldives. We are preparing for a comprehensive election day observation, recruiting up to 200 observers who will be assigned to randomly selected ballot boxes,” said TM’s Executive Director Ilham Mohamed.

“We thank and recognise the contributions of domestic elections observers towards a credible elections,” she added.

EC President Fuwad Thowfeek highlighted the need for domestic observers and the positive role they play in strengthening the electoral system, while addressing participants during the training program’s launch.

Long term elections observations will be conducted in order to increase confidence in electoral processes and civil society participation in the democratic process. Observers will also identify areas related to the democratic electoral process that require further improvement.

The long term observations will begin July 15 – the date presidential hopefuls can file their formal candidacy with the EC – and continue beyond the 2013 presidential election to the 2014 local council and parliamentary elections, noted TM Communication Manager Aiman Rasheed.

As part of TM’s elections program, the NGO will also implement a comprehensive voter education program, upgrade their online complaints system, and conduct media monitoring.

Election environment

Transparency also conducted domestic election monitoring during the 2008-2011 cycle of elections, including the country’s first multi-party presidential, parliamentary and local council elections. The results of these elections were widely accepted both locally and internationally – a notable outcome given the high temperature of the country’s politics.

“However, the current political polarisation and the tense, sometimes violent, political environment have strained and continue to further threaten the democratic gains of the previous election processes,” Transparency Maldives warned.

The 2013 presidential elections are set to unfold “against a context of uncertainty, crises of political legitimacy and unprecedented levels of political polarisation,” Transparency Maldives has stated, in an extensive pre-election assessment published in March.

“The latter is characterised by mistrust, categorical negative framing of one another and by the lack of self-accountability of institutions, politicians and their parties for their role in the existing political crises. The electoral background is therefore discouraging,” Transparency noted.

The detailed report identifies key challenges in the lead up to the election, such as the candidacy of former President Mohamed Nasheed, lack of monitoring of campaign financing, an extensive and entrenched culture of vote buying, and a media establishment set on fueling personality politics and further polarisation.

“The upcoming Presidential Elections are currently headed to unfold against this political context of crisis of legitimation, uncertainty of democratic transition, existing polarisations and other challenges that have been aggravated by the controversial transfer of power on 7 February 2012,” Transparency stated.

No police within 100 feet of ballot boxes, confirms elections commissioner

With two months remaining before the Maldives’ second multi-party presidential elections, former President Mohamed Nasheed, the current Maldivian Democratic Party (MDP) presidential candidate, has alleged that police are plotting to ruin the polls under instruction from Police Commissioner Abdulla Riyaz.

Nasheed, who won the Maldives’ first democratic election in 2008, made the allegations during an MDP rally held in the Galolhu ward of Male’ on Sunday night (June 29).

Attempts to influence the polls by the Maldives Police Service (MPS) were one among “a few concerns”, said Nasheed.

During a press conference held today (July 1), Nasheed emphasised his concerns about police influencing September’s presidential election results.

“We are revealing these possible issues only with the hope that the elections commission would take adequate measures to resolve them. The [Elections] Commissioner should only allow police and military officers [in polling places] after discussing with the candidates’ agents and receiving their consent,” Nasheed stated.

“Police should not be able to enter the polling station without an informed decision made unanimously with the elections commission members and agents of the candidates present at the polling station,” he continued.

“MDP members will not allow police or military to go inside polling stations unlawfully,” he added.

Speaking at the rally entitled “People of Galolhu with President Nasheed” on Sunday, the former president stressed that he was strongly convinced that no one could tamper with the election results, and said to ensure elections are free and fair MDP will have more than 1,900 of its own observers at the polling stations.

“According to information I am getting, Abdulla Riyaz is instructing police officers to barge into polling stations upon his signal, after two individuals enter and create a scene. The remedy to this is that we will ensure no police officer can enter the polling station unless approved by the elections commission,” Nasheed declared.

“This is how it is practiced in other places around the world. Police cannot just enter polling stations. Only the voter and elections officials are allowed. That is why, even a Special Operations (SO) police officer cannot go into a voting station on a whim,” said Nasheed.

The second method by which the police will attempt to ruin the elections is intervening during the vote counting process, after claiming that difficulties are being experienced, such as the election being “rigged”, Nasheed alleged.

The former President  reiterated he was confident he would win the election from the first round, predicting that his party would secure 56-57 percent of the popular vote.

“Based on the figures received during the party’s door to door campaign, we are currently able to secure 56 to 57 percent of the voters. From Galolhu, figures indicate MDP getting 73 percent of the vote. We are getting full support from other wards of Male’ as well,” he said.

The Elections Commission outlined some of the key regulations related to concerns regarding police interference with elections.

“Police cannot stand within a 100 foot radius of the ballot box,” Elections Commission President Fuad Thaufeeq confirmed to Minivan News today.

“Police can enter the area only if the Head of Polling Station requests their assistance to control any criminal activity that goes beyond his control,” he continued.

“The role of the police will be to assist the Elections Commission in keeping peace and public safety,” he added.

SO begin MDP arrests on Thinadhoo

Meanwhile, SO police officers have arrested MDP supporters on Thinadhoo Island in Gaafu Dhaal Atoll for allegedly “creating unrest” during President Mohamed Waheed Hassan Manik’s visit to the island earlier in June, according to social media reports and photographs.

“They started arresting MDP supporters today, at least three people so far,” a source from Thinadhoo told Minivan News today on condition of anonymity.

The Maldives Police Service (MPS) decided to station officers of the Special Operations (SO) command on Thinadhoo last week. According to local media, the SO officers will work with the Thinadhoo police station to establish “peace and security”.

The Maldives Police Service had not responded to Minivan News enquiries at time of press.

Police reserve force

President Waheed inaugurated the police special constabulary reserve force at a ceremony today.

The MPS announced plans for recruitment of officers for the special constabulary in May this year, with the new officers to be paid 85 percent of the salary of a regular police officer of the same rank.

At the function, 43 recruits from the first batch were presented documents of employment by President Waheed, after which they were sworn-in as police officers at an oath-taking ceremony.

The oath was administered by Criminal Court Chief Judge Abdulla Mohamed. According to police media, the judge advised the news officers on the importance of respecting oaths.

On June 23, police made an announcement seeking 75 “civil assistants” as non-uniformed personnel for administrative work.

Maldives failing to uphold international human rights obligations: Forum Asia

The Maldives has failed to uphold its obligations to core international human rights treaties related to freedom of expression, assembly and association, the regional NGO Forum Asia has concluded.

The Asian Forum for Human Rights and Development (Forum Asia) – a regional human rights NGO with 47 member organisations from 16 Asian countries – evaluated the promotion and protection of these core human rights in the Maldives in regard to September’s presidential elections during their recent mission to the Maldives.

Forum Asia noted the “shortcomings in the laws relating to freedom of assembly”, particularly relating to the “shrinking space” for the exercise of the right to assemble as well as the right of all workers to associate and assemble, during their press conference held Saturday (June 22).

Reports of security forces engaging in excessive use of force to prevent and disburse assemblies, also “concerned” the Forum Asia mission.

Security personnel were urged to exercise restraint and refrain from using excessive force, irritants, or dyes on assemblies, while the Police Integrity Commission (PIC) has been asked to closely monitor and prevent such situations, said Forum Asia.

“We hope that the PIC and the security forces will work together to ensure they are able to resort to reasonable and internationally accepted means while engaging with assemblies,” said Forum Asia’s South Asian Programme Officer Gayatri Khandhadai. “Similarly we hope that all protesters also resort to peaceful and democratic means while exercising their right to assembly.”

“We are particularly also worried about the restrictions placed on journalists covering these protests,” she added.

Khandhadai highlighted that it is unrealistic for journalists to seek accreditation for different types of events – protests, cultural events, etc – given the time and energy involved in the registration process.

“Media is the platform that brings information to the people, so media must have free access. we have requested to amend the laws on the basis of practicality because Maldives also belongs to the civilized world of the 21st century,” said Forum Asia Chairperson Subodh Raj Pyakurel.

“It may be legal to put some kind of regulation and restriction process etc, but this is not legitimate, because one journalist can go anywhere, anywhere, informally,” he noted.

Forum Asia also identified “difficulties faced by the various associations”, including NGOs, professional associations, trade unions, community based organisations, and political parties, in the Maldives attributed to “unclear regulations, especially relating to registration.”

Human rights perspective needed

The limitations codified in the ‘Freedom of Peaceful Assembly Act’ “must be amended to meet constitutional guarantees and international norms”, the organisation stated.

“There has to be a method – on paper and in practice – for what are the different peaceful engagements you have to have with the crowds,” said Khandhadai.

“These rights are particularly important to ensure ahead of elections” and to guarantee peaceful and inclusive elections occur, she added.

The Government of Maldives was also compelled to implement recommendations made by the Human Rights Commission of the Maldives (HRCM) and PIC.

Additionally, political parties were requested to “adopt a human rights perspective and formally include the promotion of human rights in their official agendas and manifestos prior to elections”.

The Forum Asia mission also “implored the Maldives’ government, judiciary, legislature, independent commissions and media to develop and strengthen their engagement with civil society organisations, which are essential for a healthy democracy”.

Meanwhile, civil society and human rights defenders within the Maldives were encouraged to unite in solidarity and engage with the state to promote a culture of human rights in the country, said Forum Asia.

Use of force disastrous

Having less than 10 percent of Male’ available for protests is “quite a worrisome issue”, said Khandhadai.

Unprovoked actions against demonstrators have been seen in the Maldives and it is necessary to identify whether that use of force could have been avoided or not, as well as whether the crowd was posing a threat, noted Khandhadai.

“The points to be taken into consideration are what would have happened if that force was not used,” she explained. “If any other means could have been put in place to disperse that crowd, or even if that crowd needed to be disbursed to start with.”

“I’m particularly worried about the sanction of the use of irritants in a space like Male, which is particularly small… and shrinks the already small area where people can protest,” she continued.

Sanctioned or encouraged use of force within that small space “will become very, very difficult and disastrous even,” Khandhadai added. “The only solution is to promote a culture of peaceful engagement.”

Pyakurel echoed these sentiments and emphasised that holding democratic elections means maximising public mobilization.

“During the elections we always expect that each and every citizen has the opp to interact and understand,” he noted.

“People [protesting] become destructive only when they are restricted, if you don’t restrict them they don’t become destructive,” he continued.

“Discipline is a must but it should be regulated through a very concrete and specific law, not the will of the [police] officer – that creates a problem,” he added.

Vice President calls for “population consolidation”

Vice President Mohamed Waheed Deen has lambasted the country’s current presidential candidates for resorting to a “divide and rule policy” to stay in power, rather than focusing on issues such as “population consolidation” which he claimed would help sustainable development.

Speaking on May 13 during the launch of the UN’s 2013 human development report, Deen argued that it was extremely difficult for presidential candidates to discuss relocating and consolidating island populations due to fears “islanders will be angry”.

However, the vice president said he believed there were ulterior motives to avoid addressing population consolidation – the practice of relocating geographically isolated, small island communities to larger landmasses.

“The other reason – which is worse – is the divide and rule policy that has been in the Maldives for hundreds of years. I hope those who are going to be on the list of presidential candidates, and politicians, will seriously think about the development of this nation and not be thinking ‘how long can I stay in power?’,” he told Minivan News.

“The whole idea of population consolidation is for the government, or the leaders whoever they are, not to control Maldivian citizens, so if they want to be free and independent they should do it.”

Vice President Deen highlighted a number of development issues and interrelated democratisation challenges he believed were vital to development, during his speech at Sunday’s UN report launch.

These issues included included the need for improving freedom of expression and democratic education to reduce inequalities. Deen emphasised “population consolidation” as an important way of ensuring this.

“It is easier to control votes if you are on small, small little islands, but it’s difficult when the population is consolidated,” stated Deen. “I strongly believe that the Maldives must have a population consolidation method.”

“Unless populations are consolidated, economically viable solutions – healthcare, education and other services and facilities – required for development cannot be sustained,” he added.

Deen claimed there were also numerous economic and social service benefits that would come from relocating people living on small islands, whom he said faced “lots of difficulties” due to limited healthcare and educational opportunities. Restricted transportation options were another concern he identified.

“Population consolidation would also reduce income and gender inequality. They would find it easier to find jobs and things like that,” he said. “I strongly believe that’s the key to a successful Maldives.”

Voter buy-offs, other corrupt practices, political polarisation and a lack of civil education were identified by Transparency Maldives, the Elections Commission of the Maldives (ECM), and the Elections Commission of India (ECI) as threatening free and fair democratic elections from taking place in September.

Additionally, the International Federation for Human Rights (FIDH) and the Maldivian Democracy Network (MDN) released a joint human rights brief this April accusing the Maldivian government of failing to create conditions conducive to free and fair elections.

Relocation gone wrong

Population consolidation is a controversial issue for many islanders, given the unique cultural characteristics and strong inter-relationships each island community in the Maldives possesses.

The displacement and subsequent relocation of the entire Kan’dholhudhoo Island community in Raa Atoll following the 2004 tsunami is one example of the development challenges posed by relocating entire island communities.

“The community is still suffering tremendously,” Island Council Vice President Amir Ahmed told Minivan News.

“Kan’dholhudhoo is our motherland, however, the whole island was fully damaged [in the tsunami]. Four years after our community was split and living on different islands in Raa Atoll – Alifushi, Ungoofaru, Meedhoo, Maduvvari – or in Male’,” Ahmed explained.

The International Federation of Red Cross and Red Crescent Societies (IFRC) – in partnership with other nation-state donors – provided temporary shelter and food for the internally displaced in the aftermath of the tsunami, Ahmed continued.

In 2008, the bulk of Kan’dholhudhoo’s nearly 4,000 community members were eventually relocated to Dhuvaafaru Island. However, administratively the community remains under Kan’dholhudhoo, which poses a problem for voting, explained Ahmed.

The IFRC transformed the previously uninhabited island with the construction of 600 new houses, office buildings, a health centre, playgrounds, roads, and a garbage area, Ahmed added.

Unfortunately the government’s lack of community consultations, inadequate infrastructure development, and political opposition leading to local “administrative problems” has greatly degraded quality of life for the Kan’dholhudhoo community, lamented Ahmed.

He explained that the combination of too few island-level civil servants – the government mandates one per every 500 people, but only four represent Kan’dholhudhoo – and the stanch allegiance of island office employees to former president Maumoon Abdul Gayoom created huge development-related problems and a lack of basic services.

“Maumoon’s people were working in the island office and they still supported him,” said Ahmed. He claims that the island office staff requested too few homes from the IFRC after the tsunami.

“They don’t know how the people suffer,” said Ahmed. “This is no ‘safe island’, there are many problems.”

“Day by day things get worse”

Currently 75 families still need homes, according to Ahmed. He explained the homes which have been constructed were meant to house a single six person family in a 2000 square foot area with three bedrooms and two bathrooms.

“Instead, three or four families are living in one house. Many people are not coming back because they have no place to live, or because the living conditions are so uncomfortable,” Ahmed said.

“The constitution should provide one area of land per family, but this has not happened for our community,” he added.

Overcrowding due to the lack of adequate housing has caused a variety of societal problems, including property disputes, rising divorce rates, and children “don’t learn the responsibilities of how to live… additionally they see what’s happening to the community. Disputes are increasing,” said Ahmed.

Many of the homes were constructed near a “pond area” on the island, explained Ahmed.

“The land is not good for people to live on because the well water is bad. It has a bad smell and causes skin problems, especially for children and old people,” he explained. “Maumoon decided where to build the houses, we were not consulted.”

Although a pipeline has since been built to supply safe drinking water to the 40 families living in the area, given the overcrowding problem the water supplied is not sufficient. Thus, “a lot” of well water continues to be used.

Ahmed further explained that there is a waste management shortfall also posing a serious threat to community’s health.

“The garbage [problem] is terrible here. A garbage area was made but we cannot use it because there is not enough budget. So islanders have been dumping waste in the beach area, which is now full, so garbage is all over the road blocking vehicles from driving,” Ahmed said.

“There are also diseases spreading, such as viral fever, as well as mosquitoes and flies. And there are people living nearby this [garbage] area,” he added.

Despite these human health threats, Dhuvaafaru still lacks medicine and adequate medical facilities.

“There is no pharmacy or medicine [available]. We tried to establish one, but it is still not open,” said Ahmed.

“We have a health centre but it is without medicine. It lacks basic necessities and cannot even perform blood tests or give injections. We have to go to Ungoofaru [for medical treatment] which is 10 or 15 minutes away by speedboat,” he added.

Education and economic opportunities are also very limited, according to Ahmed.

“I am reluctant to say this, but the community is not very aware. Educated community [members] are very rare and if anyone is educated they will move to some other island because they want their children to have a quality education and standard of living,” Ahmed said.

“The community’s living standard is very dependent on the fishing industry. There are no administrative jobs, so fishing is the only way to make a living,” he continued.

“Day by day things get worse and worse,” he lamented.

“Government doesn’t listen”

Successive government administrations have failed to address the development problems and threats to the Dhuvaafaru community.

“Maumoon provided us no choices. We informed the government [of these issues], but nothing changed,” said Ahmed.

Although former President Mohamed Nasheed’s administration provided the community with sandbags to thwart coastal erosion, “now the erosion has spread to another side” of the island and the ongoing development problems went unresolved, he continued.

The island office was controlled by the former opposition who did not cooperate with Nasheed’s administration to improve quality of life for the Dhuvaafaru community, claims Ahmed.

“We informed the coup government, but they don’t listen. [President Mohamed] Waheed makes many promises, but has taken no action,” he added.

Regarding whether island relocation and “population consolidation” are beneficial for island communities, Ahmed believes that if the government will actually provide the proper infrastructure for communities then the policy would be beneficial.

“I think most people would follow that, especially the younger generation. If there are good facilities I’ll go there for sure,” Ahmed declared.

“I’m happy now because everything is new [on Dhuvaafaru], but when I enter the house I want to leave immediately [due to the overcrowding],” he added.

In March 2012, the Anti-Corruption Commission (ACC) sent a corruption case involving MVR 24 million (US$1.55 million) to the Prosecutor General’s Office concerning the Disaster Management Centre and a housing project carried out on Gan in Laamu Atoll, following damage suffered in the 2004 tsunami.

The Maldivian government is obligated under national and international law to guarantee the human rights and protections enshrined in the International Covenant on Civil and Political Rights (ICCPR) and International Covenant on Economic, Social and Cultural Rights (ICESCR), which include access to adequate housing, water, healthcare, and political participation.
