DQP MP Riyaz submits bill proposing hanging as preferred method of execution

Dhivehi Quamee Party (DQP) MP Riyaz Rasheed has submitted a bill to parliament proposing executions be carried out by hanging people sentenced to death in court.

Riyaz told newspaper ‘Haveeru’ that he submitted the bill because the government’s version of the bill, drafted in December 2012, had yet to be submitted to parliament.

According to Riyaz’s bill, the trials of people accused of offences punishable by death under the penal code are to be conducted with a defence lawyer, even should the defendant refused.

The bill requires the lower courts to forward a case report to the High Court 14 days from the date the trial reaches a conclusion. The High Court is required to conduct a trial to determine whether the lower court’s ruling is lawful.

Should this decision be upheld, the matter must then be referred to the Supreme Court, which issue the final ruling on the case.

According to the bill, the defendant is given the opportunity to meet his family and say his last words before he is hanged.

The bill obliges the state to delay implementing death sentences if the person is a minor, pregnant woman, mentally ill or suffering from a disease.

In December last year, Attorney General Azima Shukoor drafted a bill outlining how the death sentence should be practiced in the Maldives, with lethal injection being identified as the state’s preferred method of capital punishment.

The government’s draft, which has yet to be submitted to parliament was criticised by religious groups in the Maldives, who argued that the state’s method of execution should be beheading or firing squad.

Singaporean woman drowns at Embudu Village Resort

A Singaporean woman on vacation with her husband at Embudu Village Resort died while snorkeling, the second such incident at the resort in the past three years.

The 34 year-old Singaporean, Irene Soon, drowned last Saturday (May 4) in a snorkelling accident at Embudu Village resort, located eight kilometres from Male’ in Kaafu Atoll.

Soon was snorkeling near the main jetty area of the resort and is believed to have drowned, however the case is still under investigation a police media official told Minivan News today (May 12).

Soon, an insurance manager, was vacationing with her husband in the Maldives to celebrate her recent promotion. Soon and her 37 year-old husband Mike Lie were snorkeling for the first time and taking photos with a rented underwater camera when the incident occurred, reported Singaporean publication the New Paper.

The publication claims that a dive instructor ran over after Soon had been pulled from the water and asked Lie how long she had been underwater. Allegedly Lie responded that he was unsure, but “maybe 10 minutes”.

Lie then asked the “Aren’t you going to CPR (cardiopulmonary resuscitation) or something?” at which point the dive instructor said “there was no point”, claims the publication.

“She was snorkeling with her husband, taking photographs then somebody saw her motionless, lifeless, in the water,” Embudu Village General Manager Ramsay Perera told Minivan News today.

“The dive instructor did give emergency care and performed CPR. She was then taken to ADK hospital via speed boat,” he claimed.

Perera explained that the dive school staff is “well equipped” and trained in CPR, however there is no in house doctor at the resort.

“The dive school staff are very observant most of the time. It was calm weather and very shallow water. She was briefed [about snorkeling safety] when she arrived at the resort and was wearing a life-jacket, snorkel and fins [when the incident occurred],” Perera said.

Snorkel at your own risk

After approximately an hour of snorkeling Lie decided to take a break because saltwater was “getting into his mask and nose”. Lie was standing in shallow water next to the resort’s pier watching his wife continue to snorkel and diverted his gaze for five minutes to watch a group of guests learning to scuba dive. When Lie looked back for his wife, she was nowhere to be seen.

“That was when I realised, ‘Oh my goodness,’ the weather is bad, cloudy and drizzling. I decided to swim out,” Lie said. “I was worried, I wanted to get her out of the weather and say it was time to go back.”

While Lie hurried to put his snorkelling gear back on to swim out and look for Soon, she was being pulled from the water by a German uncle and nephew, with her body face down on the seabed.

The German tourists noticed that Soon’s snorkeling tube was underwater and swam out to where she was floating.

“I was shocked, I wondered what I could do to save her. Her fingernails and toenails were purple. I tried calling her name, she didn’t answer. I frantically felt for her pulse, but there was none,” said Lie.

Soon was snorkeling in water about one metre deep. “It would have taken effort for her to stand with flippers on her feet and corals below,” explained Lie.

Soon was not a strong swimmer and her husband recalled swimming together fewer than 10 times in the last 12 years they had known each other. “She wouldn’t do laps, just short distances,” Lie recalled.

Lie said there no lifeguards were present at the Embudu Village beach, however he and his wife had been briefed about water safety upon their arrival at the resort. During the briefing, entry points into the water and coral bed areas were discussed, as well as advice not to swim too far away from shore. They were also told that “activities were carried out at their own risk”.

Lie returned to Singapore May 6 and Soon’s body arrived the morning of May 9. During her wake, Lie told Singaporean media that he regrets “taking his eyes off my wife.. or else, this might not have happened.”

Second death

Soon’s drowning is the second such incident at Embudu Village Resort. In February 2010, a 69 year-old German tourist died while snorkelling at the resort.

A senior staff member at Embudu Village told Minivan News at the time that the man was snorkeling with his friend.

”His friend noticed that he had been floating in the water without movement for a while and went to help him,” the staff member said at the time. ”When he shook him he did not move, so he knew that something was wrong. The sea was calm and there was low tide at the time.”

There have been a string of tourist deaths while snorkeling in recent years.

A 51 year-old Italian tourist died in a boat propeller accident while snorkeling in January of this year near Elaa Island in Thaa Atoll.

During 2012, tourist deaths – usually while snorkelling – were disproportionately higher among Chinese visitors, who now account for a majority of Maldives tourist arrivals compared to the country’s traditional European market.

Mohamed Ibrahim ‘Sim’ from the Maldives Association of Tourism Industry (MATI) pointed out in a 2012 interview with Minivan News that Chinese guests in particular needed to be made more aware of the dangers of snorkeling in the Maldives, “because it is a totally different environment than what they are used to.”

Many resorts and Chinese tour operators have reacted to the higher incidence of casualties by issuing life-jackets to Chinese guests on arrival. However, despite efforts to adapt to a market which in 2011 brought over 100,000 visitors to resort beaches and house reefs, Sim observed that “things still have not changed” as Chinese fatalities remain higher compared to European market.

Two Chinese nationals vacationing on two different resorts in the Maldives were found dead within 48 hours in suspected snorkeling accidents in 2012.

A Chinese woman identified as Shuhui Li, aged 58, was pronounced dead after she was pulled out from the waters of Lily Beach resort on January 26, 2012, while a Chinese man identified as Ding Hai, aged 30, was found dead whilst snorkeling at the newly-opened Ayada resort the following afternoon.

In October 2012, a 26 year-old male from China staying at Alif Dhaal Atoll Vakafaru resort was suspected to have died in a snorkelling accident at the property.

In December 2012, a Chinese tourist was reported missing from the Bandos Island Resort and Spa property.

Earlier in 2012, a French tourist, identified as 49 year-old Alan Marshall, went missing during a late afternoon swim while vacationing on Club Med Kanifinolhu resort with his wife, daughter and son-in-law. A day later he was found dead near Paradise Island Resort.

A 36 year-old Chinese tourist was also found dead off the coast of Sun Island Resort and Spa in January 2011.

In August 2011, a decomposing female body was found on the shore of the Adhaaran Hudhuranfushi resort, a week after a 29 year-old Japanese tourist and her 37 year-old husband were reported missing from the property.

On March 14, 2010 police received a report that a Chinese national, Rui Dai, died while snorkeling at Holiday Inn Kandooma Resort, in Kaafu Atoll.

Earlier that same month another Chinese man died while snorkeling at Chaaya Lagoon Hakurahura Island Resort, less than a day after a German tourist died in a snorkeling accident at Embudu Village Island Resort.

In mid-August 2010 a Chinese couple vacationing in the Maldives disappeared from their resort after going for a swim. The 38 year-old woman and 40 year-old man were staying with their 13 year-old daughter on the Hilton Irufushi Beach and Spa Resort in Noonu Atoll.

In September 2010 a 48-year old Chinese woman died while snorkeling at Paradise Island Resort and Spa.

A top UK transplant surgeon died while snorkeling on holiday at the Adaaran Meedhupparu Resort in Raa Atoll in September 2010.

The following month, Sharon Duval, a 42 year-old British woman died while on honeymoon. Her body was found on the shore of Kuredhoo Island Resort.

Trial begins of second suspect arrested over murder of MP Dr Afrasheem Ali

The Criminal Court today commenced the first hearing in the trail of Ahmed Shan, the second suspect to be arrested in connection with the murder of moderate religious scholar and MP Dr Afrasheem Ali.

State prosecutors confirmed that the Prosecutor General’s Office (PGO) was pressing murder charges against Shan.

Shan is accused of entering the Funvilu house in Galolhu ward between 11:00pm on October 1 and 2:00am the following day with a group of people to murder Dr Afrasheem.

In response, Shan said the charges were clear to him and told the court that he wished to secure legal counsel.

However, the defendant told the court today that he was not aware of the evidence against him.

The presiding judge replied that the court would grant permission to produce the evidence and witnesses after Shan responded to the charges against him.

Evidence to support the prosecution would then be issued to Shan, with the exception of certain confidential documents submitted to the court by the state, the judge said.

The next hearing of the case is scheduled for May 5, 2013.

The trial of Shan’s co-accused Hussain Humam is also presently being heard in the Criminal Court, with the suspect having previously pleaded not guilty to charges of murder.  The suspect has also requested legal council.

A Maldives National Defense Force (MNDF) representative and Abdulla ‘Jaa’ Javid – son-in-law of opposition Maldivian Democratic Party (MDP) Chairperson ‘Reeko’ Moosa Manik – were also detained by police over having alleged involvement in the case.

Both were later released by the courts.

Javid had spent 45 days in detention in connection to the Afrasheem murder, which at the time his lawyer argued was unconstitutional given there was no evidence to support keeping him in custody.

In December last year, the MDP accused the police of attempting to pin Afrasheem’s murder on its members, instead of going after those guilty of the crime.

MP Afrasheem was stabbed to death on the night of October 1, by the staircase of his home.

Commissioner of Police Abdulla Riyaz has previously alleged the murder of the MP was well planned and worth MVR 4 million (US$260,000).

Man dies during MNDF military training programme

A man has died while taking part in a military training program in Addu City yesterday (February 23), local media reports.

Maldives National Defence Force (MNDF) Media Officer Abdulla Ali told local media that the man, 24 year-old Ismail Habeeb of Seenu Feydhoo Dhunnikage, died whilst taking part in swimming training.

Local media reported that Habeeb had just completed his 200 metre swimming test before suddenly drowning as he touched the finish mark.

Ali said instructors had jumped in and taken him out of the water within five seconds, and took him to Hithadhoo Regional Hospital immediately.

The MNDF media officer said the hospital had confirmed Habeeb’s death, but said the official cause of death can only be confirmed after a review of the doctor’s reports.

Missing man from Fuvamulah found dead

The body of a missing 30 year-old Fuvamulah man, Mohamed Nafiz, has been found dead on the shore of Fuvamulah.

Nafiz was declared missing by police on January 24, at 8:00pm.

Police said the body was discovered yesterday morning at 6:27am in an area of Fuvamulah beach called ‘’Ambulu fannu’’.

Police said a forensic team and investigative team had been dispatched to the island to investigate the case, and had confirmed the body was Nafiz.

In a statement, police said fingerprints of the dead body found on the beach matched those of the missing man.

The body was discovered while Maldives National Defense Force (MNDF) divers and police officers were searching for him.

Nafiz was last seen alive when he and two other friends of the same age arrived to Fuvamulah from Addu City.

Local newspaper Haveeru reported that two men have been arrested in connection with the death of Nafiz.

Haveeru reported that his family alleged he was killed by the two friends who had accompanied him to Addu.

According to ‘Haveeru’, the clothes Nafiz had been wearing were discovered on the beach, wrapped around 19 bullet-sized packets containing illegal drugs.

A councilor of Addu City, on condition of anonymity, told the paper that Nafiz may have drowned after jumping off a boat to get to shore, after attempting to avoid police officers.

Nafiz’s uncle told Haveeru that Nafiz left Fuvamulah to go fishing but later said he and his two friends had gone to Addu to traffic illegal drugs into the island.

Police Sub-Inspector Hassan Haneef was not responding to calls at time of press.

Housing minister expresses sadness over suspected suicide of Bangladeshi maid

Housing Minister Dr Mohamed Muiz has issued a statement expressing sadness over the death on Saturday (December 22) of a Bangladeshi woman employed as a maid at his Male’ residence.  Police have said they they are presently treating the death as a suspected suicide.

Dr Muiz confirmed that the deceased had been employed at the home he shared with his wife and two children, while also expressing deep sadness over the incident.

Muiz claimed he was first informed of the death while visiting Hulhumale’ with his wife. He added that after hearing of the incident he immediately called Police Commissioner Abdulla Riyaz.

According to the statement, police officers were already at the scene by the time the housing minister arrived home.

Muiz said that he hoped that further details concerning the case would be released after police had completed their investigation.

The statement also expressed sadness over what some people were allegedly saying about the incident through social media.

Speaking of the deceased, the housing minister stated she had been very good in her duties as well as being very close to his children and a key part of their lives.

“Initial stage”

The Maldives Police Service has said that that investigations were presently at an “initial stage” and it could not therefore disclose any more details on the case, which was presently being treated as a suicide for undisclosed reasons.

Speaking to Minivan News yesterday (December 24), Police Spokesperson Sub-Inspector Hassan Haneef confirmed that the body of a 24 year-old female had been found in an apartment on the ninth floor of Chandhanee House in Maafannu Ward.

“I cannot reveal any more until we complete our investigations.  We will not come to any conclusions before that,” he said.
Hours after the body was found on Saturday evening, Police Commissioner Abdulla Riyaz left a message on the social media site Twitter stating: “Police is investigating the suicide case.”

Dead body found in Male’ Home

The body of an unidentified man was found dead at a property in Lonuziyaaraiy Magu in Male’ on Friday (November 14).

The body was said to have been discovered at around 6:38pm yesterday evening after people in the area spoke of a bad smell coming from the property M. Mizamaange, according to local media.

A resident living at the property where the body was discovered told Sun Online that the deceased man was a Sri Lankan national.  It is not yet known how the man died.

A police spokesperson was not responding to calls at time of press.

Police conclude investigation into death of Lance Corporal Haleem

Police have concluded the investigation into the death of police Lance Corporal Adam Haleem, who was murdered early on Monday morning on the island of Kaashidhoo in Kaafu Atoll.

In a statement issued last Thursday, police said Haleem’s alleged assailant Mohamed Samah had confessed to attacking Haleem with a knife, and had told the police how the incident occurred.

The statement said that Haleem was attacked that night while he was on his way to the Kaashidhoo Police Station to report to duty.

While he was on the way to the police station he saw Mohamed Samah on the road, who was supposed to be on house arrest. Haleem followed Samah to his house and asked Samah to get himself ready and to come with him to the police station.

Samah refused to go to the police station and became angry. He entered his house and took an eight inch knife from the kitchen, which he used to stab Haleem in the left side of his chest, according to the statement.

Before Haleem was attacked, he called the police station and had informed officers on duty about Samah, and asked to attend the scene. However by the time the other police officers attended the area Samah had stabbed Haleem and his body was lying on the ground.

Police officers took Haleem to Kaashidhoo Health Centre, but Haleem failed to survive the deep wound in his chest and died at 12:10am that night.

The statement furthermore stated that Samah was arrested the next day and was suspected of being under the influence of illegal drugs. The test results showed his body contained THC (cannabis) and AMP (amphetamines), police said.

Police said that the investigation did not show that there was the involvement of any other person in the case.

Lance Corporal Haleem killed by “MDP loyalist”, government tells foreign media

The government has claimed that murdered policeman Lance Corporal Adam Haleem was stabbed to death by a “Maldivian Democratic Party (MDP) loyalist”, in a text circulated to foreign media outlets.

President’s Office Spokesperson Masood Imad was reported as stating in a story published by AFP that “MDP instigated the attack on policemen at Kaashidoo and one was stabbed to death” during protests.

Police meanwhile held a press conference today during which they claimed that the murdered policeman was attempting to arrest his alleged killer, 22 year-old Mohamed Samah, at the time of his death.

Police stated that Haleem had observed Samah wandering the street despite being under house arrest, and asked him to accompany him to Kaashidhoo police station. Samah had reportedly been released to house detention on Sunday following a two day arrest over an assault case.

According to local media, police stated that Haleem had asked Samah to get ready to go to the station with him, and had waited outside his house. Samah allegedly came out of the property with a knife, which he used to stab Haleem while the officer was on the phone to the police station.

Police further alleged that Samah was intoxicated at the time of the incident, and stated that he had tested positive for cannabis following his arrest.

Speaking to Minivan News, Imad said “I can assure you that he was an MDP loyalist, and an active member of the Donbileih Kaashidhoo campaign. The attack took place moments after calls to engage in violence against police, in an MDP rally.”

MDP Spokespersons Hamid Abdul Ghafoor and Imthiyaz Fahmy were not responding at time of press.

Haleem suffered serious stab wounds in the attack, including a nine-inch deep stab wound to the chest. He was alive but in critical condition when brought to the hospital, but died soon afterwards while undergoing treatment.

The death has been swiftly politicised amid spiraling political tensions in the country.

The government condemned former President Mohamed Nasheed and his Maldivian Democratic Party (MDP) for the murder, claiming that MDP’s ongoing protests against the police in the capital Male’ provoked the attack on Kaashidhoo island.

Home Minister Dr Mohamed Jameel Ahmed tweeted that the “murder of police officer came after continuous attack on police force by MDP, calling [the] entire police force traitors.”

In another tweet, Jameel also said that “evidence available to police [which] exposes MDP top leadership calling for violence against the police force.”

Police subsequently released a recording of a phone call between Nasheed and MDP MP Mariya Didi, in which Nasheed expresses frustration with the police dismantling of the party’s protest site at Usfasgandu: “I think we need to fight back. If we can get people to fight. Find kids from Male to fight the police. That is what I think. I don’t know if we can get people to fight. I want to fight against them,” the former President is heard to say.

The MDP retaliated by publishing a screenshot of the Elections Commission party registry indicating that Samah was a member of the government-aligned Progressive Party of the Maldives (PPM).

The party further alleged that the suspect was a key supporter of Jumhoree Party (JP) MP Abdullah Jabir, who won the Kaashidoo constituency in the recent by-election with official endorsement from PPM.

Jabir has denied the claim and alleged the suspect had actually been working with MDP candidates at local elections, and was mentioned in a police report at the time for attacking a member of the JP’s campaign personnel.

PPM’s Council Member Ahmed Saleem yesterday stated during a press conference that “Party is not important. What’s important is the crime committed by the criminal.”

“We have also heard people say that he is from PPM. But we have not checked if it’s true. The reality is that MDP members have been registered under other parties by mistake,” Saleem claimed.
