Criminal Court suspends staff refusing unpaid overtime

The Criminal Court has suspended a number of staff members after they allegedly refused to work overtime, reports local media.

According to local media reports, last Monday (10 February) staff at the Criminal Court refused to work overtime and left for home after the court informed them they would not be paid for overtime.

Local newspaper Haveeru quoted an employee, saying that they had been told of the suspension today. Media reports have quoted figures of around a dozen staff being involved.

According to the staff, they had previously petitioned the judges at the court over the issue prior to the strike.

The staff member who spoke to Haveeru has said that the decision to suspend the staff was made by the judges, suggesting that this was not an authority the judges had.

He also said that there were judges in the court that do not work overtime, but that no action had been taken against them thus making their own suspension unfair.

Furthermore, the employee revealed that before the allowances for judges working at night was introduced, there were four days on which all the judges of the court other that the chief judge had refused to work at night.

He also noted one instance when the chief judge had handed responsibility for extension of detention hearings to a junior colleague, before going fishing, with the result that there was no one at the court to proceed with these hearings.

Recently, the Criminal Court decided to close down after official work hours due to budget restrictions.

The court at the time told the press that it had no funds to pay overtime allowances for employees, and that the Ministry of Finance had not responded regarding the matter. The Civil Court has taken the same measures owing to lack of funds.

Spokesperson of Judicial Administrations Latheefa Gasim referred Minivan News to the Director of Department of Judicial Administration Ahmed Majidh, who in turn referred Minivan News to a Criminal Court media official.

Criminal Court media official Ahmed Mohamed Manik subsequently said he would not like to comment on the matter.

Producing an extensive report on the state of the Maldivian judiciary last year, UN Special Rapporteur for the Independence of Judges and Lawyers, Gabriela Knaul raised serious concerns about an impending budget catastrophe facing the judicial system.

“The immediate implications of the budget cuts on the judiciary are appalling. For instance, the Department of Judicial Administration only has funds to pay staff salaries until November 2013 and it had to cancel training this year,” Knaul noted in May 2013.

“The Civil Court reported that it would not have sufficient funds to pay its staff salaries after October 2013; furthermore, existing budgetary resources would not be sufficient to pay for utilities and facilities after June 2013,” read Knaul’s report.

MACL denies imminent strike action by air traffic controllers, as staff allege pay and safety concerns

Air traffic controllers in the Maldives say they are building up to a full work stoppage over ongoing grievances and safety concerns left unaddressed by the current government.

Such strikes could lead to delays and disruption of flights to the luxury tourism destination, that welcomes almost one million tourists a year.

Several controllers responsible for organising the strike explained to Minivan News that they have been raising safety concerns with all relevant government authorities following the restructuring of the state-owned Maldives Airports Company Limited (MACL). Despite countless promises, no action had been taken, they said.

“For the last six months we’ve been ‘going by the book’, following all the procedures which causes a lot of delays. In the aviation industry that is considered a mild strike,” the air traffic controllers explained.

The air traffic controllers are now “building towards a full strike”, and many are even now calling in sick to work, the sources said.

A full strike would involve notifying all the relevant regional and international agencies, airlines, and all relevant government agencies in the Maldives, because no planes will be able to land except for hospital and humanitarian aircraft.

“This strike affects everyone, sea planes as well. Whatever happens at Ibrahim Nasir International Airport (INIA) will cause delays at the domestic airports as well,” they added.

Six air traffic controllers should be on duty at all times, three in the control tower and three in area control, the sources said.

“Last night only two people showed up to work,” they confirmed.

“The [MACL] management and Maldives National Defence Force (MNDF) had to run the system last night,” the air traffic controllers claimed. “Management is totally stressed.”

“This morning only one person was working area control, so management has had to fill in and today at 1:00pm nobody one went into work,” the controllers stated.

As a result, MACL management is also trying to close the area control centre and combine all operations in the control tower, the sources said.

“A pilot from a domestic carrier called me today to say he’s hesitant to fly because the guy currently in the tower doesn’t know what he’s doing – it’s a big safety issue,” one of the controllers alleged.

Ground staff at Kaadedhdhoo domestic airport in Gaaf Dhaal Atoll told Minivan News that since strike activity began many domestic flights had been delayed “three or four hours” while a number of international flights coming into Male’ “have been diverted to Colombo”.

CEO of the Maldives Airports Corporation Limited (MACL), Ibrahim ‘Bandhu’ Saleem, told Minivan News no such strikes were occurring.

“As far as I’m concerned there is no strike – you are wrong,” said Saleem.

He explained that there have been no flight cancellations or delays at INIA and that “only Male’ international [airport], not domestic airports, are under my control.”

While Saleem insisted there is no strike, he noted “there are contingency plans in place [in the event of a strike].” He declined to answer further questions.

The air traffic controllers told Minivan News that while they were not aware of flights being cancelled as of early this afternoon, a flight from Dharavandhoo airport in Baa Atoll was one-and-a-half hours delayed this morning “because INIA couldn’t handle the air traffic.”

Safety and standards

The air traffic controllers claimed strike action was supported by 75 controllers – over 95 percent of the country’s qualified staff.  They are demanding the reinstatement of a professional grading system, adherence to International Civil Aviation Organisation (ICAO), and the holding of the presidential run-off election that remains suspended by the Supreme Court.

“This was not a political issue,” they emphasised. “But now because we’ve lost trust in and cannot negotiate with the current government, [the strike has taken a political direction],” the air traffic controller sources told Minivan News.

“We were counting on a new election and government so we could bring our problems to them. If there’s no election our grievances will be exacerbated. [Now] we don’t know when we’ll be able to vote and elect a new government,” the sources continued.

The controllers repeatedly emphasised that the Maldivian Air Traffic Controllers Association (MATCA) was not involved [in organising the strike], “because they don’t want this to appear a politically motivated thing.”

Concerns and demands

The air traffic controllers said staff were not getting proper breaks, domestic airports are understaffed, the radar system – installed at INIA in 2008 – does not meet ICAO standards, and the professional grading system for controllers had been abolished.

“Everyone got knocked down to the same grade one position, there have been no promotions or pay raises in four years,” the sources explained.

The professional grading system ranks experience level and qualifications, with four levels: 1) basic air traffic, 2) aerodrome (tower) controller, 3) approach controller, and 4) area controller. While the same task is performed at each level, the airspace area each controller is responsible for increases.

“If air traffic controllers are continuously stressed out they might get into trouble by losing a picture [on radar],” the sources warned. “More fatigue means more mistakes, but we can’t makes mistakes is this job.”

The sources said MACL staff from Male’ are sent to work the domestic airports. However, the majority of domestic airports are understaffed, with only one or two air traffic controllers. At least three people should be running the control tower at any given time, the sources explained.

“Where there is only one person working the tower – like in Forvumulah’s airport – that individual has to stay awake. He only gets four hours of sleep a day and has to work 30 days continuously without a day off,” they continued.

“If you are the only person on duty you cannot leave the room, it’s a safety issue,” the controllers explained.

Thimarafushi airport in Thaa Atoll has no air traffic controller, however the Civil Aviation Authority gave authorisation for the airport to operate anyway, the sources alleged.

“That’s totally fine by us, even in the US there is uncontrolled airspace. It’s not a big issue as long as the pilots feel that they can land and take off,” the sources added.

“No one to trust” in government

“The government is trying to say everything is running smoothly, while trying to buy us out,” alleged the air traffic controllers. “We also gave an interview to Haveeru yesterday but they nothing has been posted about it.”

“Minister Adheeb called us today asking us if we were on strike. He’s pretending he didn’t know that our concerns hadn’t been addressed, even though we met with him earlier this year,” the sources noted.

“Three supervisors – of eight total – went to the MACL Managing Director’s meeting today. He’s asking them to talk to us to bring us back to work,” the sources continued.

“We are professionals and don’t want to create chaos in the Maldives, but with the current situation there is no one to talk to,” they explained. “We’ve tried to do it in a democratic way and did every single thing [to resolve our grievances]. We’ve exhausted all resources. There is no one to trust,” they added.

“We have been trying to raise these problems – again – since 7 February  2012 with the current government run by [President Mohamed] Waheed, [Jumhooree Party Presidential Candidate and MP] Gasim [Ibrahim], and [Progressive Party of the Maldives Presidential Candidate and MP Abdulla] Yameen,” the sources continued. “They promised us action but didn’t take it.”

The air traffic controllers have additionally met with Vice President Waheed Dean, Defence Minister Mohamed Nazim, Tourism Minister Ahmed Adheeb, Transport Minister Ameen Ibrahim, MACL, the Civil Aviation Authority, and the Labour Relations Authority, “but nothing happened,” they explained.

Over a year ago air traffic controllers submitted a case to the Labour Tribunal signed by more than 40 individuals, the sources noted.

“On December 21, 2012, over 60 air traffic controllers signed a petition that gave notice that we would be going on strike. We were promised that by January 1 our grievances would be addressed, the grading structure would be re-implemented and we would receive proper raises,” the sources added.

The controllers agreed to withdraw the case when promised the reforms and did, however  the promised action was still not forthcoming.

“We met with MDP’s Mohamed Nasheed and he pledged that under his government he would correct the mistakes and try to get us better pay,” the controllers noted. “We [also recently] met with the other political parties, but so far nothing.”

“Some [of us] are waiting for confirmation in writing [that our demands will be met], but many are waiting for the Supreme Court to rule so we can have an election,” the sources continued. “We’ve heard that MACL ground services employees are also planning to strike.”

Port workers strike to “send a message to the government”

The Maldives Ports Workers Union (MPWU) has taken strike action today following the Supreme Court’s decision – backed by the government – to postpone the second round of the presidential election.

“We are taking our constitutional right to give a message to the government,” said Ibrahim Khaleel, President of the Maldives Ports Workers Union.

Around 90 of the union’s 490 members opted not to come into work for today’s morning shift, though Khaleel pointed out that workers would return to work for the later shift.

“There is not much work there today, but next week we have a charter boat with more than 300 containers. If we are not given an election date, we will stop any future operations. We are just giving that message.”

“The ports union will do this again and again if they do not listen to us,” said Khaleel.

The Supreme Court is scheduled to give a verdict on its election annulment case today – filed by the Jumhooree Party (JP) after its defeat in the first round earlier this month.

After the Elections Commission expressed its intention to go ahead with the polls – scheduled for yesterday (September 28) – the court issued an order to security forces to halt proceedings by force if necessary.

Khaleel said a decision was made not to picket outside the ports today, alleging the port’s management “sent thugs” to attack union workers picketing the port earlier this year.

He argued that police protection had been requested on this prior occasion, but had not been forthcoming.

Both the MPWU and the Tourism Employees Association of Maldives (TEAM) joined forces in May this year to demand amendments to the recently enacted Freedom of Assembly Act.

Clause 24(7)b of the law prohibits any gatherings at the country’s ports, airports, or resorts, without police authorisation – a clause the unions have claimed effectively banned strike action.

After TEAM’s call for “prolonged strikes” last week should the presidential run-off be delayed, Minivan News has received reports of a number of politically motivated dismissals in some of the country’s resorts, in what some staff described as a “firing spree”.

Import dependency

Vice President of the Maldives National Chamber of Commerce and Industry (MNCCI) Ishmael Asif warned of the likely impact such strikes could have on the country.

“As a country that relies heavily on imports for all of its needs,  a ports strike could have severe impacts on business in the country,” he warned.

As small island state with with a land mass of only 115 square miles, the Maldives has near-total dependency upon imports for basic foodstuffs and commodities, as well as goods used to supply the country’s luxury tourism industry which is indirectly responsible for 90 percent of the economy.

The country’s “excessive reliance on imports” was discussed in a recent government report into economic diversification, which noted that the country’s current account deficit had grown to US$600 million (27 percent of GDP) in year 2012.

“The import dependency continues to grow. The CIF [cost, insurance, and freight] value of merchandise imports has increased from us$120 million in 1990 to us$1.5 billion in 2012,” read the report.

It also noted that the country imported over 90 percent of foods in 2012 – worth US$318.9 million –  resulting in “huge implications for food security as well as inflation.”

Male’s port – managed and administered by the Maldives Ports Ltd (MPL) company – handled 580 ships in 2012, processing over one million tonnes of freight.

Current MPL CEO Mohamed Latheef told Minivan News today that he was unaware of any strike activity.

The MPWU staged a small strike last year after it alleged the MPL had removed the workers’ television after they had used it to watch the Maldivian Democratic Party aligned Raajje TV. MPL claimed the disagreement was a misunderstanding.

That strike received high-profile backing from the International Transport Workers’ Federation (ITF).

Nasheed calls for tourism workers to strike should election be delayed

Former President and Maldivian Democratic Party (MDP) presidential candidate Mohamed Nasheed has called on tourism workers to strike, should run-off elections scheduled for September 28 be delayed.

Following Nasheed’s appeal, the Maldives Association for Tourism Industries (MATI) issued a statement warning of “irreparable consequences” to the Maldivian economy unless the election is expedited.

“It is absolutely important to expedite the election and settle the issue or else there would be irreparable consequences to the Maldives, and especially to tourism which is the back bone of the economy. Therefore, it is important for everyone to see the importance of this in the interest of the country at large,” said MATI Chairman M.U. Manik, one of pioneers of the country’s 40 year-old tourism industry.

The Supreme Court ordered the Elections Commission (EC) on Monday to indefinitely postpone run-off polls until it issues a verdict in an ongoing case filed by the Jumhooree Party, which placed third and is now seeking to annul the vote.

Nasheed emerged as the front runner in the first round of the polls with 45.45 percent (95,224 votes), followed by Progressive Party of Maldives (PPM) candidate Abdulla Yameen who received 25.35 percent (53,099 votes). JP candidate and resort tycoon Gasim Ibrahim narrowly missed out on the run-off with 24.07 percent (50,422), and contested the results at the Supreme Court alleging electoral fraud despite unanimous positive assessments of polls by local and international election observers.

“I call on tourist workers to strike if there is no election on Saturday. For everyone to strike. There is an election scheduled on Saturday – whether that election happens or not is in one sense in your hands and mine,” Nasheed told tourism workers, at an event on Monday evening to explain the party’s manifesto.

Secretary General of the Tourism Employees Association of the Maldives (TEAM), Mauroof Zakir, told Minivan News the organisation was holding discussions on whether to endorse Nasheed’s call.

“We are discussing whether TEAM as an organisation will back [Nasheed’s] call or leave it up to individual resort workers. We have to think about the consequences on employees’ jobs. Many resort workers are calling us and are saying they are willing to go on strike, but in such a way that resorts continue to operate,” Mauroof said.

The tourism industry is indirectly responsible for upwards of 70 percent of the Maldives’ GDP, and a substantial majority of Maldivian resort workers support the MDP.

Results from resort ballot boxes in the first round revealed overwhelming support for the party, even at many properties owned by Nasheed’s political opponents such as Vice President Waheed Deen’s Bandos Island Resort (51 percent MDP).

The trend was particularly notable at prominent international chains in the luxury tourism sector, famous for providing relaxing and idyllic escapes for honeymooners, including Sheraton Maldives Full Moon Resort and Spa (58 percent MDP), Dusit Thaani Maldives (73 percent MDP), Conrad Maldives Rangali Island Resort (62 percent MDP), and One and Only Reethi Rah (75 percent MDP).

Tourism Minister Ahmed Adheeb has meanwhile told local media he will not allow politicians to sacrifice the tourism industry and its workers, and appealed to staff not to strike.

“They plan and involve the tourism industry every time there is political turmoil, every time things do not happen as they want. They called for a tourism boycott in international media. There were effects from that. We are seeing the same thing now. We cannot allow any politician to involve the tourism industry in politics. We cannot allow politicians to sacrifice the tourism industry and its workers every time things are politically turbulent,” he told newspaper Haveeru.

The Supreme Court will be hearing closing arguments this evening.

Bureau of Classifications on strike over broken air conditioner

Staff at the Maldives National Bureau of Classifications have declared themselves on strike over an air conditioner they claim has not worked for two months, reports Sun Online.

“We’ve been working in this heat for all this time. We stopped work today, until we find a solution,” a staff member told Sun.

The National Bureau of Classifications is responsible for classifying all artistic content produced in and imported into the Maldives.

Kulhudhufushi and Fuvamulah hospital staff protest over 10 hour work day

Staffs working at Kulhudhufushi Island Hospital in Haa Dhaalu Atoll and Fuvamulah Hospital in Gnaviyani Atoll have held protests over a change in their duty roster that would require them to work overtime.

Speaking to Minivan News, Kulhudhufushi Island Council President Ibrahim Rameez said the strike ended after an hour after staff came to an understanding with the Health Ministry.

‘’At about 11:00am the island council met with the hospital management and talked to them about the issue and we came to understand that the staff went on strike regarding a change in their duty hours,’’ Rameez said. ‘’Their working hours were extended to 10 hours which was eight hours before, and the staff said they would find it difficult to work 10 hours.’’

He said the staffs stopped the strike and went back to work after the Health Ministry promised to amend the change brought to the working hours.

Manager of Kulhudhufishi Hospital Mohamed Hassan said the staff stopped the strike when the Health Ministry changed the duty roster in accordance with staff wishes.

‘’They went on strike regarding a change that was supposed to be implemented on July 1 but was delayed due to Ramazan,’’ he said. ‘’The staff, especially the nurses working at the hospital, said they find it very difficult to work according to the new roster.’’

Fuvamulah Hospital Manager Mohamed Ismail said seven staff at Fuvamulak Hospital and a few Maldivian Democratic Party (MDP) activists protested outside the island council following the change in the duty roster.

‘’I wasn’t formally or informally notified about their concerns,’’ he said. ‘’I went to the area and saw the staff and MDP activists waiting outside the council secretariat.’’

Ishmail said the MDP activists had tried to portray the matter as a big protest for the sake of media attention, and accused local media of misleading the public.

‘’The issue had been already resolved when they went on strike. Everything is fine now,’’ he said.

Permanent Secretary of the Health Ministry Geela Ali had not responded to Minivan News at time of press.

Addu City Court magistrates go on strike

A majority of magistrates in Addu City have gone on strike claiming they fear for their personal safety, reports local media.

All courts in the Addu City administrative districts of Feydhoo, Hulhudhoo, and Meedhoo have only one magistrate, and are currently not functioning as a result of the strike. A Hithadhoo Court Magistrate – one of four – also failed to appear yesterday (May 29), resulting in all the cases he was presiding over to be cancelled.

The Judicial Service Commission (JSC) had not received any reports of a magistrates’ strike and told local media “all the courts in Addu are functioning properly”.

The magistrates went on strike due to alleged threats to their personal safety and property and some claim to have been harassed and abused.

The magistrates will continue the strike until “satisfactory actions were taken by the authorities”, some magistrates told Haveeru on condition of anonymity.

“We cannot work in such a tense environment, without any protection. Authorities should ensure our personal safety first. We will officially inform the JSC today,” a magistrate said.

Some court magistrates have sought police assistance on multiple occasions, but thus far they claim it has been ineffective.

“[Police assistance] is not happening in the most effective manner. We met with the police this week and discussed these matters,” a magistrate said.

Police have received reports of threats to Addu City court magistrates and will provide security upon request, Commander of the police’s southern division, Abdulla Riyaz, told local media.

Police break strike at Alimatha Resort, arrest two workers

A  strike by Maldivian employees at Alimatha Resort in Vaavu Atoll ended on Friday after 30 police descended on the resort.

Two resort staff were arrested, while 27 were subsequently dismissed. The workers were striking over a demand for an increase in their service charge compensation.

“They tear gassed all the staff”: striking resort worker

Dismissed reception supervisor at Alimatha Resort, Ahmed Fayaz, told Minivan News that police arrested the leader of the striking workers.

“The police arrested our leader Hassan. We were surrounding him, saying they couldn’t take him. We were trying to keep the police from arresting him.

“If they were going to do that, we said we would be very angry, so they tear gassed all the striking staff,” he alleged.

Police Spokesperson Hassan Haneef confirmed two people had been arrested and were later released without charge. Police received information from resort management and “tried to help negotiate”, he said.

“The Freedom of Peaceful Assembly act doesn’t allow protesting in resorts,” Haneef noted.

“There was no tear gas, no pepper spray, and no violence.”

“l’m not here to spell out what has been done”: Alimatha General Manager

Alimatha Resort General Manager Abdullah Nashiz told Minivan News that resort management wanted to talk and gave many chances to the striking workers.

“We explained this is not the way to make demands. We confronted and commanded them to return to duty,” Nashiz stated.

Nashiz claimed the striking workers were shouting and forced laundry operations to stop by frightening Maldivian staff in that department.

“We do not know what threats were made [by staff] beyond stopping operations. I’m not here to spell out what has been done. The police can tell you that,” Nashiz said.

“The first time, I requested the supervisor call the police for the safety and security of the clients, staff, and property, and two or three [officers] came.

“We called the police the second time because the strikers were shouting at and threatening [us]. We were scared,” he claimed.

Nashiz said that after the striking workers were terminated, they were unwilling to take the termination letters and started shouting. However, he also claimed that all 27 former staff have since signed the termination letters.

He said that 99 percent of service charges were being given to staff and that the amount of compensation requested by the former employees was “impossible” and “not within the budget of the company”.

“It’s not company policy to give the total service charge, not at the [US$300-$400] amount requested. It was not foreseen in the budget or present employment contracts.

“One part may be given this year, and the next year we can reconsider based on work performance,” Nashiz added.

Fayaz meanwhile stated that the striking staff did not want to resign, nor did they want to cause any trouble for  tourists at the resort.

“The management is not giving the right information to the media, what they’ve said is incorrect,” he alleged.

“[General Manager] Abdullah Nashiz is wrong. They did a very, very, very bad thing.

“We were not disturbing guests, or other resort workers. We were just sitting in our rooms and refusing to go work,” Fayaz said.

Fayaz said resort management did not want to negotiate with the striking employees, particularly through collective bargaining. Instead they insisted the staff keep working.

Ultimately, 27 staff were terminated and forced to leave the resort following Hassan’s arrest.

According to Fayaz, resort management charges guests 8-10 percent service charge as stated in the guest catalogue, but then does not distribute 99 percent of those service charges to employees, as mandated by law.

“We were only given US$25-$50 in service charges each per month. This is the same service charge amount employees received in 1997,” he said.

“If they were unwilling to give us the proper service charge amount, we proposed a US$300 pay increase as an alternative,” Fayaz stated.

Resort “has a history of serious problems”: TEAM Secretary General

Tourism Employees Association of the Maldives (TEAM) Secretary General Mauroof Zakir told Minivan News the union are providing consulting services to the former employees at the resort, and noted that the workers had a history of striking for wage increases.

Strikes have occurred on the resort annually since 2009 and pay has increased from MVR 1200 (US$77.42) a month to MVR3000 (US$193.55) a month in 2012, he said.

“Management has refused to the workers’ demands, because if they accede they will have to pay all the service charges from 2008 until now,” Zakir stated.

He also explained that the constitution guarantees workers’ rights and that the Maldives had ratified the International Labour Organisation covenant, which protects the right for form associations for collective bargaining.

Zakir also said police “warned” strike leader Hassan and then arrested him in his room, at which point the other striking employees held onto him to prevent the police from taking him, and were ultimately pepper-sprayed.

“The staff were  really really afraid because of the police involvement,” Zakir said.

He added that since the resort is private property, the police said the terminated employees could not stay and forced them to leave the resort.

Tourism Ministry

Tourism Minister Ahmed Adheeb told local media the “disruption of services and harmony in resorts is unacceptable”.

“Tourism is the most significant industry in the Maldives. Adverse impact on the industry as a result of such protests would directly affect the entire nation. It could also have a major effect on our economy,” Adheeb said.

Director General of Elections Commission alleges political motivations behind dismissal

The recently dismissed Director General of the Elections Commission (EC), Ahmed Tholal, has alleged that his removal is related to his participation in a strike earlier this year which had questioned the impartiality of certain commission members.

Following his dismissal Tholal took to Twitter, suggesting that his dismissal was politically motivated.

“The reason for my dismissal is to retaliate because we protested, and also because votes cannot be rigged at 2013 Elections if we are there,” he tweeted.

“On March 20, the Elections Commission staff protested. I believe this is the reason for my dismissal,” he told Minivan News. “I received a chit saying  that I’ve been dismissed yesterday because I have another post.”

“I am President of the Athletics Association – that is not a job, that is a social responsibility,” he added.

Tholal explained that he had been on the executive committee of the Athletics Association since 2004 and had been promoted to chair of the committee in July this year.

The strike in question, which included 45 EC employees, demanded better remuneration for staff as well as the resignation of three of the five members of the commission who were accused of acting with bias and in violation of EC regulations.

“They have not been following rules and regulations,” said Tholal. “I fight for the right thing, always – I always tell them they have to follow the regulations.”

He noted that the three commissioners in question – Mohamed Farooq, Ali Mohamed Manik and Ogaru Ibrahim Waheed – were still on the commission.

Tholal also pointed out that other staff members who had taken part in the protest had faced repercussions. He noted that a fellow Director General had been demoted and the Human Resources Director dismissed.

“I will fight for my rights,” said Tholal.

The right to strike is protected by Article 31 of the Maldivian constitution.

Secretary General of Elections Commission, Asim Abdul Sattar, denied that Tholal’s dismissal was politically motivated, arguing that Tholal had acted against the rules of the commission.

“It is against the rules of the commission to have any other job, whether paid or not, it is a conflict of interest,” said Sattar.

Sattar also said that the March strike had mainly been about money and that the issue had now been settled.

He explained that the decision had taken one and a half months to be made, although Tholal has claimed his dismissal came without warning.

Independent institutions such as the EC have come under increasing scrutiny once more following the release of the Commission of National Inquiry’s final report (CNI).

This week has seen prominent members of both the Police Integrity Commission (PIC) and the Anti Corruption Commission (ACC) question the ability of their own institutions to fulfil their mandates.

Transparency Maldives’ Aiman Rasheed suggested that weak and unassertive institutions must take some of the blame for the events of February 7 and the surrounding political crises.

“The independent institutions need to step up their game by standing for and protecting the values for which they were constituted,” said Aiman.

Although the EC was not specifically mentioned in the final CNI report, it has been mentioned as an institution in need of strengthening by prominent members of the government.

State Minister of Foreign Affairs Dunya Maumoon told the BBC in April that the EC was too weak to withstand the rigours of an early election campaign.

This charge was dismissed at the time by EC President Fuad Thawfeeq and, when asked today about the need to strengthen the commission, Sattar was equally confident.

“We have a good system but we feel there is always need for improvement and capacity building,” he said.

“For any constitutional elections, we will be given two months – we will be able to do it,” said Sattar.

When asked the same question, Tholal suggested that the key to strengthening the EC was to change some of the body’s members.
